Present: Mayor, Gary Acromite; Councilmembers, Robert Mitchell, Ann Thies; clerk -Treas- urer, Donna Roehl; Public Works Director, James Dillman; Police Chief, Richard Rabenort; Engineer, Glenn Cook; Attorney, Ron Batty Absent: Councilmembers, Wilfred Scherer; Philip Zietlow 1. MINUTES OF DECEMBER 3, 1991 Ann Thies stated that Drs. Olson and Dedeker Item, Page 158 should be corrected to Leonard Leuer, not Loren Leuer. Moved by Thies, seconded by Mitchell to approve minutes of December 3, 1991, as corrected. Motion declared carried 2. PUBLIC WORKS DEPARTMENT Truck Weighing Scales Jim Dillmanstated that the city should purchase four additional scales for weighing trucks during road posting season. He stated there would then be two sets, but if one scale did not work there still would be one complete set. He explained that the cost is $1200 each and had been budgeted in the 1991 budget. Robert Mitchell stated that council had agreed earlier that the city should be agressive with regards to overweight trucks. Rick Rabenort stated that last season scales had been borrowed from edina but that they were not available for the upcoming season. Moved by Acromite, seconded by Mitchell to authorize purchase of four additional scales for $4800, with cost to be taken from the Pulbic Works contingency fund. Motion declared carried * CONSENT AGENDA 3. PLANNING AND ZONING DEPARTMENT * Cox Brothers Escrow Moved by Thies, seconded by Mitchell to release remaining $1500 escrow posted by Cox Brothers for completion of road in Cox Brothers Farm. Motion declared carried *Dan Richardson, Septic System variance Moved by Thies, seconded by Mitchell to adopt Resolution 91-94, granting a variance to Dan Richardson to place a septic system on a slope of up to 12% on Tract F, Registered Land Survey # 1049. Motion declared carried *Jeff Ruchti, Setback Variance Moved by Thies, seconded by Mitchell to adopt Resolution 91-95, granting a setback variance to Jeff Ruchti to construct an addition to his house at 3102 Hwy. 55. Motion declared carried * Dr. Rolland Olson/Dr. Kenneth Dedeker, Preliminary Plat Approval Moved by Thies, seconded by Mitchell to adopt Resolution 91-96, granting preliminary plat approval to Dr. Rolland Olson and Dr. Kenneth Dedeker to subdivide property on Medina Rd. Motion declared carried Wetlands Conservation Act Loren Kohnen explained that rules are being written for wetlands conservation but for the next year cities will continue to handle all applications along with the watershed districts. He stated that the city should write a letter to the BOWSR Board telling them we will contine to administer applications at the city level. Gary Acromite asked if the process was being endorsed by the watershed districts. Anne Theis, Chairperson of the Pioneer Creek Watershed District, stated that a lot of work needs to be done with regards to rules before the state can take over applications. Moved by Acromite, seconded by Mitchell to write a letter to the state informing them that the city is participating in the interim wetlands conservation program by continuing to review applications. Motion declared carried r 164 Stormwater Management Plan Glenn Cpok reported that the stormwater management plan referred to in the letter form the Minnehaha creek Watershed District has been put off as there seemed to be no rush for one in Medina. Ann Thies stated that the watershed districts need to complete their plans before the cities finish their plans. Robert Mitchell stated that the watershed district assumes that Medina is going to develop like Plymouth. Patricia Raskob stated that they own property to the west of an area in Plymouth that is being developed for housing and that she has attended many meetings, always being told the City of Medina needs to develop a stormwater management plan. She presented information gathered from a number of meetings from the City of Plymouth and the Minnehaha Creek Watershed District at which the water run-off was discussed. She also indicated on a map where the development is to take place in relation to their property. Gary Acromite asked what the problem seemed to be. Glenn Cook stated that developiitent taking place in an adjacent community must provide a place for water run-off and the Raskobs do not want it diverted onto their property. Pat Raskob stated that a city culvert under Holy Name Dr. can not handle the volume of water being generated. Glenn Cook stated that the water from the first development will flow in an easterly direction but the next phase of the project will need to be monitored closely as the water will flow westerly. Gary Acromite asked how long it would take for a review. Glenn stated that it would take six months and they would like to do the work for the city. Pat Raskob stated that in the meantime the developer keeps on digging. Glenn Cook stated that he had seen a plan and a portion of the water will flow to Basset Creek. Patricia Raskob stated that she believed that their plan was on hold that that she had tried to call the watershed district but was unable to reach them. Gary Acromite asked what the short term problem is. Patricia Raskob stated that water backs up north of 2112 Holy Name Dr. Jim Dillman stated that there is a 55 year old tile line that may not be working. Patricial Raskob stated that