The following guests attended the meeting: Councilman Randy Wright, Phil Freeman, Stephi Smith-News Tribune, Eric Landwehr –Cole County PW and Harry Otto 1) Introductions No formal Introductions made. 2) Approval of the September 14, 2023 Committee meeting minutes Councilman Deeken moved and Councilman Lester seconded to approve the September 14, 2023 meeting minutes, motion carried. 3) Citizen opportunity to address Council Committee on Stormwater and Other Public Works Issues. No one present Minutes/Jefferson City Public Works and Planning Committee October 12, 2023 2 4) New Business a. Equipment & Vehicle Leasing (Britt Smith) Mr. Britt Smith provided a handout to committee members explaining the truck needs of the Street Division and provide three options to obtain and fund those needs. Discussion among Committee members and staff took place. It was recommended that staff come back to the Committee with more information and precise dollar amounts. b. Madison Street Improvement Discussion (David Bange) Mr. Bange presented various options and dollar amounts required. He provided five potential improvement options and spoke on which option may be best. Mr. Phil Freeman was present and spoke before the committee about needed improvements to Madison Street. Discussion among Committee members and staff took place. The committee chose to endorse a larger project to be done. Councilman Schwartz motioned, seconded by Councilman Deeken to move forward to full Council with a City/County Project to upgrade Madison Street. Motion carries with the following roll call vote: Aye: Spencer, Deeken, Lester, Schwartz, Spicer Nay: c. Wastewater Farm Lease (Eric Seaman) Mr. Seaman gave a brief slide presentation on renewal of the Airport and Wastewater ground lease which is due every five years. Mr. Seaman noted that the Purchasing Division has received proposals. There was no discussion among committee members and staff. d. Rail Spur/Transload Facility Funding Agreement (David Bange) Mr. Bange spoke briefly on the funding needs increasing, creating a shortfall for the project. Mr. Eric Landwehr spoke to committee members regarding the grant process and assessment changed. Looking at possibility of City helping with shortfall amount. Discussion among committee members and staff took place on funding options City might be able to provide. Staff will bring back to the committee at a later time when there is a better idea of the amount of funding needed. e. Project Update – Requested by Councilman Spencer 1. Northwood Drive Sewer Extension (Eric Seaman) Mr. Morasch and Mr. Seaman noted to committee members this project was not funded in the Fiscal Year 2024 Budget. They also noted there has been no discussion with residents on costs pertaining to hooking up to the system. Discussion among committee members, staff and council persons present took place. It was decided to proceed with design and set up public meetings. Minutes/Jefferson City Public Works and Planning Committee October 12, 2023 3 2. Airport Projects-Parking Lot and Fence (Britt Smith) Mr. Britt Smith presented two options to committee members including costs associated with each option. He noted staff will take a look at the parking area for improvements to be done. Discussion among committee members and staff on which option, whether the chip & seal or the overlay would be best and most cost efficient. After discussion committee members directed staff to look into a hybrid option. 5) Other/Old Business Mr. Eric Landwehr spoke briefly again on the Transload Facility. He informed those present that it will now be referred to as C.A.R.T. Capitol Area Rail Terminal. He also noted there will be update presentations on the following dates: November 6, 2023 to the City Council; November 7, 2023 to County Commission and November 8, 2023 an informational meeting with prospective customers. 6) Reports a. Neighborhood Service Grant Updates (Rachel Senzee) Ms. Senzee was not present at the meeting so Mr. Clint Smith spoke briefly on the grant updates. b. Quarterly Sales Tax Projects Report (David Bange) Mr. Bange presented a handout and spoke briefly of just a few small changes in the funds. c. Quarterly Building Permit and Business License Report (Clint Smith) Mr. Clint Smith spoke briefly on the building permit and business license report. He provided a spreadsheet of all permit and licenses issued for the last quarter Mr. Smith highlighted there were four new residential subdivisions to be developed. Mr. Clint Smith mentioned to those present that there is a Housing Workshop a few staff members will be attending. He also gave a brief Cemetery update on complaints received that those issues have been resolved at Longview Cemetery and Old City Cemetery. 7) Adjourn Councilman Lester moved, seconded by Councilman Deeken to adjourn the meeting at this time (8:56 a.m.) DEPARTMENT OF PLANNING AND PROTECTIVE SERVICES MEMORANDUM TO: Public Works and Planning Committee THROUGH. Clint Smith, Director of Planning and Protective Services CS FROM David Grellner, Environmental Health Manager �� DATE November 6, 2023 RE: Yard Waste Drop-off Services At City Councils request, City Departments are exploring new ideas in the handling of yard waste for the City of Jefferson residents. Staff is looking for feedback from the Public Works and Planning Committee on what options they would like to pursue regarding the handling of yard waste in Jefferson City. Currently a temporary yard waste drop-off location is being operated at 708 Ellis Boulevard. This facility is open on Saturday and Sundays from 8:00 a.m.-12:00 p.m. from November 4, 2023 until January 7, 2024. The temporary facility will close after January 7 in anticipation of a more permanent solution. Options to consider are: Option #1 -Privately Owned & Operated Yard Waste Site • This process would create a request for proposal (RFP) for private industry to manage the site. A scope of services would be developed for the RFP including cost (City funded, shared cost, or user funded), who can use the site (residents only, or residents and businesses/non- residents), materials accepted, hours of operation, and site location. Option #2- City ofJefferson Managed 8c Operated Yard Waste Site • The City ofJefferson operates the site on City owned property and staffed by City employees or the City leases property from private ownership and operates the site with City staff. A scope of services as listed above in option one would be considered in this scenario. The previous yard waste proposal is included in the packet for your review. Also, a survey completed in 2017 regarding public input into yard waste services is included. Staff is requesting direction in what option the Public Works and Planning Committee would like pursued or any other ideas that need explored. This information will be brought back to the committee at a future meeting for further discussion. Proposals should be submitted electronically through Bonfire. GENERAL INFORMATION 1.1 Invitation The City of Jefferson, Planning and Protective Services, herein referred to as City, is seeking proposals from qualified contractors to provide yard waste drop-off site(s) and composting systems capable of handling yard waste generated in Jefferson City, Missouri as described herein. 