HomeMy Public PortalAboutResolution 97-3635RESOLUTION NO. 97 -3635 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING TENTATIVE TRACT MAP NO. 52373 TO ALLOW THE SUBJECT SITE AS SHOWN ON EXHIBIT "A" OF THIS RESOLUTION AND ADDRESSED AS 9812 -9816 LEMON AVENUE TO BE SUBDIVIDED WITH FIVE (5) SINGE - FAMILY RESIDENTIAL LOTS AND A PRIVATE DRIVEWAY. (LAUWAY/INTER- PHASE /SPEIGHT) THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: SECTION 1. Based upon testimony received at a noticed hearing before the City Council and upon facts contained in the staff reports, as well as information and testimony contained in the Planning Commission Minutes, the City Council hereby approves the requested subdivision map based upon the fmdings contained in Planning Commission Resolution No. 97 -1862 and subject to all conditions contained in said Planning Commission Resolution, plus additional conditions as enumerated in Section 3 below. SECTION 2. This project should not result in significant effects upon the environment and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no potential for adverse impact to the environment generally and specifically as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. SECTION 3. Accordingly, Tentative Tract Map No. 52373 is hereby approved, subject to all conditions contained in Planning Commission Resolution No. 97 -1862, plus the following special conditions of approval: A) Adequate drainage to meet the approval of the County Engineer: said drainage plan shall be presented as a component of the precise plan which shall show the subdivision layout as being "flipped" so that the access driveway is situated along the west property line. The precise plan of development shall be subject to a noticed public hearing before the Planning Commission so that neighboring property owners will have an opportunity to review proposed grading and drainage. B) The required six foot high block wall which is to be constructed around the perimeter of the property shall be measured from the highest grade on either side of abutting lots. C) No parking shall be allowed along the west side of the proposed private driveway, which will abut the rear property lines of four singe - family residential lots fronting on Golden West Avenue. In particular, vans, motor homes, recreational vehicles, etc. shall not be parked adjacent to the west wall of the project. D) Low -level (non - intrusive) street and residents' lighting shall be installed so that neighboring yards are not flooded with light during the evening hours. E) The CC&R's shall adequately provide for continuous maintenance to the satisfaction of the City Attorney: if the City Attorney is not satisfied with the CC &R's in terms of providing for on -going maintenance of the common areas, said CC &R's shall be presented to the Planning Commission or the City Council for review and approval. In addition, the CC &R's shall specifically state that the City of Temple City shall have the right to require a Homeowner's Association in the future, should that be deemed necessary for purposes of property maintenance. Resolution No. 96 -3635 Page 2 SECTION 4. The City Clerk shall certify to passage and adoption of this resolution and enter it into the book of original resolutions.
