The Council of Bal Harbour Village met Saturday, February 24, 1973 at
9:30A.M. inthe Village Hall.
Present: Messrs. Beatty, Brush, Printup, Taplin and Villeneuve
Also present were Fred W. maley, Village :hoe gee; Mary T. Wetterer,
Village Cleric; and Thomas H. Anderson, Village Attorney.
On motion of Mr. Beatty, seconded by Mr, ?aplin, and voted the minutes
of the previous meeting of January 27, 1973 were approved as submitted.
Mr. Lucien inky asked the Council. if any decision had bean reached on
their request for on site sewage treatment at the proposed apartment on the
Balmoral site. Mr. Maley said he had requested en opinion -om an outside
engineering firm on this as there was a conflict of interest with our Village
engineers. He read an opinion from :udovtci and grange, Consulting Engineers,
setting forth certain safeguards to be specified for '+n on site treatment plant,
should such a plant be allowed. Mr. Maley said he ha! discussed this matter with
Mr. von Oesen who had stated that placing the effluent in our present system would
be an absolute requirement, and also had personally visited five of these plants
in Velusia County last week and ooudd find no dallei ne to their operation. He
stated, however, that the plants he observed were small, about one -tenth the size
of those being considered. After further discusainn it was moved by Mr. Beatty,
seconded by Mt. Taplin and voted that the Council would defer action on this matter
until we can be furnished a letter from Polutien Control stating that they will
allow the effluent from this system to be discharged into our present sewer system.
Mr. Marion Sibley and Mr. Morris Lapidus requested that the Council grant
the developers of the building proposed on Lot 11 of the oceanfront district a
variance to permit a building 130' high under a plan drawn on the present ordinance
requirements. It was suggested that inasmuch as the new zoning code is about to be
passed that the building they are planning should confnrm to the new regulat.iens.
Mr. Lapidus said they had studied the tentative new regulations and found that the
suggested floor area ratios would serve to prohibit luxury -size apartments. Mr.
Anthony wiles of Barton-.Aschman Associates discussed with Mr. Lapidus some of the
new regulations and it was the opinion of the o..ounttl that Mr. Wiles and Mr. Maley
should meet with Mr. Lapidus next week and then report back to the Council at a
special meeting, so the new ordinance could be passed as soon an possible.
Mr. Maley said that node County has given us written approval to award
the beach restoration project contracts and that we have verbal approval from the
State of Florida. He said that Mr. von Oesen and he had met in Atlanta with the
representatives from Hardaway Constructionand Standard it'edging Corporation. A
pre -constriction conference will be held in Bal harbour on March 28, 1973 at which
time Standard nredging should have cost differdntlal figural ready, due to fact
that the work will take place in 1973 after their wage contracts have expir.d,
the actual contract should be ready for signing at the March 31st, meeting.
In regard to Mr. Whitman's request for additional ordinances covering
proper attire and r_ondeet In Bad harbour, Mr. Maley said he had met with Mr.,
Anderson who feels that our present ordinances and State laws will suffice and
that the police department could enforce, compliance with the existing provisions.

Mr. Maley presented a bill from Clifton Light.sey, Inc.which represented
his claim under a contract with the Village during the construction of the side-
walk on the east side of Collins Avenue. His claim is in the amount of $10,000.00
for additional costs during the first 560' of construction. Under the contract
he could claim $12,315.00 but was willing to settle for this figure. He said
Mr. Lightsey had also agreed to replace all broken tiles for the period of one
year from date of this claim. On motion of Mr. Villeneuve, seconded by Mr. Brush
the Council agreed to pay $7,500.00 now and the balance of $2,500.00 when he
finished replacing the tiles that are now broken.
At the request of the Bal Harbour Resort Association, it was moved by
Mr. Beatty, seconded by Mr. Taplin and voted that the Village pay $760.00 for a tab
page in the Convention Resource Direction Spring/Sunsaer issue.
Mr. Maley reported that the Chief of Police is still interviewing appli-
cants for additional officers and that we have leased a K-9 dog on a minimum two
months basis for $325.00 a month. He said that Chief Dulany J. Dupuy had submitted
his resignation from the Police Department effective March 1, 1973 and that he
had asked him to withdraw it, but was informed that he had already made arrangements
to enter another business. Mr. Maley said he intended to appoint Captain Staubesand
as Acting Chief of Police for three to six months. It was the decision of the
Council that Chief Dupuy should be presented with an engraved silver tray in appre-
ciation of his years of service to Bat Harbour.
There being no further business on motion of Mr. Beatty, seconded by
Mr. Taplin, the meeting was adjourned at 11:30 A.M.

A Special Meeting of the Council was held Thursday, March 15,1973 as a
work session for the Council to put the proposed zoning ordinance into final
form.
Present: Messrs. Beatty, Brush, Printup, Taplin and Villeneuve
Also present were Fred W. Maley, Village Manager; and Mary T. Wetterer,
Village Clerk.
Mr. Lapidus and Mr. Sibley, representing the owners of Lot 11 of the Ocean
Front Section appeared and asked the Council if any changes had been made since -
the last meeting in the proposed floor area ratio and density per acre regulations
