HomeMy Public PortalAboutResolution 97-36161 1 RESOLUTION NO. 97 -3616 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISHING STANDARD CONDITIONS PURSUANT TO SECTION 5209 AND 4180.1 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO BUSINESS LICENSE PERMITS AND ACUPRESSURIST /ACUPRESSURE ESTABLISHMENTS THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: SECTION 1. The City Council hereby approves and adopts the criteria labeled as Attachment "A" hereto as Standard Conditions for specific business types listed in Section 5200 and 4180 of the Temple City Municipal Code. SECTION 2. The City Clerk shall certify to the passage and adoption of this Resolution and the same shall thereupon take effect and be in force July 1, 1997. The entire premises is subject to inspection by the Sheriff's Department at anytime. Any locked or otherwise secured rooms will be opened upon request; 2. The approved floor plan and/or room use will not be changed without prior approval of the Sheriff's Department and City; 3. All licenses, permits and these conditions will be displayed in the reception lobby immediately viewable upon entry. All such permits and licenses will be maintained valid; 4. All employees will possess, at the site, a California (DMV) identification. They will present such identification upon request; 5. A manger will be present at all times while the business is open. This manager will be familiar with the City laws regulating acupressure establishments and these conditions. This manager will meet the following qualifications: A. Must be twenty -one (21) years of age. B. Must possess on their person a valid California (DMV) identification. C. Must be able to communicate effectively with City Regulatory Officials. D. This manager will introduce himself to any City Official (Sheriff, Fire, Code Enforcement, Etc.) at such time the Official's presence is announced to any employee. This manager will cooperate with the City Official's investigation. 6. No person(s) other than employees and customers will be allowed anywhere other than the lobby /reception area; 7. Any violation of any applicable laws and/or these conditions will be grounds for suspension and/or revocation of this license; 8. Must comply with all applicable regulations for adult businesses as set forth in Section 9455 in the Temple City Zoning Code. CC Resolution No. 97 -3616 1 1 1 1 1 1 ATTACHMENT "A" ACUPUNCTURE /ACUPUNCTURIST 1. Entire premises subject to inspection by the Sheriff's Department at anytime. Any locked or otherwise secured doors will be opened upon request; 2. The floor plan, as approved by the Sheriff's Department and/or the room use will not change without additional approval by the Sheriff's Department and City; 3. The business owner will maintain a valid California State Acupuncturist License and require all Acupuncturist to have in their possession valid California State Acupuncturist Licenses. All required licenses must be posted at the work station in full view. All Acupuncturist must carry valid California (DMV) identification; 4. Front door will not be locked during business hours; 5. No massage or acuppressure services will be performed or advertised. CC Resolution No. 97 -3616 ATTACHMENT "A" AUTO WRECKING 1. The entire premises is subject to inspection at any time. Any locked or secured rooms or containers will be made available for inspection of the contents. This inspection will only be conducted by the Sheriff's Department; 2. The licensee will maintain all records as required by any law. These or any other related documents will be furnished to the Sheriff's Department upon request; 3. The licensee will cooperate with any Sheriff investigation, including, but not limited to, the origin of any item in the business, whether displayed for sale or not, and the identity of the person that transacted the business; 4. The licensee agrees that all employees will have qualifications of a licensee and that he will not violate any conditions or applicable laws; 5. Violation of any conditions or any applicable laws may be grounds for suspension or revocation of this business license and closure of the business. 1 1 CC Resolution No. 97 -3616 1 ATTACHMENT "A" TOWING 1. Company license; 2. Individual driver's license; 3. The Licensee shall keep records of all tow transactions, including, but not limited to, date, time, location vehicle towed from, person requesting tow, contact telephone, purpose of tow, destination, make, model, color, license and or vehicle identification number and truck driver's name. CC Resolution No. 97 -3616 ATTACHMENT "A" 1 BEAUTY SALON (WITH OR WITHOUT FACIALS) 1. Entire premises subject to inspection by the Sheriff's Department at anytime. Any locked or otherwise secured doors will be opened upon request; 2. The floor plan, as approved by the Sheriff's Department and/or the room use will not change without additional approval by the Sheriff's Department and City; 3. The business owner will maintain a valid California State Board of Cosmetology Establishment License and require all beauty operators to have in their possession valid California State Board of Cosmetology Operator Licenses. All required licenses must be posted at the work station in full view. All beauty operators must carry valid California (DMV) identification; 4. Front door will not be locked during business hours; 5. All of the business' operations must occur in this designated building; 6. Shoulder massages and/or arm massages only in conjunction with hair styling or facial. 