Dear Ed and City Council— We have an office tenant that, despite its lease signed a year ago, has yet to occupy one of our University Avenue buildings. When we met with the tenant this morning to discuss this surprising delay, they told us that, among other reasons, Palo Alto now requires every employee to have their own non- transferable parking pass. This restriction—a relic from the bygone era when all employees actually came to the office—is absolutely nonsensical now when maybe 5-10 percent of employees show up on any given day. If one has 100 employees, but only 10 come in on a daily basis, then the already expensive parking pass costs the company 10 times as much. We urge you to immediately revert back to when parking passes were transferable, to when the pass simply attached to the rear-view mirror and could be shared. This is admittedly a very small step toward revitalizing our moribund downtown, but we need every small step we can muster to return to our former civic vigor. Thanks for your consideration. John E. LWVPA Virtual Speaker Event Register Now Wednesday, April 19, 2023 12:00 pm - 1:00 pm Featuring our Guest Speaker Professor Michelle Oberman The US Abortion War in 2023: A California Perspective In addition to the flurry of abortion bans enacted in 2022, the U. S. witnessed the highest number of abortion protections ever passed. Fully one-quarter of these protections were enacted in California. What does it mean to be an abortion-friendly state in a country where almost half of the states have banned abortion or are likely to do so? Professor Oberman is an international expert on the impact of abortion regulation in countries with widely divergent abortion laws. In this talk, she will share findings from her current research in a state where abortion is banned, to explore what changes on the ground when U. S. abortion law changes on the books, and to consider how California’s commitment to reproductive justice does (and does not) alter that landscape. BIO: Michelle Oberman, J.D, M.P.H. Katharine and George Alexander Professor of Law Santa Clara University School of Law Professor Oberman is an internationally recognized scholar on a wide range of legal and ethical issues arising at the intersection of sex, pregnancy, motherhood, and criminal law. For the past decade, she has studied the impact of abortion regulation in countries with widely divergent abortion laws. Her work in El Salvador, along with other countries and a range of U. S. jurisdictions, informs her 2018 book, Her Body, Our Laws: On the Frontlines of the Abortion War from El Salvador to Oklahoma. Her current work focuses on what changes on the ground when U.S. abortion law changes on the books. Rail Committee members and City Council, I submit a suggestion to implement underpasses only for pedestrian and bikes to pass under the rails and also under Alma, at three crossing locations, as a quicker and cheaperintermediate solution. The design can allow for later underpasses for cars, while keeping the pedestrian and bike underpass as is. Why? A solution for high speed rails and crossing auto traffic is unlikely to be operational inthe near term, if ever, given the enormous cost. In addition, there are the unsolved problems of very loud noise produced by the passage of high speed trains, and possible need to destroy astrip on each side of the rails for the needed right of way or tall sound walls. Let's seriously consider a quicker, cheaper solution for pedestrians and bikes, while we wait to see if the rails for the high speed trains are ever built. It is like a ghost center. Avenidas has at least four empty medium sized rooms for La Comida, four empty rooms nearly every day. They pay $1/year rent to PA. They need to step up and bring La Comida back to the Senior Center asap. Folks now stand in long lines at the First Methodist Church. They mustleave. There is not any place to go to share a meal, socialize, but they pick up a tray, and then go home. No place to socialize, to share ideas, make friends, etc. AVENIDAS Senior Center on Bryant NEEDS TO SERVE THE SENIOR COMMUNITY BETTER! They are hardly serving the middle class of Palo Alto, and not serving working class folks or others who want to share a lunch with others for a small donation.Check it out for yourselves. Go there and see how vacant it is. We can do better. THEY CAN DO BETTER! Staff is pretty well paid. Let's serve seniors, ALL seniors. But, frankly, after many people trying and failing for many years to get the City of Palo Alto to meaningfully address this matter, it seems fully appropriate. Just over a week ago, on April 5th, there was an automobile crash at the intersection of Middlefield Road and Lincoln Avenue – just another in a seemingly endless stream of such collisions there. For those of us living (or working) within earshot of that crossing, the sound of blaring horns (many times daily), screeching brakes (at least weekly) and, all too often, crashing metal and glass is painfully familiar. I haven’t researched the history of injuries associated with these mishaps, but I’ve seen ambulances and fire trucks on the scene numerous times. Tow trucks are routinely needed. And, police – often multiple units – are invariably and extensively involved. Damage has also been done, repeatedly, to both public (street lights and