Hello Mr. Fisk, I've been in contact with Dr. Ehrentraut and others regarding investigations of 2008 relating toMarkham Plaza Apartments in San Jose & the Santa Clara County Public Guardian. One of deputy public guardian's involved was Rhondi Opheim. Her siister, Robin Opheim wasassistant city auditor and worked directly with Lisa Herrick. The Public Defender's office was wellaware of this and so was the District Attorney's office and there is Case # with DA and federalagencies were also involved. One of the investigators under Marti Oakley claims one of theattorneys is also a witness & believes that Lisa Herrick knew this & kept it secret. The attorney alsohad responsibility to speak up but did not. ( or there is no record of this ) - Also, Former JudgeMary Anne Grilli is under investigation also as she appears to be tied to fraudulent constructioncompany contract and "Home First" , a non profit organization. Mary Ann Grilli sent letter to HeidiYauman in 2008 relating to these investigations. An individual arrested in London may be tied toMary Anne Grilli and Lary Kubo and police in England tracked this individual knowing of relation toinvestigation in the United States. Lisa Herrick and Sunnyvale Police Chief are both believed to be involved in missing $6,000,000 inAudit of Emergency Housing Consortium in 2006. Emergency Housing Consortium is same nonprofit as Home First under different name. The property management was overseen by "Ky Le" ,who later worked for office of supportive housing , controlling funds from US Department of UrbanDevelopment. In November of 2020, County Officials and Sunnyvale Police Department kicked us out of theVagabond Inn which was paid for by FEMA through project homekey. The same week that Ky Lebecame deputy county executive, there was a change of security companies & both used samesystem called "Silver Track" the records of the two comanies do not appear to be consistant withone another. Chris Welsh, the attorney who was supposed to represent me is aware & he was hand picked byLisa Herrick & IDO & will not allow any evidence that they decide contradicts the false andfraudulent narative that they created. Gary Goodman has also been caught & so has Molly O'Neilas they have looked into the timing and circumstances of her placement as PDO & the MarkhamPlaza Attacks are believed to be closely tied to George Shirakawa who was president of Board ofSupervisors. Markham Plaza Apartment's was in his district & happened during same time period. I do not hold you responsible or anyone from your office. The false police report by detective david carroll was reviewed by Sheriff Captain RicardoUrena, head of Count Security for all court locations in County. ?Urena worked directlywith Lisa Herrick, Presiding Judge and CEO. The Fake eviction was on 10/03/2012 and on 10/18/2012, Lisa Herrick was namedGeneral Counsel for the court. The false police report by detective david carroll misreprents the fraud by Robert Ridgewayand his failure to produce video that he claimed existed. The video did not exist. Underthe supervision of Lisa Herrick and Ricardo Urena, Carroll's false police report fraudulentlyprocured juridstiction claiming that Ridgeway's fraud was part of his duties as police officer& connected his wife: Aleksandra Ridgeway - making it appear as if Ken Ditkowski haddecided there was some law enabling her to testify in court to something she neverwitnessed. Detective Carroll omitted references to Public Guardian , Whistleblower complaintregarding County Counsel attorney Larry Kubo, etc. The court had no business assigning public defender in 2014 & Lisa Herrick new that thiswas conflict of interest. One of the reasons is because public defender George Abel wasassigned to "represent" Heid Yauman in coresponding probate court matters. it is obvious that the Sheriff dept & Public Defender were in collusion with each otherbecause both agencies were aware of the investigations referenced in eviction.pdf, yetthey dodged out of involvement with these things & both insisted that it had nothing to dowith Public Guardian. Lisa Herrick of course also knew & her double role as assistant city attorney and generalcounsel for the court is of huge significance that was illegaly concealed & it is obvious thatLisa Herrick abused her office for personal gain and that court officials were well aware ofthis. As you can also see, The civil grand jury investigation report refenced internet searches,yet failed to reference public guardian related banners that were highest ranking in searchengines. Attatched is document regarding Human Relations committee investigation intoGrand Jury with testimony that prosecutor directed grand jury members to disregardtestimony from certain individuals. The current "case" is a bogus domestic violance charge. I was helping Heidi who washaving medical issues not overdose on aspirin by making sure she did not overdose. islapped table in Starbucks to get her attention as she was having massive panic / anxietyattack. I did exactly what I needed to do. The MC-410 speaks volumes & the court & Lisa Herrick are responsible for inflicting theseinjuries on Heidi. There is no way in hell they can claim to have no