1.2 Notice to Bidders Before submitting a proposal, each contractor shall become fully informed as to the extent and character of the work required. No consideration will be granted for any alleged misunderstanding of the equipment to be used or services to be required, it being understood that the submission of a proposal is an agreement to all items and conditions referred to herein. 1.3 Validity of Proposals Proposers agree that proposals will remain firm for a period of ninety (90) calendar days after the closing date. 1.4 Preproposal Conference and Questions A preproposal conference will be held at 10:00 am on March 24, 2023 at 320 E McCarty St, Jefferson City, MO in the Boone Bancroft Conference Room. Proposers are encouraged to attend. Questions regarding the Request for Proposal (RFP) must be directed to Leigh Ann Corrigan (lcorrigan@ajeffersoncitymo.gov). Questions should be submitted no later than April 24, 2023. Any oral responses to questions shall be unofficial and not binding. Only information submitted in an addendum or submitted as additional information to all known bidders through Bonfire is to be considered official and binding. 1.5 Proposal Submittal Proposals shall provide information necessary for the City staff to evaluate the qualifications, experience, and expertise of the proposing company to manage yard waste and composting for the residents of Jefferson City. 2 The Offeror is to make a written proposal which presents an understanding of the work to be performed. The proposal should demonstrate and provide evidence that the Offeror has the capabilities, professional expertise, and experience to provide the necessary services as described in this RFP. Proposal pricing shall include all costs associated with this RFP. Proposals must include the following: • System description (Attachment C) to include: o The composting system or option proposed to use; o The procedures for identification of residents, commercial and non-resident patrons; description residential and commercial identification; and o Method of recording volumes of materials and who the patrons are. • Description of the site(s) considerations (Attachment C) to include the site(s) locations, size of site(s), and transfer services to the composting site. • Description of any zoning considerations (Attachment C) that will need to be met. • Description of the operation of the site(s) (Attachment C) to include: o The operating hours and holiday closures; o The number of people that would be available to operate the site(s); and o Curb -side, on -demand pick-up of residential yard waste, if provided, to include the terms required to provide the service, days and hours pick-up services would be available, and the proposed cost to residents. • Description of advertising (Attachment C) to be implemented by the contractor. • Description of how the contractor will dispose of the processed material, the intended uses or markets for the compost product, and how an adequate supply of compost material will be maintained (Attachment C). • Cost Proposal: Cost proposal shall cover the initial year plus the four additional 1 -year periods. More than one cost proposal may be submitted. An example of information provided in the past is included in Exhibit 3 for reference. Cost proposal shall include: o A finance plan which describes the sources and use of funds indicating the amount needed from the City to subsidize for the cost of the services, if any; o Options for the following: • There are no fees for residential users for waste drop-off or pick-up of compost and mulch and fees for non -City residents and all businesses; • There is a fee schedule for residential on -demand curbside pick-up of yard waste; • There are no fees for the City of Jefferson departments to drop-off yard waste and pick up compost or mulch; and • Other cost scenarios. o The estimated required per ton tipping or service fee to process and market material. Include other revenue sources such as market sales or drop-off fees. Include estimates for capital necessary to operate equipment and annual operation and maintenance expenses; o Method of controlling cost, cost recovery, and volumes of usage; o If the proposal requires a longer term than one year, specify the necessary term and the reason; and o Any other financial related information. • Company information to demonstrate the proposer's stability and ability to perform services as specified in this RFP, proposer's past history and experience as it relates to this RFP, company size, location, ownership, name of personnel to be assigned to this project with their experience (Attachments A and B); • Describe the proposed method of performance or plan for performing the requirements of the RFP; • Describe the City's role in the contract; • List any sub -contractors to be used to carry out the tasks of the RFP and indicate what their role will be. • Attachment D — E -verify Affidavit of Compliance; • Attachment E — Authority to Execute; and • Attachment F — Anti -Collusion Affidavit. Hard - copy proposals should have the proposal number (RFP4122) indicated on the outside of the envelope. City of Jefferson Purchasing Agent 320 E McCarty Street Jefferson City, MO 65101 Regardless of submittal method, proposals must be received no later than 1:30 p.m. on April 27, 2023. Proposals received after this date and time will not be considered. Proposals will not be publicly opened. Proposals will become public records at the time of contract execution or when all proposals have been rejected. Do not mark "confidential" in your RFP response, or include any proprietary information with your proposal response. 1.6 Evaluation and Award Award will be made to the lowest and best responsible offeror whose proposal conforms to the solicitation that will be most advantageous to the City. In determining lowest and best, the following criteria will be considered. POINTS ITEM Cost to the City 40 Cost to the Residents, Non -Residents, and Businesses 5 Method of performance 30 Location of Site(s) 10 Experience and Reliability 15 Total 100 Under the provisions of City Code, Section 26A-40, the City reserves the right to conduct negotiations of the proposals received or may award a contract without negotiations. The City may conduct interviews or request additional information from proposers as deemed necessary by the City. Upon selection of awardee, the City will issue a formal contract with the selected vendor. See Exhibit 1 — Sample Contract. 