We barely made it through the 2008 financial crisis with all the offices full in the area and anopen street.We also barely made it through the street remodel that happened about 9 years ago. I don’t think we willsurvive a big recession as many businesses wouldn’t as well. Opening the street is crucial to Cal Ave’ssurvival including our business.There is no reason for people to come and hangout on Cal Ave because too many businesses and officesare closed. That’s the bottom line.Let’s look at some pros and cons shall we Pros of Cal Ave being closed1.A few restaurants have the ability to triple their dinner revenue so they don’t have to open for lunch.2.Starbucks employees get to go home early lol as they close at 2:30 and is the SLOWEST Starbucks inthe whole Bay AreaIt’s bad when a big corp business can’t survive3. A few pedestrians and their kids get to enjoy walking around and shop at the 3 stores on the street thatare open4. We can have some live music5. The cyclist and scooters get to have a whole street to ride on even though they’re supposed to walktheir bikes And now the Cons1. Our business and many others have suffered tremendous loss2. The street and businesses are not handicapped compliant and are liable for lawsuits3. There is no foot traffic during 90% of the time making it difficult to make money as people only comeduring the farmers market4. Some of the buddings look absolutely depleted5. We are completely surrounded by construction6. Our customers call everyday, they can’t find our business and it’s the same for a lot of businesses andwe lost a lot of our older customers that have limited mobility7. The empty spots aren’t getting filled8. The tech industry is in a down cycle and we don’t expect a big boom in businesses and office spacerental. Therefore hurting our local economy Cal Ave has really been neglected for many years now. It’s sadWe’ll see what happens next but hopefully you will make the right decision and save Cal Ave byreopening the streetA lady got hit by a guy on a scooter who took off on her. Be cautious of opening attachments and clickingon links.________________________________ Honorable Palo Alto City Council: I am opposed to the proposed e-bike ban which includes "Class 1" e-bikes, which are pedal assist electric bicycles. Class 2 (throttle operated with 20MPH limit) and Class 3 (throttle operated with ~30 MPH limit) do not require anyrider effort, and more clearly fall into the category "motor driven vehicles" presently prohibited from the Baylandsand other trails. A reasonable speed limit would be sensible to address the use of all types of e-bikes. I believe an exception should certainly be made for class 1 e-bikes, and many surrounding parks are alreadyproviding signage related to allowing class 1 e-bikes where bicycles are permitted. 1) E-bikes are environmentally friendly, and Class 1 e-bikes only match some fraction of the rider's pedal effort withelectric assist, are speed limited to 20MPH, and increase access for riders of all abilities while the cyclist providesmost of the pedal effort. 2) My Class 1 E-bike is my primary transportation, and after spinal surgery, I prefer the smoothened ride of dualsuspension with rough terrain of the Baylands. Recreational riders such as myself usually have the electric pedalassist turned off in places with flat terrain such as the Baylands, and I can’t think of any reason I’d need a seconddual suspension (non electric) bicycle other than this proposed legislation banning e-bikes of all types on thebaylands. 3) The proposed amended ordinance does not ban the activity of riding a bicycle or how responsibly it is used, butinstead bans the capability of the bicycle, whether that capability is used or not. I drive a motor vehicle which iscapable of going faster than the speed limit, yet we don't ban certain cars on a roadway merely because they arecapable of exceeding the speed limit. The same public safety concerns apply to both and should be sensiblyaddressed according to operator conduct and not operator equipment. 4) An e-bike ban should be based on some sort of specific measured metric of use that makes them unsafe forpedestrians or riders, or some specific evidence that shows e-bikes are inherently unsafe for the rider or others on theBaylands trails. 5) I believe an origin of the ban against e-bikes is based in the long standing 'motor powered vehicles prohibited'signage from the past directed to motorcycles, which have neither a 20 MPH limit, nor a pedal assist mode, and areconsiderably heavier than an e-bike. The predicate device relied on for this legislation is not applicable to thecurrent one. 6) Modern e-bikes are no heavier then old steel Schwinn bicycles I've owned in the past, and cyclists typicallyweigh more than their bike. If total mass of a bicyclist vs a pedestrian is the safety issue that is sought to beaddressed, the e-bike vs pedal bike risks to pedestrian trail walkers are identical. My belief is that legislative changes should be made with a particular underlying principle in mind, so that theapplication of the legislative change is consonant with the principle it seeks to protect, which remains unarticulatedwith this proposed legislative change. I request that the vote on this matter be either NO, or tabled until the underlying principle for the change is articulated and demonstrated as being an actual public hazard so that the change reflects that principle rather thanthe proposed current ban which identifies neither. Here's an analogous example. Bicyclists and dog walkers are both allowed on baylands trails, and I've