NOTICE IS HEREBY GIVEN that the Architectural Review and Planning
Board of the Town of Gulf Stream will hold a meeting on Wednesday,
December 28, 1994, at 9:00 A.M., and the Town Commission will hold a meeting
on Friday, January 13, 1995 at 4:00 P.M., both in the Commission Chambers
of the Town Hall, 100 Sea Road, Gulf Stream, Florida, at which the
following will be considered:
An application for development approval submitted by James
A. Ballerano, as agent for William and Gail Bradbury, owners
of the property located at 1357 N. Ocean Blvd., Gulf Stream,
Florida 33483, which includes:
1. A request to subdivide and replat the present 200.21
foot parcel adjacent to State Road AlA at the address
herein, and briefly described as the South one half
of Lot 4, all of Lot 5, North one half of Lot 6,
Block D; Revised Plat of Block D and E, Palm Beach
Shore Acres, into two 100.10 foot lots.
2. A request for a Demolition Permit to demolish the
existing single family dwelling and all other structures on
the property with the exception of the driveway.
The Architectural Review and Planning Board shall make a recommendation
to the Town Commission, and the Town Commission shall make a final
decision regarding the subject application, at their respective meetings
noticed above. These meetings may be adjourned from time to time and
place to place as may be necessary to hear all parties and evidence.
Complete application materials are on file in the office of the Town Clerk
located at 100 Sea Road, Gulf Stream, Florida 33483 and may be reviewed
during regular business hours which generally include non -holiday week-
days from 9:00 A.M. to 4:00 P.M.
ALL PARTIES INTERESTED IN THIS MATTER may appear before the
Architectural Review and Planning Board and the Town Commission of the
Town of Gulf Stream at the times and place aforesaid and be heard.
SHOULD ANY INTERESTED PARTY SEEK TO APPEAL ANY DECISION MADE BY THE
ARCHITECTURAL REVIEW AND PLANNING BOARD OR THE TOWN COMMISSION WITH RESPECT
TO ANY MATTER CONSIDERED AT THESE MEETINGS, SAID PARTY WILL NEED A RECORD

Mr. Ballerano explained that Mr. Bradbury has had this propery for sale for
(� an extended period and has no serious prospects. He stated that Mr. Bradbury
\I 'believed that the property would be more likely to sell if it were to be
divided into two lots of 100' frontage each but that this is not possible
due to location of the existing structures. Mr. Ballerano advised that
they are requesting to remove all structures with the exception of the
driveway and seawall. The Board was concerned about the future condition
of the property if a demolition permit were to be granted. Town Manager
Harrington explained that there would be no disturbance to the vegetation
on the first 50' of the property adjacent to AlA without obtaining a
Vegetation Disturbance Permit and the parcel would be seeded and maintained
until development takes place.

Mr. Lynch moved that it be recommended to the Town Commission that the
Demolition Permit be granted provided the landscape material is not removed
and the parcel is properly seeded and maintained,and,.Mr. McGraw seconded. Roll

2. SUBDIVISION REVIEW -To permit the creation of two, 100+ foot
lots from the existing parcel of 200+ feet.
Town Manager Harrington explained that the two proposed lots would meet
the zoning provisions in that each will have more than 100' frontage and
the depth is approximately 300' as measured from the Coastal Construction
Control Line. Mr. Lynch moved and Mrs. Souder seconded that it be recom-
mended to the Town Commission that the subdivision of the parcel be approved
as requested. Roll Call: Mr. McGraw; AYE, Mrs. Souder; AYE, Mr. Lynch;
AYE, Mr. Ogren; AYE, and Chairman Orthwein; AYE.
3. SITE PLAN REVIEW -To review the interim state as a maintained
vacant lot prior to future development.
Mr. Ballerano reported that there is a buyer for one of the lots if the
subdivision is approved. He further reported that the buyer proposes to
build a home like the one he lives in now which is in Highland Beach. He
added that the present home is on a small lot, close to AlA, and the family
desires to move farther back and have a dwelling that is a little larger
than their current home. He then circulated a photo of the current dwelling.
Town Manager Harrington advised that any development on this parcel of
land will have a site plan review prior to applying for any building permits.
Mr. Lynch moved that it be recommended to the Town Commission that the
site plan be approved as requested provided the landscape material is not
disturbed and the parcel is seeded and maintained until development is
commenced. Mrs. Souder seconded the motion. Roll Call: Mr. McGraw; AYE,

