REGULAR COUNCIL MEETING, MAY 15, 2023
CALL TO ORDER
Mayor Ron Fitzwater called the May 15, 2023 City Council meeting to order at 6:02 P.M.
ROLL CALL
The f ollowing Councilmembers were present for roll-call:
Present: Ahlers, Deeken, Hensley, Lester, Mealy, Schwartz, Spencer, Spicer, Wiseman
Absent: None
ADOPTION OF THE AGENDA
Councilmember Lester motioned and Councilmember Ahlers seconded the motion to adopt
the agenda. The motion passed unanimously by voice-vote.
MISCELLANEOUS AGENDA ITEMS
a. Former Mayor John Landwehr announced the Kiwanis Club 17th Annual Mayor’s Cup Golf
Tournament scheduled for Friday, June 2, 2023.
b. Public Hearing – Six Nominees for Ward 4 City Councilmember
i. Mayor Fitzwater opened the public hearing.
ii. Jeremy Bowman, FOP President, spoke in support of Carlos Graham. James Noah,
Local 671 Firefighters Union President, spoke in support of Carlos Graham.
iii. There being no one else to speak on the nominees, Mayor Fitzwater closed the public
hearing.
iv. Acting Interim City Administrator Ryan Moehlman explained the nomination process.
Each Councilmember may motion to nominate one candidate. A second to the motion
is not necessary, but may be made to show support. Once the nominations are made,
a roll call vote will be taken. Each councilmember will vote for the candidate they
choose. The candidate(s) with the lowest votes will drop off. If there is a tie for lowest
votes, those candidates will all drop off. The process will continue until one candidate
receives 5 votes (majority).
v. Nominations: Councilmember Spicer nominated Carlos Graham . Councilmember
Lester nominated and Councilmember Deeken seconded the nomination of Rand all
Wright. Councilmember Mealy nominated Julie Allen. Councilmember Hensley
nominated Kathi Harness.

vi. City Clerk Emily Donaldson swore in Randall Wright as the Ward 4 City
Councilmember. Councilmember Wright took his seat with the City Council for the
remainder of the meeting.
PUBLIC HEARINGS
a. Rezoning 2.4 acres from RS-2 Low Density Residential to C-2 General Commercial for
property located at 2738 Rock Ridge Road
i. Associated Pending Bill 2023-004 (Lester) Staff: Clint Smith
A Staff presentation was made by Eric Barron, City Planner.
The applicant, David Elkan with Glenwood Equities, 1415 Elbridge Payne Rd.,
Chesterfield, MO spoke in favor of the bill.
The following spoke against the bill: Jenni Lang, Deborah & Melvin Scholenberg,
Dennis Lachelee, Ron & Karen Lueckenhoff, Thomas Bartlett, Shawna Pooler, Mike
Michaelson, Aaron Kliethermes, and Lori Novak.
There being no one else to speak on the bill, Mayor Fitzwater declared the
evidentiary portion of the public hearing concluded.

AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING,
AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF
THE CITY OF JEFFERSON, BY REZONING 2.4 ACRES OF LAND LOCATED AT
2738 ROCK RIDGE ROAD FROM RS-2 LOW DENSITY RESIDENTIAL TO C-2
GENERAL COMMERCIAL.
Bill 2023-004 was read third time by title, placed on final passage, and failed by the
following roll-call vote.

b. Approving a Preliminary PUD Plan and Final Subdivision Plat of Dogwood Park
Subdivision located at 810 El Dorado Drive

A Staff presentation was made by Eric Barron, City Planner.
Representing the developer, Josh Lage; Paul Sampson with Central Missouri
Professional Services spoke in favor of the bill.
William Scott Randolph spoke against the bill.
Developers Josh and Shannon Lage spoke in favor of the bill and answered City
Council’s and citizens’ questions.
Shawna Bruemmer expressed her concerns with neighborhood safety, upkeep ,
and maintenance. Mr. and Mrs. Lage addressed her concerns, noting it being in
their best interest to maintain the upkeep and safety of the neighborhood.
David Rosel expressed his concern with parking around the proposed
development. Mr. and Mrs. Lage and Matt Morasch, Director of Public Works
explained the parking allowed near the development and also informed M r. Rosel
that each unit would have a garage for either one or two cars.
Susan Randolph spoke against the bill expressing concerns with stormwater run -
off and culverts in the neighborhood. Matt Morasch said he would put Ms.
Randolph in touch with Don Fontana, City Waste Water Engineer.
There being no one else to speak on the bill, Mayor Fitzwater declared the
evidentiary portion of the public hearing concluded .

AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A
PRELIMINARY PUD PLAN FOR PROPERTY ADDRESSED AS 810 EL DORADO
DRIVE, ACCEPTING AND APPROVING THE FINAL SUBDIVISION PLAT OF
DOGWOOD PARK SUBDIVISION, A SUBDIVISION OF THE CITY OF
JEFFERSON, MISSOURI, AND AMENDING SECTION 19-401, SCHEDULE J,
PARKING PROHIBITED, WITH RESPECT TO EL DORADO DRIVE.
MOTION: Councilmember Lester motioned and Councilmember Ahlers seconded
the motion to amend the PUD, accepting the revision with the new location position
of lot unit 8 and addressing storm water issues.
Bill 2023-005 with the amended PUD was read third time by title, placed on final
passage, and passed by the following roll-call vote as Ordinance 16342.

A Staff presentation was made by Eric Barron, City Planner.
Paul Sampson with Central Missouri Professional Services spoke in favor of the bill.
Randy Ford expressed his concerns with the blind curve in the area.
Mr. Sampson addressed his concerns noting he worked with MoDOT on the
proposed development and had adjusted the location to eliminate the blind curve
from MoDOT’s perspective.
There being no one else to speak on the bill, Mayor Fitzwater declared the
evidentiary portion of the public hearing concluded .

MOTION: Councilmember Spencer motioned to table the appointments until the next City
Council meeting to allow Mayor Fitzwater more time to review the recommended
appointments. Councilmember Lester seconded the motion. The motion passed

Staff announcements:
• Rachel Senzee, Neighborhood Services Manager announced the HPC Historic Bike Tour
on March 30th at 6:00 P.M. The ride will start on the parking lot at 109 Madison St.
Jefferson City Historic Preservation Commission is partnering with JC Parks to host the
event.
• Ms. Senzee announced the 2023 Annual Action Plan public meeting on Jun e 1st at 4:00
P.M. in Council Chambers.
City Council committee announcements:
• Committee on Administration – The June meeting is scheduled for June 7th, 7:30 A.M. in
the Boone-Bancroft Room.
• Finance Committee – The next meeting is scheduled for May 23rd, 8:00 A.M. due to a
scheduling conflict.

Councilmember Spencer requested to suspend the rules and take up bill 2023-012 for third
reading and final passage.
MOTION: At the request of Interim Acting City Administrator Ryan Moehlman, Councilmember
Spencer motioned to strike language under Section 2, “subject to the easement retained in
Section 2” since such easement does not exist. Councilmember Lester seconded the motion.
The motion passed by voice-vote.
With no objection, bill 2023-012 as amended was third read by title, placed on final passage,
and passed by the following roll-call vote as Ordinance 16345.

408 Lafayette St. Demolition – Clint Smith, Director of Planning and Protective Services and
Dave Helmick, Code Enforcement Supervisor presented a request to demolish 408 Lafayette
St. After some discussion between Councilmembers and Staff on the history of the property,

CLOSED SESSION
Pursuant to Sec. 610.021 of the Revised Statutes of Missouri, Mayor Fitzwater entertained a
motion to go into Closed Session to discuss the following:
i. Attorney Client Privilege [Sec. 610.021(1)]
ii. Hiring, firing, disciplining or promoting of particular employees [Sec. 610.021(3)]
iii. Individually identifiable personnel records, performance ratings or records pertaining to
employees or applicants for employment [Sec. 610.021 (13)]
A motion was made by Councilmember Wiseman to go into Closed Session for the above-
stated reasons, seconded by Councilmember Deeken and approved by the following roll-call
vote at 10:45 P.M.:
