This is to confirm that at the meeting held by the Town Commission on February 14, 2003, your
Special Exception, Land Clearing and Level 3 Architectural /Site Plan Review application to
demolish the existing dwelling and permit the construction of a two -story Gulf Stream Bermuda
style residence and pool house consisting of 5,491 square feet at the above address was
considered.
The Land Clearing and Special Exception requests were approved with the condition that prior to
the issuance of a certificate of occupancy, the owner shall record a deed restriction requiring that
315 S.F. of loggia and patio area shall forever remain unenclosed as long as the structure exists.
Your request for a Level 3 Architectural /Site Plan Review was approved with the following
conditions:
1. PBC Health Department approval of the septic system shall be required prior to issuance of a
building permit.
2. Gulf Stream driveway permit and removal agreement shall be obtained prior to issuance of a
building permit.
3. The amount of areca palms for privacy hedge on east side shall be doubled and planted in a
staggered design.
4. Design pool with drainage built into the Swale.
If a building permit, including the aforementioned improvements, is not applied for by February
14, 2004, these approvals will expire.

Gulf Stream Bermuda
Basement shall mean that portion of a building, the ceiling of which is entirely belozv grade or less
than four feet, six inches above grade. A basement is not considered a story with regards to the height
measurement of a building. A basement is designed for, adapted to, and used solely for the purpose of
auto storage, heating and other utility purposes for the main building with no entrances to such
basement on the street side and the exterior appearance of such basement conforming to the general
architecture of the building.
Grade shall mean: (1) For buildings adjoining one street, the elevations of the sidezvalk at the center
of the wall adjoining the street. (2) For buildings adjoining more than one street, the average of the
elevations of the sidezvalk at the centers of all zvalls adjoining streets. (3) For buildings having no
wall adjoining the street, the average level of the finished surface of the ground adjacent to the
exterior zvalls of the building.

family dwelling meets the minimum intent of the Design Manual and applicable review
standards, with the following condition:
