HomeMy Public PortalAboutr 06:212 ~Zl'Wht±tal1 af ±~B (@hrraug~ üf C!brh~rd, ~t Jt 1',10 fi6-7..12 If Date of Adop¡ioJ1 Jul v 20. 2006 APPROVING THE DESIGNATION OF REDEVELOPMENT AREA BOUNDARIES FOR THE FEDERAL BOULEVARD REDEVELOPMENT AREA-PHASE II WHEREAS, by Resolution No. 06-95, adopted on Marcb 2, 2006, tbe Mayor and Council of the Borough of Carteret ("Borough Council") authorized and directed the Planning Board of the Borough of Carteret (the "Planning Board") to undertake a preliminary investigation to detennine whether those properties listed on Exhibit A thereto ("Delineated Area") meet the criteria set forth in the New Jersey Redevelopment and Housing Law, N.J.S.A. 40A: 12A-l et seq. ("Redevelopment Law"), for being determined to be an "area in need of redevelopment" as therein defined; and WHEREAS, after providing requisite notice, the Planning Board held a hearing on May 24, 2006 to review the results of the preliminary investigation and to solicit public comment on whether the Planning Board should recommend to the Borough Council that the Delineated Area be detennined to be an "area in need of redevelopment"; and WHEREAS, at the public hearing, the Planning Board considered the testimony of and exhibits furnished by Andrew W. Janiw, a license professional planner with Beacon PJanning and Consulting Services, LLC, the author of the Redevelopment Area Assessment Report for the Delineated Area, dated April 2006, and afforded all interested members of the public an opportunity to make inquire into and give testimony concerning the boundaries of the proposed Delineated Area and whether said area should be detem1ined to be a redevelopment area; and 'I , \VHEREAS, the Planning Board, by a Resolution of Findings and Conclusions, memoriaJized on June 28, 2006, has recommended to the Borough Council, pursuant to Section 6 of the Redevelopment Law, that the Delineated Area be determined to be an "area in need of redevelopment", finding that said properties meet at least three (3) of the statutory criteria to be an area considered in need of redevelopment all as set forth in the Assessment Report prepared by Beacon Planning; and WHEREAS, the Borough Council has given due consideration to the recommendation of the Planning Board and further finds that said recommendation to designate the Delineated Area as an Area In Need Of Redevelopment is supported by substantial evidence; and ,I I[ II I Ii ,I Ii II Ii WHEREAS, the Borough Council further concludes that there exits within the Delineated Area sufficient criteria for the designation of a redevelopment area as set forth in N.J.S.A. 40A:12A-5, as more fully described and delineated in the Federal Boulevard Redevelopment Area Assessment Report- Phase II, and as found by the Carteret Planning Board. NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey that the Federal Boulevard Redevelopment Area - Phase II, as depicted on Figure 4, Proposed Redevelopment Area, containing those properties listed on Table 1, Study Area Properties, namely Block 64.02, Lots 1 and 7, as set forth in the above- referenced Beacon Planning Assessment report, dated April 2006, a copy of which is attached hereto and made a part hereof, is a redevelopment area as so defined by N.J.SA 40A: 12A-3. NO _.106-212 PAGE~LZ BE IT FURTHER RESOLVED, that a duly executed copy of this Resolution shall be transmitted to the Commissioner of the New Jersey Department of Community Affairs. BE IT FURTHER RESOLVED, that a copy of the Redevelopment Area Assessment Report shall be kept on file in the Office of the Borough Clerk for public inspection. BE IT FURTHER RESOL VED that duly executed copies of this Resolution shaH be transmitted to the Planning Board and filed in the office of the Borough Clerk. BE IT FURTHER RESOLVED, that the Borough Clerk shall, within ten (10) days hereof, serve notice of the within dctennination upon each person who has filed a written objection thereto and has stated, in or upon the written submi~sion, an address to which notice of the detennination may be sent.
