Dear Mayor Kou and City Council Members, As a resident of GreenAcres 1, I am disturbed to hear that Terman Park, our neighborhood park, is once again being considered as an item the City can use to exchange for schooldistrict property at Cubberley......and all this is being done essentially behind closed doors, behind our backs......without even bringing the adjacent neighborhoods into the discussion.This doesn't sit at all well with residents of our GreenAcres 1 neighborhood. Terman Park, as a City park, is important to us from many aspects. We have a right to have a voice.Before there are any further talks, kindly extend an invitation to our neighborhood and to other concerned neighborhoods nearby to join in the discussion. We have a right to beincluded. Terman Park was established by voter approval. It can't just be taken away. I thought that the Commission'srole included making recommendations to the Council on EIRs. Sea Level Rise seems to be addressed in the Addendum only withlevees, but does not discuss the alternatives of (1) notbuilding new projects in the affected areas and (2) removinguses to areas not affected by sea level rise. I don't see any distinction in the Addendum between sea levelrise and rising water table. The Sea Level Rise AdaptationStudy also seems to be focused on intrusion from rising sealevels, but silent about intrusion from rising ground water. JUNE 5, 2023 CITY COUNCIL MEETING, AGENDA ITEM #11237 SAN ANTONIO ROAD I urge you to remove this item from your agenda, because thesubject proposal and site is a segment and alternative locationof the Purified Water Project proposed by the Santa ClaraValley Water District (Valley Water) for which Valley Water hasinitiated the process for preparing an Environmental ImpactReport (EIR) by filing and posting a Notice of Preparation(NOP) of an EIR. Comments on the project or any of its segments need to be madein accordance with regulations of the California EnviromentalQuality Act (CEQA). The City of Palo Alto cannot violate CEQA Regulations by simplyamending its zoning ordinance (Title 18 of the Palo AltoMunicipal Code) to say that its procedures are in addition tothe CEQA Regulations and that if Palo Alto's proceduresconflict with CEQA Regulations, that Palo Alto proceduresprevail. CEQA Regulations for the EIR process provide four opportunitiesfor the City Council to comment about a proposed project. First, during the 30-day period following the posting of theNOP, which Council could have done if staff had placed thesubject on Council's agenda during that time period, but staffdid not place the item on Council's agenda. Second, following the publication of the Draft EIR for theproject, but that document has not been completed, and the onlycomments about the EIR from Valley Water are about when itexpects to issue the Final EIR, but Valley Water has beensilent about its schedule for issuing the Draft EIR. Third, when the Final EIR is published. Fourth, if and when project approval and EIR certification havetaken place and 1237 San Antonio Road or some other site inPalo Alto is selected as part of the approved CEQA project. The NOP for Valley Water's Purified Water Project identifiedthe preferred Project for a new advanced water purificationfacility (AWPF) as a site in San Jose adjacent to the existingSilicon Valley Advanced Water Purification Center, andidentified the former Los Altos Treatment Plant site at 1237San Antonio Road as an alternative site to be evaluated in theEIR. Despite the fact that the NOP identifies 1237 San Antonio Roadas an alternative to the preferred site, actions by Valley Water and the City of Palo Alto after the circulation of theNOP and before the circulation of the Draft EIR assume that1237 San Antonio Road has already been chosen as the projectsite as the following chronology indicates: December 1, 2021: Valley Water's Recycled Water Committeerecommended that Valley Water approve 1237 San Antonio as thelocation. December 14, 2021: Valley Water's Board of Directors approvedthe Committee's recommendation and directed its staff tofinalize agreements with Palo Alto to locate the Advanced WaterTreatment Facility at 1237 San Antonio Road February 28, 2022: Palo Alto City Council study session on theproject that includes 1237 San Antonio Road as the site andincludes a timeline in the staff report for that meeting thatincludes the initiation of a Comprehensive Plan amendment andparcel subdivision prior to the issuing of the Final EIR, butdoes not include the Draft EIR in the timeline. April 10, 2023: Palo Alto City Council approves fundingagreement with Valley Water for the 1237 San Antonio Road site. All of the above, including the item on this Council meeting'sagenda provide substantial evidence that Valley Water haschosen 1237 San Antonio Road as the site before the Draft EIRhas been circulated and that Palo Alto has agreed to that sitebefore Valley Water has certified the Final EIR and approved aproject that locates a segment of the project at 1237 SanAntonio Road. The pattern of actions described above constitutes aprejudicial abuse of discretion and a violation of CEQA. Therefore, I urge to remove this item from you agenda. Whatother big home insurance Cos. might pull out of California? A bunch of them have pulled out of Florida due to hurricanes. Or gone BK. Newsom has hired some more fire fighters with some more trucks. I have long urged thedeployment of 50 747 tankers like the Global