AUTHORIZING A PROFESSIONAL SERVICES CONTRACT WITH
CME ASSOCIATES FOR DPW SITE PROJECT
WHEREAS, the Borough of Carteret is in need of specialized engineering
services in connection with the preparation of a remedial action work plan for the
DPW Site Project; and
WHEREAS, CME Associates, 1460 Route 9 South, Howell, New Jersey 07731,
possesses the requisite experience and expertise to provide said services; and
WHEREAS, CME Associates has submitted a proposal to provide said services
at a total cost not to exceed $8,100; and
WHEREAS, the Mayor and the Council have reviewed said proposal; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be
available for said purpose.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the
Borough of Carteret, County of Middlesex, State of New Jersey, as follows:
1. The proposal ITom CME Associates for engineering services related to the
preparation of a remedial action work plan for the DPW Site
Project, at a total cost not to exceed $8,100 is hereby approved;
2. This action is approved as an award of a professional services contract
pursuant to NJ.S.A 40A:] 1-5(1)(a).
3. A copy of this Resolution be forwarded to the Borough's Purchasing
Department and CME Associates.

Dear Mayor Reiman:
Introduction
In accordance with your request, Icon Engineering (ICON) a division of CME Associates,
has prepared a scope of work and budget estimate for environmental services at the
Carteret DPW site. Specifically the scope of work includes preparation of a Remedial
Action Workplan for contaminated soil in the area of former tank E-3 (AOC-1) and former
tanks E-2 (AOC-3) and E-5 (AOC-5). This scope of work and budget estimate does not
include services related to implementation of the remedial action. This scope of work
and budget does not include services or costs related to any additional investigations
that might be required by the NJDEP.
Backqround
ICON performed a remedial investigation in the areas of a former 3000-gallon No 4
heating oil UST (Tank E-3, AOC-1), a former 3000-gallon gasoline UST (Tank E-2, AOC-
3), and a former 2000-gallon gasoline UST (Tank E-5, AOC-5). The objectives of the
investigation were to: (a) delineate the horizontal and vertical extent of soil
contamination in the vicinity of former Tanks E-2 and E-5, and in the vicinity of former
Tank E-3; and (b) delineate the horizontal extent of groundwater contamination on the
site related to discharges from former Tanks E-2, E-5, and E-3. The following findings
and recommendations for further action are included in the April 2006 Remedial
Investigation Report:
. In the Tank E-3 area, further action is recommended for TPH contamination that
was detected in previous investigations. Potentially contaminated soil should be
excavated and disposed at an offsite facility in accordance with applicable
regulations. Post-excavation soil sampling and analysis for TPH is
recommended to demonstrate that contaminated soil does not remain. No
groundwater contaminants were detected that exceed the Class IIA
Groundwater Quality Criteria (GWC), and no further action is recommended for
groundwater in the area of Tank E-3.

. In the area of former Tanks E-2 and E-5, soil contaminants consistent with a
gasoline source including benzene, ethylbenzene, toluene, and xylenes were
locally detected at concentrations that exceed the NJDEP unrestricted use soil
cleanup criteria. The detected benzene concentrations range up to 520 ppm in
the former tank excavation area. Further action is recommended for soil
contamination in the area of former Tanks E-2 and E-5. Contaminated soil
should be excavated and disposed at an offsite facility in accordance with
applicable regulations. Post-excavation soil sampling and analysis for VO+10
and lead is recommended to demonstrate that contaminated soil does not
remain.
. In the area of former Tanks E-2 and E-5, benzene was detected in the
groundwater at concentrations that exceed the GWQC. The detected benzene
concentrations range up to 1200 ppb in the former tank excavation area. The
locally high concentrations of soil contaminants in the former tank excavation
area may be acting as a source of groundwater contamination. Additional
groundwater monitoring is recommended in AOC-3 and AOC-5 following
completion of the soil remediation.
Scope of Work
Task 1: Prepare Remedial Action Workplan
ICON will prepare a Remedial Action Workplan (RAWP) in accordance with the
Technical Requirements for Site Remediation (NJAC 7:26E-6.2). The report will address
the required RAWP items pursuant to NJAC 7:26E-6.2, including but not limited to a
detailed description of the proposed remedial action, dust control measures, cost
estimate, remedial action schedule, health and safety plan (HASP), maintenance plan,
and post-remedial sampling plan.
The proposed remedial action will be coordinated with the proposed construction of the
DPW facility to the extent possible.
Estimated Budqet
The estimated budget to perform the Scope of Work outlined above is $8,100.
Exceptions
. The cost of certified mailings for permit applications and costs associated with same
are considered extra and will be invoiced on a time and expense basis.

Environmental services wUl be biUed in accordance with CME's Environmental Rate Schedule
Invoices - CME Associates (CME) will submit invoices to Client monthly and a final invoice upon completion of services Payment is due upon presentation of invoice and is
past due thirty days from invoice date. Client agrees to pay a finance charge of one and one-half percent per month, or the maximum rate allowed by law, on past due
accounts. In the event that the invoice is not paid voluntarily and promptly, and must therefore be referred to an attorney or agency for collection, the Client agrees to pay a
collection fee equal to the actual attorney or agency collection fee incurred by CME. Overtime rates are applicable after eight hours Monday through Friday, and all day
Saturday and Sunday, and charged at one and one--half times the quoted rate. Holidays are ctJarged at two times the quoted rate. Expenses incurred for reproduction, postage
handling. photographs and for services including subconsultants equipment and facilities not furnished by CME are ctJarged to the Client at cost plus ten percent. Automobife
travel may be charged at $0.41 per mile.
Standard of Care - Services peñormed by CME under this Agreement will be conducted in a manner consIstent with that level of care and skill ordinarily exercised by members ~