1.7 Contract Documents The final contract between the City and the successful offeror will include the specification and the offeror's final response. Any changes, additions, or modifications here to will be in writing and issued by the City Attorney. No other individual is authorized to modify the contract in any manner. A sample contract is included in Exhibit 1. This is based off the previous contract; therefore, changes will be adapted to fit a new cost proposal. 1.8 Contract Period The contract period will begin on November 1, 2023 and be for one (1) year. The City shall have the option to automatically renew the contact for four (4) additional one-year periods. Renewals will be contingent upon satisfactory performance of the contractor. Each year is subject to the annual appropriation of funds. A sample contract is available in Exhibit 1 — Sample Contract. 1.9 Withdrawal of Bids Offerors may withdraw their proposal after depositing with the Purchasing Agent at any time prior to the stipulated time for opening of such bids. No proposal may be withdrawn within ninety (90) days after the opening thereof, unless obvious errors are apparent or approved by the Purchasing Agent. 5 1.10 Right to Accept or Reject Bids The City of Jefferson reserves the right to reject any or all proposals received in response to this RFP, or to cancel the RFP if it is in the best interest of the City of Jefferson to do so. Failure to furnish all information requested in this RFP may disqualify the proposal. Any exceptions to the requirements specified must be identified within the proposal. Alteration of Solicitation The wording of the City of Jefferson solicitation may not be changed or altered in any manner. Respondents taking exception to any clause in whole or in part should do so by listing said exceptions on their letterhead and submitting them with their proposal; such exceptions will be evaluated and accepted or rejected by the City of Jefferson, whose decision will be final. 1.12 Response Material Ownership All material submitted regarding this RFP becomes the property of the City of Jefferson. Any person may review proposals after a recommendation for award or all offers have been rejected. 1.13 Incurring Costs The City shall not be obligated or be liable for any cost incurred by respondents prior to issuance of a contract. All costs to prepare and submit a response tot his request shall be borne by the respondent. 1.14 Collusion Clause Any agreement or collusion among respondents and prospective respondents to illegally restrain freedom of competition by agreement to fix prices, or otherwise, will render the proposals of such respondents' void. 1.15 Tax Exempt Status The City of Jefferson is tax exempt by law. Do not include tax when preparing the Pricing Form. A federal tax-exempt certificate will be furnished when requested. 1.16 Applicable Law The proposal and contract shall be governed in all respects by the ordinances of the City of Jefferson and the laws of the State of Missouri, and any litigation with respect thereto, shall be brought in the courts in the State of Missouri. 6 1.17 Assignment Contractor shall not assign the contract, subcontract it, or sublet it as a whole without the prior written consent of the City of Jefferson. Assignment, subcontracting, or subletting without such consent will in no way relieve the offeror of any of its obligations under this contract unless specifically stated by the City as its consent. 1.18 Invoicing and Payment The contractor shall submit invoices for services to the Planning and Protective Services, 320 East McCarty Street, Jefferson City, Missouri 65101. The City shall only be liable for charges as indicated in the awarded proposal. 1.19 Cooperative Procurement. The City has entered into cooperative purchasing agreements with Cole County and the Jefferson City Housing Authority. Cole County and/or the Jefferson City Housing Authority may or may not request an unknown quantity of goods or service under this bid during the bid period or resulting agreement period at the same prices, terms and conditions stated herein. It is understood and agreed that each participating political subdivision will make its own separate contract with the successful bidder, that each participating political subdivision shall only be liable to the successful bidder for materials or supplies contracted for by such political subdivision without any liability for purchases contracted for by any other participating political subdivision, and each successful bidder shall be required to bill each participating political subdivision directly for the materials or supplies purchased by it. 1.20 Restrictive Clause Bidders must contact the Office of the Purchasing Agent at least five (5) days prior to the bid opening if any of the specification contains restrictive language or requirements that render him unable to bid. 1.21 Proprietary Products Any piece of equipment described herein that is a proprietary product, or the use of a manufacturer's or vendor's brand name, is referenced with the intent to indicate a standard of design desired by the buyer and shall not be construed to exclude other manufacturer's products of comparable quality. The buyer reserves the right to determine the quality of the equipment offered. 7 1.22 American's with Disabilities Act Individuals should contact the ADA Coordinator at (573) 634-6570 to request accommodations or alternative formats as required under the Americans with Disabilities Act. Please allow three business days to process the request. 1.23 Federal Work Authorization Program Proposers that meet the definition of a business entity as defined in section 285.525, RSMo, pertaining to section 285.530, RSMo, providing services exceeding $5,000, shall maintain enrollment and participation in a federal work authorization program with respect to the employees hired after enrollment in the program who are proposed to work in connection with the contracted services included herein. If the contractor's business status changes during the life of the contract to become a business entity as defined in section 285.525, RSMo, pertaining to section 285.530, RSMo, then the contractor shall, prior to the performance of any services as a business entity under the contract enroll and participate in a federal work authorization program, such as E -Verify. Proposers must, by sworn affidavit and provision of documentation (copy of E - Verify Memo of Understanding Electronic Signature Page), affirm their enrollment and participation in a federal work authorization program. Bidders shall complete and sign the Affidavit of Compliance with Section 285.525- 285.550 RSMo and submit a copy of the signature page of their MOU with Homeland Security. See Affidavit of Compliance with Section 285.525-285.550 RSMo and sample MOU, Attachment D. For Proposers that are not already enrolled and participating in a federal work authorization program, E -Verify is an example of this type of program. Information regarding E -Verify is available at https://www.e-verify.gov/. 