conflict. Additionaly, County Social Workers: Robert Rocco, Peggy Chou and others falsified publicrecords in collusion with Sunjnyvale Police Department illegaly kiucking us out of VagabondInn Hotel which was paid for by Federal Funding out of Project Room Key. As Heidi's advocate, I redressed these grievances as I was supposed to do & as my rightand Heidi's under U.S. Constitution. Because I/ had redressed these grievances, SocialWorker Peggy Chou filed document claiming that Heidi Yauman was banned frokmrecieving services until December, 2025. Peggy Chou committed felony and must beprosecuted. She misreprespresented my valid expression of first amendmant rights anndclaimed it was "harassing emails" - She has failed to follow through with her requirementto produce evidence backing these claims. Just as Robert Ridgeway could not back hisclaims. ( See attached MC 410 Yaumandocument ). This caused Heidi Yauman's condition to worsen & when I was arrested by Palo AltoPolice on Donestic violence charge,. I was actually tending to her medical conditioninvolving injuries caused by the court , sheriff dept , etc. In 2013 & 2014,. As you can see by the evictiondocument, that this was not the case. A deputy Public defender named George Abelwas working corresponding probate court case , and therefore , it was conflict ofinterest to assign Jeff Dunn public defender to represent me in case C1493022. JeffDunn ,. ADA James Leonard , and court railroaded me. Any doubt that there was no foul play or conflict of interest can be dismissed bysimply comparing the false police report and eviction document. The false police report was reviewed by Sheriff Captain Ricardo Urena ,. who at the time,. was headof Court Security and reported directly to the Presiding Judge. The presiding Judgeis responsible for overseeing all activities and case in the court and the problemswith this are obvious. Additionally they had no reason for responding to situation inarea jurisdiction of San Jose where Ridgeway was residing and the falsified Policereport failed to show any court security related issues or anything regarding any"duties of law enforcement" , as adopted by fake narrative are dismissed asdelirious nonsense and lies in order for "court officials" to evade responsibility andliability. The fact that the false report was overseen by Presiding Judge demonstrates that itwas the Court itself that levied the fake charges and invented the fake theme about"Law enforcement duties" and other lies and distortions. No judge within Santa Clara county can be expected to act without BIAS favoringDetective Carroll and the other who stalked and terrorized us and threatened us tonot speak about the crimes. My false arrest on case C1494032 occured on September 16th, 2014. It is nocoincidence that one week later,. Donald Moody was escorted from his office bysecurity. Donald Moody was Public Guardian and named as Co-Defendent in case112cv236958. I appeared as witness. Not defendant. West Valley division , which holds jurisdiction over theunincorporated communities of Cupertino, Los Altos Hills and Saratoga I was railroaded also on fake felony charges and arrested on Christmas 2015.Deputy Public Defender Gary Goodman hijacked that case which led me to berailroaded and sent to prison on fake charges. Although I had exercised poorjudgement in an email sent out of pain from the horror we were put through,. Itwas ultimately Gary Goodman's fault because of his incompetent legalrepresentation in C1493022. Despite the fact that Ridgeway could never present the *video". that he lied about& I was living in Palo Alto, not San Jose,. Goodman pulled a fake PC 1368 whichdefrauded me of my right to speedy trial. I refused to change my position and Istuck to the facts and would not adopt his false narrative. Goodman falsified recordthat fake video existed and fabricated mental health conditions. Gary Goodman is aliar. He declared conflict of interest when proceedings were finally renewed. Publicdefender should never had been involved and they refused to address the issuesthat I brought fourth . The fraud and conflicts are obvious and self evident toanyone who reviews the documents. There is no excuse to not see these problemsand the most basic fundamental responsibilities like assigning an investigator wereignored. Document is attached showing that this is not the first time that Mental healthissues were fabricates Ito skew Civil Grand Jury investigation.I do not have mental health problem not did I at trial. Even if not for the fraud on & by the court and the conflicts of interest and theinjuries , etc. The DV case would still have to be dismissed due to fact that timelimit for speedy trial has now been exceeded. If your records to not adequately reflect this fact,. please check with court & ChrisWelsh should verify to you that the time Waiver was dropped & case now mustlegally be dismissed. If Chris Welsh failed to notify the court and / or the court failed to register thisfact,. that is not my fault & blame can not justifiably be placed on my shoulders. I am reluctant to comment on any budget detail since I am far removed from drivers of city revenues and expenses. You don't need more details from