1 CC Resolution No. 97 -3616 1 1 1 ATTACHMENT "A" BILLIARD ROOM 1. The entire premises is subject to inspection by the Sheriff's Department at any time. Any locked or otherwise secured doors will be opened upon request; 2. The floor plan and/or room use will not change without prior approval of the Sheriff's License Detail and the City; 3. The operation will be in strict compliance at all times with the most recently approved security plan approved by the Sheriff's License Detail. The security plan may be modified as circumstances warrant; 4. All license /permits along with adopted conditions will be posted behind the alcoholic beverage bar in public view. All license /permits will be maintained valid. These items will be presented to any City Regulatory Official upon request; 5. The business will maintain at all times, while the business is open, a management designated "Responsible Person ". This "Responsible Person" will immediately introduce himself to any City Regulatory Official, (Sheriff, Fire, Health, Building or Code Enforcement) that announces his presence to any employee. The management designated "Responsible Person" will meet the following qualifications: A. Must be a minimum of twenty -one (21) years of age. B. Must possess on their person, a valid California (DMV) identification. C. Must be able to communicate effectively with any City Regulatory Official. 6. No dancing, entertainment or other regulated business activity will occur without prior approval of the Sheriff's License Detail and the City; 7. All members of the public will only enter through the main entrance. The licensee will video record all persons entering the business via the entrance, daily until closing. The equipment video quality is subject to approval of the Sheriff's License Detail. The video format will be "VHS ". The tapes will be kept and appropriately labeled for thirty (30) days. Any tape requested by any Sheriff Personnel will be furnished promptly upon request. The video will include accurate date and time. All video /recording equipment will be maintained in good working order at all times; 8. The entire premises is subject to inspection by the Sheriff's Department at any time. Any locked or otherwise secured doors will be opened immediately upon request. Any keys or combinations necessary to comply with this condition will be available on the premises at all times; 2. The floor plan and/or room use will not change without prior approval from the Sheriff's License Detail and the City; 3. The entertainment format will not change without prior approval from the Sheriff's License Detail and the City; 4. The business will operate in constant compliance with the City's noise ordinance; 5. The business will operate in constant compliance with all of its operating conditions; 6. The licensee will not allow any other nonapproved regulated business activity without prior approval by the Sheriff's License Detail and the City; 7. All State/local licenses /permits and their operating conditions will be posted behind the bar in public view. All licenses /permits will be maintained valid at all times; 8. In addition to any "Entertainment Manager" requirements by City law, a "Responsible Person" will be present on the premises at all times while the business is open. The management designated "Responsible Person" will meet the following criteria A. Must be twenty -one (21) years of age. B. Possess a valid California (DMV) identification. C. Must be able to communicate effectively with all regulatory City Officials (Sheriff, Fire, Health, Building, Code Enforcement, etc.). D. The "Responsible Person" will immediately introduce himself to any Regulatory City Official at such time when their presence is made known to any employee. The Licensee / Representative will cooperate with all official requests. 9. Any violations of these conditions or any applicable laws will be grounds for suspension or revocation of this license; 10. The business will operate under a "Security Plan" approved by the Sheriff's License Detail at all times. This "Security Plan" may be changed as circumstance warrant. Any locked or otherwise secured doors will be opened immediately upon request. Any keys or combinations necessary to comply with this condition will be available on the premises at all times; 2. The floor plan and/or room use will not change without prior approval from the Sheriff's License Detail and the City; 3. The entertainment format will not change without prior approval from the Sheriff's License Detail and the City; 4. The business will operate in constant compliance with the City noise ordinance; 5. The business will operate under a "Security Plan" approved by the Sheriff's License Detail at all times. This "Security Plan" may be changed as circumstance warrant. Must be able to present a valid California (DMV) identification upon demand to the Los Angeles County Sheriff's Department; 3. The City must be notified of any personnel changes; 4. The entire premises is subject to inspection by the Sheriff's Department at any time. Any locked or otherwise secured rooms will be opened upon request; 2. The approved floor plan and/or room use will not be changed without prior approval of the Sheriff's Department and City; 3. All licenses, permits and these conditions will be displayed in the reception lobby immediately viewable upon entry. All such permits and licenses will be maintained valid; 4. The licensee will maintain all records as required by any law. These or any other related documents will be furnished to the Sheriff's upon request; 3. The licensee will cooperate with any Sheriff investigation, including, but not limited to, the origin of any item in the business, whether displayed for sale or not, and the identity of the person that transacted the business; 4. The licensee agrees that all employees will have qualifications of a licensee and that he will not violate any conditions or applicable laws; 5. Violation of any conditions or any applicable laws may be grounds for suspension or revocation of this business license and closure of the business.
