HomeMy Public PortalAboutr 05:359 ¿ih£íúIutiúl1 ú£ ±4£ lßúrúuø4 ú£ QIad£rd, ~ ~ W ~ No. 05-359 Date of Adoption DecemJ>er 1, 2005 OPPOSING NEW JERSEY TURNPIKE CONDEMNATION OF PROPERTIES WHEREAS, Ordinance No. 02-05, approved on March 7, 2002, authorized the adoption of the Amended and Restated Redevelopment Plan (the "January 2002 Redevelopment Plan) for the Landfill Reclamation Improvement District in the Borough of Carteret (the "District"); and WHEREAS, Ordinance No. 04-28, approved on October 7, 2004, later authorized the adoption of a Redevelopment Plan (the "2004 Redevelopment Plan") describing a Landfill District Redevelopment Area; and WHEREAS, the 2004 Redevelopment Plan was intended to reflect certain revisions of the January 2002 Redevelopment Plan related to the land area related to a certain Redevelopment Agreement between Titan-PDC Carteret Urban Renewal, LLC and the Borough of Carteret (the "Titan Redevelopment Agreement"); and WHEREAS, the 2004 Redevelopment Plan was not intended to supersede the January 2002 Redevelopment Plan or alter the permissible land uses prescribed and contemplated by the January 2002 Redevelopment Plan in the areas of the District that were not the subject of the Titan Redevelopment Agreement; and WHEREAS, the Borough Council was advised by its staff that the 2004 Redevelopment Plan may have inadvertently superseded and altered the permitted land uses for portions of the January 2002 Redevelopment Plan, specifically for the permitted land use for Block 1 1.03, portions of Lots 56, 59, and 61, Block 11.04, Lot51; and WHEREAS, the Borough Council, following the recommendation of the Carteret Planning Board, adopted Ordinance No. 05-45 adopting the Corrected Redevelopment Plan to clarify that the January 2002 Redevelopment Plan continued to govern redevelopment of Blocks 11.03, Lots 56, 59 and 61 and Block 11.04, Lot 51 which Redevelopment Plan authorizes the land uses for said lots and blocks as approved by the Carteret Planning Board and as contemplated by said Plan; and WHEREAS, the Borough Council is in favor of the redevelopment of said lots and blocks pursuant to the approvals for the same issued by the Carteret Planning Board; and WHEREAS, the New Jersey Turnpike Authority is now seeking to exercise its power of eminent domain to acquire said lots and blocks pursuant to a roadway program. " NO. ii 05-359 PAGE ? NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as follows: 1. That the Borough is in favor of permitting the land uses for Blocks 11.03, Lots 56, 59 and 61 and Block 11.04, Lot 51 as approved by the Planning Board and as contemplated by the applicable Redevelopment Plan. 2. That the Borough opposes the New Jersey Turnpike Authority's efforts to condemn the aforementioned properties.