VII. Architectural Review and Planning Board Action.
A. Review and Recommendations to the Town Commission
1. Design Manual
Town Manager Harrington explained that the Design Manual did not provide
for controlling the exterior color of structures. He stated that the Task
Force had determined that this should be included in the Manual and at their
last meeting, approved colors in the first two rows on the color wheels,
plus some deeper earth tone shadesfor Mediterranean designs, and deleting
those in the first two rows that were of pink to purple shades. The Task
Force did not include any control for trim colors on the structures, he said.
Mr. Harrington advised that inasmuch as color was to be controlled, some
criteria needed to be established to review this, which he and Mr. Randolph
would be providing.
The Board members recommended that the Town Manager and the Design Consultant
review the existing structures and determine both extremes. With those
established, they recommended that the Town Manager and Consultant select
specific approved colors and that trim color be included in the review.
The Town Manager reminded that there had been a question with regard to
the height and location of walls in the Ocean West District. He called
attention to amended pages VI. 3. & 4. that provide for walls along AlA
to be a maximum of 6' in height and setback a minimum-of.12'_from the.front
property line, and that all walls higher than 41along AlA must be screened
with plant material. In addition, solid gates and gates over 6' in height
are prohibited. It is required that fences must be screened from view from

AlA by landscaping, pools must be enclosed with a fence 5' in height(minimum),
fences must be finished on both sides or screened, fences over 6' in height
are prohibited, chainlink is prohibited unless concealed by plant material,
and fences closer than 5' to the edge of street pavement or property line,
whichever is further from the street, are prohibited.
2. Home Occupations Regulations
Mr. Harrington explained that the Commission had requested an ordinance to
control Home Occupation Uses and read the Home Occupations that are proposed
to be permitted. Mrs. Souder asked if trunk sales are a permitted use and
Mr. Harrington advised that these are not permitted in the proposed ordinance.
3. Amendments to the Official Zoning Map to reflect the new
Single Family Zoning Districts as described in the Design
Manual.
The Town Manager advised that the current Single Family Zoning District is
proposed to be divided into 5 districts as was shown in previous drafts of
the Design Manual. He stated there have been no changes in the draft recom-
mended, other than the walls and fences in the Ocean West District which
has already been discussed in Item 1.
4. Amended Powers and duties of the Town Commission, Local
Planning Agency, Board of Adjustment, Architectural Review
and Planning Board and the Planning & Building Administrator
With regard to this matter, Mr. Harrington summarized by advising that the
Architectural Review and Planning Board and the Planning & Bldg.-, Administratc
are proposed to be given final approval authority on a number items.
Chairman Orthwein observed that the proposed amendment provides that an
architect on the ARPB will no longer be required, but that the Board is
authorized to obtain the services of an architect when it is felt that
professional assistance is needed. Mrs. Souder asked when the terms would
expire for current members'-.. Mr. Harrington replied that all members,
except Mrs. Orthwein & Mr. Lynch would expire next year. He added that
the Task Force had felt a need to establish term limLts;.for'th6;:Z'Alternate
Members of the ARPB of 3 years, however, an alternate member who is appointed
to fill a full member position may serve up to 2 terms as a full member
regardless of the number of terms served as an alternate.
5. Amendment to Architectural/Site Plan Review Standards and
Approval Processes.
Mr. Harrington advised that standards and processes exist in the current
code but they are poorly organized and many do not apply to Single Family
development. The provisions have not changed but have been rewritten to
organize the process for each type of review and include the designated
review authority in the proper sequence in the review processes. The
Architectural/Site Plan Review Standards is revised to implement the
0design requirements in the Design Manual, Mr. Harrington said.
1 6. Recodification of Variance Standards & Procedures
The Town Manager stated that the proposed amendments in the Zoning Code
related to variances do not change any of the standards and procedures
but will remove these standards and procedures that were under the heading
of Board of Adjustment and be given a section heading of Variances.
7. Amendments to Special Exceptions Standards and Processes
Special Exceptions are recognized in the current code but only apply to
construction trailers, Mr. Harrington said. He further advised that in
the Design Manual, there are several circumstances recognized to which
Special Exceptions could apply and those need to be recognized in the
Zoning Code. In addition, there is a provision that a Special Exception
shall not be granted in instances where a variance is also required.

8. Appeals Process
Mr. Harrington explained that this amendment is a recodification to move
the provisions covering appeals from the section of Board of Adjustment
to a section entitled Appeals with the Board of Adjustment still designated
to hear appeals.
Town Manager Harrington advised that a summary of comments regarding the
Design Manual and proposed amendments to the Code will be furnished to
the Town Commission and an amendmed document will not be available until
the Commission has had an opportunity to review the comments.
There were no changes recommend for the proposed amendments to the Zoning
Code.
Mr. Lynch moved that it be recommended to the Town Commission that the
Design Manual be adopted as amended in Item VII.A.1. by the ARPB and
amended by the Task Force regarding walls and fences in Ocean West District,
and that all amendments to the Zoning Code as presented by the Town Manager
be adopted. The motion was seconded by Mr. McGraw. Roll Call: Mr. McGraw;

X. Public.
Mr. Charles Velie, Old School Road,expressed a concern that runoff
from the driveway of the Crocker property across the street from him
would flood the street and his property when it was completed. Town
Manager Harrington advised he would review the drainage design to make
certain that it has been certified by a Florida Certified Engineer.
