Mayor Tyrell called the regular meeting of the City Council to order at 7:37 p.m. on Tuesday, April 16, 1974, in the Council Chamber of the City Hall. 2. The invocation was given by Reverend Kenneth Grant, Westminster Presbyterian Church, 9642 Live Oak Avenue, Temple City. 3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell. 4. ROLL CALL: Present: Councilmen- Dennis, Gilbertson, Greenberg, Merritt, Tyrell Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Planning Director Dragicevich, Assistant to the City Manager Biel, Director of Parks and Recreation Kobett, Pub- lic Works Coordinator Leonetti 5. APPROVAL OF MINUTES: Councilman Dennis moved to approve the minutes of the regular meeting of the City Council held April 2, 1974, as written, seconded by Coun- cilman Gilbertson and carried, Councilman Merritt abstaining. IIICANVASS OF MUNICIPAL ELECTION: City Clerk Koski presented Certificate of Canvass of the Municipal Election held April 9, 1974 (Exhibit "A ") which showed incumbents Louis T. Gilbertson and Louis W. Merritt as re- elected for a seat on the Council, and Everett H. Greenberg elected for a seat on the Council. He read the title to Resolution No. 74 -1351, A RESOLUTION OF. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, RECITING THE FACT OF THE GENERAL. MUNICIPAL ELECTION HELD IN SAID CITY OF TEMPLE CITY ON THE 9th DAY OF APRIL, 1974, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. Councilman Merritt moved to adopt Resolution No. 74 -1351, seconded by Council- man Greenberg and unanimously carried. SEATING OF CITY COUNCIL: City Clerk Koski presented Certificates of Election to Louis T. Gilbertson, Louis W. Merritt and Everett H. Greenberg. Mayor Tyrell administered the Oath of Office to the newly elected Councilmen. Councilmen Gilbertson, Greenberg, and Merritt expressed appreci- ation in being elected to serve as Councilmen for the coming four years, and their willingness to serve the community in this manner. REORGANIZATION: At this time the City Clerk assumed the Chair and opened nomin- ations for the office of Mayor for the coming year. Councilman Merritt moved that nominations be closed and a unanimous ballot be cast for Coun- cilman Dennis for the office of Mayor, seconded by Councilman Green - berg_and unanimously carried. Mayor Dennis accepted the gavel, and as a first duty in office, presented a plaque to outgoing Mayor Tyrell on behalf of the Coun- cil in appreciation of the leadership he had provided for the past year. Mayor Dennis called.for nominations for the office of Mayor Pro Tem. Councilman Greenberg nominated Councilman Gilbertson for the office of Mayor Pro Tem, seconded by Councilman Merritt. Councilman Mer- ritt moved that nominations be closed and that a unanimous ballot be cast for Councilman Gilbertson, seconded by Councilman Greenberg and unanimously carried. Merritt Councilman Tyrell moved to adopt Resolution No. 74 -1352 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING AN ALTER- NATE DIRECTOR OF COUNTY SANITATION DISTRICT NO. 15, seconded by Councilman Gilbertson and unanimously carried. Council Minutes, April 16, 1974 - Page 4 Councilman Tyrell moved to adopt Resolution No. 74 -1353 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, APPOINT- ING A MEMBER OF SAID COUNCIL OF SAID CITY TO THE RTD CITY SELECTION COMMITTEE PURSUANT TO PART 3 of DIVISION 10 OF THE PUBLIC UTILITIES CODE, seconded by Councilman Gilbertson and unanimously carried. Mayor Dennis recognized Arcadia Boy Scout Troop 109 who was attending the Council session as a requirement toward their civic badge. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. ASSESSMENTS FOR STREET IMPROVEMENTS - Installation of Two Street Lights (Avon Avenue, north of Burg - hardt Road) Pursuant to Chapter 27, Improvement Act of 1911, Streets and Highways Code. City Manager Koski presented background information, stating the City Council at their regular meeting held April 2, 1974, set pub- lic hearing for the purpose of assessing the property owners adja- cent to Avon Avenue, north of Burghardt Road, property were notified by mail and by notice posted on each property., the assess- ment is shared equally by_ eightproper,ties at $32 each, covering the total cost of $256 for the installation of two street lights. Mayor Dennis declared the public hearing open. There being no one present come forward to speak, Councilman Merritt moved to close the public hearing, seconded by_Councilman Greenberg_ and carried. Councilman Gilbertson moved to approve the assessment as proposed and shown on Exhibit "B" on file in the City Clerk's office, and direct the properties to be so assessed, seconded by Councilman Greenberg and unanimously carried. 7. ORDINANCE NO. 74 -383: 2nd read. ANNEXATION NO. 73 -1 City Attorney Martin presented Ordinance 74 -383 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY APPROVING THE ANNEXATION OF CERTAIN UNIN- HABITED TERRITORY TO THE CITY OF TEMPLE CITY (ANNEXATION NO. 73 -1) for second reading by title only. Councilman Gilbertson moved to waive further reading_ and adopt, seconded by Councilman Merritt and unanimously carried. 