signs) and private (hedges and fences) property. As a clear matter of public safety, and with the City having been repeatedly alerted by residents, over a period of many years, to the evident danger (as if the City’s own accident-response records shouldn’t be enough to raise the alarm), the City’s failure to meaningfully address the issue seems inexplicable at the very least. Especially so, given that just three blocks to the south, another intersection, that of Middlefield and Kellogg Ave, is constructed in a way that could very possibly alleviate the entire problem at Lincoln. Please examine the slides attached to this email for an explanation of what I think are the main problems at the Middlefield/Lincoln intersection and how they might, relatively easily and quickly, be remedied. This is first and foremost a safety issue. But, it’s also a city budget issue (especially, I imagine, were civil liability to come into play in the case of a serious accident) as well as one of neighborhood quality of life. Two men who are not young, sort of searching around for words, butthey know of what they speak Buffett is worth $100 billion and Munger is worth $4 billion. Of course, it is not just the checks the government has sent out, it is the huge spending it is doing that is provoking our inflation. $856 billion this year to defend the whole world, e.g.,and the infrastructure bill. Those too puts huge money into the economy, causing demand-pull inflation. Mr. Buffett did not mention it, but we have also had a lot of cost-push inflation. Things likelumber prices and other materials have caused now homes to cost more. Also diesel prices have raised the cost of everything moved by the big-rigs, we are reminded often, also causingcost-push inflation. So we have had both kinds of inflationary pressures. The most recent numbers show a 5% increase in prices, March, 2023 over March, 2022. The Fed still has a long way to go to get to their target of 2% inflation. I heard about this item tonight thanks to the outreach of the Palo Alto Renters' Association (PARA) who do the direct work of supporting tenants who are struggling in Palo Alto. Renters are almost half of Palo Alto, they include our most vulnerable residents, and the city needs to ensure their voices are heard. Until PARA was formed a couple years ago there had not been an organizing body for renters since the 1970s in Palo Alto and property owners have many different large well funded groups to support their own organizing work. Visitors can helpkeep the JMZ’s bird collection safe by using the zoo’s foot washing stations, and by changing clothes before visiting the zoo after handling any wild birds. In addition to seeingall of the zoo’s familiar bird residents again, visitors will see a number of new (and verycolorful!) birds as well, including Victorian crowned pigeons, Bruce's green pigeon, and theviolet turaco. You can read more about these new birds and the “Loose in the Zoo”experience below. In honor of Earth Day later this month, the Friends will host an interactive educationalevent about butterflies from 3 - 4 p.m. on Tuesday, April 18. I hope you will join us! Lauren Angelo President, Friends of the Palo Alto Junior Museum & Zoo Curating "Loose in the Zoo" and New Birds Arriving at the JMZQuestions for John Aikin, JMZ Executive Director What is “Loose in the Zoo” and what inspired its creation? “Loose in the Zoo” is an immersive experience in which birds are free to wander around the zoo and visitors can see them up close. What is so unique about this experience is that no two visits are ever the same. It depends on which animals are active that day, where they are in the zoo, and how they feel about letting humans closeby. The JMZ was designed to provide a child-centric experience – children are given the option to explore the exhibit hall and the zoo at their own pace. We wanted to allow children to encounter animals in nature. That way, they could learn more about the different habitats that some animals prefer, and ultimately draw their own conclusions about animal behavior. Birds are perfect for this experience because if they are uncomfortable being close to a human that day, they can easily fly away. When they choose to stay close, it teaches children about respecting animals in their own homes. We’re really excited we can bring this back for our visitors. We have learned a lot about avian flu since the outbreak started last year. In the BayArea, there has not been a single infection witnessed in an animal in a zoo. The JMZ islucky because our birds are even more protected by the netting over the zoo. Our staffhas monitored the netting to see if any birds perch on it throughout the day, and not asingle staff member has spotted a wild bird doing so. That being said, we still do have to take precautions. The greatest risks we’ve identified are visitors coming in who may have birds at home, like outdoor chickens, or may havehiked in a wetland area. Sanitizing stations for shoes are inside the zoo to the right of theentrance. We also have boot scrapers ready to wipe mud off of shoes if they areparticularly dirty. While we wish it were not currently circulating, avian flu gives us the chance to teachvisitors about what they can do to protect our flock. Animals allow our ecosystems toflourish, and sometimes, we