used bothmodes of transport. Some dog walkers prefer an extendable reel-style leash, and their dog may bolt across the pastof a bicyclist on that reel-style leash, presenting a hazard to both. Yet, we don't ban reel-style leashes (which arecapable of being locked) on the baylands. Are those next? Such restrictions may be counterproductiveif additional power lines cannot be installed quickly enough or ifwe cannot store electric power in sufficient quantities for use atnight. Lithium ion batteries, for example, are expensive but inaddition, they are needed for electric vehicles. It is probablymore important to eliminate automobile engines that use gasolinethan to restrict home heating applications because gasoline usein motor vehicles is one of the least efficient ways of generatingpower. The article is more about the tradeoffs than any specificrecommendation, and includes a very short introduction tothermodynamics because understanding that is needed for makinginformed decisions. I've heard it twice now: (KCBS can be heard in Fresno, 200 miles from their transmitter. It can be heard really well in Sacramento. I used to hear the other all-news stationin SF, KGO, 810AM, in Guadalajara, Mexico, 1500 miles to the SE, especially on cold winter nights via a skip signal. It sounded like a local station in Guadalajara. KTRH in Houston wason the same frequency and I could "tune" to them in Guadalajara by swinging the antenna on the back of my Tandberg receiver across their signal path). KCBS is saying that the local water agencies in the San Joaquin Valley of California havenot been managing the aquifer properly and the level of water in the aquifer has beenfalling for decades. Anybody who lives here knows that. In dry years, farmers on the westside of the valley drill wells 1500 feet deep. It causes ground subsidence, serious subsidence. That damages canals and highways. Fifteen hundred feet is way more than the WTC towerswere tall. Now the State Water Resources Control Board has taken management of the aquifer away from these local agencies, or several of them, at least. Big news. A lot of people, including me, have observed that during our rare wet years, like 2023,TRILLIONS of gallons of precious water go down the San Joaquin and Sacramento Rivers, to the Delta, and out to the Pacific. Bye-bye. So now the second big news out of the State WRCB. The Governor has signed anExecutive Order that will suspend CEQA and one other tough environmental rule in California through June, 2023, to permit the following: Now, the trillions of gallons roaring down therivers, or at least some of it, will somehow be caused to go into our aquifer. Great news, but THEY DO NOT SAY HOW!! I wish KCBS would ask them how. Here is an excellent March 11, 2023 "LA Times" article that tells how they plan to do it. Divert flood waters in our rivers out to areas with permeable soils. TO AREAS WITHPERMEABLE SOILS. It just took ages to come up with this plan. Better late than never, Isuppose. It seems that CEQA and various local agency permitting processes have prevented this approach up to now. For decades up to now, making it a national scandal. Farmersfallowing fields, tearing out certain crops, like almond trees. Little towns having their wells run dry. Ground subsidence. Severe water restrictions for towns and industry. When onefourth of the food consumed in the United States is produced in California's Central Valley, or is tried to be. Can you believe what you are reading? The Natural Resources Defense Councilhas weighed in about how diverting water out of the San Joaquin River for this new policy could be bad for the Chinook salmon. But, some enviros say, in a very wet year like 2023,there is enough water for the aquifer and the fish. Hope this link opens for you. California will use floodwater to recharge groundwater - Los Angeles Times (latimes.com) Two female researchers at Stanford, about 10 years ago suggested that berms be pushed upnear the rivers, water channeled out to them, and water in wet years be impounded in the resulting spaces to perc into the aquifer. If you enclosed 100 acres with berms 10 feet tall, youcould impound 1,000 acre-feet of water and let it perc. The farmers would be paid for the value of their lost crops.These could be built on marginal land, where possible. Water justsitting out on MOST land, if it has layers of clay under it, does not perc. It just runs back into rivers and out to sea or it just evaporates. It would be MOST interesting if the State WRCB would say how they are going to nowget some water to perc into the aquifer under the San Joaquin Valley when the vast snow-pack we now have in the Sierra starts to melt and flows down-hill between now and the end ofJune. (See article above). You mean CEQA and local permitting agencies have allowed trillions of gallons of water to flow to the sea and caused massive water shortages inthis valley for decades? If so, CEQA and those agencies have been a pox on our houses. The former Mayor of Costa Mesa said that CEQA prevents the construction of vast new housing in the Central Valley. Instead, Newsom signed the obnoxious, traitorous SB9 and 10which is to allow the construction of apartments and condos in areas zoned now for single family neighborhoods. Control of zoning has now been removed from local government andthose decisions will now be "ministerial", dictated from Sacramento, apparently. Then, you can be certain that our expensive state prisons will be emptied of murderers, rapists and childmolesters and the inmates placed in these new dwellings in our now peaceful, safe neighborhoods. A measure to repeal SB9 and 10 will appear on the November, 2024 ballot.Newsom's political career is now finished for his having signed this traitorous SB9. He revealed himself as a traitor to the decent people of California by signing SB9. He is adangerous, radical ultra-liberal. That crap flew in San Francisco, but it won't fly in the rest of California. I've noticed that this bastard is just not very smart. You get these 3 second sound-bites and we are supposed to think that he "knows something". Even if the new residents in all of the backyard "auxillary dwelling units" ADUs, and condos and apartment buildings to be permitted in our neighborhoods under SB9 are alldecent, sort of law-abiding people, a 30 unit apartment building will put 60 new children in your neighborhood. They will inflict vandalism on your homes and vehicles, and assault youand your family. Loud music 24-7. Parking in front of your driveway and ON your driveway. Want to go out and take on a murderer, or his pals, who have parked on your driveway? Packa gun when you do. That is what Newsom and the Dems in the legislature have set you up for with SB9 and 10. They just can't STAND people living in nice, safe single familyneighborhoods. People don't have that in Kuba or North Korea, and they shouldn't have it in California. Newsom and the Dems who passed SB9 are just traitors and they deserve the worstwe can legally dish out. City of Palo Alto Members of the City Council I have loved living in Palo Alto since 1962. However, my mind-boggling Utility bills make me wonder if Palo Alto, in striving for excellence, is becoming a place where people like me, with no active income, can no longer afford to live. I rely very much on electric heaters and multiple layers of clothing but since I have two chronic lung diseases it is impossible to idle the furnace altogether. If you drive by my little house (unfortunately with zip code 94301) you can see that I have eliminated lawns and changed to succulents and other plants requiring minimum water (with no request for rebates from the City). Additionally, I collect shower water and lug it outside to water plants. In other words, I am doing all I can to conserve and follow city recommendations. To already announce now further cost increases is adding insult to injury. I am sure you will get many letters like mine and hope that you make this cost problem a priority. I feel that the Utility Department procedures and costs should be closely monitored and any surplus not be passed to the Palo Alto General Fund but be kept separate for future up-grade expenses. We have been in the retail business for over forty years. We are in favor of parklets if and only if: a) they do not block traffic; b) their length is limited to the frontage of the restaurant they serve (i.e., they do not block the frontage of adjacent tenants); and c) they are professionally designed and constructed. Our recent storms have shown how poorly designed parklets have contributed to street flooding. Also, by giving away public property—our parking spaces—to certain restaurants, allowing some to effectively double their seating capacity rent-free, you are giving these restaurants an enormous competitive advantage, thereby dooming other restaurants to failure. At a minimum, the city should charge fair market rent for the parklets. Finally, California Avenue is an absolute disaster. Closing that street benefitted a handful of restaurants at the expense of nearly everyone else, particularly the poor retailers counting on foot-traffic to sell their wares. PAO reports to City Council should also report: annual sales of aviation fuel at PAO, including how many gallons of leadedfuel are pumped at PAO each year, and how many gallons of "unleaded" aresold. the proportion of PAO based aircraft currently using leaded Avgas, and the percent of these aircraft that could burn unleaded fuel (UL94) withoutengine modification? These numbers should be made public each year. I was told 8 years ago by PAO staff that leaded fuel would be phased out "soon", but here we are. No other option is available. Local hobby pilots and owners of decades old planes have no incentiveto let go of leaded fuel. Once the promised UL94 is available, will PAOdiscontinue the sale of leaded Avgas? Becasue as long as leaded Avgas is available at PAO, I assume that the majority of single-piston engine aircraft there will continue to use the older, cheaper leaded fuel. Lastly, since the Flight Schools are such a vital part of PAO, can these businessesprovide any data on how many graduates of their schools have become commercial pilots and how many are just "hobby pilots" and high-impact commuters? Dear Council, I was encouraged at the PAO study session by some of the questions about the legal/regulatory constraints that PAO is working with. I hope that you will receive detailed responses - inparticular about the uses of the money the airport generates after expenses. As you may be aware, airports are increasingly being more transparent because the capital markets demand more information about environmental, social, and governance concerns. See,Dallas' DFW Sustainability by Design Report. It's important to know that DFW has purchased all the 65 DNL contour (the scope at which the FAA limits monetaryresponsibility for mitigation), like SJC (which also bought out the 65 DNL contours years ago) these airports have considered that their job is pretty much done as far as noise is concerned.Frankly, the capital markets and I hope the law will eventually see that an arbitrary line of 65 