whereas, since 1991 Judy and David Daniels have supported and been involved with one of
the most visible partnership projects undertaken by the Midpeninsula Regional Open Space District
and Peninsula Open Space Trust with the development of the David C. Daniels Nature Center at
Skyline Ridge Open Space Preserve; and
whereas, Judy has volunteered as an Outdoor Education Leader and Nature Center Host for
the District for 20 years, and David has volunteered as a Nature Center Host for 13 years; and
whereas, Judy and David have graciously and enthusiastically welcomed thousands of visitors
with their generous spirits to discover the natural wonders found within the Daniels Nature Center,
in and around Alpine Pond, and throughout Skyline Ridge Open Space Preserve; and
whereas, Judy and David have a special passion for connecting children to nature and
outdoor enjoyment demonstrated through their many years of shared discoveries with the youngsters
who have visited the Nature Center. Judy and David have facilitated experiences that include:
wildlife observations, how to use a microscope, and first time up close encounters with a
captive gopher snake; and
now therefore , on this Fourth day of November 2015, the Board of Directors of
the Midpeninsula Regional Open Space District unanimously and wholeheartedly recognizes
Judy and David Daniels for their support of vital environmental education efforts and for their
dedication to the District’s mission.

General Manager’s Recommendation: Adopt a resolution amending the fee structure for Board
Policy 4.04 – Concessions Operating on District Lands.
4. Agreement to Expand Volunteer Opportunities on District Preserves (R-15-145)
General Manager’s Recommendation: Authorize the General Manager to approve a partnership
agreement with Acterra for $34,788, plus a 15% contingency, for a total amount not to exceed
$36,800 in Fiscal Year 2015-16 to manage volunteer outdoor service projects at two District
preserves.
Motion: Director Cyr moved and Director Hassett seconded the motion to adopt the Consent
Calendar.

BOARD BUSINESS
5. Update on Actions of Mutual Interest taken by the District and by Lehigh
Southwest Cement Company during the Past Year (R-15-147)
General Manager Steve Abbors provided comments regarding District’s work with Lehigh
Hanson and the District’s ongoing relationship with the company including a floating easement
for the Black Mountain Trail, which will be finalized once the trail alignment is finalized.
Kari Saragusa, Region West President of Lehigh Hanson, described the plant’s process and
precautions in place for mining the quarry during the rainy season including reactivation of the
water treatment system in September, especially as related to a forecasted El Niño weather
pattern for this winter. Mr. Saragusa also provided an update on the West Materials Storage Area
and future plans to revegetate it and use the material as infill once the supply has been exhausted.
Mr. Saragusa described the ongoing air quality and noise pollution oversight and reporting
requirements completed by Santa Clara County, Bay Area Air Quality Management District, and
Lehigh Hanson and reported on a current study being conducted to test for noise pollution from
the quarry. Finally, Mr. Saragusa provided an update on the restoration of Permanente Creek,
including a revised plan created in cooperation with the Sierra Club. Once approved restoration

will begin during the dry-season periods over multiple years with the goal of returning
Permanente Creek to “pre-plant condition.”

Tim Brand from Bay Area Clean Environment provided comments regarding the West Materials
Storage Area and regarding the noise pollution study being completed by Santa Clara County.
Karen Del Compare shared her concerns regarding the release of toxins into waterways by
Lehigh Quarry.
Rod Sinks, Mayor of Cupertino but representing himself, thanked the Board and District staff for
their efforts related to public access and for providing updates related to Lehigh Quarry. Mr.
Sinks also provided comments regarding creek restoration.

6. Approval of Assignment and Amendment of the Bear Creek Stables Rental
Agreement (R-15-146)
Senior Real Property Agent Elaina Cuzick presented the staff report describing Bear Creek
Stables Rental Agreement providing background information regarding management of the
stable and describing the process by which the proposed amendment to the Bear Creek Stables
Rental Agreement was completed, including a meeting with the stable tenants. Ms. Cuzick also
described the benefits of the transition, such as presence of an onsite caretaker and continued
community outreach and education.
Director Hassett asked questions regarding the auto liability insurance and also regarding the
difficulties of getting all of the stable boarders to comply with the requirement to sign
agreements.
Ms. Cuzick noted these requirements have been problematic, but there will now be a greater
emphasis on gaining compliance.

Ms. Pam Ashford expressed her desire to continue the legacy of the previous stable manager.
Ms. Glenda Smith spoke and thanked the District for all of the work done by staff and for the
cooperative working relationship.
Director Riffle inquired regarding the selection process for choosing the new stables manager.
General Counsel Sheryl Schaffner explained there is not a legal requirement for a competitive
bid since the lease agreement allows for assignment of the management.

Motion: Director Riffle moved, and Director Hassett seconded the motion to authorize the
General Manager to approve the Assignment and Amendment of the Bear Creek Stables Rental
Agreement from Glenda Smith to Pamela Ashford.

INFORMATIONAL REPORTS
A. Committee Reports
Director Riffle reported on the recent Planning and Natural Resources committee meeting to
discuss the Bear Creek Redwoods Preserve.
B. Staff Reports
Assistant General Manager Kevin Woodhouse reported staff held an Emergency Management
Operations and disaster response training exercise earlier in the day. Mr. Woodhouse provided
an update on the implementation of the Financial and Operational Sustainability Model.
General Counsel Sheryl Schaffner provided an update on an ongoing tenant issue at the District
residence at 16060 Skyline Boulevard in Woodside.
Mr. Abbors provided reports on several recent meetings between District staff members and
other local officials, including Supervisor Joe Simitian and members of East Palo Alto city staff.
Mr. Abbors also reported on his recent presentation to the Peninsula Open Space Trust Board of
Directors.
C. Director Reports
The Board members submitted their compensatory reports.
Director Siemens reported his attendance at the California Special District Association Annual
Conference and several seminars he attended there, including one discussing public comments at
a public meeting.

