Mayor Dennis called the regular meeting of the City Council to order at 7:33 p.m. on Tuesday, October 15, 1974, in the Council Chamber of the City Hall. 2 The invocation was given by Reverend Edwin Linberg, Temple City Christian Church, 9723 E. Garibaldi Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Dennis. 4. ROLL CALL: Present: Councilmen- Gilbertson, Greenberg,Merritt,Tyrell,Dennis Absent: Councilmen -None Also Present: Assistant to the City Manager Biel, Planning Director Dragicevich, Public Works Coordinator Leonetti 5. APPROVAL OF MINUTES: Mayor Dennis stated under. Item #6 of the minutes of the Council meeting of October 1, 1974, his statement that he felt request for variance was for reasons of personal hardship rather than to the property should be included; that Page 4, paragraph 5, should read "City Council" rather than Planning Commission. Councilman Gilbertson moved to approve the minutes of the regular meeting held October 1, 1974, as corrected, seconded. by Councilman. Merritt and carried. UNFINISHED BUSINESS: 6. ORDINANCE NO. 74 -393: 2nd read. CHANGING ZONE OF CERTAIN PROPERTIES FROM R -1 AND RPD (74 -415) TO RPD (74 -424) Assistant to the City Manager Biel. presented Ordinance No. 74 -393 AN ORDINANCE OF THE CITY OF TEMPLE CITY CHANGING THE ZONE OF CERTAIN PROPERTIES FROM R -1 AND RPD (74 -419) TO RPD ` (74 -424) for second . reading by title only. Councilman Tyrell moved to waive further reading and adopt, seconded by Councilman Gilbertson and carried. 7. RESOLUTION NO. 74 -1396: DENYING A VARIANCE: ZONE VARIANCE CASE 74 -419. 9818 and 9824 LONGDEN AVENUE Assistant to the City Manager Biel presented Resolution No. 74 -1396 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DENYING A VARIANCE IN CASE NO.•74 -419 by title only Councilman Tyrell moved to adopt, seconded by Councilman Gilbertson and carried. NEW BUSINESS: 8. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of October 8, 1974 A. FUTURE DEVELOPMENT OF GOLDEN WEST. AVENUE Assistant to the City Manager Biel presented background information, stating the Planning Commission, at their regular meeting held October 8, 1974, considered an amendment to the Circulation Element of the General Plan with respect to the future development of Golden West Avenue. Planning Commission reco min ended •that no amendment to the Circulation Element of the General Plan be considered at this time pending possible future development of large, undeveloped parcels facing Lower Azusa Road, that Golden West Avenue be improved with a cul -de -sac approximately 460 ft.. south of Hallwood Drive, and that immediate steps be taken to correct the problems relating to the unimproved drainage ditch south of Hallwood Drive. Council Minutes, October 15, 1974 - Page 2 Planning Director Dragicevich gave staff report, stating consideration of the future status of this street was prompted by the reconstruction of Lower Azusa Road, Golden West Avenue is shown on the General Plan as a collector road, the residential parcels beginning approximately 450 ft. north of Lower Azusa Road are primarily single family dwellings with one church and its facilities located on the east side of Golden West, an unimproved drainage ditch runs down publicly owned right -of -way which occasionally washes out causing maintenance pro- blems and is frequently covered with trash and debris creating . environ- mental problems, a number of automobiles use the unimproved and partially dedicated road daily as access to their properties north of Lower Azusa Road. Mr. Daniel Arquette, 4863 Golden West Avenue, directed Council's attention to a petition submitted to the Planning Commission indicating . an overwhelming desire to have the street improved with a cul -de -sac, stating he would be in favor of a change in the General Plan. Mr. Dick Payne, 5226 Golden West Avenue, stated he grew up in Temple City and used to drag race on Golden West Avenue, such activity still being done by teenagers. He is in favor of a cul -de -sac being constructed now, not in contemplating future development 20 years from now. Mrs. Gail Goldsmith, 4836 Golden West Avenue, stated she was in favor of a cul -de -sac, that development of the street through to Lower Azusa Road would require widening the street. In answer to her question as to why Council would consider amendment to the General Plan, Councilman Gilbertson explained that a change of the circulation element of the. General Plan would indicate Golden West is no longer a through street and give the residents the assurance a through street is . not planned at any time. Mr. Milton Booher, 9807 Hallwood Drive, stated if Golden West is developed as a through street it would become a speedway, that Golden West Avenue would become the logical place for motorists to line up waiting to enter the El Monte Drive-in Theatre. Mr. John Buthman; 5217 Golden West Avenue, stated he would ask Council to look at the map,-read the petition, and be a government for the people. Councilman