Request filed by Jefferson City Flying Service, lessee of property owned by the City of
Jefferson, for a variance to floodplain regulations. The purpose of the request is to
permit construction of a new 120' x 100' airplane hangar as a wet -flood proofed structure.
The property is described as part of Section 16, Township 44 North, Range 11 West,
Jefferson City, Callaway County, Missouri.

filed by David Overfelt, property owner, for a 6 foot variance from the required 25 foot
front setback for the RS-1 Low Density Residential zoning district to permit a 19 foot
front setback to accommodate construction of a garage addition. The property is located
on the east side of the intersection of Green Meadow Drive and Whitney Woods Drive

1. Call to Order and Introduction of Members, Ex-Officio Members and Staff
Chairman Hake called the meeting to order at 7:35 a.m. and introduced Board members and asked
staff to introduce themselves. A quorum was present to hear the items on the agenda. The
following members were designated to vote: Hake, Crabtree, Seaver, Schaefer, and Cartwright.
Those wishing to speak to the Board were sworn in.

Chairman Hake explained the procedures of the meeting. Ms. Bliss entered the following
documents as exhibits for all items under consideration at the meeting:

4. A list of property owners to whom notice of the hearing was sent

Case No. B23008 — 500 Madison Street, Signage Variance. Request filed by Central Missouri
Trust Co., property owner, for a variance to Chapter 3 of the City Code Section 3-5.1, (Electronic
message centers) to permit a three sided electronic message center in a C-3 central commercial
zoning district. The property is located on the north side of Highway 50 between Madison Street
and Jefferson Street and is described as in lots 704-707, in the City of Jefferson, County of Cole,
Missouri. (Pinnacle Sign Group.
Ms. Bliss described the location, zoning, and surrounding properties. The request is for a variance
to permit an electronic message center sign. Mr. Seaver asked why this signage situation is
different than that of other businesses in the area. Mr. Barron stated that it is in a different zoning
district than many of the surrounding properties and that the district does not have an allowance
for electronic message centers.
Mr. Pearce, Pinnacle Sign Room, presented the case. He gave details on the project and stated
that there is a need to keep up with competitors and modernize the signage. He also stated that
the sign will be able to be dimmed at night and that the current sign has to be replaced either way.
Mr. Crabtree asked if the new sign will be bigger. Mr. Pearce responded that it will be. Mr. Hake
then asked about the rate of change for the images upon the sign. Mr. Barron stated that there was
a 4-second rate of change regulation. Mr. Crabtree asked if there will be ground mounted lighting.
Mr. Pearce stated yes, and it will be soft and subtle. Mr. Crabtree then asked what the sign is made
of, and Mr. Pearce stated that it is aluminum and dusted with crystal silver so it will not rust. He
also stated that there is a concrete footing with a steel pipe up the middle, and that there will be a
nicely landscaped pad that it sits upon. Mr. Crabtree then asked if the roof would be capped. Mr.
Pearce stated yes it will be capped, and there will be ventilation.
There was no one to speak in favor of the project.

No one else spoke regarding the request.
Ms. Bliss referred the Board to the recommended form of motion.
Mr. Seaver moved and Mr. Crabtree seconded to approve a signage variance from Section 3-
5.1.1.b regarding the type of electronic message center permitted within the C-3 central commercial
zoning district to permit a standard commercial electronic message center.
A roll -call vote was taken and the motion passed 5-0 with the following votes:
Aye: Hake, Crabtree, Seaver, Schaefer, and Cartwright

December 12, 2023
Case No. B23009 — 527 Airport Road; Variance from Floodplain Regulations. Request
filed by Jefferson City Flying Service, lessee of property owned by the City of Jefferson, for a
variance to floodplain regulations. The purpose of the request is to permit construction of a
120-foot x 100-foot Airplane Hangar as a wet-floodproofed structure. The property is
described as part of Section 16, Township 44 North, Range 11 West, Jefferson City, Callaway
County, Missouri.
NATURE OF REQUEST
This proposal for a variance to floodplain regulations would permit wet floodproofing by allowing the
use of engineered flood vents that allow for the automatic entry and exit of floodwater to be
incorporated into the construction of a 120-foot by 100-foot airplane hangar, similar to other existing
hangars at the Jefferson City Memorial Airport. The Flood Code allows wet floodproofing of accessory
structures up to 400 square feet. The proposed hangar exceeds the allowable square footage, and the
building would not be considered an accessory structure, which is why a variance is requested.
CONSIDERATIONS REQUIRED

Jefferson City Memorial Airport provides a vital function to not only Jefferson
City, but also the Central Missouri area and due to changes and growth at
Columbia Regional Airport, many smaller aircraft are being relocated to this
facility, thus the need for extra storage which this facility will provide.

