HomeMy Public PortalAbout2009.168 (09-01-09)RESOLUTION NO. 2009.168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD REJECTING THE NON-RESPONSIVE BID FROM ORTIZ ASPHALT PAVING, INC.; AWARDING A CONTRACT TO PALP, INC. DBA EXCEL PAVING COMPANY AS THE LOWEST RESPONSIBLE BIDDER, IN THE AMOUNT OF $953,965 (UNIT PRICE BID SCHEDULE "B") FOR THE IMPERIAL HIGHWAY STREET IMPROVEMENT PROJECT (FROM ALAMEDA STREET TO MARTIN LUTHER KING, JR. BOULEVARD), PROJECT NO. 4011.67.96.7 AND AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT WHEREAS, the Imperial Highway Street Improvement Project (from Alameda Street to Martin Luther King, Jr. Boulevard) is scheduled for completion during fiscal year(FY)2009-201O;and WHEREAS, the City Council of the City of Lynwood adopted the plans, specifications and working details for the Imperial Highway Street Improvement Project (from Alameda Street to Martin Luther King, Jr. Boulevard) on May 19, 2009, and Public Works staff advertised the project on July 23, 2009 and on July 30, 2009; and WHEREAS, twenty-two contractors received project plans and contract documents; and WHEREAS, the bid opening took place in the Office of the City Clerk on August 20, 2009, and twelve contractors submitted bids; and WHEREAS, Ortiz Asphalt Paving, Inc,'s bid was determined as non-responsive and therefore rejected; and ;~ WHEREAS, the Director of Public Works /City Engineer has ascertained that PALP, Inc. dba Excel Paving Company was the lowest responsible bidder at $953,965 for Unit Price Bid Schedule,"B"; and WHEREAS, staff has recommended that the project should be undertaken utilizing schedule "B" which requires that certain pavement construction activities be performed between the hours of 8 pm and 5 am to minimize traffic congestion during the daytime hours; and WHEREAS, a reference check has revealed that this contractor, PALP, Inc. dba Excel Paving Company, has the necessary experience and contractor's license for this type of project; and WHEREAS, the project budget is adequate to pay for the.lmperial Highway Street Improvement Project (from Alameda Street to Martin Luther King, Jr. Boulevard). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. That the City Council of the City of Lynwood rejects the non- responsive bid from Ortiz Asphalt Paving, Inc. Section 2. That the contract for the Imperial Highway Street Improvement Project (from Alameda Street to Martin Luther King, Jr. Boulevard), Project No. 4011.67.967, be awarded to PALP, Inc. dba Excel Paving Company for the lowest bid'of $953,965 for Unit Price Bid Schedule "B". Section 3. That the Mayor is hereby authorized to execute the agreement between the City Council of the City of Lynwood .and PALP, Inc. dba Excel Paving Company, approved as to form by the City Attorney. Section 4. This resolution shall take effect immediately upon its adoption. Section 5. The City Clerk shall certify as to the adoption of this City Council Resolution.