Gilbertson stated that a cul -de -sac is contrary to the existing circulation element, that:a deteLmination should be made at this time, and he would be in favor of considering an amendment to the General Plan deleting Golden West Avenue from the circulation element. Mayor Dennis agreed with Councilman Gilbertson to the extent that a cul -de -sac is contrary to the existing circulation element. Councilman Merritt felt that no change should be made at this time pending possible future development of the large, undeveloped parcels on Lower Azusa Road. Councilman Greenberg agreed that no change should be made at this time, keeping the option open as to future development. Councilman Tyrell felt the problem relating to the unimproved drainage ditch is the immediate problem, as well as barricading the unimproved portion to eliminate the traffic problem. Councilman Tyrell moved to authorize the preparation of construction plans for the construction of appurtenant drainage structure and to barricade Golden West Avenue at both the south end at Lower Azusa Road and approximately 460 ft, south of Hallwood Drive, seconded by Councilman Gilbertson and carried. Council Minutes, October 15, 1.974 - Page 3 Councilman Merritt moved to concur with Planning Commission recom- mendation-not to amend the Circulation Element of the General Plan, seconded by Councilman Greenberg and carried on a roll call vote: ROLL CALL: AYES: Councilmen - Greenberg, Merritt, Tyrell, Dennis NOES Councilmen- Gilbertson Council concurred to refer to Traffic Commission consideration of possible need for stop signs at the north and south approaches to La Rosa Drive on Golden West Avenue and instructed staff to initiate a speed survey for Traffic Commission consideration. B. PROPERTY NUISANCE CASE N0. 74 -26: 10800 DAINES DRIVE Assistant to the City Manager Biel presented background information stating the Planning Commission, at their regular meeting held September 10, 1974, held public hearing and adopted Resolution No. 74 -581PC determining that a public nuisance exists on subject property. Inspection revealed that the open and broken windows had been secured and staff was advised by the owner that the property is in escrow, and it is recommended that the case be terminated. Planning Director Dragicevich presented pictures taken October 15, showing the boards had been removed from the open and broken windows creating a hazard and would recommend at this time that proceedings not be terminated. Councilman Tyrell moved to continue the matter to November 5, 1974 to notify the property owner a public nuisance is still under consideration, seconded by Councilman Gilbertson and carried. 9 RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of October 2, 1974 A. GLICKMAN AVENUE AND LA ROSA DRIVE - Install Stop Sign with pavement markings Assistant to the City Manager Biel presented background information, stating that pursuant to request from a resident for some form of control at subject intersection, the Traffic Engineer made an . investigation and recommended to Traffic Commission placement of a boulevard stop sign on Glickman Avenue at the south approach to La Rosa Drive, with stop and stop bar pavement parkings. Traffic Commission, at their regular meeting held October 2, 1974, recom- mended placement of a boulevard stop sign per Traffic Engineer's report. Councilman Merritt moved to approve placement of boulevard stop sign, with stop and stop bar pavement markings on Glickman Avenue at the south approach to La Rosa Drive, seconded by Councilman Gilbertson and carried, B. OAK AVENUE AND LEMON - TRAFFIC CONTROL DEVICES Assistant to the City Manager Biel presented background information, stating the City received a letter from the Temple City Unified School District expressing concern about traffic conditions on Oak Avenue between the Intermediate School and Longden Avenue and requesting City consideration of installation of sidewalks and limited parking restrictions. City Engineer reported the need for improving the west side of Oak Avenue with the installation of a short section of curb and gutter and extending the sidewalk on the west side of Oak Avenue from Lemon to Emperor to provide additional protection for pedestrians. Traffic Commission, at their meeting of October 2, -1974, made six recommendations to City CouneiI, including initiating Chapter 27 proceedings to place curb and gutter on the west side of Oak Avenue from Lemon Avenue northerly the distance of three properties. 