RESOLUTION NO. 97 -3634
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY APPROVING ZONE VARIANCE 97 -1316 TO ALLOW THE
SUBJECT SITE ADDRESSED AS 9812 -9816 LEMON AVENUE TO BE
RE -ZONED TO THE (RPD) CLASSIFICATION WITH LESS THAN
THE MINIMUM REQUIRED ONE ACRE. (LAUWAY
INTERNATIONAL/INTER- PHASE /SPEIGHT)
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
SECTION 1. Based upon testimony received at a noticed hearing before the City Council and
upon facts contained in the staff reports, as well as information and testimony contained in the Planning
Commission Minutes and the Planning Commission Staff Report, the City Council hereby approves the
requested variance to allow the subject property to be re -zoned from R -1 to Residential Planned
Development (RPD) with less than the minimum one acre of land based upon the findings contained in
Planning Commission Resolution No. 97- 1862PC and subject to all conditions contained in said Planning
Commission Resolution.
SECTION 2. This project should not result in significant effects upon the environment and a
Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial
statement as prepared indicates there is no potential for adverse impact to the environment generally and
specifically as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological
communities, including the habitat upon which the wildlife depends for its continued viability.
SECTION 3. Accordingly, Zone Variance 97 -1316 is approved.
SECTION 4. The City Clerk shall certify to passage and adoption of this resolution and enter
it into the book of original resolutions.