DNL is not a great way to behave and investors or bond holders could have choices to punishthose who are not reporting material information. Where PAO can be a leader is in having full disclosure of reporting both carbon and noise emissions. Carbon has scope 1 and 2 reporting which is like about energy for the lights in thebuildings. Scope 3 is what the airport customers are burning. I believe that even SFO has started reporting scope 3 but there are IMHO squirrely ways that carbon emissions getcalculated - for example only on outbound operations. We know first hand that fuel is burned on arrivals as well. How to report on noise emissions? The City and region has a long history on the topic ofnoise metrics and measurements. I would probably start with the attached unanimous vote by the Select Committee on South Bay Arrivals on Noise Metrics and Measurements. The SelectCommittee encompassed the votes from three counties, San Mateo, Santa Clara, and Santa Cruz and East Palo Alto was represented on the committee. One of the reports that informedthe Select Committee was this review of aviation noise metrics. On the topic of engaging youth in the "life of the airport," I suggest that PAO's environmental, social and governance reporting is a tremendous topic for youth to be involved in and wherewe have successfully engaged Stanford on the topic of big data and visualization methods for noise. Get students from both East Palo Alto and Palo Alto high schools involved from soup tonuts on getting the noise monitors set up, understand how the data gets collected, processed to produce the metrics; document and film the story, and make sure that PAO is a real leader onhow we capture noise data, analyze, and communicate about it. One last note on the airport money - I think you have to really dig deep into what is allowed or not. For example, airport legal expenses are covered as East Hampton found, and yet a noisemonitor may not without constraints. Kind of backwards because what you really want is to invest in quality communications that especially for the Bay Area also need to be scientificallyaccurate and not just glossy pages. From my experience a lot will depend on how the rainfall isdistributed in time. Some years back around Christmas (2012) we had a very close call with overtopping because we had 3 rain cells move through separated bya couple of hours from each other. Even though none of the 3 was particularly intense the timing between the storms led to a very interesting response. Thetiming of the third cell at the time when the hydrograph would typically be receding was particularly impactful. What caught my attention in the findings include: --the challenging retail environment everywhere but especially in Palo Alto for downtown where I live and work and Cal Ave given the diversity and central management at Stanford Shopping Center and T&C --their finding that neighboring cities are competing strongly to make their area attractive but also adding to the customer base by welcoming housing and jobs. --the relatively high and enduring retail vacancy and rent rates around Univ and Cal Ave. Iwould add high, enduring and likely to continue office vacancies as firms economize onspace. --the importance for a thriving hospitality sector of business travel and travel related to Stanford activities (parent visits, sports visits as well as related to on campus research SRP, SSC and the hospital. As an economist I feel optimistic here as international travel is opening up in addition to domestic growth. --the difficult but important challenge of reconciling the different perspectives of business and property owners and customers. Even within business owners, I suspect the perspective of restaurant, cafe and bar owners may differ from those of retail proprietors. I noted that downtown food and beverage sales were much higher than store sales the reverse of most other areas. My sense is many of these findings will link to council decisions on open versus closed(possible combinations by time period) for Cal and Univ Ave. I hope you will ask the team to spend more time on the office space market and possibilities and what is needed to convert unused office and retail space. I understand that the market and economic reality may make achieving some of residents' wishes hard or unrealistic. A follow-up note was sent by Greg Schmid to Tim Wong on December 15th asking for confirmation that the two letters sent on December 5th had been received. When no response was received over the holidays Greg made a call to City Staff. The response was that the Housing Element had been submitted to HCD on December 23rd. The document submitted by the City included a 248 page appendix that summarized "citizen contributions". There was no mention of our two letters with their detailed sets of comments and questions. City Staff said they had "gone to spam", but that excuse is contradicted by the fact that at least the PASZ letter was included in the Council packet for the November 28th joint meeting. Jonathan Lait has offered to meet with Greg Schmid (and other representatives of PASZ) to discuss the comments and questions in the two letters. His offer will be accepted, but the timing is such that we still want the responses we were entitled to if the responses to us has been made on time. Accordingly, we believe that we are legally entitled to comprehensive responses by City Staff to our comments and questions. We ask Council (or the Mayor) to direct City Staff to promptly give the City&rsquo;s detailed responses to us, with copies to Council and HCD (along