The Council of Bal Harbour Village stet Saturday, November 18, 1972 at
9:30A.M. in the Village Hall.
Present: Messrs. Beatty,Brush,Printup,Taplin and Villeneuve
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Thomas H. Anderson, Village Attorney.
On motion of Mr. Brush, seconded by Mr. Villeneuve and voted, the
minutes of the previous meeting of October 28, 1972 were approved as submitted.
Mr. Maley said he was unable to make any recommendations on the advisa-
bility of the Village acquiring Lot 5 Block 8 and Lot 1 Block 8A for park and
recreation purposes, but suggested that Barton-Aschmwn could be asked to advise
the Council on this matter. Mr. Taplin said it would be to the Village's advantage
to acquire these lots for tennis courts and open space. Mr. John Looby, owner of
Lot 1 Block 8A, said he strongly objected to the Council considering this action
as his plans were almost completed for his building which the Council has approved
as to design, and because his financing had been arranged. Furthermore, he said
as owner of another building which would be adjacent to this site, he would object
to tennis courts and a park on this sits, as his tenants are complaining now about
the nuisance caused by the parking lot under Bakers Haulover Bridge and the small
park area there. After further discussion, it was moved by Mr. Taplin, seconded by
Mr. Brush, and voted, Messrs. Beatty, Brush, Printup and Taplin "yes" Mr. Villeneuve
"no" to authorize Ba on-Aschman to make a study at a cost not to exceed $500.00
as to whether the Village should acquire this or any other land in this area for
tennis courts and parks. Mr. Villeneuve moved that the Council give up the idea
of acquiring land in Block 8 and Block 8A for park purposes. The motion died for
lack of a second.
Mr. Maley reported that Dade County has authorized a construction permit
for our beach restoration project. The State is concerned about what our beach will
do to the Town of Surfside and will hold a public meeting there on December 13,1972.
He said that inasmuch as our permits will be ready for issue in about sixty days,
he would like the Council to authorize the engineers to advertise for bids as the
contractors will need sixty days to bid the jobs and we will need time to analyze
them. Mr. Whittaker said the Corps of Engineers has no objection to our asking
for bids before the permits are issued. On motion of Mr. Taplin, seconded by
Mr. Villeneuve and unanimously voted, the Village engineers were authorized to
advertise for bids for the entire beach restoration project.
The Barton-Aschman study of the oceanfront district was discussed and the
Council felt that inasmuch as they would have the results of the study and Barton-
Aschman's recommendations by December let, that the Village Manager should notify
all property owners that the Council will consider proposed changes to the ocean-
front zoning at a public hearing to be held in conjunction with the Council
meeting on December 9, 1972.
There being no further business, on motion of Mr. Taplin, seconded by
Mr. Brush the meeting was adjourned at 10:25A.M.