2. Amendments to Consultant Contracts in Support of Completion of the Bear Creek
Redwoods Open Space Preserve Plan (Includes the Bear Creek Stables Site Plan and Alma
College Site Rehabilitation Plan) (R-15-149)

President Siemens inquired regarding the current schedule for the opening of Bear Creek
Redwoods Preserve and expressed his concerns that delays are occurring due to work related to
Alma College.
Planning Manager Jane Mark explained that the expedited planning process proposed to open the
Bear Creek Redwoods Preserve requires several key tasks to be completed before even a portion
of the preserve can be opened, including safe and useable parking lot, trails built, and extensive
weed management performed.
General Manager Steve Abbors explained that the estimated schedule provided by staff to the
Action Plan and Budget Committee in February has been modified to represent a fully developed
understanding of the project. Since that time, staff has completed additional studies and
determined several complex projects must be completed to open the preserve, including
removing invasive weeds and building a road crossing. Mr. Abbors stated staff will be providing
additional information to the Board of Directors at its November 17, 2015 retreat.
Directors Cyr and Hassett expressed their opinion that based on the information provided to the
Planning and Natural Resources Committee staff is working to open the preserve as soon as it is
ready for visitors, which is currently 2018.
Motion: Director Cyr moved and Director Hanko seconded the motion to:
1. Approve a contract amendment with Populous, Inc., for a total amount not to exceed
$41,230, increasing the total contract amount to $269,880, to complete preparation of the
Bear Creek Redwoods Open Space Preserve Plan (Preserve Plan) and Environmental Impact
Report (EIR).
2. Approve a contract amendment with PGA Design, Inc., for a total amount not to exceed
$18,000, increasing the total contract amount to $168,000, to complete the Alma College Site
Rehabilitation Plan and provide supporting information necessary to complete the Preserve
Plan and EIR.
3. Approve a contract amendment with Hexagon Transportation Consultants, Inc., for a total
amount not to exceed $9,000, increasing the total contract amount to $27,000, to perform
additional agency coordination in support of Preserve Plan traffic safety improvement actions
and provide supporting information necessary to complete the Preserve Plan and EIR.

3. Authorize the General Manager to Enter into Two Agreements to Provide Vehicle
Maintenance and Repair Services (R-15-153)
General Manager’s Recommendations:
1. Authorize the General Manager to execute and agreement with CMK Automotive Inc. for
maintenance and repair service for the District fleet for a not to exceed amount of $50,000
for Fiscal Year 2015-16.
2. Authorize the General Manager to execute an agreement with Sol’s Mobile Service for
maintenance and repair service for the District fleet for a not to exceed amount of $50,000
for Fiscal Year 2015-16.
3. Authorize the General Manager to extend either one or both of these agreements for three
consecutive one year extensions under the same terms and conditions upon agreement of any

price changes with written confirmation of both parties; any increase shall not exceed more
than 2% per year.
4. Authorization to Purchase One Vehicle (R-15-154)
General Manager’s Recommendation: Authorize the General Manager to execute a purchase
contract with the State Department of General Services and associated dealers to purchase one
vehicle not to exceed $40,000.

5. Office Space Lease at 4984 El Camino Real, Suite 110, Los Altos (R-15-155)
Senior Real Property Agent Allen Ishibashi presented the staff report describing the need for the
additional office space to accommodate additions staff positions related to implementation of the
Financial and Operational Sustainability Model. Mr. Ishibashi also described the market rates for
Class A, B, and C office spaces and the terms of the proposed lease.

Motion: Director Hassett moved, and Director Hanko seconded the motion to:
1. Determine that the recommended actions are categorically exempt from the California
Environmental Quality Act, as set out in the staff report.
2. Adopt a Resolution authorizing the General Manager to enter into an Office Lease with
Wellington Park Investors.

discuss future District facility options.

Assistant General Manager Kevin Woodhouse reported on the joint work day at El Corte de
Madera and recent Operations department retreat. Mr. Woodhouse also reported staff members
Allen Ishibashi, Meredith Manning, and Michael Bankosh graduated from the Santa Clara
County Leadership Academy.
Assistant General Manager Ana Ruiz reported on ongoing staff recruitments and improvements
to the delivery process for staff projects and interdepartmental communication.
Mr. Abbors reported on a recent Bay Nature hike in Russian Ridge Open Space Preserve and
annual benefit for the Loma Prieta chapter of the Sierra Club.
C. Director Reports
The Board members submitted their compensatory reports.
Director Hanko thanked staff for their efforts related to the bench dedicated to the District’s first
General Manager Herb Grench stating that Mr. Grench was very appreciative of the recognition.
Director Hanko also shared several of Mr. Grench’s accomplishments as general manager.
Directors Kishimoto, Cyr, and Hassett thanked staff for organizing the event recognizing Herb
Grench.
Director Kishimoto reported her attendance at the recent Santa Clara Valley Water District’s
Water Commission meeting.
Director Hassett reported that he attended a recent meeting of the South Skyline Association and
recommended the speaker at that meeting, Brian Liddicoat, come speak to the Board regarding
the old South Pacific Coast Mountain Division railroad.
