Tuesday.Juiv 13. 2010 PRESENT: Arnold Henson, Chairman; Judith Bruce, Vice-Chairman; Adrienne Pfluger; James Trainor; Jamie Balliet (Associate Member); and Jennifer Wood, Conservation Administrator. ABSENT: Bob Royce, Steve Phillips (Members) Jim O'Brien (Associate Member) 8:30am Call to Order Request for Determination Nature Conservancy, Town Cove, Pleasant Bay, Cape Cod Bay, The proposed testing for possible sites of eelgrass restoration. Work will occur on Land Under the Ocean. Kate Morrison from the Nature Conservancy said that the project has been narrowed down to one site in Orleans for restoration which is south of Hopkins Island in Town Cove. The area that will be harvested for eel grass to be transplanted is east of the end of Weeset Proprietors Way identified on the June 28th map. Work will be in 3 meter parcels and will occur in late September into early October. There will be a one-year monitoring program to determine if further revegetation projects would be feasible. Judith Bruce asked if the Town Harbor Master had been contacted. Kate Morrison said yes. MOTION: A motion for a Negative Determination was made by Judith Bruce and seconded by James Trainor. VOTE: Unanimous Certificates of Compliance Richard Manqinelli (2008). 93 Tar Kiln Road. COC request for an Order for a new dwelling that only the driveway is within the ACEC and the 100' buffer to a coastal bank. The limit of work is on the 100' buffer line. MOTION: A motion to approve this project was made by Judith Bruce and seconded by Adrienne Pfluger. VOTE: Unanimous Richard Manninelli (1999), 93 Tar Kiln Road. COC request for an Order for a new dwelling that no work was done under this Order. All the work was completed under the Order above. MOTION: A motion to approve this project was made by Judith Bruce and seconded by Adrienne Pfluger. VOTE: Unanimous Frank and Virqinia Middleton. 126 Skaket Beach Road. COC request for an Order to take down the existing dwelling and build,a new one on the northern section of the lot and to also build a new dwelling on the southern portion of the lot. Only the new dwelling on the southern portion of the lot has been built. An as- built has been submitted to show air conditioning units, changes to the driveway, steps, and entranceway overhangs. The 50' buffer to the salt marsh that was a condition on the Order has not been allowed to naturalize. The existing drive to the dwelling on the north has not been moved and revegetated. Arnold Henson stated they have not complied with the conditions previously set forth. Judith Bruce clarified that they have only completed part of the Order and have not done any of the mitigation. The Commission asked to hold the request for mitigation. Harry Hunt III (Kennedy) (2002) 40 Tom's Hollow Road. Request for a COC for an Order of Conditions for a Planting Plan that was requested under an Enforcement Order. When last requested a non-native willow had been planted in the resource area. The willow has been removed. Even though the planting plan was not followed there is a good cover of native trees and shrubs at the site. See Bond Release below. MOTION: A motion to approve this project was made by Judith Bruce and seconded by James Trainor. VOTE: Unanimous Request to Release Bond Harry Hunt 2002, 40 Tom's Hollow Road A request to release the $7,000 bond that was held for restoration of a disturbed area. See COC request above. MOTION: A motion to approve this project was made by Judith Bruce and seconded by Adrienne Pfluger. VOTE: Unanimous Administrative Reviews Athanassiou/Mcnett 31 Loomis Road. Request to prune several branches on two trees in a view right of way for the neighbor. These trees are near the road on the landward side of the house. Most of this property'is within the buffer to a salt marsh. MOTION: A motion to approve this project was made by Jamie Balliet and seconded by Adrienne Pfluger. VOTE: Unanimous Town of Orleans Skaket Beach Road. Request to treat grapevine on Town property near the Captain Linnell House. Work by Wilkinson Ecological Design. MOTION: A motion to approve this project was made by Jamie Balliet and seconded by Judith Bruce. VOTE: Unanimous Erica and Fred Parra 60 Payson.Lane. Request to flush cut and remove 22 trees on a coastal bank. This bank has large areas of sliding sand. Some of these trees have gone over and are on the beach. Some of these trees appear stable. These trees are red cedars except for 3 black cherries and an oak. Work by Wilkinson Ecological Design. Erin Hilley from Wilkinson Ecological Design explained that the owners wanted to allow the bank to erode naturally, and flush cutting said trees would slow it down. Jenny Wood expressed her concern that many of the proposed trees were stable and living trees would hold the bank better than stumps with dead roots. Arnold Henson said this is a lot of work to be filed under an AR. James Trainor expressed interest in seeing the site. Judith Bruce agreed and said the owners should be encouraged in their plan to leave the bank natural. This application was held for more information and a reduction in the scope of the project. Tunnev Lee 114 Baker's Pond Road. Request to install an awning window 24" x 24"within 50' to Baker's Pond. Work by Rich Goldberg. MOTION: A motion to approve this project was made by Adrienne Pfluger and seconded by Judith Bruce. VOTE: Unanimous Robert Parry 11 gerry Hollow Road. Request to build a 14' x 12' addition greater than 75' from the top of the coastal bank and outside the ACEC on a flat lawn area. Under zoning regulations the addition must be connected to the garage with a walkway. Robert Parry, the owner, was present. Judith Bruce questioned if an N01 had to be filed because the building is larger than 8'x10'. MOTION: A motion to approve this project was made by Judith Bruce and seconded by James Trainor. VOTE: Unanimous Michael Jones 32 Shore View Road. Request to remove two dead trees a cedar and a cherry. These trees are within the buffer to freshwater wetlands. Work by Bartlett Tree Experts. MOTION: A motion to approve this project was made by Jamie Balliet and seconded by Judith Bruce. VOTE: Unanimous Jean Elmore 23A South Orleans Road. Request to remove limbs off of two red maples that are going over the dwelling and to remove a dead cedar on the landward side of the house by the garage. Work by Bartlett Tree Experts. MOTION: A motion to approve this project was made by Judith Bruce and seconded by Jamie Balliet. VOTE: Unanimous Barbara Barnette 66 Tides End Lane. Request to reshingle the exterior walls on the east end of the house next to the top of a coastal bank by the flood elevation. Work by Tom Hughes. MOTION: A motion to approve this project was made by Jamie Balliet and seconded by Adrienne Pfluger. VOTE: Unanimous Rob and Sally Low 165 South Orleans Road. Request to build a retaining wall within 10' of Crystal Lake on an unstable bank to support a path to Crystal Lake. The design of the wall was not submitted. This application was held for more information on the design of the stairs and erosion control. Helen Pettit 19 Kettle Pond Road. Request to remove an oak tree very close to Kettle Pond. There is little buffer to this pond. Work by S&L Tree Company. Arnold Henson questioned if this removal was to expand the viewing area for the property. Jenny Wood said there are two large red maples between the house and the pond so that there will be no increase in the view. The lawn area between the house and the pond is not fertilized. MOTION: A motion to approve this project was made by Judith Bruce and seconded by James Trainor.