relatively uninformed citizens like me at this late date. If more informed citizens step forward, listen to them. I am more confident that I can comment constructively at the macro level. #1 Gather as much direct information as possible from informed local leaders. Assess their opinion about city revenues and expenses. What are hotels/merchants/restaurants anticipating? What are the economic and social pressures on your friends and neighbors? What are local assumptions about localemployment? Who has access to professionally compiled economic data? Palo Alto is located in an exceptionally optimistic region but it is not immune from macro- economics. #2 Listen to but don't blindly follow leaders in state government. Pray that their staff and professional advisors have better data than local government. #3 Question city staff again and challenge their revenue and expense projections. Iwould like to see stronger consensus among the Council as it accepts so many variances from staff budget recommendations. Every variance from staff projections may compound accumulated risk. Finally, my personal bias. I am by age less willing to accept staff and council budgeting without assessing pressures on state government. Flux is greatest at the national/state levels and then improves locally to the fortunate citizens of Palo Alto. Nevertheless, our city is very dependent upon state budget stability. Our local expertise, the often-cited bubble, is our greatest asset and risk. Seven members of the Council have the task of anticipating the future wisely. PS Here is an excerpt from this morning's CalMatters morning newsletter. Also below is a link to the state budget analyst. "Budget alarm bells: The nonpartisan Legislative Analyst’s Office is warning legislators against spending more. In its multiyear budget outlook published Tuesday, the office estimates that the 2023-24 budget deficit is more like $34.5 billion than the $31.5 billion projected in Gov. Gavin Newsom’s May plan. And to cover that shortfall, the office recommends that the Legislature further cut one-time spending it added in 2021-23 from $11 billion to $4 billion and eliminate it entirely going forward. Looking further out, the analyst warns that it is “very unlikely” that state revenues will support the spending proposed by Newsom — revenues would need to be $30 billion more than forecast to cover the deficit in 2024- 25. And because reserves would cover less than half the projected deficits, the rest would have to come from cuts in one-time spending, plus other spending trims or revenue increases, according to the analysis. The Legislature must pass a budget by June 15, and the governor must sign it by June 30." We are currently in occupied East Jerusalem/Al-Quds, where we have been for the last week. On May 18th, we witnessed the Jerusalem Day Flag March, a yearly event where tens of thousands of far-right Israeli Jews descend upon the old city ofJerusalem in a horrific display of ethnocentrism, nationalism, and colonialism. I spent the day with one of CJNV’s movement partners, Khalil, from Grassroots Al-Quds. The day of the march begins with what is called ‘sterilization’, where police violently clear Palestinian residents from public space in order to make way for the march.This removal begins at Damascus gate, which is not only an entrance to the old city, but also one of the few spaces where the Palestinian community is able to gather together and socialize. At this gate, 20 Palestinians were brutally murdered by the ZionistIrgun militia in a barrel bomb attack 1947. Despite its painful history, it is still a place for children to play, friends to meet for coffee, and teens to make TikTok videos. But today the square is filled with young men waving Israeli flags. We walked into the old city from the gate and watched as all the Palestinian businesses closed up their shops for the day. Despitetheir entire livelihood coming from these stores, the threat of settlers destroying their goods and storefront and terrorizing the shopkeepers is enough to prompt them to sacrifice their livelihood for a day. These closings also meant that any of the Palestiniansstuck in their quarters were unable to buy anything they might need during the day. The few Israeli businesses in the Muslim quarter remained open. They sold water and snacks all day while blaring nationalist music in Hebrew, benefitting greatly from theclosure of all Palestinian businesses. Even before the march officially started, young settlers were running through the Arab quarter of the old city, saying chants like “may your village burn” and waving Israeli flags in the faces of those Palestinians cordonedoff by the army. Yet, Khalil was not fazed by this. It is his everyday reality. He tookus to the neighbourhood where he grew up. Yet again, all the businesses were closed, but every person we passed stopped to greet and hug Khalil. They spoke about the day and rumours of what was expected. Khalil’s friends greeted us, a visibly Jewishgroup, with love and kindness and shared stories of growing up in the neighbourhood. A short while later, we came upon some young Israeli settlers running through the street and attempting to destroy Palestinian