Supertanker we had in California a few years ago. It can carry 19,000 of water/retardant. That one was from Colorado and they went BK. Sonow we are down to one DC-10 and smaller aircraft. Fifty 747s might cost $100 million each to buy and convert. So $5 bllion. I suggest that a consortium of California, Oregon, Washington, Idaho, Montana, Wyoming, Colorado, NMand maybe Australia be formed to buy and operate these. All of those get big wild fires now but usually not at the same time. Diane Feinstein got 6 or 7 old planes from the Coast Guard for California fire fighting.Each can carry 6,000 gal. of water/retardant per flight. We need 50 747s at 19,000 gal each. Gov. Newsom just never has much to say about the endless, horrific wild fires in California that destroy hundreds of homes every year. Now that State Farm has stopped issuing newpolicies on homes in California as a result, maybe he will consider upping the game wrt how we fight wild fires. Those around him should tell him that he looks, and is, totally out of touchon this issue. What is so repellant about a multi-state consortium in the West to buy the 50 747s that could put a big dent in the destruction caused by these annual wild fires? States can'tco-operate like that? That is part of their job. Maybe we need the feds to force such co- operation. Where is Congress and Biden on this? All of this is not to even mention the health impact of 40 million Californians breathingwild fire smoke for months every year. Dr. Jon LaPook on CBS said once that this smoke contains 5,000 compounds as it burns through communities. You have to know that thatincludes a few carcinogens. My favorite outcome is fibrosis of the lungs. They become stiff like leather and the victim can't get air. I remember the day that passed in 1988, the same day the 747 was bombed out of the sky over Lockerbie, Scotland. This spring I took the tour of the Valley Water water purification system and was very impressed with the level of purification of the water they receive. I drank some of the purified water they got from the Orange County facility as Valley Water was still in the process of getting their water approved. I need we need to support all the options for water reuse and this is a good one that’s well-tested. ( or there is no record of this ) - Also, Former Judge Mary Anne Grilli is under investigation also as she appears to be tied to fraudulent construction company contract and "Home First" , a non profit organization. Mary Ann Grilli sent letter to Heidi Yauman in 2008 relating to these investigations. An individual arrested in London may be tied to Mary Anne Grilli and Lary Kubo and police in England tracked this individual knowing of relation to investigation in the United States. Lisa Herrick and Sunnyvale Police Chief are both believed to be involved in missing $6,000,000 in Audit of Emergency Housing Consortium in 2006. Emergency Housing Consortium is same non profit as Home First under different name. Dear Mayor Kou and Members of the Council: I want to thank you for keeping the animal shelter located in Palo Alto. You might recall the public outcry in 2012 when the city manager proposed closing the shelter doors. I am writing in support of Trap/Neuter/Return (TNR). 1. This is a proven method of cat population control, endorsed by the major humane organizations, and attested to by the success of the project on the Stanford campus. At Stanford, the cat population was controlled through spay/neuter and care, and a population of at least 1500 cats was reduced to a current handful. Stanford’s TNR program became an international model for the control of cat numbers. 2. Please know that feeding feral cats in city parks and in the Baylands was prohibited by Palo Alto in 1996: City Code 22.04.270 “Flora, fauna, feeding of wildlife.” Cat rescuers back then worked with Daren Anderson of the City Community Services to draft this regulation in a mutual effort to protect these wildlife and bird sensitive places. 3. In my years as Executive Director of the Palo Alto Humane Society, I witnessed the local Audubon people trying to scare city councils up and down the Peninsula with their anti-cat rhetoric. What they do not tell you is that Audubon actually partners with TNR groups (such as in New Jersey and in Portland, Oregon), as they have had to recognize that TNR is the only effective way to reduce the numbers of homeless cats. The only city council who has, in the past, seriously considered their arguments is Palo Alto. 4. Your residents do the work of cat control in Palo Alto. Most feral cats are “backyard cats” that residents catch and bring in for spaying and neutering. They pay for this out of pocket, saving public monies. They are doing vital unpaid animal control work. It costs more to hold and euthanize a cat (and on the public dime), than it does to perform a spay or neuter surgery. 