The Council of the City of Medina met in regular session on Tuesday, December 5, 1978
at 7:35 P.M. / 7 ` I
Members present: Mayor, Wayne Neddermeyer; Councilmembers, William Reiser, Arthur Theis,
Thomas Crosby; Clerk, Donna Roehl; Planning and Zoning Administrator,
Robert Derus; Police Chief, Charles Hoover; Public Works Director,
Ron Duran, Attorney, Richard Schieffer.
Member absent: Nancy Laurent
Minutes of November 21, 1978:
Motion by Crosby, seconded by Theis to accept minutes of November 21st, as presented.

1. PUBLIC WORKS DEPARTMENT
Ron Duran reported that the city engineer had advised that the city pay G and L Sealcoating
all but 10% of the bid amount.
Donna Roehl reported that a check for $616.22 was included in the current checks, as this is
the amount that Medina has to spend before January 1st from the 1975 County -State Aid funds.
Ron Duran reported that G and L will completethe project in the spring of 1979.
Motion by Crosby, seconded by Theis to pay G and L Sealcoating all but 20% of the $12,600.00
bid award.
Motion declared carried
2. POLICE DEPARTMENT
Automobile quotes
Police Chief Hoover presented the following quotes:
Iten Chevrolet--$6570; Hopkins Dodge--$6581; Malkerson Chevrolet--6935•
Chief Hoover reported that prices would increase after January 1, that delivery would take
from 2 - 3 months.
Wayne Neddermeyer inquired as to need of owning 3 vehicles and paying additional insurance,
also if necessary to have all vehicles insured.
Thomas Crosby stated that he is in favor of purchasing a car so as not to get behind by own-
ing vehicles that require to much repairing.
Chief Hoover reported that he could get from $800-$1000 for the 1976 Oldsmobile by selling
at County auction.
Motion by Crosby, seconded by Reiser to authorize purchase of Dodge from Hopkins Dodge for
$6581 on the advice of Police Chief that the vehicle is a heavier car than the Chevrolet
on which he received a lesser quote, with a delivery date of April or earlier.

3. COMMUNITY DEVELOPMENT BLOCK GRANT
Mark Hendrickson of Hennepin County explained that the city would need to prepare a 3 year
plan for use of funds.
Council discussed the following use of funds:
Implementation of Comprehensive Plan
Purchase of Medina Morningside Water system, if qualified under income requirements of HUD
Sewers in Medina Morningside,
Survey of Hamel sewer lines to locate infiltration
Payment of special assessments in Medina Morningside for those declared not able to pay
Thomas Crosby stated that he would complete figures for the December 19th meeting.
4. ASSESSOR
William Dredge, newly appointed assessor, appeared to sign a salary contract, request that
he be paid on a monthly basis and report to council that he had begun the assessing work.
Richard Schieffer reported that he would have a contraot prepared for the December 19th
meeting.
Wayne Neddermeyer appointed Thomas Anderson to attend meeting of assessors and mayors.
5. MARK PETERSON
136 Thomas Crosby reviewed cities posistion with regards to'zoning code which makes no mention
of a structure such as R caboose.
Jeanne Mabusth, former Planning and Zoning Administrator, reviewed the original request for
information that she had received from Police Officer LaPond.
Crosby asked for opinions of neighbors in attendance.
Marlene Zeuer owner of parcel to the north of Mr. Peterson stated that allowing the cab-
oose to remain would set a precedence in Medina and that her property would be devalued.
Art Peabody and Julia Porter, residents on Tamarack Dr. and Pinto Dr. stated that a cab-
oose in an inappropriate structure and out of keeping with the surrounding area.
Richard Schleifer reported that the State Building Code, Chapter 15, permits accessory
buildings, but a caboose is not mentioned specifically. He advised that Council would
need to decide if this type of structure is acceptable in Medina.
Crosby asked that attorney provide the Council and the Petersons with his analysis of the
issue.
Schleffer reported that he would talk with the city building inspector and the Zoning Adm-
inistrator and prepare a memo for council before the December 19th meeting.
Mark Peterson stated that he has plans to screen and would make any concession the city
might request because he wishes to retain the caboose on the property. He added that he
feels that there is a need for individuality in enforcing building regulations.
Robert Derus was asked to check with Orono and Plymouth regarding railroad structures in
their cities.
Clerk was asked to put on the December 19th agenda at 8:30 P.M.
6. CHRISTIAN WAGENER, LAND DIVISION
Polly Patch appeared to request a division of 10.4 acres into 2 parcels of 5.2 acres each,
owned by Dr. Wagener on Pinto Dr.
Julia Porter, resident on Pinto Dr., requested information as to possible upgrading of Pinto
and whether it should be required at this time.
Polly Patch informed Ms. Porter that when property was divided by Donald Heehl a 66 ft.
road easement was obtained.
Wayne Neddermeyer stated that the city could upgrade the road and assess the abutting
property owners but has never taken that option.
Motion by Crosby, seconded by Reiser to approve the Christian Wagener land division with-
out prejeduce and ultimate issuance of building permit.