This facility is not a "waterfront" facility, but will be located at the Jefferson
City Memorial Airport which is located in the Missouri River Floodplain area.

development. Include details about the relationship with the site and surrounding
properties.
This is an aircraft hangar designed to store aircraft and must be located at the
airport. The City of Jefferson placed the airport at this location which happens
to be in the floodplain.
8. Describe the relationship of the proposed use to the comprehensive plan and floodplain
management program for the area.
This facility would be compatible with the existing and proposed uses of this
area.
9. Would the proposed variance affect safe access to the property in times of a flood event
for ordinary and/or emergency vehicles?

This can vary with the particular flood event, but in general, flood events in the Missouri
River floodplain are predicted by the Corps of Engineers and ample time is usually available

This is not anticipated to be an issue. The Missouri River has a high
sediment content, but will not affect or impact the site as designed.

PUBLIC NOTICE
Public notice was given by publication in the newspaper, by letter to all adjacent and affected property
owners located within 185 feet of the subject property, and by property sign posting; each of these
means adequately distributed in advance of the meeting.
NATURE OF REQUEST
The applicant desires to construct a car garage addition to the side of the house. This expansion is for
a 12' garage addition to the northern side of the existing garage as shown in the visual provided by
the applicant. Based on the proposed dimensions and placement of the garage addition, the structure
would extend approximately 4' into the required 25' front setback for property located within a RS-
1 Single Family Residential zoning district. Therefore, to permit the construction of the buildout in
the desired location, the applicant is requesting a 6' variance from the required 25' front setback to
permit a 19' front setback for the subject property. Variances such as those for front setbacks,
according to the City Code for the City of Jefferson, must go through review and approval status
determination made by the Board of Adjustment. Findings are a part of the decision making process
and 4 votes in favor of the request is needed for granted approval.

BACKGROUND INFORMATION
One driveway serves as vehicular access into the property. The existing house on site rests at an angle,
running parallel with the south property line and at an acute angle from the west property line/street.
Lots within the RS-1 zoning district are required to have a front setback of 25' per Exhibit 35-51A
Density and Dimensional Standards. The proposed garage addition would extend a maximum of 6'
into the required front setback.
Tributary branches of Moreau River exist on the east and north side of site. The garage buildout is
proposed to connect to the north side of the existing garage. This 12' extension north is proposed to
be 18.5' minimum from the tributary on the north side of the property. City stormwater regulations
require a 30' setback from the ordinary high water mark of a drainage way. However, this required
setback may be varied administratively by staff in low density residential situations. The Public
Works Department has approved a reduced setback of 18.5' from the creek at the north side of the
property for the proposed garage addition.
FINDINGS REQUIRED
The Zoning Code within the City Code outlines certain findings for review by the Board of

variances. In addition, as this request is for a variance under the density and dimensional

1. Would the proposed variance eliminate an adequate supply of light or air to the adjacent
property?
No. The distance between the two properties means that no shadow from a structure
on my property can reach the adjacent property. Additionally, the narrow but thick
stand of trees and brush blocks nearly all visibility, even in the winter.
2. Would the proposed variance substantially increase congestion on the public street?
No. No additional inhabitants will be in the household.
3. Would the proposed variance increase the danger of fire or endanger the safety of the
public?
No. There will be additional structure to the house but it will be modern construction
and built to all current fire codes.
4. Would the proposed variance be unduly injurious to the use and enjoyment of the
adjacent property?
No. The distance between the two properties means that no shadow from a structure
on my property can reach the adjacent property. Additionally, the narrow but thick
stand of trees and brush blocks nearly all visibility, even in the winter.

No. I will stay architecturally consistent. The goal of this variance request is to
increase my garage space while keeping the style of the house overall.

Yes. Here the intent is to improve property value while maintaining the look and feel
of the house in this neighborhood.

Yes. The triangular shape of the lot, the presence of the creek running through the
property, and the angle of the house relative to the street make it such that the
setback requirements prevent me from extending the carport straight out.