1 Council Minutes, October 15, 1974 - Page 4 Mr: William Schmidt, Principal, Oak Avenue Intermediate School, urged Council's positive action with respect to the recommendations, stating he would appreciate the City's help in providing him a time schedule for the improvements, so that the school can cooperate by placing emphasis on the supervision of students before and after school. In answer to Councilman Gilbertson's question with respect to how this project would fit in with City's overall plan for curb and gutter, Public Works Coordinator advised it would have been done in approximately two years, that the City could probably defer improvements on the south side of Lemon Avenue between Temple City Boulevard and Golden West which is currently budgeted. Councilman Tyrell moved to set public hearing November 19, 1974, to consider curb and gutter on the west side of Oak Avenue from Lemon Avenue northerly the distance of three properties under Chapter 27 proceedings, seconded by Councilman Greenberg and carried. 10. SLURRY SEAL PROJECT - FY 1974 -75 - MAINTENANCE AREA #2 Assistant to the City Manager Biel presented background information, stating as a part of the City's preventive maintenance program, the streets in Maintenance Area #2 have been scheduled for slurry sealing during the current fiscal year, plans and specifications and a calendar of events have been provided. A negative declaration has been filed and notice posted. Councilman Tyrell moved to acknowledge the negative declaration, approve plans an'd specifications and authorize advertising and receiving of bids, seconded by Councilman Gilbertson and carried. 11. PROPOSED POLICY RE: ALLEY IMPROVEMENTS Assistant to the City Manager Biel presented background information, stating staff has made a study of the half mile of alleys in the City which are totally unimproved and 3 3/4 miles of alley which are partially improved, several of which need major maintenance, . and has prepared proposed policy for Council consideration. Public Works Coordinator Leonetti advised there are three alternatives for dealing with the alleys; 1) the City can continue to maintain the alleys on an "as needed" basis as is presently being done; 2) the City could implement an alley improvement program, covering a period of several years and pay for the full amount of improvements; or 3) the City can use Chapter 27 proceedings to fund the construction of the improvements in the same manner curb and gutter projects are initiated. Alternatives under Chapter 27 are set forth in memo dated October 11, 1974, and on file in the City Clerk's office., the following policies being recommended for consideration; 1) alleys are to be improved under Chapter 27 procedures; 2) the property owner is to pay a fixed cost per lineal foot of frontage on the alley for the . construction of the improvement, which costs for FY 1974 -75 is $5.80/1.f.; and 3) the City will pay for engineering costs and bear the difference between the fixed unit cost and the bid cost. Staff would further recommend authorization to circulate petition for the construction of improvements in the alley south of Broadway between Sultana Avenue and Loma Avenue. Councilman Gilbertson moved to approve the recommended policies as listed on Page 3 of memo dated October 11, 1974 and on file in the City Clerk's office, and to authorize circulation of a petition for the construction of improvements in the alley south of Broadway between Sultana and Loma. Avenues, seconded by Councilman Merritt and carried. In answer to questions from Mr. Heber, 9033 E. Rancho Real, concerning initiating a petition, Mr. Heber was advised to contact staff at City Hall. 1 Council Minutes, October 15, 1974 - Page 5 12 NORTHEAST REGIONAL BURGLARY INVESTIGATION TEAM Assistant to the City Manager Biel presented background information stating the Sheriff's Department, with other local police. agencies of the Greater Pasadena Area; are joining together to apply for federal funds through the Office of Criminal Justice Planning to fund a multi - jurisdictional burglary investigation team; total grant request is approximately $360,000 of which there is a 57 hard match from local participating jurisdictions., Temple City's share being $418. Sgt. Doreen Owens, Comprehensive Burglary Bureau, gave background information on the project, stating a pilot program was started in the South Bay area in June with the result $75,478 of stolen property has been recovered. and 71 arrests of burglars and persons receiving stolen property; the multi - jurisdictional team provides a source to deal with burglaries which jump city boundaries; most of the local jurisdictions have already authorized participation in the Greater Pasadena Area. Councilman Tyrell moved to adopt Resolution No. 74 -1397 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AUTHORIZING THE FILING OF AN APPLICATION ON BEHALF OF THE CITY OF PASADENA, CALIFORNIA, appropriate additional funds in the amount of $418 and amend the adopted budget - accordingly, seconded by Councilman Gilbertson and carried. 13. RESOLUTION NO. 74 -1398: EMPLOYMENT OF PERSONNEL Councilman Gilbertson moved to adopt Resolution No. 74 -1398 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING TEMPORARY PERSONNEL, seconded by Councilman Greenberg and carried. 14. RESOLUTION NO. 74- 1399: -- "WARRANTS & DEMANDS, Demand Nos. 777 thru 906 in the amount of $57,078.68. Councilman Tyrell moved to adopt Resolution No. 74 -1399 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS: IN THE SUM OF $57,078.68, DEMAND NOS. 777 THRU 906, seconded by Councilman Merritt and carried. 