need to take extra steps to ensure they stay healthy. Newsignage at the zoo teaches guests about avian flu and how you can keep our birds, andwild ones, safe. How do you decide which new animals to bring to the JMZ? Many of the animals at the JMZ were hand selected because they are great children’s zooanimals. These animals are social, colorful, and safe for kids to be around, which was arequirement for “Loose in the Zoo.” Many of these animals have obvious adaptationswhich inspire questions from children, like the spoonbills with their unique beaks. Our zoohas really evolved to fit the needs of the community over the years. Many reptiles, andeven our new opossum, Ms. O, were pets that were difficult to care for. This resulted in ustaking in more non-native species, starting about 40 years ago. When curating the newzoo, we decided to introduce animals like the meerkats and the cichlids to show ourcommunity animals from other parts of the world. Palo Alto, and the Bay Area as a whole,is very globally connected. It is our responsibility to reflect that at the JMZ. We have plenty of other animals behind the scenes that are great for our education department to bring to schools. Our educators also weighed in on which animals would be important to have in the zoo. For example, the raccoons were selected because children are often familiar with them. When a child can personally connect with an animal they have seen in the wild that is in our zoo, they are curious to learn more about them. This resonates with adults as well; animals we may find in our backyards have unique characteristics and contribute to our environment in ways we might not realize. Can you tell us more about some of the new birds that visitors will soon see at“Loose in the Zoo”? We have three new bird species that will be in the zoo soon thanks to Eugene Samas of San Francisco, who donated these birds from his family's aviary. Bruce’s green pigeon is native to much of northern sub-Saharan Africa. Despite the name, they are not entirely green. Much of their chest is a vibrant yellow and their wings are partially violet. Children will be able to recognize the similarities these birds have to feral pigeons, also known as rock doves, they see in the Bay Area. Photo of a Bruce's green pigeon. These birds have an amazing fan of feathers that stick out of their heads like a crown. All three of these new crowned pigeons are related: a male, a female, and their offspring. Native to Papua New Guinea, these birds are near threatened species and give us the perfect opportunity to talk about conservation. They also make a very unique “whooping” noise when they call. Like the name indicates, these birds are primarily violet with a beautiful iridescentsheen. Their beaks are an interesting shape with both yellow and orange. They have a redhead and bright red feathers underneath their wings. We are really excited for visitors tosee the violet turaco in flight when the red underside of their wings is on full display. We are excited to bring “Loose in the Zoo” back to our visitors. The new birds I mentionedwill not be the only ones to join our flock, so stay tuned! I have been an educator and renter in Palo Alto for over 10 years. I often have felt disenfranchised as a renter. In the past, I have gone to work and returned home each day. Sometimes the rent has been increased with little concern by the landlord about my ability to pay the increase or certain noise issues. At Alma Place, renters to not have a secure mailbox. I have also been a resident property manager and seen how apart renters live day to day from each other and the community. In addition, I have become aware of how little owners spend on maintenance, flood control measures, and other safety measures. Below, please see the emails that have sent to Julie and Lydia about my recent renters experience and my past experience as a resident manager. In solidarity, Mary An Email to Julie from Me about the Impact of the Storm on Me as a Renter Dear Julie, Below is an email that I sent to the PA Council in September of 2022 to share how renter’sblues for me and others in Palo Alto, CA is not new and not new in the US or the world. In the interest of time, let us have an agenda that enables us to be clear about the problemand ask questions to determine what actions/ideas can lead to a solution/address theproblem. Although, I get less upset, I still find talking about my personal Poseidon adventure upsetting after Alta Housing managers refused to take proactive flood control measuresbefore the ferocious deluge of rain (atmospheric river) during the first two weeks of January 2023 arrived to 300 Palo Alto, CA 94306 3x in 2 weeks. It’s important to know:a. Flood control measures were denied. b. Assistance was provided only after the water was gushing out of the gutters on 3occasions. c. First deluge Alta Housing after-hours maintenance tech arrived without a pump, but cameback an hour later. d. Second deluge with a sump pump.e. Third deluge, the PAFD arrived by my request 2x without a pump. The third time, the dispatcher offered an ambulance and a call from the captain to the manager, who refused tosend a maintenance tech with a pump for this 3rd deluge. f. Another Alta Housing maintenance tech came during a break in the storms to fix the gutter—but came without a