No. 05-354 Date of Adoption December 1. 2005 AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH CME ASSOCIATES - SOIL AND GROUNDWATER REMEDIATION WHEREAS, the Borough of Carteret is in need of specialized engineering services in connection with soil and groundwater remediation at the proposed new Department of Public Works/Sewer Department facility; and WHEREAS, CME Associates, 3141 Bordentown Avenue, Parlin, New Jersey 08859, possesses the requisite experience and expertise to provide said services; and WHEREAS, CME Associates has submitted a proposal to provide said services at a total cost not to exceed $65,000.00; and WHEREAS, the Mayor and Council have reviewed said proposal; and WHEREAS, the chief Financial Officer certifies that funds are or will be avaiJable for said purpose from the Meridian II (Mobil I) Redevelopment Project Escrow Account. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Cmieret, County of Middlesex, State of New Jersey, as follows: 1. Dear Mayor Reiman: In accordance with your request, CME Associates has prepared a scope of work and budget estimate for environmental services at the above-referenced site, This scope of work has been prepared to comply with the Remedial Investigation requirements outlined in the July 15, 2004 New Jersey Department of Environmental Protection (NJDEP) review letter. BACKGROUND Five (5) Underground Storage Tanks (UST's) at the abandoned wastewater treatment plant site were closed in June 2000 (Tanks E1 through E5; Killam Associates, January 2003). A discharge was reported in the vicinity of gasoline tanks E-2 and E-5, Contaminated soil was excavated and removed from the site, In one post-excavation soil sample (S-35), benzene was detected at a concentration exceeding the unrestricted use soil cleanup criteria, Two monitoring wells were installed and sampled on November 21-22, 2000, Benzene was detected in the groundwater sample from well MW-1 at a concentration exceeding the Class IIA Groundwater Quality Criteria, Based on these findings, additional soil and groundwater sampling was recommended. In review letters, dated September 19, 2003, July 15, 2004, and March 17, 2005, the NJDEP outlined the remaining remedial requirements that must be addressed to comply with the UST Regulations (NJAC 7:14B) and the Technical Requirements for Site Remediation (NJAC 7:26E). Conduct quarterly ground water monitoring; · Prepare a Classification Exception Area (CEA) for groundwater contamination above the applicable remediation standards; and · Prepare a Remedial Investigation and Remedial Action Work Plan Report, In addition, in order to obtain a No Further Action Determination for the site, all areas of concern identified in a Preliminary Assessment Report must be addressed in accordance with the Technical Requirements for Site Remediation (NJAC 7:26E), Note that the NJDEP has issued a Notice of Violation (EA ID #: PEA050001-033136; 6/28/05) to the Borough of Carteret for the following: Failure to Perform a Remedial Investigation; Failure to Perform a Receptor Evaluation; Failure to Delineate Soil and Groundwater Contamination; S:\Environmental\PROPOSAlS\HCA500.01 Remedial Investigation 11-23-05.doc @ - Mayor Daniel J, Reiman Re: Proposal for Professional Environmental Services Department of Public Works Borough of Carteret, Middlesex County, NJ November 23, 2005 Proposal No, 2005-211 Our File: HCA00500.01 Page 3 Failure to Properly Locate Groundwater Sampling Points; Failure to Perform a Baseline Ecological Evaluation; Failure to Establish a Classification Exception Area; and Failure to Submit a Remedial Action Work Plan, In order to comply with the NJDEP corrective action requirements, CME Associates has completed the following tasks: · Preliminary Assessment (PA); · Receptor Evaluation (RE); and · Baseline Ecological Evaluation (BEE). The following scope of work and budget estimate have been prepared to address the outstanding remedial requirements and comply with the requirements stated in the July 15, 2004 NJDEP letter, as well as the NJDEP Notice of Violation. SCOPE OF WORK Task 1: Remediallnvestiqation of Soil In accordance with the July 15, 2004 NJDEP letter and the NJDEP Notice of Violation, up to twenty-seven (27) additional soil samples will be collected in the vicinity of former gasoline UST's E-2 and E-5 and previous samples S-21, S-6 through S-10, and S-35 in order to delineate the horizontal and vertical extent of contamination to the applicable unrestricted use remediation standard, Soil samples will be collected using Geoprobe boring equipment. All samples will be analyzed for volatile organic compounds (VO+10) by a New Jersey certified laboratory, Delineation samples in the vicinity of previous samples S-6 through S-10 will also be analyzed for lead, S:\Environmental\PROPOSAlS\HCA500-01 Remedial Investigation 11-23-0S.doc @ Mayor Daniel J, Reiman Re: proposal for Professional Environmental Services Department of Public Works Borough of Carteret, Middlesex County, NJ November 23, 2005 proposal No, 2005-211 Our File: HCA00500,01 Page 4 Task 2: Remedial Investigation of Groundwater Task 2.1: Preliminarv Groundwater Samplinq ICON recommends that prior to installation of the permanent monitoring wells, up to six (6) groundwater samples be collected from temporary well points and analyzed for volatile organic compounds (VO+10), The temporary well points will be installed in Geoprobe boreholes, and will be used for initial characterization of groundwater quality and groundwater flow direction in order to optimally locate the permanent wells, Task 2.2: Well Installation In accordance with the July 15, 2004 NJDEP letter and the NJDEP Notice of Violation, one (1) monitoring well will be installed in the excayation area (source area) of former heating oil UST E-3, Depending on the results of Task 2.1, up to five (5) additional permanent wells will be installed