15. COMMUNICATIONS: A. Temple City High School - Request to hold fireworks display, November 1, 1974 A communication dated October 11, 1974, . requesting permission to hold fireworks display in conjunction with the Temple City High. School Homecoming Ceremony Friday, November 1, 1974. Councilman Gilbertson moved to approve request subject . to approval of the County Fire Department and the required certificate of insurance, seconded by Councilman Greenberg and carried. 16. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mr, Robert Imhoff, 4923 Golden West, inquired as to when the General Plan was adopted and Council's reasons for not amending it at this time. He was advised the General Plan was adopted in 1971 and that it may be necessary to improve Golden West Avenue as a through street at some time in the future and it was felt that option should be left open. Mr. Daniel Arquette, 4863 - Golden West, stated many people in the audience were disappointed at Council's decision not to amend the General Plan and with the fact that the southern portion will be barricaded rather than ,construction of a cul -de -sac. Council Minutes, October 15, 1974 - Page 6 Mrs.. Marianne Milch, Temple City Chamber of Commerce, expressed the Chamber's thanks for the Bicentennial Committee supporting the impressive half -time performance at the October 11 football game at the High School. Mrs. Milch further advised the Chamber had submitted two entries in the Los Angeles Beautiful contest. Thirty - eight entries were selected out of 32.7 submitted, the two entered . by the Chamber, American Savings and Loan Association and Temple Town House were among the 38. Mrs. Bonnie Harrison, 4851 Golden West, stated that someone from City Hall came to her and told her that if she dedicated a portion of property for right -of -way, the City would improve the street and install curb, gutter and sidewalks. Mrs. Harrison also stated: they have a problem with dead rats and the street sweeper seldom comes down there. Staff was instructed to research City files to see what contact may have been made with residents on Golden West. RECESS TO CRA: The City Council recessed at 9:00 p.m. to meet as the Community Redevelop- ment Agency, all members being present and approved the minutes of the regular meeting held October 1, 1974. Meeting adjourned at 9:01 to Tuesday, October 29, 1974. RECONVENE AS CITY COUNCIL: 17. MATTERS FROM CITY OFFICIALS: A. Councilman Greenberg stated he was disturbed to see the Los Angeles Times print financial information required to be filed with the Secretary of State September 30. He felt the newspaper had gone beyond the limits of good reporting in publishing the information. B. Councilman Merritt agreed with Councilman Greenberg, stating he did not feel the statements were for general public information. Councilman Merritt also directed staff's attention to the unsightly conditions existing at the Exxon Station at Baldwin Avenue. and Lower Azusa Road. C. Councilman Tyrell agreed with Councilmen Greenberg and Merritt with respect to the publication of financial statements in the Los Angeles Times, stating he did not feel it was the intent of the law to make City officials second class citizens. D. Councilman Gilbertson stated he felt that Proposition 17 on the November ballot is a hoax being perpetrated on the people in the name of ecology and felt the Council should oppose the proposition officially. Councilman Gilbertson stated he had a telephone call bringing to his attention President Ford would meet with Mexican President Echeverria Monday, October 21 in our Sister City, Magdelena de Kino; George Koumachian, President of the Sister City Association called Magdelena this afternoon, and a delegation of Temple City representatives were warmly invited to come to Magdelena to participate in the welcome of 'the two Presidents. Mayor Dennis has indicated he will be able to attend, Postmast Don Wheeler has been contacted and he has expressed a willingness to fly a rented airplane to Magdelena Sunday, returning Monday evening. Councilman'Gilbertson moved to authorize the expenditure of $200 to rent an airplane and instruct the Assistant to the City Manager to communicate with the White House and advise of the City's plans, seconded by Councilman Greenberg and carried. Council Minutes, October 15, 1974 - Page 7 Mayor Dennis invited Councilman Greenberg, Council representative to the Sister City Association, and George .Koumachian, President, to join him in the trip to Magdelena, E; Mayor Dennis advised he had. received a letter from the office of the Mayor of Pomona requesting his support in opposing Pro- position "A ", copy of which he had forwarded to the Council e Mayor Dennis felt that any action should be a personal preference and each Councilman take whatever action he felt appropriate. 18.