8. ORDINANCE NO. 74 -384: 1st read. DEVELOPMENT STANDARDS FOR R -3 and R -4 ZONED PROPERTY AND PARKING STANDARDS. City Attorney Martin presented Ordinance No. 74 -384 entitled AN ORDINANCE OF THE CI {.Y OF TEMPLE CITY AMENDING SECTIONS 9122, 9123, 9296, AND 9366 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO DEVEL- OPMENT STANDARDS FOR THE R -3 and R -4 ZONES OF THE CITY. Councilman Tyrell moved to waive further reading, seconded by Councilman Mer- ritt and unanimously carried. 9. JOINT POWERS AGREEMENT - San Gabriel Valley Juvenile Diversion Project City Manager Koski presented Joint Powers Agreement creating Agency to be known as the West San Gabriel Valley Juvenile Diversion Pro- ject Joint Powers Authority which has been drafted by City Attorney Martin and other City Attorneys, outlining the purpose, terms, authority, powers and duties for the purpose of allowing the seven participating cities to carry out the functions of the project known as the San Gabriel Valley Juvenile Diversion Project. City Attorney Martin answered questions of concern relative to term of agreement, powers and authority and the City's financial liability of $1,607. Councilman Tyrell moved to approve the Joint Powers Agreement and authorize the Mayor and City Clerk to sign, seconded by Councilman 1 1 1 Council Minutes, April 16, 1974 - Page 5 Merritt and carried on a roll call vote: ROLL CALL: AYES: Councilmen- Greenberg, Merritt, Tyrell, Dennis NOES: Councilmen- Gilbertson Councilman Greenberg moved to appoint Councilman Tyrell as City representative to the San Gabriel Valley Juvenile Diversion Project, seconded by Councilman Merritt and unanimously carried. 10. FINAL TRACT MAP NO. 31886 - 5422 -32 MCCULLOCH City Manager Koski presented background information, stating__Ten- tative Tract Map No. 31886 was approved December 4, 1973 by_ Plan- ningCommission Resolution No. 73- 526PC, the condominium was found to be consistent with the General Plan, conditions relating_to cov- enants and restrictions, bonds for faithful performance and bond for Labor and material for public works improvements have been met, final map has been approved by the County Engineer and Subdivision Com- mittee. Councilman Merritt moved to approve per memo dated April 10, 1974 on file in the City_ Clerk's office, seconded by Councilman Gilbert- son and unanimously carried. 11. AGREEMENT: GASOLINE PURCHASE (County of Los Angeles) City Manager Koski presented background information, advising the County had terminated previous contract effective March 14., 1974; City staff had made alternative arrangements for City vehicles. The County has now indicated they would be willing to negotiate a new contract ending_June 30, 1974. Councilman Tyrell moved to approve the agreement and authorize the Mayor and City Clerk to sign, seconded by Councilman Gilbertson and unanimously carried. 12. RESOLUTION NQ. 74 -1354: Employment of Personnel Councilman Tyrell moved to adopt Resolution No. 74 -1354 A RESOLU- TION'OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL, seconded by. Councilman Gilbertson and unanimously carried. 13. RESOLUTION NO. 74 -1355: WARRANTS &DEMANDS, Demand Nos. 9718 thru 9873 in the amount of $125,266.20. Councilman Merritt moved to adopt Resolution No. 74 -1355 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $125,266.20, DEMAND NOS. 9718 THRU 9873, seconded by Councilman Greenberg and unanimously carried. 14. COMMUNICATIONS: A. Council referred to budget session a communication from Temple City Sister City, Inc. requesting inclusion of $100 in the 1974 -75 budget to help defray the cost of membership fees in United ;States /Mexico Sister Cities Association, in National Association of Sister Cities, and in Town Affiliations. B. Council supported the Mayor proclaiming the week of April 21 -27, 1974 as NATIONAL SECRETARIES WEEK. C. Councilman Tyrell moved to adopt Resolution No. 74 -1356 A RESOLUTION'OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY PROCLAIMING THE MONTH OF MAY-, 1974, SENIOR CITIZENS MONTH, seconded by Councilman Gilbertson and unanimously carried. Council Minutes, April 16, 1974 - Page 6 D. California Pet Shop - 9566 E. Las Tunas Drive City Manager Koski presented background information, advising the City had received a complaint petition concerning_the operations of the California Pet Shop, with .147 signatures primarily from students at Oak Avenue Junior High School and Temple City High School. The San Gabriel Valley Humane Society and the County of Los Angeles Department of Health Services have investigated the shop and report there is no apparent sani- tation problem at this time. Mrs. Janette Corothers, 8835E. Naomi, stated she visited �he pet shop_£he preceding Saturday and the odor was very bad. Council received communication from Mrs. Terry McFall, owner of California Pet Shop requesting a postponement for one month and referred the matter to staff for further investigation to be placed on the May 21, 1974 agenda for further consideration. E. On motion by Councilman Tyrell, seconded by Councilman Merritt and unanimously carried, Council approved request from the City of San Gabriel for $85.37 as City share in cost for administra- tion of federal grant to Criminal Justice Planning Board. F. Council received and filed report from the Temple