Mr. Maley presented a bill from Clifton Lightsey, Inc.which represented
his claim under a contract with the Village during the construction of the side-
walk on the east side of Collins Avenue. His claim is in the amount of $10,000.00
for additional costs during the first 560' of construction. Under the contract
he could claim $12,315.00 but was willing to settle for this figure. He said
Mr. Lightsey had also agreed to replace all broken tiles for the period of one
year from date of this claim. On motion of Mr. Villeneuve, seconded by Mr. Brush
the Council agreed to pay $7,500.00 now and the balance of $2,500.00 when he
finished replacing the tiles that are now broken.
At the request of the Bal Harbour Resort Association, it was moved by
Mr. Beatty, seconded by Mr. Taplin and voted that the Village pay $760.00 for a tab
page in the Convention Resource Direction Spring/Summer issue.
Mr. Maley reported that the Chief of Police is still interviewing appli-
cants for additional officers and that we have leased a K-9 dog on a minimum two
months basis for $325.00 a month. He said that Chief Dulany J. Dupuy had submitted
his resignation from the Police Department effective March 1, 1973 and that he
had asked him to withdraw it, but was informed that he had already made arrangements
to enter another business. Mr. Maley said he intended to appoint Captain Staubesand
as Acting Chief of Police for three to six months. It was the decision of the
Council that Chief Dupuy should be presented with an engraved silver tray in appre-
ciation of his years of service to Bal Harbour.
There being no further business on motion of Mr. Beatty, seconded by
Mr. Taplin, the meeting was adjourned at 11:30 A.M.

A Special Meeting of the Council was held Thursday, March 15,1973 as a
work session for the Council to put the proposed zoning ordinance into final
form.
Present: Messrs. Beatty, Brush, Printup, Taplin and Villeneuve
Also present were Fred W. Maley, Village Manager; and Mary T. Wetterer,
Village Clerk.
Mr. Lapidus and Mr. Sibley, representing the owners of Lot 11 of the Ocean
Front Section appeared and asked the Council if any changes had been made since -
the last meeting in the proposed floor area ratio and density per acre regulations

as discussed with the Council and Mr. Wiles of Barton-Aschman Associates, Inc.
at the previous meeting of the Council. Mr. Maley read a letter. from Mr. wiles
in which they recommended certain changes in their original figures. Mr.
Lapidus stated that luxury type apartment buildings such as they propose need
proper outside treatment and that some cities are willing to give a bonus to
developers in exchange for almost all underground parking with the top of the
garage fully landscaped. He asked that for a guarantee of 95% covered parking
that the following variances be allowed: 29% instead of 25 land coverage;
from a maximum of 5.3:1 to a minimum of 5.0:1, instead of. 4.5:1 floor area
ratio; a 125 foot front set -back instead of 150 feet; and that the buildings be
allowed to be 400 feet in length, or if held to 350 feet, then 200 feet in
height, vs, the proposed 180 feet.. It was pointed mit to Mr. Lapidus and Mr.
Sibley that the Council was anxious to put the proposed ordinance in final form and
when that was accomplished they could give consideration to the points brought out.

A Special Meeting of the Council was held Thursday, March 22, 1973,
at 9:00A.M. in the Village Hall for the ;urpose of reviewing in detail. the
proposed new Zoning Ordinance.
Preaent: Messrs. Beatty, Brush, Printup, Taplin and Villeneuve
Also present were Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Thomas H. Anderson, Village Attorney.
After study and discussion on the ordinance it was the opinion of the
Council that Mr. Maley should contact Barton-Aschman and Associates and have
either Mr.wiles or Mr. Adels come down for further study on the proposed ordin-
ance on the subject of land coverage, density and floor area ratio. The Council
