AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING
CHAPTER 6 OF THE LYNWOOD MUNICIPAL CODE TO ADD A NEW SECTION 6 -8
"FEE FOR COLLECTION OF DELINQUENT PENALTY PAYMENTS" TO RECOVER
ITS PARKING VIOLATION RELATED COLLECTION COSTS
WHEREAS, The City of Lynwood may utilize the services of private collection
agencies to collect delinquent parking penalties; and
WHEREAS, these private agencies charge the City of Lynwood for the cost of
their services; and
WHEREAS, the City of Lynwood wishes to recover all of its costs associated with
the collection of delinquent parking penalties; and
WHEREAS, it is the intent of the City of Lynwood to enact, establish, amend,
modify and supplement its .Schedule of Parking Civil Penalties and late payment
penalties to deter parking violations and to provide for the payment of late payments
and penalties.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Chapter 6 of the Lynwood Municipal Code is hereby amended to
add Section 6 -8 as follows:
,
"6 -8. Fee for Collection of Delinquent Penalty Payments.
If the City incurs collection costs in conjunction with the assignment of a parking
citation, those costs shall be added to the penalty and the violator shall be liable
to the City for both the civil penalties and the collection costs."
Section 2. Severability.
If any section, sentence, clause or phrase of this ordinance is for any reason held
to be invalid or unconstitutional by a decision of any court or competent jurisdiction,
such decision shall not affect the validity of the remaining portions of this ordinance.
The City Council hereby declares that it would have passed this ordinance and adopted
this ordinance and each section, sentence, clause or phrase thereof, irrespective of the
fact that one or more sections, subsections, sentences, clauses or phrases be declared
invalid or unconstitutional.
Section 3. The City Clerks of the City of Lynwood is hereby directed to certify
to the passage and adoption of this Ordinance and to cause it to be published and
posted as required by law.
First read at a regular meeting of the City Council held on the 1St day of September,
2009 and adopted and ordered published at a regular meeting of said Council on the
15th day of September, 2009.
PASSED, APPROVED and ADOPTED this 15th day of September, 2009.