1.24 Insurance The contractor shall provide at their own expense the all insurance required in connection with the operations of this contract. The insurance requirements are as specified in the sample contract. See Exhibit 1 — Sample Contract. 1.25 Termination The City reserves the right to terminate the contract at any time, for the convenience of the City, without penalty or recourse, by giving written notice to the contractor at least thirty (30) calendar days prior to the effective date of such termination. The contractor shall be entitled to receive compensation for services and/or supplies delivered to and accepted by the City pursuant to the contract prior to the effective date of termination. 8 1.26 Laws and Regulations The contractor shall perform services in accordance with all applicable state, local and federal statutes and legal requirements in his performance of this contract. In addition, the bidder's attention is directed to City Code, Chapter 17 — Licenses, Taxation and Miscellaneous Business Regulation. 2. BACKGROUND INFORMATION 2.1 The current contract agreement provides for a site within the City of Jefferson maintained by the contractor with fees supplemented by the City. During the past three years, the average volume of yard waste has been 24,000 cubic yards of processed material per year. 2.2 The current contract allows the City to dispose of a maximum of 35 tandem-axel trucks per year of acceptable yard waste free of charge. 2.3 Information on current operations for yard waste can be found on the City's website: https://wwwieffersoncitymo.gov/government/trash and recycling/yard waste 1. php. Interested proposers should keep in mind that the City is not necessarily looking to continue to operate in the same fashion was it has in the past concerning the collection of yard waste. New ideas with new rate schedules are welcome. The City's goal is to reduce the cost to the City. 3. GENERAL SCOPE OF WORK 3.1 The City of Jefferson, Missouri is requesting proposals from qualified service providers for yard waste drop-off site(s) and composting services. The city wishes to have a yard waste drop-off site and composting systems capable of handling yard waste generated in Jefferson City, Missouri available to its citizens. The yard waste drop-off site(s) must be operated in a way that insures a clean and orderly appearance at the location. The public must be accommodated by easy access to the drop off of yard waste and the pick-up of compost and mulch. 3.2 The City will contract with the successful offeror following negotiations to provide one or more drop off site(s) and a composting site. 3.3 The fee schedule for all charged users and all increases must be approved by the City of Jefferson. 3.4 The successful bidder shall be responsible for securing and maintaining all required permits (City, State, and Federal). 3.5 The City of Jefferson wishes to explore all possible options for continuing yard waste services by a drop-off site or sites and a composting site. In addition, the 9 City wishes to consider a contractor operated curbside pick-up on demand of yard waste for citizens within the corporate city limits of the city. 3.5.1 The contractor shall provide all labor, materials, and equipment to provide drop-off site(s), composting, mulching, receipt of yard waste, distribution of compost/mulch, and reporting. 3.5.2 Curbside on -demand pick-up is a customer paid fee. The contractor shall provide all labor, materials, and equipment to provide an on -demand curbside pick-up of yard waste for the residents of the City of Jefferson, Missouri. The contractor shall establish a plan allowing for residential users to contact the contractor, identify curbside yard waste pick-up need, and for scheduling the pick-up. 3.5.3 The contractor shall allow the City to dispose of acceptable yard waste free of charge. If there is a limit to the quantity the City is allowed to dispose of, it should be identified in the proposal. 3.5.4 With the exception of yard waste from the City, yard waste shall be limited to tree limbs (six inches or less in diameter and a maximum length of 4 feet), grass clippings and leaves (must be bagged or placed in a disposable container), wood chips, or flocked/unflocked Christmas trees. 3.6 The City also desires to explore different cost options such as the residents use the drop-off site at no cost, a reduced cost, or full cost and the residents receive mulch/compost at no cost, reduced cost, or full cost. 3.7 The City requires for the contractor to accept limbs, trimmings, brush, etc., from the Parks, Recreation and Forestry Department at no additional cost. 3.8 Optional: The City desires that the contractor accept limbs up to 36" in diameter and 6' in length. The City anticipates approximately 26 large limbs/logs per year and approximately 26 loads of brush and trimmings. The proposal shall indicate in their proposal if this is acceptable. 3.9 Proposers may respond with more than one option/proposal. 3.9.1 Options may include: a. A drop-off site in which the contractor designs, constructs, and operates their own drop-off site(s) and compost site that is free to all Jefferson City residents and a fee is charged to non-residents and commercial patrons and is funded by the City. b. A drop-off site in which the contractor designs, constructs, and 10 operates their own drop-off site(s) and compost site that requires a fee from Jefferson City residents as well as non-residents and commercial patrons and is funded in part by the City. Fee structure may be the same or at a lower rate. c. Pick up of yard waste curbside on a resident demand basis within the corporate limits of Jefferson City. Contractor must describe method of picking up yard waste curbside on a demand basis. It is contemplated that costs for such on -demand service would be the responsibility of the requesting resident but would be subject to a standard set of rates established in the contract. d. Proposer may submit a new and innovated program not listed above. 4. CONTRACTOR REQUIREMENTS 4.1 Manage yard waste drop-off and compost/mulch pick-up services for the residents, non-residents, and commercial patrons of the City of Jefferson. 4.2 Identify users prior to dropping off yard waste as residents, non-residents, or commercial patrons. 4.3 Provide reporting on a monthly basis along with invoices to the City. Reporting shall indicate the volume of yard waste being collected, compost or mulch being picked up, number of patrons dropping off yard waste and picking up compost/mulch, and the number of completed requests for the on -demand of curbside pick-up of yard waste. The City desires to have reporting information to know who is using the services, how often, etc. 4.4 Dispose of the processed material in an appropriate manner using markets described in the proposal. 