businesses (with police escorts). They bashed in metal shop doors and pushed over everything they could. We watched as they threwstones into the one shop that was open, breaking the glass door and the clay tiles below, all the while shouting insults in Hebrew. The shop owner was furious and went to chase after the boys, but two of his friends stopped him. The police who had safely allowed the boys to destroy his shop would surely arrest him for any sort of self-defence. The young boys took this opportunity to comeback and mock the shop wonder, asking in Hebrew if everything was alright and if he had a problem. Their raucous laughter echoed through the street as Israeli police and army escorted them away from us. We left the old city to check on how the members of the neighbourhoods in East Jerusalem were managing. Many of theresidents were on the street, arguing and resisting as the police and border guards forced them further and further out of their own street. Despite having very little movement on a regular day, today Palestinians could not even walk on their own streets. We asinternationals however were able to walk right through the police cordons. No one questioned our movements. We reached a second barricade and went through again with ease, but this time, Khalil was unable to walk through with us. His darker skin was enoughfor the police to decide he was an undesirable. We continued on to witness the march, walking freely in between all the checkpoints that prevented those who lived there from passing. We walked back to Damascus gate, now filled with thousands upon thousandsof settlers. The few Palestinians left in the area were pushed, harassed, and had things thrown at them as the police and army looked on. At one point, Israel’s fascist Minister of National Security, Itamar Ben-Gvir, came out to greet the crowd with anescort of over 20 soldiers. He was greeted with chants of “here comes our next Prime Minister”. Surrounded by armed guards and fervent settlers, I was struck by how safe I felt. My white skin, Ashkenazi features, and English tongue allowed me to avoid the anger of the settlers and all of the armed guards. I walked in and out of the march, in and out of theold city, and in and out of East Jerusalem with ease, while Khalil, who’s family has lived here long before Israel even existed, was forced to remain at our hotel until the police decided otherwise. I’m too young to have lived through South African apartheid orJim Crow segregation. These are things of the past that I learned about in history books. But in the three days I’ve spent in Jerusalem/Al-Quds, I’ve seen with my own eyes what it means to live under apartheid. Photo: Emily Glick) In Canada we have systemic racism, but most Canadians whoexhibit racist behaviour would be ashamed to be called a racist. In Israel, this settler-colonial racism is a point of pride. It is celebrated by Israelis. It is admired by police forces from around the world. At times I need to pinch myself to remind myself that Iam not in a science-fiction movie, but in an actual, modern day country. A country specifically created in my name. Apartheid is not history, it is the lived reality of every Palestinian seeking to hold on to their homeland. It is an extensive and intricate systemof policies, practices, surveillance and brutal repression that is practiced every minute of every day. It is the uncertainty Palestinians feel in whether their water, electricity, and roads will be cut off tomorrow. It is the banning of the Palestinian flag in thevery place it should be flown the most. My first night here, I broke down in tears. My heart ached for thethings I had seen that day. I thought of my Palestinian comrades in Toronto; how proud they are of their culture. How much they wished for nothing more than to return to their homeland. I wept for the people of Palestine. I wept for the cruelty of Jewishsupremacy and the ways my religion, which has always taught me the importance of Tikkun Olam (“repairing the world”), has been weaponized for this brutal land theft. I wept for those who have lost their lives and lives of loved ones for this project. I have neverimagined that I could witness such injustice with my own eyes. But this is the reality that the Palestinian people face every day. Palestinians talk about existence as resistance. I felt this concept so strongly in my travels with Khalil. Everywhere we went, Palestinians gathered to laugh, chat, and drink the best coffee I’ve ever experienced. There was dancing and singing and childrenplaying in the street. These moments of joy and community were interspersed with tense aggression between the community and the settlers seeking to harass them, but even the small children could instantly move from extreme trauma back to their soccergame. In a place where the government is doing everything it can toseparate Palestinians from their homes, they remain. Glass panes are repaired. Graffiti is painted over. Life continues on. Because it must. Palestinian culture has a value of sumud, or steadfastness. This is a value that Palestinians live every moment, both here andin the diaspora. There is no other way but to remain steadfast. I am in