ladder. So, the gutter did not get fixed before the last and mostvoluminous atmospheric river. Moreover, I was gas lighted when told: “There is nothing wrong with the gutter.” I was alone and feeling helpless against the deluge of rain as I moved 30-50 gallons ofwater on 3 occasions to prevent the 4 kitchens on the first story from flooding during these 2 weeks of historic rain in the SFBay area. Fortunately, the downspout sleeves that I boughton Wednesday eve during a storm worked to divert the water away from the building and toward the storm drains. Unfortunately, it was the uncleared and poorly positioned gutters +down spouts that caused the water to gush out of gutters and into 3 basins that I set up. Emptying the basins and keeping up with the rate of rainfall falling seemed like a mission impossible. “Jim” one of the maintenance techs witnessed and experienced the seemingfutility of our efforts. What can renter’s do when faced with owners or property managers who refuse to respond to urgent or not so urgent requests to protect renters and the property? I have at least a fewpoignant examples as a renter and property manager serving negligent owners. Please be aware I do have a request for mediation with Alta Housing’s VP of property management, through Project Sentinel to discuss my experience further and ask forremuneration. Respectfully, Mary My Adverse Experience as a Renter and Resident Property Manager Re: City Council about Agenda Item 1 on Policy & Services Committee' schedule: city.council@cityofpaloalto.org Dear Members of the Palo Alto City Council: I have been a renter in Palo Alto from the Fall of 1988 through 1997 (mostly married years) and from 2006 - Present. From my adversarial experiences as a renter and a resident property manager in Palo Alto, I think: 1. We need to know more about renters and rental properties right now. This is the first step towards having greater understanding about both of those, the needs therein and how those needs have arisen. The registry helps us build policies that address community needs directly. 2. We would benefit from having a rent registry as a potentially self-funding data source that will monitor compliance and open a direct line of communication with all renters, which is not possible to do without a registry. 3. Question: Why is this personal for you? Does tracking rent increases help you feel more stably housed? Do you know folks who worry about rent increases and evictions in the community? As a renter, I have experienced annual increases and had leases end at the discretion of owners who had other plans for a property where I have lived. If we had a rent registry, renters and city leaders would have strength in numbers and data to support decisions that protect the tenancies, *the residencies*, of residents, and stabilize our communities. In March of 2006, I returned from Lake Tahoe where I went to decompress from 2001-2006 after 10 years of teaching at Stanford and writing for the tech sector. I had managed mountain homes, began lifeguarding again, and wrote for one automotive tech company in Carson City, NV in 2005. In March of 2005, I had an in person interview with the owner of Stanford Gardens, Matt Madison in February of 2005 to manage Stanford Gardens. After 3 months, I became aware Mr. Matt Madison was a convicted felon having laundered HUD money. He said in a phone conversation that I was too honest and you can't teach that (honesty). He wanted me to become a tenant and pay $900 per month while I did not have any other job, but managing Stanford Gardens, an 80+ unit apartment complex on Woodland Ave. So, I declined and left this position after 3 months--essentially homeless, sofa surfing, and networking to find better housing and a job. I was able to share a 2 bedroom apartment with a couple at 314 Grant and later a 3- bedroom apartment at 345 Sheridan with the same couple. In January of 2009, Mr. Harold Hohbach, asked me to manage 345 Sheridan, an 80+ unit apartment complex that he owned. I agreed to manage his portfolio of properties and did so for about 3 months. I was not able to negotiate satisfying terms of service as the resident manager. Mr. Hohbach wanted to only pay me $15 per hour in 2009 and pay $500 per month for the one-bedroom apartment that he had allowed me to move into as the resident manager. There was no certainty about the term of my employment as the resident manager or how high this rent would be increased had I stayed. I also found Mr. Hohback had practices that were not in compliance with certain laws and a notorious dictator style of managing his staff. So, I searched for another resident manager position in Palo Alto and was hired by Mr. Harold Davis to manage at 801 Middlefield in Palo Alto, CA. Mr. Davis owns a real estate sales and management firm at 2225 Showers Drive in Mountain View, CA. Beginning in April of 2009, I agreed to work 40 hours per month and pay half the rent of $1000 per month for a 2 bedroom 2 bathroom apartment. I served Mr. Davis of Palo Alto, CA and the owner, Mr. Dieter Ott of Cologne, Germany for 30 months. During these months, I often worked more than 40 hours per month because there was at least 10 years of deferred maintenance, re-leasing of 6 of the 12 units in the first 3-6 months of starting, and the need to replace a balcony that extended