A RESOLUTION ESTABLISHING AND SETTING FORTH THE
MOAB CITY ANNEXATION POLICIES AND PROCEDURES.
WHEREAS, the Governing Body of the City of Moab finds it
necessary to establish and set forth annexation policies and
procedures to assure that annexations shall proceed to promote
orderly growth so that all needed services (water, sewer, garbage
collection, police and fire protection, adequate road
maintenance, sidewalk, curb and gutter, etc.) can be readily and
economically provided; and
NOW THEREFORE, BE IT HEREBY RESOLVED by the Moab City
Council that the annexation policies and procedures of the City
of Moab shall be as follows:
1. Development of land for urban residential purposes where
services, to -wit: water, sewer, garbage collection, police and
fire protection, adequate road maintenance, curb and gutter,
etc., cannot be provided will be discouraged.
2. The governing body shall assign a zone to territory
annexed to the municipality at the time the territory is annexed.
3. Moab City shall encourage annexation of land contiguous
to the City and expand outward. Property bounded by four sides
and three sides of the City limits should be annexed.
4. Annexations shall be in conformance with state
annexation laws.
5. The City of Moab reserves the right to permit or not to
permit urban development within 1/2 mile of Moab city in the
unincorporated territory which the City proposes for municipal
expansion.
6. In conjunction with these annexation policies, the areas
under consideration for annexation will be shown on an annexation
proposal map which will be prepared in conjunction with the Moab
City Master Plan.
APPLICATION FOR ANNEXATION:
Each application for annexation of five (5) acres or more
shall have an impact statement prepared which includes the
following:
1. A petition for annexation must be submitted, signed by a
majority of the property owners of the proposed area representing
at least 1/3 of the assessed valuation of that area according to
the last assessment rolls.
2. An accurate map of the proposed annexation area showing
the boundaries and property ownership within the area, the
topography of the area and major natural features (e.g. drainage

channels, wooded areas, areas of high water table, etc.,) a legal
description, plot plan and amount of land to be annexed.
3. Current and potential population of the area and the
current residential densities.
4. Land use(s) presently existing and those proposed.
5. Statement as to how the proposed area, and/or its
potential land use, will contribute to the achievement of the
goals and policies of the Moab City Master Plan.
6. Assessed valuation of the current properties.
7. Potential demand for various municipal services, and the
need for land use regulation in the area:
A. Distance from existing utility lines;
B. Special zoning needed (e.g., flood plain and
hillside ordinances, etc.)
C. Distance to public schools, parks, and shopping
centers.
D. Traffic and circulation patterns generated by such
land uses.
E. Proposed densities of housing and people.
F. Demand for water and sewer and number of lines or
hookups needed for proposed development.
8. Timetable for extending services to the area and the
manner by which these services would be financed.
9. An estimate of the tax consequences to residents of the
area to be annexed.

ANNEXATION APPROVAL
1. All applications for annexations must first be referred
to the Moab City Planning Department for review and their
recommendations presented to the Planning Commission.
2. The Planning Commission shall review the annexation
application at a regularly scheduled meeting and their
recommendation shall be forwarded to the City Council.
3. After 15 days but not more than 60 days, the City
Council must hold a public hearing to review the annexation
application and the recommendations of the Planning Commission.
Notice of the public hearing shall be according to the following:
A. Advertised in a newspaper of general
circulation 15 days before a public hearing
if the property to be annexed is less than
five (5) acres; 30 days before a public
hearing if the property to be annexed is in
excess of five (5) acres.
B. At least 20 days prior to the public
hearing, a mailed hearing notice and a full
copy of the policy declaration must be given
to the governing body of each affected entity
and to the Grand County Boundary Commission
(if five (5) acres or more).
C. Property owners living within 300 feet of
the proposed annexation must be notified by
certified letter indicating the intended
zoning, the time and date of the public
hearing. The cost of the notices shall be
incurred by the petitioner.

4. Approval of an annexation application must be passed by
ordinance or resolution with at least a 2/3 majority vote of the
governing body.
5. The ordinance or resolution may be passed by the
governing body if no protest hearing is initiated with the
Boundary Commission within five (5) days of the public hearing.
A map of the annexed area shall be drawn and a certified copy of
the map along with the ordinance shall be recorded with the
County Recorder.
PASSED AND APPROVED in open Council by a majority vote of
the Governing Body of Moab City Council this 5th day of
March , A.D., 1991.
