1. Call to Order and Introduction of Members, Ex-Officio Members and Staff
Chairman Hake called the meeting to order at 7:30 a.m. and introduced Board members and asked
staff to introduce themselves. A quorum was present to hear the items on the agenda. The
following members were designated to vote: Hake, Crabtree, Seaver, Lacy, and Schaefer. Those
wishing to speak to the Board were sworn in.
2. Procedures Explained
Chairman Hake explained the procedures of the meeting. Ms. Bliss entered the following
documents as exhibits for all items under consideration at the meeting:
1. The City Code of the City of Jefferson, as amended
2. The Comprehensive Plan and Land Use Map
3. Copies of applications under consideration
4. A list of property owners to whom notice of the hearing was sent
5. The affidavits of publication of notice of the public hearing

6. New Business — Public Hearings
Case No. B23006 — 1112 Jackson Street, Conditional Use Permit and Rear Setback Variance.
Request filed by Jefferson City School District, property owner, for a Conditional Use Permit for a
new 7,680 square foot building at the Jefferson City High School campus for Nichols Career Center
and a setback variance of 8" from the required 25' rear setback of the RS-4 Medium Density
Residential zoning district in order to permit a 24.33' rear setback. The property is located on the
west side of Jackson Street 200 feet north of Union Street and is described as Part of Woodcrest
Subdivision, in the City of Jefferson, County of Cole, Missouri.
Ms. Bliss described the location, zoning, and surrounding properties. The request is for a rear
setback variance and conditional use permit. Mr. Barron gave additional details on things staff
looked at with respect to buffering from the surrounding properties. Mr. Seaver asked how access
to the back yard of the house to the North would be affected. Mr. Barron that access will be available
through their side yard as it presently is.
Mr. McMillan, 2500 East McCarty Street, presented the case. He gave details on the project and
the schools need for the building. Mr. Hake asked if the building was going to be for commercial
use. Mr. McMillan responded that it will not be for commercial use; it will instead be for practical
experience for the participants.
Mr. Underwood was sworn in.
Mr. Underwood, Director of Facilities for Jefferson City School District, 315 East Dunklin, spoke on
the project. He gave details on the positives of the new addition.
There was no one to speak in opposition of the project.
No one else spoke regarding the request.
Mr. Hake asked if there would be any pedestrian impact. Mr. McMillan stated that he does not
anticipate a big hinderance, as there are pedestrian walkways above and below the area.
Ms. Bliss referred the Board to the recommended form of motion.
Mr. Crabtree moved and Mr. Seaver seconded to approve the requested setback variance of 8"
from the required 25' rear setback of the RS-4 Medium Density Residential zoning district in order
to permit a 24.33' rear setback.
A roll -call vote was taken and the motion passed 5-0 with the following votes:

Mr. Seaver moved and Mr. Crabtree seconded to approve requested Conditional Use Permit for a
new, stand-alone 7,680 square foot building expansion of Nichols Career Center with the following
condition: Signage allowance for the site to be regulated by requirements of the C-1 Neighborhood
Commercial zoning district.
A roll -call vote was taken and the motion passed 5-0 with the following votes:

Case No. B23007 —1842 East McCarty Street, Conditional Use Permit. Request filed by
Jefferson City School District, property owner, for a Conditional Use Permit for an Early
Childhood Center. The property is located approximately 500 feet west of the intersection of East
McCarty Street and Eastland Drive and is described as Part of the East Half of the Southwest
Quarter of Section 16, Township 44 North, Range 11 West, and Part of Tract 2 of Landwehr Hills
Subdivision Section 11, in the City of Jefferson, County of Cole, Missouri.
Mr. Crabtree left the board at 8:08 AM to abstain from this case.
Ms. Bliss described the location, zoning, and surrounding properties. The request is for a
conditional use permit.
Mr. McMillan, 2500 East McCarty Street, presented the project. He gave details on the flaws of
the old center and details on the potential positives of the new center. Mr. McMillan then gave
two options on how the center could be laid out.
Mr. Barron gave additional details on the possible building footprints with Mr. McMillan explaining
each one. Mr. Barron spoke regarding stormwater plans and Mr. McMillan gave details on the
stormwater detention system. Mr. Barron stated there were multiple options to meet the
standards of the stormwater regulations. Mr. Barron then spoke regarding the traffic impact. Mr.
McMillan stated that three lane road will be adequate for the project. He then gave details on the
planned pick-up and drop-off procedures.
The following people spoke in favor of the project:
Mr. Frank Underwood, Director of Facilities for Jefferson City School District, 315 East Dunklin
Street, gave details on the positives of the project. He stated it will be able to accommodate an
additional 30-50 students. He also gave details on the flaws of the current center. Mr. Hake
asked what the early childhood center encompasses. Mr. Underwood stated that the center is for
assistance with speech, mobility, pre-school, and others that are developmentally challenged.
Mr. Jack Deeken, 236 South Bluff Street, gave details on why he believes the project is
necessary.
No one spoke in opposition.
The following spoke in general on the project.
Mrs. Colleen Meredith, 1841 East McCarty Street (across the street from the site), stated that her
concerns for the site were water detention and where her mailbox would be placed.
Mr. Steve Meredith, 1841 East McCarty Street, asked if there would be a tremendous amount of
leveling during construction. Mr. McMillan stated that, yes, there would be a need to level the
property and that a DNR permit would be necessary to help with the run-off regulations.
There were no further comments on the project.
Mr. Hake closed testimony.
Ms. Bliss gave final details on the application.