5. SITE(S) 5.1 The site location must be on privately owned property on appropriately zoned property within one mile of the corporate city limits of the City of Jefferson. Sites outside of this radius may be proposed, but it will be at the City's discretion to accept the site. 5.2 The site must provide easy access by the public to the drop off of yard waste and the pick-up of compost and mulch. 5.3 Entrance, Exit and public vehicle access areas must be clearly marked, paved or gravel, and maintained. 5.4 Contractor shall clearly display at its entrance identifying information and 11 operating hours of the yard waste drop off and compost site. The drop-off area for yard waste must be clearly identified with the type of yard waste to be deposited and location of free mulch and compost for the residential citizens. Fee schedules shall be posted for those that are non-residents or businesses. 5.5 Jefferson City Zoning allows "Yard Waste and Composting Site" as a permitted use in the M-2 General Industrial zoning district, as a Conditional Use in the RU Rural zoning district, and as a Special Exception Use in the M-1 Light Industrial and C-2 General Commercial districts. 5.6 Properties zoned M-2 would be approvable as a composting site. Properties zoned M-1, C-2, or RU would require a special permit, with applicable vote by the approving body. 5.7 Composting sites are subject to Zoning Code Specific Use Standards, Section 35-41, #33 Composting Site as follows: A. Location. Composting facilities may be authorized in the districts specified by City Code, Section 35-28, Exhibit 35-28 Land Use Matrix. B. Performance Standards (1) No materials or compost shall be stored within 25 feet of any property line. (2) No excessive dust, noise, vibration, smoke, fumes, odors, or glare shall be detected beyond the property line. (3) Minimum parcel size of four (4) acres is required. (4) Subject to other applicable local, state, and federal permits are required. 5.8 If the presumptive successful bidder's proposed yard waste location requires a zoning amendment or zoning permit to comply with application zoning requirements, the award of the bid shall be processed in conjunction with any required zoning approval actions and final bid award shall be subject to final approval of such zoning amendment or zoning permit. 6. OPERATION OF THE DROP-OFF SITE(S) 6.1 The hours of operation must include weekend and evening availabilities. Below are the current operating hours: Summer (March 16 through November 30) 8:00 a.m. to 7:00 p.m. Monday through Friday 8:00 a.m. to 5:00 p.m. Saturday Noon to 5:00 p.m. on Sunday Winter (December 1 through March 15) 12 8:00 a.m. to 5:00 p.m. Monday through Friday 8:00 a.m. to 5:00 p.m. Saturday Noon to 5:00 p.m. on Sunday 6.2 The City will entertain options with fewer hours of operation in order to reduce cost to the City, but the hours must include weekend and evening availability. This does not mean that the contractor must be open every weekend or even both Saturday and Sunday. The proposer may also propose periods when they do not take yard waste at all, for example January through February. If closed during the winter months, there may be a need for special drop off arrangements for the Parks Department. 6.2 The contractor shall be open on all stated days except for holidays as indicated in the proposal. 6.3 The City is requesting an option for the contractor to provide curbside, on - demand, pick-up of residential yard waste within the corporate limits of the City of Jefferson. 7. ADVERTISING 7.1 The contractor shall advertise the yard waste drop off site(s) and mulch and composting pick up to include the hours of operation. If there are different hours based on seasonal changes, the contractor shall advertise the seasonal change. Advertising shall include notices in the local newspaper, no less than twice per year regarding the seasonal change and the services provided by the yard waste facility. Contractor shall notify the City of Jefferson when advertising is distributed. 7.2 The City will post information regarding yard waste services on the City's website. 8. Bid Bond 8.1 Each bid must be accompanied by a certified check or bid bond made payable to the City of Jefferson for five (5%) percent of the amount of the bid. Bid securities will be returned after award of the contract except to the successful bidder. Should the successful bidder fail or refuse to execute the bond and the contract required within seven (7) days after he has received notice of acceptance of his bid, he shall forfeit to the City as liquidated damages for such failure or refusal, the security deposited with his bid. 9. Performance and Payment Bond 9.1 The contractor shall furnish an original performance bond (no copy or facsimile is acceptable), cashier's check, certified check, cash, bank draft, or irrevocable letter of credit to the City, within ten (10) days after award of the contract and prior to 13 the start of any work to insure payment of all materials and labor used in the performance of the contract and to fully complete the project in a satisfactory and timely manner. Personal or company checks shall not be accepted. The performance bond shall be made payable to the City of Jefferson in an amount equal to the amount of the total bid price. Signed corporate seal 21 EXHIBIT 1— SAMPLE CONTRACT YARD WASTE DROP-OFF SITE AND COMPOSTING SERVICE CONTRACT This agreement made and entered into the date last executed by a party as indicated below, by and between the City of Jefferson, a municipal corporation, hereinafter "City", and ., hereinafter "Contractor", WITNESSETH: That for and in consideration of the mutual promises herein contained, the parties hereby agree as follows: 1. Scone of Services. The City agrees to engage the services of the Contractor to perform the services set out in Response to Proposal No. and incorporated herein as Exhibit A. The Contractor shall operate a drop- off site located at Jefferson City, Missouri, and shall be solely responsible for the operation of said site and the proper disposal ofall materials brought to said site. 2. Additional Services. The City may add to services activities of a similar nature. The Contractor shall undertake such changed activities only upon the direction of the City. All such directives and changes shall be in written form and approved by the Director of Planning and Protective Services and shall be accepted and countersigned by the Contractor or its agreed representatives. 3. Term. This contract shall be for the period of one year beginning on November 1, 2023, and terminating on October 31, 2024 provided that the City shall have the right to cancel at any time upon giving one hundred twenty (120) days' notice. This contract shall automatically renew for up to four (4) additional one-year periods, subject to annual appropriation by the City Council. 