to delineate the horizontal and vertical extent of groundwater contamination to the Groundwater Quality Criteria (NJAC 7:9-6). Boring logs and certifications (Forms A and B) will be provided to the NJDEP in compliance with regulations. Well borings will be continuously sampled to identify the hydrogeologic conditions at the site, Selected samples will be tested to determine soil properties required to evaluate migrations of the contaminant plume. Monitoring wells will be survey located, and Form A and Form B will be prepared for each well in accordance with the applicable regulations. Task 2,3: Groundwater Samplinq One (1) round of groundwater sampling will be performed for the permanent monitoring wells, including existing wells and newly installed wells. It is assumed up to 10 wells will be sampled, Up to 2 trip blanks are assumed as quality control samples, All samples will be analyzed for volatile organic compounds (VO+10) by a New Jersey certified laboratory , S:\Environmenlal\PROPOSALS\HCA500-01 Remedial InvesUgation 11-23-05.doc @ - Mayor Daniel J, Reiman Re: Proposal for Professional Environmental Services Department of Public Works Borough of Carteret, Middlesex County, NJ November 23, 2005 Proposal No. 2005-211 Our File: HCA00500,01 Page 5 Task 2.4: Performance of Sluq Tests Slug tests will be performed at up to three (3) wells in order to determine basic hydraulic properties of the shallow water bearing soils underlying the site, Field data will be evaluated to estimate the hydraulic conductivity, The information obtained in the slug tests will be used to estimate the extent of groundwater contaminant migration for the purpose of establishing a CEA (Task 3), Task 2,5: Disposal of Soil Cuttinqs and Purqe Water Waste soil boring cuttings and well purge water will be temporarily stored on site in sealed drums. Samples will be collected for laboratory waste classification, and the waste will be properly disposed in compliance with applicable regulations. Note that for budgeting purposes we assume the waste to be contaminated but non-hazardous, Task 3: Prepare Groundwater Classification Exception Area Proposal In accordance with the July 15, 2004 NJDEP letter and the NJDEP Notice of Violation, ICON will prepare a Classification Exception Area (CEA) proposal to be submitted to the NJDEP as part of the Remedial Action Workplan (Task 4) in accordance with the Technical Requirements for Site Remediation (NJAC 7:26E-8,3). A CEA is established as part of a remedial action for groundwater at a contaminated site, and serves as an institutional control by providing notice that groundwater does not meet the groundwater quality standards in a localized area. The designated uses of water from the contaminated aquifer will thereby be restricted. The CEA proposal will include analytical or numerical fate and transport modeling of the contaminant plume to estimate the following: (a) the distance the plume will migrate before contaminant concentrations decrease to the applicable groundwater quality standards; and (b) the time required for contaminants to degrade below the groundwater quality standards. The duration (expiration date) and the boundaries of the CEA will thus be determined. Note that quarterly groundwater monitoring is typically required as a condition of a CEA, and monitoring is not included in this scope of services (see Limitations below), Task 4: Prepare Remediallnvestiqation/Remedial Action Work Plan Report All site and remedial investigation activities and findings will be presented in a combined Site Investigation and Remedial Investigation Report prepared in accordance with the Technical Requirements for Site Remediation (NJAC 7:26E-3,13 & 4,8). In addition, a Remedial Action Work Plan (RAWP) will be prepared in accordance with NJAC 7:26E- 6,2, The RAWP will outline a course of action to remediate contaminated areas of concern on the site and ultimately obtain a No Further Action Determination, S:\Environmental\PROPOSALS\HCA500-01 Remedial Investigation 11-23-05.doc @ - Mayor Daniel J. Reiman Re: Proposal for Professional Environmental Services Department of Public Works Borough of Carteret, Middlesex County, NJ November 23,2005 Proposal No, 2005-211 Our File: HCA00500.01 Page 6 ESTIMATED BUDGET The estimated budget to perform the Scope of Work outlined above is $65,000,00 as summarized below: Task Task 1: RI of Soil Cost Estimate Task 4: Prepare RI-RAWP Report $9,500 $33,000 $8,500 $14,000 $65,000 Task 2: RI of Groundwater Task 3: Prepare CEA Proposal Estimated Total Budget LIMITATIONS Based on the July 15, 2004 NJDEP letter, if a groundwater contaminant plume is present at the site, the NJDEP will require quarterly sampling of select monitoring wells as a condition of the CEA. If natural remediation of groundwater contamination is proposed in the Remedial Action Work Plan, the NJDEP typically requires a minimum eight (8) quarters of sampling data to demonstrate a decreasing trend in contaminant concentrations with time. All samples would be analyzed for VO+10, MTBE, and TBA, and quarterly groundwater monitoring reports would be submitted to the NJDEP for reyiew. If the NJDEP imposes quarterly monitoring, ICON estimates that an additional budget of approximately $35,000 will be required to comply with the NJDEP requirements for a minimum 2-year period (i.e" 8 quarters), depending on the number of wells to be sampled. If the NJDEP requires further sampling beyond 8 quarters, additional costs would be incurred, Note that the extent of groundwater contamination is not known at this time, and it is assumed natural attenuation will be an appropriate remedial action for contaminated groundwater at the site, The actual remedy for groundwater contamination will depend on the findings of the groundwater investigation (e,g., contaminant levels, the extent of any contaminant plume, and potential receptor impacts).