awe of the Palestinian people and how strongly they resist this daily injustice. The way they find joy and community in a world that literally does not want them to exist is truly aweinspiring. They believe a free Palestine will come, and that hope and sumud inspires me to fight even stronger back home. Thanks for reading my dispatch from occupied Palestine. As mentioned during our presentation earlier this week, Thursday marked an important deadline for fiscal bills with the Appropriations Suspense File Hearings. The Suspense file is essentially an accumulation of bills that have passed throughtheir policy committee process for assessment of their fiscal impact to ensure their draw on state resources isn’t unbudgeted or duplicative of existing efforts. The first suspense hearings of a legislative session happen in May, when lawmakers and their staff have a better idea of the budgetpicture for that year. Given the recent budget projections of an increasing budget deficit totaling $31.5 billion, lawmakers exercised prudence in moving forward bills with big price tags. Of the 755 bills considered during the Assembly Appropriations Committee’s Suspense File hearing, 534 passed (71%), and 221 were held and deemed inactive for the remainder of the Session (29%). Similarly, the Senate Appropriations Committee’s Suspense File Agenda featured 416 totalbills – 326 of which were passed (78%), and 90 that were held and deemed inactive (22%). This Appropriations Committee Suspense File process has impacted the progress of two of the priority bills the City has taken a position on: 1. SB 719 (Becker) which would have required the de-encryption of police radio channels, was made into a 2-year bill by the author. It may be acted upon January 2024. The City is in support of this measure. 2. SB 634 (Becker) which would have expanded the by-right approval of low-barrier navigation centers, was held in the Appropriations Committee and will not progress. The Council moved to support this measure on May 15. Additionally, there are some new developments on two additional pieces of legislation: 1. SB 572 (Stern) was just amended to require the California Public Utilities Commission (CPUC) to submit a report to the Legislature, by February 1, 2024, on the status, outcomes, and recommendations of the Federal Energy Regulatory Commission’s (FERC) investigation into natural gas prices during winter 2022-23.Given that this directly aligns with Council action on the matter, TPA is providing a draft letter of support for the City to move forward with. We have circled in with the Author’s office this week to discuss the City’s actions on high natural gas prices and its unique position as full suiteutilities provider. 2. AB 1469 (Kalra) authorizes Valley Water to take action to assist homeless individuals living within the District’s jurisdiction. This could be in the form of a contract with the city, and general waste cleanup and supportive services provided by the District to protect water quality and mitigate homelessnesswithin the region. Ultimately, this bill provides additional regional coordination and support for homeless individuals within Valley Water’s jurisdiction, at no cost to the City. We circled in with the Assembly Member and Valley Water representatives this week on the bill, and both noted that it would be great tosee the City supportive of the measure.This bill aligns with two of the City’s policy priority statements, including support for policies and collaboration that improves watershed quality for the San Francisquito Creek, and support for homeless supportive services. As a community member concerned about animals and animalwelfare, I write to urge the City of Palo Alto to include in its Pets in Need (PIN) contract a provision for TNR of feral cats. I’ve lost count of how many feral cats I have TNR’d over theyears and I like to think that due to my efforts (not to mention personal cost in time and money), there are a lot fewer feral cats in our neighborhoods, thereby preventing further cyclesof more cats being born and reducing predation of birds. There are actually very few truly feral cats in Palo Alto. Most outdoor cats are either owned or fed as “backyard” cats by residents. Volunteers and city residents get these cats spayed andneutered, at no cost to the city. Where TNR is banned, nobody wants to trap because they know the cats will be killed at the shelter. The result is unfixed cats reproducing rapidly, anoutcome that no one wants—not the cat rescuers, not the Audubon members, not the citizens of Palo Alto. Banning TNR would basically endorse a policy of killing healthy animals. While the Audubon Society would like to eliminate outdoor cats, that effort is futile. Estimatesare that at least half of all cats seen outside are pets not ferals. Per Brian Kortis, Program Manager, PetSmart Charities, Phoenix, AZ, “When [outdoor] cat populations are present, thechoice is not between having cats or not having cats. The choice is between having a managed community cat population (i.e., through TNR) or an unmanaged one.” TNR has been the nationally recognized means of addressing free-roaming cats for decades.Stanford University, Peninsula Humane