4. Insurance. Contractor shall procure and maintain at its own expense during the life of this contract: (a) Workmen's Compensation Insurance for all of its employees to be engaged in work under this contract. (b) Contractor's Public Liability Insurance in an amount not less than $3,000,000 for all claims arising out of a single occurrence and $500,000 for anyone person in a single accident or occurrence, except for those claims governed by the provisions of the Missouri Workmen's Compensation Law, Chapter 287, RSMo., and Contractor's Property Damage Insurance in an amount not less than $3,000,000 for all claims arising out of a single accident or occurrence and $500,000 for anyone person in a single accident or occurrence. The City shall be named as an additional insured. (c) Automobile Liability Insurance in an amount not less than $3,000,000 for all claims arising out of a single accident or occurrence and $500,000 for anyone person in a single accident or occurrence. The City shall be named as an additional insured. (d) Subcontracts. In case any or all of this work is sublet, the Contractor shall require the Subcontractor to procure and maintain all insurance required in Subparagraphs (a), (b), and (c) hereof and in like amounts. (e) Scope of Insurance and Special Hazard. The insurance required under Sub- paragraphs (b) and (c) hereof shall provide adequate protection for the Contractor and 22 its subcontractors, respectively, against damage claims which may arise from operations under this contract, whether such operations be by the insured or by anyone directly or indirectly employed by it, and also against any special hazards which may be encountered in the performance of this contract. Certifies of Insurance must be on file with the City prior to beginning work. 5. Contractor's Responsibility for Subcontractors. It is further agreed that Contractor shall be as fully responsible to the City for the acts and omissions of its subcontractors, and of persons either directly or indirectly employed by them, as Contractor is for the acts and omissions of persons it directly employs. Contractor shall cause appropriate provisions to be inserted in all subcontracts relating to this work, to bind all subcontractors to Contractor by all the terms herein set forth, insofar as applicable to the work of subcontractors and to give Contractor the same power regarding termination of any subcontract as the City may exercise over Contractor under any provisions of this contract. Nothing contained in this contract shall create any contractual relations between any subcontractor and the City or between any subcontractors. 6. Termination for Cause. The City reserves the right to terminate this contract by giving at least five (5) days prior written notice to the Contractor, without prejudice to any other rights or remedies of the City should the Contractor be adjudged a bankrupt, or if Contractor should make a general assignment for the benefit of its creditors, or if a receiver should be appointed for Contractor or for any of its property, or if Contractor should persistently or repeatedly refuse or fail to supply enough properly skilled workmen or proper material, or if Contractor should refuse or fail to make prompt payment to any person supplying labor or materials for the work under the contract, or persistently disregard instructions of the City or fail to observe or perform any provisions of the contract. 7. Indemnity. To the fullest extent permitted by law, the Contractor shall indemnity, defend and hold harmless the City , its elected and appointed officials, employees, and agents, from and against all claims, damages, and expenses, including but not limited to attorneys' fees arising out or resulting from the performance of the Work, provided that any such claim, damage, loss or expense attributable to bodily injury, sickness, disease or death or to injury to or destruction of tangible property (other than the Work itself) including the loss of use resulting therefrom and is caused in whole or in part by any negligent act or omission of the Contractor, any Subcontractor, anyone directly or indirectly employed by any of them or anyone for those acts any of them may be liable, regardless of whether or not it is caused in part by a party indemnified hereunder. Compensation. Contractor owns the property located at , Jefferson City, Missouri. 11. Waste Guarantee and Acceptable Waste. Contractor shall accept organic material including tree limbs and brush 6" or less in diameter and smaller cut into four (4) foot lengths, grass clippings, leaves, wood chips, yard and garden vegetation, flocked and unflocked Christmas trees, and similar material. Contractor shall accept processed materials from City departments at no additional charge. Contractor shall accept larger material from the City. 12. Unusual Weather Event. In the event of abnormal or unusual weather which causes a significant increase in the volume of material which would go to Contractor pursuant to this contract, the City shall self -impose a moratorium on the delivery of processed materials by City departments to Contractor for a period of five (5) days from the event. After the five (5) days have expired, the City may resume its delivery of processed material at no additional charge to the City. 13. Marketing Compost. It will be the responsibility of the site operator to dispose of the processed material in an appropriate manner. Section of the Contractor's bid proposal indicates uses or markets anticipated for the compost product Contractor will provide. 14. Days and Hours of Operation. The days and hours of operation are as specified in the proposal, but not to be less than the following: 24 15. Reports. Volume reports shall be submitted to the City on a monthly basis and are to be received before payment will be made. The reports shall include the volume of yard waste received and the number of patrons each month. 16. Performance Bond. The Contractor must furnish a performance bond in the amount of one hundred percent (100%) of the offer. The Contractor must submit the performance bond to the City of Jefferson upon signing this contract. The performance bond must be issued by a company authorized to do business in Missouri or secured with a certified check, cash, or cashier's check and made payable to the City of Jefferson in the amount specified. The ordinance number and dates of performance must be specified in the performance bond. Personal or company checks are not acceptable. In the event the City of Jefferson exercises its option to extend this contract for an additional period, the Contractor must maintain the validity and enforcement of the bond pursuant to the provision of this paragraph for the extended period. 