City Chamber of Commerce Board; of Directors for the first nine months of their 1973 -74 program. Mrs. Penn Graham, President, expressed the Board's pleasure at wor ing wit ormer Mayor Tyrell and pledged their support of Mayor Dennis. G. Discussion ensued relative to communication from the Temple City Ministerial Association and Campus Crusade for Christ International requesting a resolution proclaiming April 30, 1974 a National Day of Humiliation, Fasting and Prayer. Al- though Council agreed with the concept, they did not agree with the language of a sample resolution attached. Councilman Tyrell moved to support_ the Mayor signing an appropriate proclamation, seconded by Councilman Gilbertson and unanimously carried. H. Council supported the Mayor proclaiming the week of May 5 -11, 1974 HIRE A VETERAN WEEK. I. Council received communication from Yellow Cab Company of San Gabriel Valley requesting approval of proposed fare increases and continued the matter to the May 7, 1974 agenda for further study. 15. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward. RECESS TO CRA On motion by Councilman Tyrell, seconded by Councilman Gilbertson, and unanimously carried, Council recessed at 8:54 p.m. to meet as the Com- munity Redevelopment Agency. Council convened as the Community Redevelopment Agency, all members being present, and took the following actions: 1) approved minutes of March 28, 1974; 2) authorized the Executive Director to communicate with Environ- mental Protection Agency and Air Resources Board supporting the position taken by Special Counsel Jacobs relating to Indirect Source Review; and 3) appointed the Planning Commission as the Relocation Appeals Board. The minutes of the Community Redevelopment Agency are set forth in full in the minutes of that Agency. Mr. Gilbertson moved to adjourn, seconded by Mr. Greenberg and carried. Council Minutes, April 16, 1974 - Page 7 RECONVENE AS CITY COUNCIL: Council reconvened at 8:48 p.m., all Councilmen being present. 16. MATTERS FROM CITY OFFICIALS: A. Council received a staff report concerning alternative funding for the Planning and Engineering Aide position, which was trans- mitted for information only at this time, Be Council received and filed a communication from Pacific Tele- phone and Telegraph Company concerning hearing before the Public Utilities Commission on the interconnection of various customer- provided devices to the facilities of telephone utilities. C. Statewide Youth Conference - Los Angeles, May 10 -12, 1974 Councilman Gilbertson moved to approve Youth Commissioners attendance to the Statewide Youth Conference to be held in Los Angeles May 10 -12 with attendant expenses, seconded by Councilman Tyrell and unanimously carried. D. City Manager Koski presented Council with a copy of the pro- gram summary for Students in Government Day, May 2, 1974. E. California Society of Municipal_Finance Officers Legislative Conference - Sacramento, May 10, 1974 Councilman Tyrell moved to approve the attendance of the City Treasurer to the second annual one -day legislative seminar for municipal finance officers scheduled for May 10, 1974, Sacramento, with attendant expenses, seconded by Councilman Greenberg and unanimously carried. F. City Manager Koski advised the City had received a telegram advising Los Angeles County_Board of Supervisors had termin- ated Gasoline Allocation Management Plan (odd- even'Tlan). G. On motion by Councilman Gilbertson, seconded by Councilman Merritt and unanimously carried, Council adopted Resolution No. 74 -1357 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ENDORSING PROPOSITION W ON THE JUNE 4, 1974 BALLOT. H. City Manager Koski reported that the public nuisance at 9834 Las Tunas Drive has been abated, the Building Department having made final inspection of the wall and approved same. The property owner at 9661 Las Tunas Drive has advised he is in the process of obtaining bids to abate the nuisance at that location. Staff was directed to investigate the possibility of gas being stored at the 9834 Las Tunas Drive location and to contact the Fire Department regarding any hazardous condition. I. Councilman Tyrell directed Council's attention to letter received from a resident concerning the 10 ft. strip still pending at the triangle at Encinita and Broadway. City Man- ager Koski advised funds were being proposed in the 1974 -75 budget to complete the project. J. Councilman Greenberg expressed concern regarding the apparent lack of sufficient bicycle racks at Live Oak Park and requested staff re- evaluate the numbers and placement of racks. Coun- cilman Greenberg also directed staff's attention to a water fountain at the south field which is apparently not functioning correctly. Council Minutes, April 16,.1974 - Page__.8, K. Councilman Merritt expressed his concern regarding the number of dogs running loose in City parks and on the streets. Staff was directed to contact the San Gabriel Valley Humane Society re: patrol. 17. ADJOURNMENT: On motion by Councilman Tyrell, seconded by Councilman Merritt the meeting was adjourned at 9:15 p.m. Next regular meeting of the City Council will be held Tuesday, May 7, 1974, 7:30 p.m. in the Council Chamber of the City Hall.
