The meeting was officially called to order by Fred Devitt, III, Vice Chairman of the Zoning Code Task Force. II. Pledge of Allegiance. Pledge of Allegiance was dispensed with at this meeting. III. Presentation by Desian Consultant for information and discussion related to proposed design Guidelines and possible code amendments Mr. Harrington, Town Manager, introduced Henry Skokowski after fir having complimented the Task Force Members and briefly explaining the process that was followed in preparing the Manual. Mr. Skokowski distributed a Comparative Overview, a copy of which is attached and made a part of the minutes, which listed the most significant items that are proposed to be changed. He then introduced John Carleen and explained that he had helped with the data gathering and production of the Manual and had done an excellent job. Mayor Koch complimented Town Manager Harrington, Mr. Skokowski and Mr. Carleen on the production of the Manual and congratulated the members of the Task Force on the excellect job -they have done, expressing -the Town's appreciation for their hard work over the entire summer. Commissioner Armour asked how this change will affect property values and was advised that while it could have some adverse effect on property Special Joint Meeting -November 17, 1994 Zoning Code Task Force, Town Commission page and Architectural Review and Planning Board that is being divided, there would be a positive effect on the value of all others. V. Public. Scott Tiernan objected to the provision that perimeter walls in the proposed Ocean West Design District be restricted to a maximum of 4' in height, which would affect his property. He believed they should be permitted the same maximum height of S' as those in the Beachfront Design District; citing the need of a higher wall for security and noise buffering. Commissioner Wallace believed that a 4' wall would be out of scale when considering the large size of the parcels in this district and the 6' walls on the other side of AlA. Mr. Harrington and Mr. Skokowski explained that the provisions had been developed based on what is currently existing which has developed the character of each district individually. They pointed out that there are very few walls at all in Ocean West and that if the wall were to be placed at the setback line rather than the property line, there would be no maximum other than the maximum that would apply to a building in that particular district. Mr. Skokowski suggested that perhaps the Zoning Code Task Force could review this item once more at their last meeting which will be held in early December. He suggested that perhaps an alternative would be to establish variable maximums with higher walls being permitted as they are moved from the property line toward the setback line. Commis- sioner Armour pointed out that with V walls on both sides of AlA a "canyon" effect would be achieved which is something the Task Force felt would change the character of the Town. Candice Heydt questioned if the Town would be held responsible if a prospect- ive buyer was not informed of these new provisions by the realtors handling the sale. Attorney Randolph stated the Town would not be responsible as it is the responsibility of the buyer to check with the Town Hall to make sure he has not been misled by the seller or the realtor. He added that he is very pleased with the new Design Manual, it being the best he has seen to date, and explained that it will be implemented by Ordinance and will actually be a part of the Zoning Code even though it will be in a separate book. He felt comfortable that the provisions can be defended, as did Mr. Harrington. VI. Adjourmnent. The meeting was adjourned at 5 P.M. Rita L.