Society, Humane Society Silicon Valley, San Jose Animal Care, all have successful TNR programs. Dear Mayor Kou, City Council Members, and Professional Staff: I know this item is on Consent and is the Second Reading of another Ordinance Adoption but I need to voice my concerns. We have been members of the downtown for +130 years and care deeply about its healthy and well-being for all. You need to know that frustration is boiling within the retail community of our beloved Downtown because of your continued push to “change the game” over and over and over again without any apparent knowledge-based objective. Your actions over the past 3 years have done little to support our retail marketplace. But for a few food service companies who have benefited beyond belief and are doing well, you continue to invest a tremendous amount of valuable staff time to “rearrange the chairs” of our struggling retail districts. In the past 3 years you have adopted 6 (including this one) ordinances that modify how retail is conducted in our Downtown. This is in addition to the many other Resolutions effecting the same businesses. This means the goal posts are moved every 6 months on average. All the while, the rules you establish are rarely followed as enforcement is non-existent. No business can feel comfortable operating in such an environment. What has resulted are poorly executed (haphazard some would say) parklets that rarely comply with building codes and certainly do not represent a thoughtful cohesive design philosophy with retail district centric objectives at their core. Frankly most are not even safe and are not even clean. Yet you chose to support this through continued waiving of objective building codes and rules. Why waiving all City fees, bypassing long established Architectural Reviews, and creating instability for the retail environment is a big part of this Ordinance confounds us all. I have heard arguments from the dais that the building codes need not apply to retailers’ parklets, that minimum standards for electrical safety and state mandated bathroom counts do not need to be enforced. It looks like Palo Alto thinks it is in a race to the bottom of Peninsula cities retail districts. Please realize that you’ve already won. Charge fees for parklet applications and be sure to charge enough that you can staff appropriate plan review, inspections, and enforcement to protect the overall marketplace. The “emergency” for food service is past us. We now need to move forward with sane permanent rules and significantly improved zoning for all retail. You fail to appreciate that retailers (like all businesses) need the government to establish the rules (which are hopefully supportive of their success) and then stop and get out of the way. Palo Alto does the opposite. You have changed the rules every few months. The result of your “work” is the creation of the most unstable environment for business on the Peninsula. You all have chosen to not listen to those with the most experience. A couple of you have decided to demonize property owners – many of whom in Palo Alto have been an integral part of Palo Alto’s successes for many decades and even centuries. The same seem to think they are retail experts, with wisdom as to when building codes should be enforced, and what the path is for a new vibrant retail core. Sadly, no council person is and those with expertise are dismissed. [BTW – no one expects you to be the experts. You are expected to listen to the experts and be guided by them (both staff and 3rd parties).] When the consultants and professional staff you have hired speak in council chambers they are often chided and given direction – not what should be happening. You have created chaos in our little market and then think that property owners are to blame for the growing vacancies. This is completely absurd. Property owners can only rent to retailers who make an independent decision that the location is worthy of their significant investment of capital and time. Rent is a two-way negotiation and just one component in the overall business decision just as are the condition of the property, free rent, tenant improvement allowances, brokerage fees, security deposit, the tenants’ work experience and credit worthiness, the term of the lease, options to renew, etc. Case and point – when a retailer, or her broker, call to inquire about opening a store and want a quick explanation of what the City’s rules are regarding street parking in front of the vacant space, the answer is that the Council has loudly been saying that all parking is “its” real estate and any parking space may be converted to other uses and even may be auctioned to the highest bidder for use by another business is unsettling. Additionally all public parking is subject to the whims of the Council and Staff as it may be removed and allowed to be a different use for another retailer. No certainty anywhere. PLEASE stop the Ordinance merry-go-round. Our Downtown does not need ANOTHER interim ordinance. Simply enforce your existing parklet rules and focus on Cleanliness and Safety until a serious and thoughtful evolved zoning ordinance with the support of all constituents can be implemented.