5. If you ban TNR, your residents will not bring in cats when euthanasia is the likely outcome. This just increases the numbers of kittens born. Please support your residents! I attach a white paper on the control of feral cats which the California Humane Coalition drafted in order to counter statewide campaigns that would have set back cat control programs. We were successful in our efforts in Sacramento to defeat these proposed bills and to instead support the growing movement to control numbers through TNR. Sincerely, Carole Carole Hyde President (650) 504-5898 www.projecthumanekind.org California Humane Coalition (California Against AB 302) POSITION PAPER THE CONTROL OF HOMELESS CAT POPULATIONS TTVAR-M: A COST-EFFECTIVE, ENVIRONMENTALLY-SENSITIVE, AND HUMANE METHOD OF STABILIZING AND REDUCING POPULATIONS Until there is universal sterilization of household pet cats, homeless and feral cats will exist in our neighborhoods and public places, including urban, man-made, local and regional parks and recreation areas. Homeless and feral cat populations themselves are best controlled and ultimately reduced through sterilization and maintenance for the duration of their lifetimes. The TTVAR-M (trap, test, vaccinate, alter, release, and maintain) method is used increasingly throughout California and other enlightened States to address the homeless cat population issue. The TTVAR-M method has arisen in response to the inhumaneness, cost, and ineffectiveness of the eradication method of controlling cat numbers. The TTVAR-M method is a complement to state and local mandates for owner and animal shelter pet cat sterilization. The TTVAR-M also recognizes the important role that cats play in the ecosystem. Sterilizing and maintaining homeless cats is cost effective The costs of impoundment and euthanasia of a cat in a public animal control facility are considerable. In the County of Santa Clara, they are estimated at $74 per animal of taxpayers’ money -- $46 for impoundment, $28 for euthanasia (Coalition for Humane Legislation and Office of Council member James Beall). In the City of Berkeley, they are even higher (Berkeley Humane Commission). In contrast, the sterilization and maintenance of homeless cat colonies is uniformly accomplished by private individuals and organizations at no cost to local government. As the recession in the State of California continues to reduce available discretionary monies for cities and counties and to place greater economic burdens on local governments for the provision of human services, there is persuasive argument for the TTVAR-M method carried out at non-public expense. And, TTVAR-M does work to reduce the size of cat colonies. Sterilizing and maintaining homeless cats is humane California is always on the cutting edge of innovation, and the United States sets a standard of animal protection for the world. The humane treatment of animals (for example, the Endangered Species Act and the Humane Slaughter Act) has been sought by millions of Americans. The California humane community is in the fore of the animal protection movement. The eradication of cats through starving, poisoning, shooting, or impoundment and killing at animal control facilities is inhumane and particularly so in the face of the proven alternative of sterilizing and feeding them in groups. Because those who love cats can also love and wish to protect birds and environment, the maintaining of homeless cats and reducing their proclivity to hunt is humane. Mandates forbidding the care of homeless animals are politically tenuous. Mandatory eradication could be political suicide. Sterilizing and maintaining homeless cats is the most effective means of population control Until the total pet cat population is sterilized, the attempted eradication of homeless and feral cats will be doomed to failure, as the ecological vacuum created by their destruction is merely filled by irresponsible pet owners and therefore more stray cats. On the other hand, stabilized (sterilized) colonies maintained by a caretaker can be monitored for the appearance of unsterilized newcomers. In addition, sterilized and maintained cats are usually healthy and present less of a “public nuisance” issue than poisoning and other means of eradication. Sterilizing and maintaining homeless cats is environmentally sound Reducing the numbers of homeless cats through sterilization is the least harmful method environmentally. Poison and similar pest control methods wreak irreversible damage to the ecosystem and human populations. Cats, on the other hand, provide natural control of the rodent population and are self-regulating (see discussion below). The bird predation argument is scientifically unsound The hypothesis that cat predation of birds is responsible for the disappearance of species is refuted by the scientific literature (see, for example, National Geographic, “Silence of the Songbirds,” June, 1993, which lays the blame on a complex of factors relating to habitat and continental land management). Cats, rather, by evolution are rodent specialists; and feral cats usually become scavengers, most frequently on human garbage (see, inter alia, reports by Paul Leyhausen, ethologist, Great Britain; Robert Berg, San Francisco; Ellen Perry Berkeley, Maverick Cats). “A deliberate strategy of scavenging has enabled many feral cats almost to give up hunting altogether” (Peter Neville, Great Britain). Cats, in fact, have a significant place in ecological system. “Cats suppress populations of other more damaging predators such as rats and thus allow denser populations of birds than would exist without them” (Fitzgerald and Karl). Summary The overpopulation of domesticated companion animals should be addressed by sterilization, an approach more humane, more time effective, and more cost effective than impoundment and euthanasia. Legislation and local ordinances mandating the sterilization of cats should focus on household (indoor or outdoor-going) pet cats and should complement the sterilization