across 3 2-story structures. At the end of 30 months, Mr. Davis chose to have his office manager, Jessica Ayayla, move into my apartment with her husband and their yet to be born child in November of 2011. In hindsight, I should have exercised my rights to stay and exit to have more stability of housing than I did. I once again found myself homeless searching for a sofa or other temporary residence to call home while I find new employment. I did file a wage claim against Mr. Davis. After 17 months in February of 2014, the CA Labor Division in San Jose, CA determined my claim was valid and ordered Mr. Davis to pay what the Labor Division determined was due based on the overpayment of rent. The demands of leasing and maintaining the property kept me too busy to keep a detailed log of my hours. I had a long list of projects, but not a time log. The Labor Division was able to determine by the laws governing resident manager positions that I was overpaying rent by about $500 and based the settlement on the overpayment of rent for 30 months. In 2007, I had put my name on wait lists with Alta Housing, formerly, Palo Alto Housing Corp. In 2014, I received word a studio had opened up at Alma Place. I did not want to move into a living space of less than 300 square feet after living in a place of 1000 sq ft, but did so out of desperation. Last year in May 2021 after much wrangling with Alta Housing to keep my name on a waitlist and negotiate to qualify for a studio at the Curtner Apartments in Palo Alto, CA, I moved into a studio at the Curtner Apartments. When real estate is a commodity, the only folks who win are those who can afford to own. The commoditization of real estate along with the paper means and property management practices by HUD / other non-profits creates significant obstacles between those who have housing with housing with those who need housing. A rent registry is at least one tool to give renters a little more power, some power, to defend against the commodity of housing that ideally should be a human right, like health care and education. The council as do other leaders have the power to change the game, level the playing field, for those of lean means. I hope they seize this opportunity and create a rent registry. According to the Hechinger Report, transfers “represent a large yet hidden share of California’s exclusionarydiscipline, blocking students from attending their own schools and pushing them onto new campuses or into smaller,alternative schools,” creating “the sameproblems associated with expulsion by disrupting a child’s education.” The Equal Justice Society and our partners have, over the past decade, challenged on a systemic basis such useof transfers as harmful, unlawful, and racially discriminatory, including in R.W. v. Thurmond, a lawsuit that alleges that theCalifornia Department of Education and state Superintendent lack accountability for and have failed to take required actions to address raciallydisproportionate transfers and other harmful disciplinary practices in school districts around the state. As the L.A. Times article explains, California’s largest school districts collectively transfer tens of thousands of students involuntarily, or “voluntarily”under pressure to avoid formal expulsion. “Transfers are being used as a backdoor way of removing kids from school,” saidChelsea Helena to the L.A. The county safe streets 4 all plan showed that safety improvements are needed for allroad users. So, how does a highly engaged community end up with a liability, like the Pope Chaucer bridge $25 millionand 25 years later? I know, it's complicated, but what shouldn't be complicated is for the City to handle community engagement vis a vis performance targets or objectives - the objectivesyou were meant to set for priorities. Community engagement for the sake of engagement is wrong. Talking, listening and communicating without an objective, purpose, goal or any measure to track performancewastes people's time, city resources and while it may work for you during your terms (press articles, etc), it's not good for the City over time. For example, maybe you can escape yourtime on council without a change in aviation noise levels and feel good about accepting a work plan that you had nothing to do with which is "engaging the SFO Roundtable on GBAS." Thepublic knows that GBAS is about building navigation route procedures but FAA Air Traffic Control has a different customer service window to address usage of routes. What are you trying to do? Can you explain it? At some point, the question raised is also what are you supposed to be responsible for? You are currently responsible fornot missing the 60 day deadline to file a petition for review on procedures that can negatively affect Palo Alto. Saying we "don't know how GBAS will affect the City'' is not really anoption, the issues are administrative and procedural - you either file or not file and then if it turns out to be bad, it's on you that you failed to meet the 60 days notice. Not having any filters to better understand Council actions over time is a bad risk. I lookforward to following up more on this topic as it relates to airplane noise, but it worries me that this is the way an issue that impacts so many people is handled and I hope you will not takecommunity engagement for granted.
