HomeMy Public PortalAboutResolution 97-36231 1 RESOLUTION NO. 97 -3623 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY SUPPORTING THE ADOPTION OF THE MUNICIPAL SETTLEMENT POLICY FOR LOCAL GOVERNMENT SUPERFUND LIABILITY RELIEF BY THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY WHEREAS, the collection and disposal of Municipal Solid Waste and Municipal Sewage Sludge is a traditional function of local governments that is critical to the protection of public health and safety of their citizens; WHEREAS, local governments have traditionally performed that service at little or no profit to their communities; WHEREAS, studies have determined that Municipal Solid Waste and Municipal Sewage Sludge contain only minute quantities of hazardous constituents; WHEREAS, hundreds of local governments across the country have been subject to unjustified litigation that has burdened them with exorbitant legal costs and exposed them to millions of dollars in unfounded liability simply because they owned or operated municipal landfills or sent municipal solid waste or municipal sewage sludge to landfills that were also used by generators and transporters of industrial hazardous waste and subsequently became Superfund sites; WHEREAS, the Environmental Protection Agency has issued a Draft Municipal Settlement Policy to establish appropriate settlement contributions under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA) and to resolve the liability of local government owners /operators and generators /transporters of municipal solid waste and municipal sewage sludge at co- disposal landfills that are on the National Priorities List. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Temple City concludes that the Draft Municipal Settlement Policy provides an equitable and consistent methodology for resolving the potential liability of local government owners /operators and all generators /transporters of municipal solid waste /municipal sewage sludge in a fair and efficient manner. THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Temple City supports the Draft Municipal Settlement Policy and urges EPA to adopt it as a final policy and implement it as soon as possible.