17. Nondiscrimination. The Contractor agrees in the performance of this contract not to discriminate on the ground or because of race, creed, color, national origin or ancestry, sex, religion, handicap, age, or political opinion or affiliation, against any employee of Contractor or applicant for employment and shall include a similar provision in all subcontracts let or awarded hereunder. The Contractor agrees to comply with all federal, state, and local nondiscrimination laws and ordinances. 18. Illegal Immigration. Prior to commencement of the work: a. Contractor shall, by sworn affidavit and provision of documentation, affirm its enrollment and participation in a federal work authorization program with respect to the employees working in connection with the contracted services. b. Contractor shall sign an affidavit affirming that it does not knowingly employ any person who is an unauthorized alien in connection with the contracted services. c. If Contractor is a sole proprietorship, partnership, or limited partnership, Contractor shall provide proof of citizenship or lawful presence of the owner prior to issuance of the Notice to Proceed. 19. Nonsolicitation. The Contractor warrants that they have not employed or retained any company or person, other than a bona fide employee working solely for the Contractor, to solicit or secure this contract, and that they have not paid or agreed to pay any company or person, other than a bona fide employee working solely for the Contractor, any fee, commission, percentage, brokerage fee, gifts, or any other consideration, contingent upon or resulting from the award or making of this contract. For breach or violation of this warranty, the City shall have the right to annul this contract without liability, or, in its discretion, to deduct from the contract price or consideration, or otherwise recover the full amount of such fee, commission, percentage, brokerage fee, gifts, or contingent fee. 20. Compliance with Applicable Laws. The Contractor must agree to comply with all federal, state and local laws or ordinances, and all applicable rules, regulations, and standards established by an agency of such governmental units, which are now or hereafter promulgated insofar as they relate to the Contractor's performance of the provisions of the agreement. It shall be the obligation of the Contractor to apply for, pay for and obtain all permits and/or licenses required by any governmental agency for the provision of those services contemplated herein. 25 21. Cancellation Due to Unavailability of Funds in Succeeding Fiscal Periods. When funds are not appropriated by the City Council or otherwise made available to support continuation of performance in a subsequent fiscal period, the contract shall be cancelled. In the event that funds are not appropriated for the contract, the Contractor shall not prohibit or otherwise limit the City of Jefferson to pursue and contract for alternate solutions as deemed necessary for the conduct of City affairs. 22. Independent Contractor Status. In performing the services under this agreement, the Contractor will direct the operation in all respects and will determine the method, means and manner of performance including, but not limited to, such matters as choice of any lawful routes, points of service, and time of services. The parties intend to create by this agreement the relationship of an independent contractor and not an employee -employer, co- partnership, joint venture, or any other relationship. Neither the Contractor nor any of their employees, agents, or representatives is to be considered employees of the City insofar as the subject matter of this agreement is concerned or in performing services under this agreement. 23. Assignment. The Contractor shall not assign any interest in this contract, and shall not transfer any interest in the same (whether by assignment or novation), without prior written consent of the City thereto. Any such assignment is expressly subject to all rights and remedies of the City under this agreement, including the right to change or delete activities from the contract or to terminate the same as provided herein, and no such assignment shall require the City to give any notice to any such assignee of any actions which the City may take under this agreement, though City will attempt to so notify any such assignee. 24. Jurisdiction. This agreement and every question arising hereunder shall be interpreted according to the laws and statutes of the State of Missouri. 25. Notices. I don't think it should be open in periods of darkness, but some days a little longer hours would be helpful. Since yard waste cannot be put in the weekly Republic trash pickup bin, the Southridge facility provides a necessary service. If citizens would have to pay a fee based on usage for the Southridge facility, then it would only be fair for regular trash service be based on usage Instead of a fiat monthly fee. You need to have yard waste pick up at the curb side at least four times a year. Not everyone has access to a truck to bring stuff to the center. People who are aged or disabled have to pay twice. First to transport the material and then to dump the material.l don't mind paying for the former since a service has been provided. However, why should the aged and disabled, or just those who do not own a vehicle, be charged for what is free for other residents. The yard waste was generated from a city residence; it belongs to me, a resident of Jeff City, not to the company that transported it. Provision needs to be made to stop this discriminatory practice. Perhaps a form could be developed that a resident could sign attesting that the yard waste originated at a certain address within the city limits and the name of the company or individual hired to transport it Right now the program only serves those who are physically able of loading the yard waste into a vehicle and personally transporting it to the yard waste facility. Public Work and Planning Committee Subject: Proposed Parking Rate Increase and Operational Modification Staff is requesting the committee's concurrence with the proposed parking rate increase for FY2024, and possibly beyond, as well as operational changes which would move our monthly permits to a digital environment. As previously discussed, the parking rate for the division have not been changed since 2005. At this time, it is difficult to know what the changes to the parking rates will be required to support the future improvement needed for our parking customers. However, we believe the need for additional revenue will be much higher than what is currently being charged. Instituting a large change in fees in a single year is difficult for customers budgets. As a result, staff believes it is prudent to begin smaller increases now to begin working toward the increases needed to support the future development needs of the