AGREEEMENT

Second Party.
WITNESSETH:
1. For the sum of - � )Cents per gallon,
the First Party agrees to heat and spread approximately

2. Second Party agrees to pay the above mentioned price in
cash to First Party upon the spreading of the material called
for in this contract.
3. It is underood that the above work is to be performed
on or about ��G-��� If any demurrage
accrues, it is understood that party responsible for said
demurrage will pay same. Any demurrage caused by inclement
weather is to be paid equally by First and Second Parties.
4. First Party agrees to carry Workmen's Compensation, Lia—
bility Insurance and Truck Insurance and will hold Second Party
blameless for any accidents caused. by First Party's equipment
while heating, hauling and applying the above material.
5. Neither Party shall be liable for breach of this contract
occasioned by causes beyond its control, and it is also under—
stood that this contract embodies the full understanding, is
not affected by any verbal agreements, and is not subject to
countermand.

the First Party agrees to furnish Second Party approximately

2. Second Party agrees to pay the above mentioned price in
cash to First Party upon the delivery of the material called
for in this contract. It is understood that the freight
charges on this material are to be paid by the Second Party
and deducted from payment made to First Party. Second Party
agrees to pay railway demurrage upon any tank car held or
detained by Second Party.
3. It is understood that the materia, cal ed for in this con—

As the price in this agreement includes freight charges, it is
understood that same is based on present freight rates, conse—
quently if there is any change in the freight rate on this ma—
terial during the life of this contract, the price is to be

Regular Meeting.
Council met in regular session, Mayor Ross presiding and
the following councilmen present;-
W. Haack, H P Kruse- Geo Lindaman- H L Luwe- and Neil
Okones.-
Minutes of Jan 6th and Jan 31st meetings were read, and on
motion by Okones second by Haack approved as read.' Motion carried.
Secretary of the Fire Company present the name of H.B.Lindaman
to be approved as a fireman t-o take the place of H. Sietseman who
has moved out of Town.
On motion by Luwe second by Haack, H.B. Lindaman was approved
to be a fireman in the Town of Wellsburg. Motion carried.
It was moved and seconded that the Marshall start suit
against several persons that have not paid their 1940 poll taxes.,
same being Arthur Geerdes, Harlyn Kneppe, Ben Kneppe, Julius Zech
and�Thomas Claassen. motion carried.
Mayor Ross made a report of the meeting which he attended
at.Des Moines, regarding the Legislative matters in Municipal
government.
The following Bills were presented. and read, and it was moved
by Kruse second by Okones that the fol owing bills be allowed;-

Fabruaxy 25th 1941.
Council met in special session, Mayor Ross presiding
W.Haa.ck, Neil Okones , and Geo Lindaman present.;
The meeting was called for the purpose of considering
proposal of the cost of Street Oil;
Mr Otten of the Iowa Road Bu'lding Co was present and
a proposal on the net cost per gallon of Road Oil spread
streets, subject to the appro vat of the council in case
council decides to oil the streets the coming season.
