HomeMy Public PortalAbout20130225 - Conservation Commission - Meeting Minutes Conservation Commission Meeting 25 February 2013 Page 1 of 2 CORRECTED MINUTES- 25 February 2013 Called to Order: 7:30 PM Hopkinton Town Hall, Room 216 Adjourned: 8:45 PM Members Present: Jeffrey Barnes, Frank D’Urso, Craig Nation, Melissa Recos, Kerry Reed, Marcus Waldron, Bob Ingram: Conservation Scientist, Don MacAdam: Conservation Administrator Members Absent: Andre Griben 7:30 PM Commission Business • The Commission signed the following documents: • Mastroianni, 0 Lumber St - Order of Resource Area Delineation (188-1514) • Ms. Recos made a motion to approve the Request for Payment dated 25 February 2013. The motion was seconded by Mr. Waldron and it passed unanimously. • Mr. Waldron made a motion to approve the Minutes of 17 December 2012, 14 January 2013, 28 January 2013, and 11 February 2013. The motion was seconded by Ms. Recos and it passed unanimously. • A discussion was held regarding the proposed public opinion survey for the revised Open Space and Recreation Plan. The Commission determined to forward comments to the Director of Land Use, Planning and Permitting. • A discussion was held regarding the letter from H&H Realty Trust dated 19 February 2013. The Commission determined to draft a response letter. • Mr. D’Urso entered the meeting. 7:45 PM Ofria, 202 Wood Street DEP File No. 188-1517 Notice of Intent Joseph P. Marquedant, J.D. Marquedant & Associates, Inc.; Michael Moroney, MVA Engineering Company Mr. Marquedant provided an overview of the Notice of Intent and engineered plans dated 14 November 2012. Mr. Ingram stated that if more than 100 cubic yards of material is proposed to be dredged from the intermittent stream channel and pond then the applicant will need to file a Water Quality Certification application with the Massachusetts Department of Environmental Protection and a Programmatic General Conservation Commission Meeting 25 February 2013 Page 2 of 2 Permit with the U.S. Army Corps of Engineers. Mr. Ingram noted that a standard condition for an Order of Conditions is that all local, state and federal permits must be obtained before site work can begin. A discussion was held on whether the pond acts as a vernal pool. Mr. Marquedant stated that he believes the applicant’s wetland consultant has previously documented fish in the pond and will provide further information on the matter. A discussion was held regarding the identification of fencing on the plans that is no longer present on site. A discussion was held on whether livestock from the farming portions of the property could enter, alter and degrade the wetland resource areas within the undisturbed portions of the property due to lack of adequate fencing. Mr. Marquedant stated that the farm livestock would be adequately contained and not allowed to alter the undisturbed portions of the property. It was noted that the Commission’s engineering consultant required more time to perform the peer engineering review. The hearing was continued to 11 March 2013. 8:10 PM Perkins, 201 and 215 Hayden Rowe Street DEP File No. 188-____ Notice of Intent Joseph P. Marquedant, J.D. Marquedant & Associates, Inc.; William Perkins, applicant/owner Mr. Barnes opened the public hearing and asked whether the applicant was prepared to submit the outstanding information which was identified in the Commission’s letter to the applicant dated 05 February 2013. Mr. Marquedant stated that the applicant does not have all the outstanding information and has not filed the Notice of Intent (NOI) with MA DEP to date. The Commission determined that the review of the Notice of Intent cannot be initiated until the applicant has filed the NOI with MA DEP and submitted the outstanding filing and consultant fees. The hearing was continued to 11 March 2013. 8:10 PM PRC Builders, 0 and 294 Hayden Rowe Street (Lot B) DEP File No. 188-1516 Notice of Intent-continuation On 25 February 2013, the applicant requested in writing that the public hearing be continued. The public hearing was continued to 25 March 2013. 8:10 PM Commission Business • A discussion was held regarding the request for comments from the Hopkinton Historical Commission (HHC) on their proposed change to the Historic Preservation Bylaw, drafted as Chapter 125-3.L. Procedure. The Commission determined to provide comments to the HHC. • A discussion was held regarding the newly forming Lake Maspenock Advisory Group. Corrected Minutes Approved: 29 April 2013