city. With this memo staff is recommend increasing rates such that we could expect an approximate increase in revenue of 10% in the current fiscal year. The proposed fees and fines rates are outline on the attachment. Additionally, our current garage management system is outdated and the computer operating system is no longer supported. Upgrading the current system would cost between $50,000 and $75,000 in software and hardware upgrades. These upgrades would mostly not be useable in any new garage configuration. Given the cost, we do not believe this expense is justifiable. In looking for alternatives, we found our existing parking enforcement vendor has a digital product which would allow us to continue to manage the garage for both hourly and monthly customers using their license plate as a digital permit. Additionally, our surface lots customers would also be transition to this system and we would eliminate the hang tags currently used. With this system we would need to move to using license plate readers (LPR) to our enforcement vehicles. We are still gathering budget cost for this transition but at this time estimate the cost to be in the range of $80,000 to $120,000 with the majority of this cost being in the LPR technology. However, all these technologies would be used for our entire parking system. Additionally, with digital permits, there would be a $4 per month fee to the vendor to manage the permits. However, the vendor would provide all billing services, thereby removing this workload from our finance department. Customers would be able to apply for permits 24 hours a day through an online portal and could sent up reoccurring payments. This $4 charge could be absorbed in the rate however, staff would recommend an additional increase over and above what is included in the attached to cover this fee. Capital Area Rail Terminal (CART) This project is anticipated to be complete by the first of December and could receive its first rail cars in March of 2024. Monroe Street (Highway 50/63 through the Dunklin intersection) Plans for this project are at the 50% mark. After exploring costs of the design and ultimate cost of retaining walls with our selected consultant it was determined that the costs would far exceed the budget and therefore alternate solutions are being perused. It is anticipated that this project will be bid in the spring of 2024 with construction completed by the end of 2024. Wildwood Drive Extension (W. Edgewood Drive to Rockridge Road) The redesign of this project is underway which includes modifications to the typical section through the removal of the curb and gutter, the redesign of the crossing of Wears Creek which may result in construction of a bridge in the place of an arch structure, and the redesign of the roundabout at Rockridge Road. Negotiations are underway with a potential developer to coordinate access to necessary fill material, the extension of the sewer main, and the dedication of right of way or easement for a greenway trail. It is anticipated that the project would be ready to bid in the summer of 2024 with the construction completion coming in 2025. High Street Viaduct A public meeting will be held on November 7, 2023. The next step will be to select a preferred alternative and begin searching/applying for funding opportunities. There is no set timeframe regarding the search for funding. Stadium and Satinwood A number of alternatives have been created for this intersection. Traffic counts have been taken and are awaiting analysis. Jefferson City, Mo. — CAMPO has started the update of the CAMPO 2045 & Beyond Metropolitan Transportation Plan (MTP). The MTP is a federally required long-range plan, updated every 5 years, that assesses regional transportation needs over a twenty-year planning horizon. The MTP sets goals and defines policies, programs, strategies, and projects to meet the transportation needs of the CAMPO region. horizon. Last updated in 2019, the plan considers several local and regional topics including transportation system development, land use, employment, economic development, human and natural environment, and housing and community development. CAMPO Technical Committee Staff Report Capital Area Active Transportation Plan November 2, 2023 Summary Staff, along with consultants Crafton Tull and LaneShift, are continuing development of the Capital Area Active Transportation Plan. The planning process will integrate the Capital Area Pedestrian & Bicycle Plan (2016), Jefferson City's Sidewalk Plan (2010) and Greenway Master Plan (2007), and the Holts Summit Pedestrian, Bicycle, and Transit Plan (2014). The Capital Area Active Transportation Plan covers all CAMPO communities and is expected to be completed by early Fall 2023. The plan will generally include the following: • comprehensive set of strategies to ensure better options for biking, walking, and transit • recommendations for prioritizing infrastructure improvements • outline recommendations for new policies, processes, and infrastructure • base recommendations on a robust public and stakeholder involvement campaign Funding for this project totals $125,000 and is provided via the CAMPO Consolidated Planning Grant ($100,000), with the required 20% match provided by JC Parks ($25,000). There are two interactive web maps depicting a sidewalk plan and bike/ped plan. Phase 1— Public Survey and Engagement A public survey was disseminated in August 2022 and more than 800 responses were received. The survey was made available in English and Spanish. Three public meetings were held in September inviting the public to comment on the current bike/ped network and what barriers and opportunities they see in the region. Staff presented to various community groups and committees requesting comment. Staff and consultants engaged with the steering committee and several stakeholder groups, including the following; Public Safety, Healthcare, Education, Small Communities, Advocates/Transit Providers, and Business Owners. Phase 2 — Public Survey/Engagement, Draft Network Development, Prioritization Survey Phase 2 occurred in December 2022, including a steering committee meeting, a public meeting, three walk -audits, and an outreach booth at Downtown #JCMO Living Windows. Invitations to participate were disseminated to all member communities and stakeholders. A prioritization survey was released seeking comment on how the draft network should be prioritized. More than 115 survey responses were received. Phase 3 — Public Engagement, Probable Cost Estimates, Phasing, Code Reform Recommendations During the months of February and March 2023 consultants and staff reviewed prioritization survey results and finalized network changes and prioritization criteria. A steering committee meeting and public meeting was held in May 2023. Consultants presented on costs, phasing, and potential municipal code and policy changes.