is the reason why the parcel is called a landlocked parcel. She also explained that she had asked Quansbeck of the watershed District, who was respon- sible and was told that they had an inspector look at it once and that they were supposed to make another inspection. Gary Acromite stated that there should be an investigation of this complaint with inform- ation about the cities plan to be discussed at a January meeting. Robert Mitchell stated that projects are always reviewed on a case by case basis. He asked if the city could do its plan before the watershed district completes their plan. Glenn Cook stated that the city could go ahead any time and that in the Tax Increment project list it is scheduled for 1994. Moved by Acromite, seconded by Thies to have staff investigate water flow onto the Raskob property resulting from a development being carried on in Plymouth and to report back to the city council after January lst. Motion declared carried 4. COMPREHENSIVE PLAN AMENDMENT Gary Acromite stated that council should decide how to respond to the Metro Council staff recommendations for Medina's Comprehensive Plan. Glenn Cook stated that the city should send them a letter as they could assume that the city is in complete agreement with their recommendations. He explained that the major difference was their recommendation that 65 acres of the Elwell Farm, now owned by Hennepin County, be included in the sewer area, as it has been assessed for sewer by the city, with the 65 acreage allocation to be taken from the Doerr property and elimination of the Commercial/Industrial property owned by the Wessins. He explained that the formula used for the 65 acres comes from that used to assess Cherry Hill Farm; that is $800 per acre, with Hennepin County being assessed $55,000 as their part of the trunk sewer cost. Council discussed the alternatives that were available; do as they request; remove the Commercial/Industrial area and tell them we haven't changed our plan or add the 65 acres of the Elwell Farm. J- Robert Mitchell stated that the original plan had over 1000 additional sewer units so the city should be able to argue for 65 acres. • Gary Acromite stated that the city should make the statement that they intend to keep the .28gpd formula through the year 2003. He asked how serious the Metro Council letter to Hennepin County seems to be. Glenn Cook stated that the county has the right to appeal the recommendation. Ron Batty stated that a property owner could make the argument that they wanted value returned for what they had been assessed. Robert Mitchell stated that the city put in the trunk sewer line to save work and money for the county some time in the future. Glenn Cook stated that they won't lose value, but its the timing of when they will get into the sewer district. Gary Acromite asked if the following responses to the Metro Council staff letter were appropriate: Agree with the .28mgd wastewater flow into Plymouth; Disagree with phe d � ctc,z� staff re ommendationto reduc the expansion on the Doerr property by 65 acres -arid elimination of `he proposed industrial expansion; Inform them that the city intends to develop an on -site septic system inspection monitoring program; Agree to meet with the Metropolitan Waste Control staff to outline a specific course of action regarding an Infiltration/Inflow reduction program; Agree to extend the review date for the plan amendment to January 23, 1992. Glenn Cook stated that the letter should be sent a soon as possible and that he would communication the response to the staff recommendations to Barbara senness, on Wednesday. Moved by Acromite, seconded by Mitchell to direct Glenn Cook to prepare a letter to Metro Council according to the items presented in the previous paragraph. Motion declared carried Robert Mitchell stated that Hennepin County, Wally Doer and other Medina residents should do everything possible to help promote the plan. 5. 1992 BOARD OF REVIEW MEETING Moved by Thies, seconded by Acromite to set the Board of Review meeting for Wednesday, April 8, 1992, at 7:00 p.m. Motion declared carried 6. CURBSIDE RECYCLING Donna Roehl reported that Polka Dot Recycling had gone out of Business on Monday, December 9th and that a new hauler, E-Z Recycling had been contacted by coordinator, Margie Vigoren, who agreed to continue the pickup without interruption. She stated that a short term contract would be prepared and later a new RFP would be sent out for the six cities pro- gram. She also asked if the November payment should be made to Polka Dot recycling in view of the fact that the city had incurred expenses notifying resident of a new pickup date Council advised that payment to Polka Dot be withheld at this time. 7. 1992 BUDGET (CONTINUED) Moved by Acromite seconded by Thies to levy $872,000 for 1992 tax collection. Motion declared carried Ann Thies stated that new revenue sources should be found. Gary Acromite suggested that she contact some of the residents who had attended the November 20th meeting and ask them to review means for additional revenues. 8. PAYMENT OF BILLS Moved by Thies, seconded by Mitchell to pay the bills; Order Checks # 10317-10356 in the amount of $44,188.31; Order Checks #8935-8943 in the amount of $710.00 and Payroll Checks # 12512-12533 in the amount of $18,971.08.
