REGULAR COUNCIL MEETING, OCTOBER 16, 2023
CALL TO ORDER
Mayor Ron Fitzwater called the October 16, 2023 City Council meeting to order at 6:01 P.M.
ROLL CALL
The f ollowing Councilmembers were present for roll-call:
Present: Ahlers, Deeken, Hensley, Lester, Mealy, Schwartz, Spencer, Spicer, Wiseman,
and Wright
Absent: None
ADOPTION OF THE AGENDA
Councilmember Wiseman motioned and Councilmember Spicer seconded the motion to
adopt the agenda. The motion passed unanimously.
MISCELLANEOUS AGENDA ITEMS
a. Mayor Fitzwater presented a Key to the City to Dick Preston who recently retired from
KRCG after 55 years on air.
b. Roxy Van Pool with Stephen Siller Tunnels to Towers Foundation presented the Tunnels
to Towers 5K “Fastest Firehouse” trophy to Fire Chief Matt Schofield and the Jefferson
City firefighters, 5K team. Ms. Van Pool also explained the services the foundation
provides to survivors and surviving family members of 9-1-1.
PUBLIC HEARINGS
a. Authorizing the Rezoning of .45 Acres Located at 211 Commerce Dr. from M-2 General
industrial to C-2 General Commercial

A Staff presentation was made by Clint Smith, Director of Planning & Protective
Services.
Brian McMillian with Central Missouri Professional Services spoke in favor of the
bill, representing the developer.
There being no one else to speak on the bill, Mayor Fitzwater declared the
evidentiary portion of the public hearing concluded .

Bill 2023-046 was read third time by title, placed on final passage, and passed by
the following roll-call vote as Ordinance 16378.

MOTION: Councilmember Wiseman motioned and Councilmember Deeken seconded the
motion to approve the above recommended appointment . The motion passed by the
following roll-call vote:

PRESENTATIONS FROM STAFF, CONSULTANTS & INVITED GUESTS
Clint Smith, Director of Planning & Protective Services gave an update on the yard waste
program. The current contract is set to expire at the end of business, on October 31st. City
Staff presented four short-term yard waste service options: 1) Extension of current contract, 2)
City owned & operated collection site, 3) Privately owned & operated yard waste site; and 4)
Discontinue service.
MOTION: Councilmember Mealy motioned to provide a City owned & operated collection site
at Tanner Bridge/Ellis Blvd. site from November 1, 2023 – March 31, 2023, funded from
General Revenue, and starting the RFP process for yard waste services provided after the
short-term period expires, with opportunity for public input.
Mr. Smith explained the period presented to City Council was for November 1, 2023 –
December 17, 2023. Brian Crane, City Administrator said City Staff can move forward with an
RFP Process that includes public input without a motion made by City Council.
The motion failed by no second motion.
MOTION: Councilmember Wiseman motioned and Councilmember Spicer seconded the
motion to move forward with the City owned & operated collection site at Tanner Bridge/Ellis
Blvd. site from November 1, 2023 – December 17, 2023.
MOTION TO AMEND THE MOTION: Councilmember Schwartz motioned to amend the
motion, extending the dates from November 1, 2023 – January 7, 2023 to allow for Christmas
tree drop off, and the Parks Department accepting Christmas trees after January 7, 2023.
Councilmember Wiseman seconded the motion. The motion to amend the motion passed
unanimously by voice-vote.

Mr. Smith then presented a public information flyer regarding the City’s open burn dates as
outlined in the City Code, along with recommendations to mulch grass clippings and leaves.
Information will be disseminated in a number of ways including social media, City website,
and advertisements in the local newspaper.
ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF
City Council committee announcements:
• Committee on Administration – The next meeting is November 1st, 7:30 A.M. in the Boone-
Bancroft Room.
• Finance Committee – This month’s meeting is October 19th, 7:30 A.M. in the Boone-
Bancroft Room.
• Public Safety Committee – The October meeting has been cancelled. The next meeting is
November 30th, 7:30 A.M. in the Police Training Room.
• Public Works & Planning Committee – The next meeting is November 9th, 7:30 A.M. in City
Council Chambers.
Mayor announcements:
• Friday, October 13th was the Special Olympics opening ceremony in Jefferson City.
• The Helias Catholic High School football team won the Mayor’s Cup trophy after winning
the football game against Jefferson City High School.
• Lincoln University Homecoming was last week with many activities including the parade
and football game.
Other announcements:
• Councilmember Spencer thanked Police Officer Hagemeyer for attending his area’s
Neighborhood Watch meeting and providing a presentation to the group.
• Police Captain Clark announced the Drug Take Back Day event on October 28th from
10:00 A.M. – 2:00 P.M. at the Jefferson City Police Department.
• Captain Clark also announced the Jefferson City Police Department Haunted Precinct on
October 28th from 5:30 P.M. – 7:30 P.M.