Mr. Seaver stated a request to the School District to consider the neighbors requests to minimize
stormwater issues during construction. Mr. Hake agreed and stated that he also has traffic
concerns, but the good outweighs the concern.
Ms. Bliss referred the Board to the recommended form of motion.
Ms. Lacy moved and Mr. Seaver seconded to approve the requested Conditional Use Permit for a
new, stand-alone 71,000 square foot early childhood center with the following condition: Signage
allowance for the site to be regulated by requirements of the C-1 Neighborhood Commercial zoning
district.
A roll -call vote was taken and the motion passed 5-0 with the following votes:

Mr. Cartwright left the Chambers at 8:44 AM.
Mr. Crabtree returned to the Board at 8:44 AM.

Case No. B23008 — 500 Madison Street, Signage Variance. Request filed by Central Missouri Trust
Co., property owner, for a variance to Chapter 3 of the City Code Section 3-5. I, (Electronic message
centers) to permit a three -sided electronic message center in a C-3 Central Commercial (downtown)
zoning district. The property is located on the north side of Highway 50 between Madison Street and
Jefferson Street and is described as Inlots 704-707, in the City of Jefferson, County of Cole, Missouri.

PUBLIC NOTICE
Public notice was given by publication in the newspaper, by letter to all adjacent and affected property
owners located within 185 feet of the subject property, and by property sign posting; each of these
means adequately distributed in advance of the meeting.
NATURE OF REQUEST
A signage variance has been requested to permit an electronic message center to replace an existing
detached monument sign currently on the property. The zoning designation for the property is C-3
Central Commercial (downtown). Per Chapter 3 of the City Code, electronic message centers located
in a C-3 zoning district are permitted to display time, temperature, and cost of automobile fuel. The
applicant is seeking a variance to permit a standard commercial electronic message center.

BACKGROUND INFORMATION
Chapter 3 of the City Code for the City of Jefferson contains provisions for signage. This chapter
details that electronic message centers located within the C-3 zoning district are permitted to display
time, temperature, and cost of automobile fuel but do not permit standard commercial electronic
message centers.
The subject property sits in the C-3 Central Commercial (downtown) zoning district adjacent to a
major highway —Highway 50. C-3 zoning only exists along Highway 50 for a 2 block area and only
on the north side of the road.
FINDINGS REQUIRED
In accordance with Section 3-11 of the City Code, variances to signage requirements require certain
findings to be reviewed by the Board of Adjustment. The chart below lists the general as well as
specific required findings for signage variances. Within the case packet, the applicant has provided

because of its high capacity drive through use and exposure to a major highway corridor. The new
sign is proposed to be similar to the other commercially oriented nearby electronic message centers.
Further, the electronic message center is subject to all applicable Code requirements, including those
outlined in Chapter 3 and Chapter 35.

General Findings:
1. Would the proposed variance eliminate an adequate supply of light or air to the adjacent
property or endanger the safety of the public?
No, the proposed sign will not eliminate adequate supply of light or air to adjacent
properties or endanger the safety of the public. We will be using the existing
detached sign location which will eliminate these concerns. Both the existing and
proposed are 30' in height. Sign to be installed per the engineered footing to ensure
no safety concerns.
2. Would the proposed variance be unduly injurious to the use and enjoyment of adjacent
property or substantially diminish property values in the neighborhood?
No, we do not believe so. The property itself, as well as the surrounding properties,
are commercially zoned. The purpose of the proposed sign matches commercial
intent and is within reasonable use of the property.
3. Would the proposed variance permit obtrusive or incompatible signs to injure the
character of the neighborhood.
As the surrounding properties are a mix of commercially zoned, we do not anticipate
the proposed to injure the character of the neighborhood. Additionally, there is an
EMC at the Miller Performing Arts Center which is located at the property directly
southeast of the Central Bank in question. Across from Hwy 50, there is also an
EMC at Coca-Cola. This keeps our sign similar to those surrounding it.
4. Would the proposed variance obstruct significant views or vistas?
With the size of the property, this sign will not obstruct significant views or vistas. As
there is an existing sign we are wishing to replace in the proposed location, we know
this to be true.

5. Would the proposed variance obstruct vision where such obstruction could create a
traffic hazard?
As shown in the attached documents, the sign itself is set back 74' from Jefferson St.
andl30' from Hwy 50. This is set back significantly from traffic on these roads listed
and should not obstruct to cause hazard.
6. Would the proposed variance be in keeping with the general spirt and intent of the
Advertising and Sign Code?
Yes, we believe the proposed keeps in the general spirit and intent of the code. If
this property were zoned C-2, this would stay within the allowances for such. As the
property is one of few which is zoned C-3 along this portion of Hwy 50, we are
seeking approval. The proposed sign will also increase attractiveness of the signage
on the property as the existing is outdated.
Specific Findings:
1. Does topography or existing buildings interfere with usual visibility?
For this specific property, topography is not an issue. As stated above, this is the
only large property zoned C-3 in this area on Hwy 50 and Central Bank is
experiencing the hardship of this. As there are neighboring properties that have
EMCs, we are requesting for the ability to have the same.
By allowing the proposed, this will also increase attraction to this Central Bank
location and promote economic development. The existing sign is outdated and does
not attract the attention of new and existing customers. 13

the morning of Tuesday, November 14, 2023, in the Council Chambers of the John G. Christy
Municipal Building, 320 E. McCarty Street, to consider the following item of business. This
meeting will be an in -person meeting.
Case No. B23008 — 500 Madison Street, Signage Variance. Request filed by Central Missouri
Trust Co., property owner, for a variance to Chapter 3 of the City Code Section 3-5.1, (Electronic
message centers) to permit a three sided electronic message center in a C-3 central commercial
zoning district. The property is located on the north side of Highway 50 between Madison Street
and Jefferson Street and is described as Inlots 704-707, in the City of Jefferson, County of Cole,
Missouri. (Pinnacle Sign Group, Consultant).
As a nearby landowner and/or neighbor, you are being provided notice of this hearing.
