RESOLUTION SUSPENDING PLENARY RETAIL CONSUMPTION LICENSE
#1201-33-044-004-SIMON S. HADDAD, INC. T/A SIMON'S NITE CLUB
WHEREAS, on October 18, 2005, the Mayor and Council of the Borough of Carteret
sitting as the local Alcohol Beverage Control Enforcement Authority issued a NOTICE
OF HEARING ON CHARGES OF VIOLATIONS against Plenary Retail Consumption
License #1201-33-044-004-Simon S. Haddad, Inc. t/a Simon's Nite Club, a copy of
which is attached hereto and a part hereof; and
WHEREAS, the Mayor and CounciJ conducted a hearing on said charges on Tuesday,
December 6,2005; and
WHEREAS, at said hearing the Governing Body considered the testimony of the
witnesses presented on behalfofthe Borough's Special Prosecutor; and
WHEREAS, the above referenced Licensee was provided with the opportunity to cross
examine all witnesses and to present a affirmative defense to the charges; and
WHEREAS, the Mayor and Council, after considering all the evidence, made a finding
that the Licensee was guilty of said charge(s); and
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey as the local Alcoholic Beverage
Control Enforcement Authority:
1. That the above referenced Licensee's Plenary Retail Consumption
License #1201-33-044-004 is hereby suspended for a term of fifteen
(15) days, to be served on the next five (5) consecutive Thursday night
through Saturday night periods, beginning on December 8, 2005 and
concluding on January 7, 2006.
Adopted this 6th day of December, 2005
and certified as a true copy of the
original on December 7,2005.

TAKE NOTICE, that the fol1owing charge(s) are preferred against you:

NJA,C. 13:2-23.1 (a)- Sale to a person under the legal age but over the age of 18,
TAKE FURTHER NOTICE, that a hearing wil1 be held pursuant to NJ5.2C:33-15(a) at
Municipal Court Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on December 6,2005 at
6:00 p.m. at which time and place you will be afforded f1111 opportunity to be heard on the foregoing
charge(s) and to show cause why Liquor License No. 120133044004 issued to you by the Borough of
Carteret should not be suspended or revoked.
You must enter a plea of guilty or non-vult or not guilty not later than December 6,2005 or at
any time before that date. The plea may be submitted by letter, provided that it reaches us nollater than
that date.