7. FARMERS STATE BANK OF HAMEL
Robert Derus stated that the engineer had the revised site plan which indicates additional
parking.
Council reviewed setbacks. Crosby stated that a variance may be needed and that the Zoning
Administrator should list the hardships involved and Council would discuss at the December
19th meeting.
8. SANITARY LANDFILL
Motion by Crosby, seconded by Theis to write letter to Hennepin County endorsing their solution
to solid waste management problems.

9. AUDITOR
Motion by Theis, seconded by Reiser to appoint Hanson and Babcock as city auditors to con-
duct the 1978 audit at a cost of $1820.
Motion declared carried
10. METROPOLITAN ANIMAL PATROL CONTRACT
Motion by Reiser, seconded by Theis to enter into contract with Mapsi for 1979; rates to
be $11.25 per hour patrolling and $3.20 per day animal boarding.

11. LAWRENCE BERTH IAUtE
Mr. Berthiaume reported that additional hours had been required to connect his property to
the city sewer due to the inability to locate a sewer stub. Be presented bills and
requested that Medina pay for the additional time which amounted to $1420 extra. 137
Ron Duran reported that city personnel had made 3 trips to the site in an attempt to
locate the sewer stub.
Wayne Neddermeyer suggested that perhaps McCombs -Knutson should be responsible for some
of the costs as their firm had purchased former engineer William Mills business.
Concensus of the Council was to refer the matter to the City engineer for study and res-
olution of the matter at the December 19th meeting.
12. HUNTER FARMS
Letter from Darrell Farr was discussed wherein Mr. Farr requested release of the escrow
funds being held by the city inasmuch as the streets were completed as per "punch list"
provided by the city engineer.
Richard Schleifer stated that the engineer had been asked by Mr. Farr's secretary to de-
termine the amount of money the city should retain until city accepts the streets.
Mr. Farr requested that he be furnished with a specific list of discrepancies in the work.
Donna Roebl that Mr. Farr notify his snow plwing contractor that plowing should be completed
in a more speedy manner that after previous snowfalls, in that residents of Hunter Farms
have assumed the city is responsible for the snowplowing and have called with questions
as to why the streets are not being plowed when other streets are plowed.
Motion by Crosby, seconded by Theis to direct city engineer to prepare figures as to amount
the city should retain from the Hunter Farms escrow fund.
13. TRAPPING ORDINANCE
Motion by Reiser, seconded by Theis to adopt Ordinance # 175 regulating trapping in the City
of Medina. Permits to be issued similar to hunting permits, for a fee of $1.00.

14. SITE SURVEYS
Robert Derus reported that the State building code does not specifically list that a site
survey is required but states "other such information, where necessary, is required." He
added that Plymouth and Orono require site survey, Maple Grove requires stakes to be main-
tained.
Discussion of site inspection by city staff as to location of building in proper spot.
Discussion of site surveys on farms or those properties that have boundary markers. Con -
census of the Council was to authorize the Zoning Administrator and the Building Inspector
to use discretion in requesting site information.
15. SEWER AND WATER RATES
Motion by Crosby, seconded by Reiser to charge senior citizens one-half the minimum water
and one-half the minimum sewer rate for minimum water usage and $1.10 per 1000 gallons
for water and $1.20 per 1000 gallons for sewer for amounts over minimum.

16. BILLS
Motion by Theis, seconded by Reiser to pay the bills; Order checks # 7774 - 7816 in the
amount of $92,593.33 and Payroll Checks # 5169-5192 in the amount of $ 7470.90.
Motion declared carried
Motion by Theis, seconded by Crosby to adjourn.
