Staff Recommendation:

Motion to Recommend Approval of a Special Exception to allow 195 SF of covered,
unenclosed area that exceeds the maximum floor area ratio (Section 70 -72 (b) (2)).
Motion to Recommend Approval of a Level 3 Architectural /Site Plan Review based on the
findings that the proposed Gulf Stream Bermuda style, partial 2 story single - family dwelling,
attached 2 car garage, detached retreat, open pavilion and swimming pool, a total of 6,015 SF
meet the minimum intent of the Design Manual and applicable review standards with the
following conditions:
1. Prior to the issuance of a certificate of occupancy, the owner of the property shall
prepare and record a deed restriction which shall provide that all roof projection
areas shall remain unenclosed as per approval of the special exception for as long
as the structure is in existence or exceeds the maximum FAR.
2. The electric service lines shall be buried.
3. Any minor modifications in the landscape plan shall be submitted to the Town Manager
for review and approval and any major modifications shall be brought back to the ARPB
for review and approval, prior to commencement of landscaping.
4. The landscape plan will protect any existing Australian pine trees and allow, at the
discretion of the Town, the planting of two - ten Australian pine trees where possible.
5. In order to loeoer the second story eave height on the portion of the structure on the north elevation
that extends to within 15' of the property line, the plate shall be lowered from 10' to Y and
additional landscaping shall be added to insure privacy for the neighbor to the north, both as
offered by Mr. Iaudani.

NOTICE IS HEREBY GIVEN that the Architectural Review and Planning Board
of the Town of Gulf Stream will hold a Public Hearing on THURSDAY, MARCH 26,
2015 AT 8:30 A.M., AND THE Town Commission will hold a Public Hearing on
FRIDAY, APRIL 10, 2015 AT 9:00 A.M., both in the Commission Chambers of the
Town Hall, 100 Sea Road, Gulf Stream, Florida, at which the following will
be considered:
An application submitted by Thomas Laudani, Manager of
Seaside Builders as agent for 3345 Oleander Way LLC, owners of
property located at 3424 North Ocean Boulevard, Gulf Stream,
Florida 33483, legally described as Lots 46 and 46A, Gulf Stream
Properties No. 2, for the following:
1. DEMOLITION PERMIT to remove existing structures.
2. LAND CLEARING PERMIT to clear property for construction.
3. NORTH OCEAN OVERLAY PERMIT to permit construction of a
driveway, decorative wall /fence & landscaping.
4. SPECIAL EXCEPTION to allow 200 square feet of covered
un- enclosed area that exceeds the maximum permitted floor
area ratio.
5. LEVEL 3 ARCHITECTURAL /SITE PLAN REVIEW to permit construction
of a Gulf Stream Bermuda Style, partial 2 story single - family
dwelling, attached 2 car garage, detached retreat, open
pavilion and swimming pool, a total of 6,015 square feet.
The Architectural Review and Planning Board shall make a recommendation to
the Town Commission, and the Town Commission shall make a final decision
regarding the subject application at the meeting noticed above. These
meetings may be adjourned from time to time and place to place as may be
necessary to hear all parties and evidence.
The complete application materials are on file in the Office of the Town
Clerk located at 100 Sea Road, Gulf Stream, Florida 33483, and may be
reviewed during regular business hours, which generally include non - holiday
weekdays from 9:00 A.M. to 4:00 P.M.
ALL PARTIES INTERESTED IN THESE MATTERS may appear before the
Architectural Review and Planning Board and the Town Commission of the Town
of Gulf Stream at the times and place aforesaid and be heard.
SHOULD ANY INTERESTED PARTY SEEK TO APPEAL ANY DECISION MADE BY THE
ARCHITECTURAL REVIEW AND PLANNING BOARD OR THE TOWN COMMISSION WITH RESPECT

We are working with Seaside Builders on the two homes that are being proposed between Oleander and
North Ocean. Unfortunately, the Sewer Association system in this neighborhood does not extend to the
homes on the east side of Oleander, and in speaking with Doug Fox, who has done most of the sewer
installation work on behalf of the Association, the Sewer Association is not desirous of expanding their
backbone system any further. Therefore, our only viable option in this case is to serve these homes via septic
systems.
Due to the fact that the Sewer Association's system is nearby, the Health Dept will want a letter from the
Town stating the availability (or unavailability in this case) of sewer to serve the proposed homes. Being that
we are the design engineers for the extension of the Association's system for the connection of the Golf Club
facilities, I am very familiar with their facilities, but unfortunately, the letter needs to come from the Town. I
have attached an example letter from the Town of Ocean Ridge for your reference — I believe just a general
letter like this will suffice. Additionally, I can provide you plans, if need be, showing that the nearest section of
the Association's sewer system (which is a 3 -inch PVC forcemain) is located in the right -of -way of Gulf Stream
Road, about 300 feet south and west of the subject parcels.

The design of the front walls for both houses is shown on the elevations for the fronts of
the houses which is Sheet L -3 in both sets. Attached please find a detail of the
entrance wall feature shown with the proposed planting and without. The detail without
the planting will indicate some dimensions to show the proposed height.
The fences on the north and south property lines of both lots are actually going to be 4'
ht. aluminum picket railings.