and maintenance of homeless or feral cats. Share this: Aviation & Airport | Development Law News LATEST NEWS AND ANALYSIS - AIR AND SURFACE TRANSPORTATION, ENERGY AND THE ENVIRONMENT Supreme Court May Have Dealt Death Blow to Judicial Deference By Barbara Lichman on May 10, 2023 Less than two weeks ago, the United States Supreme Court took the first of several actions meant to close the door on what has become a standard in opposing citizens’ efforts to challenge the missteps of administrative agencies, i.e. Judicial Deference to agency decision-making. Specifically, Judicial Deference has guided the Courts into accepting an agency determination “based on a reasonable interpretation of an ambiguous statute Congress has tasked the Agency with implementing.” Chevron vs. NRDC, 467 U.S. 837 (1984). On May 1, 2023, the Court agreed to accept certiorari in the case of Loper Bright vs. Raimundo in which herring fisheries challenged a regulation issued by the Marine Fisheries unit of the Commerce Department, requiring private payment by boat owners of monitors mandated by the agency to be located on individual fishing boats to prevent over-fishing In accepting the case for review, the Court, for the first time, agreed to confront the concept of Judicial Deference head-on. Up until recently, courts have moved incrementally to weaken the concept of Judicial Deference. As long ago as 1944, the Court held that “The courts may resort to agency expertise for guidance. The weight of its judgment in a particular case will depend on the thoroughness . . . in its consideration, validity of its reasoning, consistency with other pronouncements, and all factors with power to persuade.” Skidmore vs. Swift, 323 U.S. 144 (1944). And as short a time ago as last year, in Virginia vs. EPA, 597 U.S. ___ (2022), the Court specifically sanctioned the application of the “Major Questions Doctrine” which narrows the concept of deference to those agency actions that “are guided by clear statutory authority.” The decision to accept certiorari in Loper Bright appears to demonstrate the Court’s desire to directly confront Judicial Deference, and accept the views of newer members of the Supreme Court bench such as Neil Gorsuch. Justice Gorsuch took the position, in his dissent in the case of Buffington vs. McDonough, 598 U.S. ___ (2022), that Judicial Deference threatens the separation of powers enshrined in the Constitution by placing the decision-making power regarding consistency with Federal law in the hands of the Executive Branch, and not in the Judicial Branch where it belongs. The real world implications of this shift in emphasis includes a complete re-thinking of the way Congressional rule-making and agency implementation interact. Specifically, under the current regime, Congress drafts legislation that contains general guidance, and devolves upon agencies the task of drafting the technical mechanisms for implementation. Under a regime less restricted by Judicial Deference, Congress would have to be more specific in its legislative mandates, presumably with the aid of the agencies it displaces. Whatever the ultimate outcome, for legal challenges to federal agency actions, the demise of Judicial Deference would be a welcome relief. Challengers to the actions of the Federal Aviation Administration (“FAA”), for example, have found the last bastion of relief in the federal court system largely foreclosed by the Courts’ persistent deference to the FAA’s “technical expertise.” That refusal to consider the agencies’ actions from a legal, rather than solely technical, perspective, may eventually disappear as a result of the Court’s decision in Loper Bright, and leave open the door to a fair weighting of community benefits and burdens against those of the agencies. There are two items I want to flag: 1. We just learned that SB 2 (Portantino) passed the Senate and will now move over to the Assembly. This bill is having some positive momentum and we continue to work with the author’soffice. 2. Yesterday a Superior Court rejected constitutional challenges presented against SB 1439 from last year, which requires local elected officials to recuse themselves from votes and discussions involving anyone who has contributed more than $250 to their campaign. The FPPC is currently working on draft guidance for the law that will be released in June. We will keep you updated on these developments. As always, please reach out with any questions. SB 429(Bradford) Requires investor-owned natural gas utilities to provide customerswith an annual credit (known as the California Climate Credit) tocoincide with the highest usage month, on or as close to the Februaryutility billing cycle, as feasible. Homelessness AB 799 (L.Rivas) Requires regions to develop a regional homelessness action planevery five years and submit it the state for approval, makes variouschanges to round five and any future rounds of the HomelessHousing, Assistance and Prevention (HHAP) program, and requiresthe California Interagency Council on Homelessness (CA-ICH) todevelop a financing plan to end homelessness by 2035. SB 43(Eggman) Updates the definition of “gravely disabled” to include a new focus onpreventing serious physical and mental harm stemming from aperson’s inability to provide for their needs for nourishment, personalor medical care, find appropriate shelter, or attend to self-protectionor personal safety, due to their mental or substance use disorder.