MOTION: Councilmember Wiseman motioned and Councilmember Spicer seconded the
motion to approve the above items on the Consent Agenda. The motion passed unanimously.

Human Resources Director Gail Strope presented the bill. Councilmember Wiseman
requested to suspend the rules and take up bill 2023-049 for third reading and final passage.
With no objection, bill 2023-049 was third read by title, placed on final passage, and passed
by the following roll-call vote as Ordinance 16379.

AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ADOPTING A BUDGET AND
PERSONNEL CLASSIFICATION PLAN FOR THE CITY FOR THE PERIOD OF NOVEMBER
1, 2023, TO OCTOBER 31, 2024, AND APPROPRIATING MONEY IN THE CITY TREASURY
TO PAY THE COST OF OPERATING THE CITY GOVERNMENT DURING THAT PERIOD IN
ACCORDANCE WITH THE BUDGET.
Councilmember Hensley requested to take up bill 2023-040. Shiela Pearre, Director of
Finance and I.T. presented the variances between the original Mayor’s presented budget and
the Budget Committee’s changes to the bill.
After Ms. Pearre’s presentation, Councilmember Hensley motioned and Councilmember
Wiseman seconded the motion to accept the substitute to bill 2023-040. The motion passed
by the following roll-call vote:

and Wright
Nay: None
Councilmember Lester and Councilmember Mealy said they felt there were actions taken
during this budget cycle which didn’t align with previous budget years. They disagreed with
using Parking Enterprise funds to fund police cars and discussions of taking Parks’ Capitol
Improvement Sales Tax allocations to fund General Revenue Fund items. They said after the
public voiced their strong opinion against the reallocation, the Budget Committee decided not
to do so.
Substitute bill 2023-040 was placed on final passage, and passed by the following roll-call
vote as Ordinance 16381.

Gail Strope, Human Resources Director, presented the resolution.
Councilmember Lester motioned to adopt RS2023-28. Councilmember Wright seconded the
motion. The motion passed by the following roll-call vote:

Nay: Schwartz and Spencer
PRESENTATIONS FROM THE GALLERY ON OTHER TOPICS
Mary Williams-Coley spoke against the Parks and Recreation Commission appointment made
earlier on the agenda. She was also opposed to recent work near the Jefferson City
Community Center.
David Taylor expressed his disappointment in how he was treated when stopped by the Cole
County Sheriff’s Department for not having his child in a car seat.
Don Boes asked what was decided earlier in the meeting regarding yard waste disposal
services. Clint Smith, Director of Planning & Protective Services explained that the City will be
operating yard waste disposal on weekends from November 1 – January 7th at a Tanner
Bridge/Ellis Blvd. location.
Amy Rogers expressed her disappointment regarding the Parks and Recreation Commission
appointment made earlier on the agenda.
COUNCIL AND STAFF DISCUSSION OF PRESENTATION TOPICS

NEW BUSINESS
Councilmember Lester motioned to add “Lincoln University Student Representative Update”
to future City Council agendas. The motion failed by the following vote:

Nay: Deeken, Schwartz, Spencer, Spicer, and Wiseman
Mayor Fitzwater broke the tie, voting Nay.
Councilmember Mealy left the meeting at 7:48 P.M.

There was no unfinished business at this time.
ADJOURN / CLOSED SESSION
A closed session was on the agenda pursuant to Sec. 610.021 of the Revised Statutes of
Missouri, to discuss the following:

ii. Sealed bids & negotiated contracts [Sec. 610.021(12)]
No motion was made for a closed session.
A motion to adjourn was made by Councilmember Wiseman, seconded by Councilmember
Spencer, and approved unanimously at 8:00 P.M.