with the two original letters), and a more appropriate explanation for the record as to why the responses were not given sooner as legally required and publicly committed to by Tim Wong, which explanation should acknowledge that the failure to respond sooner was the fault of the City and not ours. Lauren AngeloPresident, Friends of the Palo Alto Junior Museum & Zoo Exhibit Spotlight: JMZ Fish TankQuestions for John Aikin, JMZ Executive Director What is unique about the JMZ’s fish tank? The fish tank was inspired after a visit to Busch Gardens in Tampa, Florida. The hippopotamus exhibit there is home to hundreds of Lake Malawi cichlids in various vibrant colors. The tank is positioned so that visitors face south looking into it. This allows light to shine through and illuminates the water all day, and it is gorgeous. We wanted to recreate a similar experience at the JMZ— without the hippos! Now, the JMZ’s cichlid tank is probably the largest of its kind in Northern California. Large fish tanks are incredibly difficult to construct. There are multiple layers built in theprocess in order to ensure there will be no leaks once filled. It takes a lot of time andspecialized knowledge. We really wanted visitors to feel like they were underwater withthe fish when the tank was built. The acrylic barrier that contains the water is actuallyslightly concave, which gives the illusion of being underwater and closer to the colorful fishinside. Our tank is roughly 6,000 US gallons. Not only are these tanks hard to build, but they are also difficult to maintain. The cichlidsinside have their own unique care needs and environment that has to be monitored. Weactually have specialists visit every week to check the water quality for the fish! We hopeto introduce turtles into the aquarium sometime in the future, which is why the artificialbranches in the tank are vertical, so that turtles cannot escape. Fly river turtles are a greatoption for the tank since they enjoy the same warm, alkaline water that our cichlids do.  Photos of the colorful cichlids inside the tank. Can you tell me more about the different cichlids in the tank? Lake Malawi cichlids are a textbook example of adaptive radiation and evolution. Cichlidsare found in Africa, South Asia, and Central and South America. In Lake Malawi in EastAfrica, cichlids have diverged into at least 850 different species. The fossil recordindicates that throughout history, Lake Malawi was inhabited by very few cichlid species,unlike today. Lake Malawi is isolated from other bodies of water, so all cichlids in the lakemost likely evolved from random mutations. This is a great introduction to evolution for ourolder visitors. There are more than 25 species of cichlids in our tank, representing a rainbow of colors.Some cichlids are common, like the yellow lab cichlid. Others, like the Moor’s cichlid, alsoknown as the humphead, are vulnerable species. It is pretty exciting that we have beenable to add rarer species of cichlids to our tank since opening. As mentioned previously,we have specialists monitor the water conditions in the tank, so our cichlids remain happyand healthy. Cichlids are so vibrant, they almost look like they belong in a saltwater coralreef, but they are actually freshwater fish! We feed the cichlids a primarily vegetable diet.Cichlids are sensitive to protein, so we can’t give our population too many treats. Three young visitors peek inside the tank. One of our volunteers, Milan del Buono, was fascinated by the tank and did his ownresearch on new cichlids we could add. Including the original population and the fish thatMilan added, we started with around 75 fish. After two years of breeding, there are over350! While he looked for new fish for the tank, Milan had to keep a lot of factors in mind.For example, most tropical fish are bred in outdoor ponds in warm environments, whichmakes these fish susceptible to disease and parasites, including parasites that can bepassed to birds if they ingest fish. Since our birds (before Avian Flu) were free to wanderaround the zoo and could easily come into contact with the cichlids, we wanted to avoidintroducing any factors that could make our animals sick. Milan had the difficult job oflooking for indoor-only breeding facilities. While these were much harder to find than thestandard ponds, acquiring fish from indoor breeders ensured that no disease would enterthe zoo. Often, when they go to a zoo, visitors don’t expect to be amazed by a fish tank. However, guests consistently tell us that they are fascinated by the dynamic and colorful ecosystem of our cichlid tank. This really all leads back to our mission of inspiring curiosity in nature. But we should move forward with unleaded fuel, and even noise abatement, although the noise does not bother me on Curtner, I have about four sources of noise far worse than overhead aircraft. It DOES sound like some people are confusing overhead aircraft landing at perhaps San Francisco or San Carlos as landing at Palo Alto. Could that be true? Given the extraordinary disproportionate extrajudicial executions of African Americans every year by the police — should the city council carve out an exception allowing African Americans to be armed in all of the same public and private locations that police are allowed to carry guns? Arguably arming African Americans in the same private and public spaces council proposes -to allow police and retired police to be armed- would substantially mitigate- act to eliminate the extrajudicial ( without trial or due process) execution of African Americans in these spaces.
