BOX 12008 Riverside, CA 92502-2208 SUBJECT: TRAINS 1N MY BACKYARD I have been attending meetings for years in regard to changes proposed for the railway system. I am going to give you my background in regard to the history of derailments I have had to deal with in the past. I have lived in my home since 1989. There have been a few train derailments right behind our home. I have a 3 year old and I am quite concerned about her health and safety. This is my history in dealing with the Railroad Company. This is a very BRIEF review. 1k Incident Trains derailed — Railroad Company brought in heavy equipment to move dirt and replace lines. The railroad Company brought in heavy equipment to work on the tracks and get it ready to start moving freight again. This work was done for weeks. It started very early in the morning and continued into the night. In the past the water from the mountain side would flow down the hill into the channel and down to the flat land past East Big Springs. When the tractors worked on the hillside they filled in the channel and moved the dirt so the elevation of the terrain was changed. Basically, the terrain was changed so the rain water had an opportunity to flow right into our backyard. The rain came, so did the mud and the boulders from the hillside into our pool and filled it up with at least 2 feet of debris. When we contacted our insurance company, they would not cover it because they considered it "earth movement" not flooding. We contacted the railroad company, who was actually responsible, since they moved all the dirt and filled up the channel where the water and mud use to go. They had two men take pictures and basically played good cop, bad cop with me and said there was a natural spring that runs right into my back yard and this why we had the water in our pool. Did they think I just got off the boat! They basically ignored us, and the pool repairs were never done. We continued to attend meetings in regard to the railroad. One of the County employees approached my husband and said the "Railroad Company said they repaired your pool". It was news to us, since I haven't used it in all these years. 21'd Incident A tractor apparently had a mishap and spilled oil all over the ground, and someone left a 55 gallon container right next to it. Our chain link fence was torn down. There was no note left on our door, nor did anyone contact us about the damage that was done. The spill in the back was quite obvious. My husband just happened to walk up our embankment and saw the damaged chain link fence. I took pictures and obtained a quote to replace my chain link fence that was ripped down. I also took a picture of the oil on the ground and the 55 gallon barrel. I mailed 2 letters. One to the Railroad Company, and one to the Heavy Equipment Company. I told them to clean up their mess and one of them needs to send me a check to repair my fence which was about $600.00. Due to the pictures, I received 2 checks in the mail, one from the heavy equipment company and one from the railroad company to repair the fence. I returned one check and cashed the other one and hired the fence company to repair my fence. I believe they knew it was a $10,000.00 a day fine to leave chemicals on the ground!! They cleaned up their oil mess and made sure there was a statement that I couldn't bring up this incident against them in the future. 3rd Incident After another train derailment they replaced the tracks. They left old railway debris behind, as well as com and other food products. We had rats galore. It took them forever before they cleaned up most of the leftover tracks and debris. Also, due to the rain, some of those old rails ended up in our backyard too. My husband and I have placed a new roofs heating/air conditioning unit, new kitchen addition and are cleaning up our entire home. We have spent a lot of money on the improvements and upgrades. We do not wish to leave our street. This Country built the Hoover Dam. Did anyone consider placing the rails in the middle of the freeway we currently have before they did the upgrades on the freeway? Above ground would have been good. We understand this railway will increase traffic near our homes. We currently have traffic from the University, and we have vehicles parking on our streets. We don't need any additional cars parking in our neighborhood. How many more changes are going to occur that will have an impact on our safety. I don't know how many more derailments will occur that will endanger us and our home. This project concerns me a great deal and I don't feel there are any guarantees on what things will be done next to my back yard that will control the noise, land changes and the potential future derailments that may further damage my property, or the health of my family. Box 12008 Riverside, Ca 92502-2208 In regards to: The University neighborhood Dear RCTC, I was fortunate enough to attend your board meeting on February 11, 2009 and I was impressed Thank you for extending the deadline for comments. I have visited the county building a few times and always think it very nice. This was my first board meeting of any kind and I thought the meeting room was first class. They did it right. That is what we in our neighborhood want you to remember when you build this thing in our back yards. Quiet Zones at the street crossings are a minimum. They will help mitigate the increased safety and noise concerns. Just about ten days ago a woman was killed on the train tracks at Riverside Ave. In this past year a fatal auto/train crash happened practically in my back yard at the Spruce train crossing. So don't say those concerns are not real. At your meeting the fact the train line has been there for about 100 years was brought up. That is no news. A sleepy and slow freight line with a few runs a week is what most of us new when we moved here and some grew up with. It has gradually increased to a couple or three runs some days and none on other days. Now you want six passenger runs per day which will cause the freight to run more at night. You must not deny your obligation to deal with the safety and noise impact on our neighborhood. Add the fact you openly desire to add future passenger service to San Jacinto and Murrieta. How many more runs per day we don't know. There will certainly be even more concern for safety and noise in the future so you need to plan for them now. In fact, some neighbors who have studied the laws say you are in violation by not including them in your studies and reports on the whole project not just this section to Perris. That is a different argument than mine. I simply say if you are determined to put this line in, then do it right. Please include the Quiet Zone Crossing in your plan. It's ridiculous to say the city would hold up the installation of such crossings. It is up to you who make this plan to include them. Remember, the citizens don't ask you to operate out of some cheesy second rate county building or meeting room. Don't aslt;us citizens to put up with a noisy second rate train line in our neighborhood. Respectfully,. Daryl L.
