The Council of Bal Barbour Village met Saturday
9:30 A.M. in the Village Hall.
Present: Messrs. Beatty, Brush, printup, laplin

On motion of Mr. Villeneuve, sec ended by Mr. Taplin and unanimously
voted, the minutes of the previous meeting of September 30, 1972 were approved as
submitted.

Mr. Jack Looby showed the Council a plot plan for his proposed 36 unit
on Lot 1 of 8A. Mr. Taplin said he still believed that the Village should

Mr. Errol Adele of Barton-Aschmnn gave, the Council a preliminary report
on the zoning study which covered background statistics, existing and permitted
ground coverage, density, total floor area, floor area ratios, building heights and
parcel utilization, urban characteristics, landscape analysis and treatments, parking,
signing and spotted problems. Mr. Adels explained that the next phase would be to
outline zoning code changes with ramifications on different approaches. It was
pointed out that no Council action would be taken within the next few weeks and
that the report would be sent to the Council for study at least one week before
the December meeting, which could be a public hearing on any proposed changes.
By common consent of the Council, a special meeting will be held on
November 18, 1972 in lieu of the November 25th meeting, also that a meeting will
be held December 9, 1972.

Applications for renewal of taxi permits were submitted and on motion
of Mr. Brush, seconded by Mr. Taplin and unanimously voted, the following taxi
permits were authorized: White Cabs, 15 permits; Morse Taxi and Baggage
Transfer, Inc., 11 permits; North Beach Yellow Cab, 10 permits; and Surf Cabs,
10 permits.
The Council then received their salaries of $1.00 for the fiscal year
ending September 30, 1972.
Mr. Maley explained that we had been notified by the City of Miami
Beach that they had increased their water rates from twenty-five cents per
1,000 gallons to thirty-three cents and also that we would have to resell to
our residents at forty-one cents. He said this was an arbitrary raise to
produce revenue and that the other municipalities involved were considering a
lawsuit to determine if this was a reasonable increase. Mr. Anderson informed
the Council of recent legal decisions on similar cases and recommended that we
file a suit against the City of Miami Beach. On motion of Mr. Villeneuve,
seconded by Mr. Taplin and unanimously voted, Mr. Anderson was authorized to
file a lawsuit against the City of Miami Beach to determine a reasonable water
rate and keep the City of Miami Beach from raising our rate until we are able
to secure sufficient water from another source.
Mr. Taplin told the Council that Harbour House North will give Bal
Harbour an easement over the north ten foot strip of their property for access
to the beach in lieu of a sale to the Village. It was agreed that Mr. Anderson
and the attorney for Harbour House, Mr. Marty Taplin, would meet to prepare
this easement.
Mr. Maley said he and Mr. Anderson had met with the attorneys for the
Internal Improvement Trust Fund and Bureau of Natural Resources and the head
of the Bureau of Beaches and Shores and that the State will consider issuing
our Permit providing that we pay the cost of the approximately 160,000 yards
of sand that will be placed in front of the Surfside lots and that we pay for
a survey showing the mean high water mark in front of the lots in Surfside
where our sand will be placed. He said the State had agreed that it would be
impossible to get written releases from Surfaide property owners regarding our
project. It was moved by Mr. Brush, seconded by Mr. Taplin and unanimously
voted that Zurwelle-Whittaker, Inc. be authorized to make the survey in front
of the affected Surfside properties from 96th to 94th Street.
There being no further business, on motion of Mr. Taplin, seconded by
Mr. Villeneuve the meeting was adjourned at 11:30 A.M.
