Reiman app oximately 6:30 P.M. on Thursday, April 20, 2006, Municipal C urt/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. - Upon individual roll call, the following were noted present: ROLL CALL Councilmember Vincent Bellino " Jorge Diaz " Randy Krum " Susan Naples " Ronald Rios Also noted present was Borough Attorney Robert J. Bergen, Esq. Noted absent was Councilmember Joseph Sitarz. NOTED ABSENT The meeting was opened with a moment of Silent Pray r and The PRAYER, PLEDGE Pledge of Allegiance led by Mayor Daniel J. Reiman. OF ALLEGIANCE The Clerk stated that the 2006 Annual Notice was mailed to The Home STATEMENT OF News Tribune, The Star Ledger and posted on the bulleti board on MEETING NOTICE -~ January 3,2006. Mayor Reiman presented a Mayoral Commendation to D uty Chief tvL\YORAL James V. Hojecki who is retiring after thirty one years as a Borough COMMENDATION: DEPUTY CHIEF police officer. Mayor Reiman congratulated Deputy Ch' f Hojecki JAMES V. HOJECKl and wished him good luck on his retirement in Florida. Deputy Chief Hojecki thanked everyone on behalf of him elf and his family. He thanked all the Crossing Guards and Police fficers that were in attendance and said he felt they have nothing but e best for their future here in Carteret with their jobs and said they know how much he loved them all. He said knew they would be in he best of hands and they all have the community at heart just as he ways tried to. He spoke about the young officers that have made arteret and Carteret Police Department proud and said he felt the ommunity would be served well and everyone would be fine. He s id he will miSS everyone. At approximately 6:35 P.M. Mayor Reiman said we would e having a RECESS - five minute recess. At approximately 6:40 P.M. the meeting was reconven d. Upon MEETING individual roll call, the following were noted present, Coun ilmembers RECONVENED Vincent Bellino, Jorge Diaz, Randy Krum, Susan Naples d Ronald Rios. Councilmember Joseph Sitarz was noted absent. I APRIL 20, 2006 APPROVAL Upon MMS&C, by Councilmembers R os and Diaz and unanimous OF MINUTES affirmative vote of the five (5) Council embers present, the minutes of March 9 & 30, 2006 were approved a transcribed and engrossed by the Clerk. -' PUBLIC HEARING Upon MMS&C, by Councilmembers iaz and Rios and unanimous 2006 BUDGET affirmative vote of the five (5) Counc i members present, the Mayor declared the Public Hearing on the 2006 Local Municipal Budget to be open: Mayor Reiman briefly explained and s id the final budget document will be presented in June or July. HEARING CLOSED There being no comments or objection to the 2006 Local Municipal Budget, the Mayor declared the Publi Hearing to be closed, upon MMS&C, by Councilmembers Dia and Rios and unammous affirmative vote of the five (5) Council embers present. Mayor Reiman introduced Dale Leubne ofT&M Associates. -- DALE LEUBNER Dale Leubner gave an update on the pgrade for the basketball and T&M ASSOCIATES tennis courts in Carteret Park which ar in need of repairs. He briefly explained the project. He said they h e applied to Green Acres for five hundred thousand dollars which is o hundred and fifty thousand dollars in a no interest loan and two hu dred and fifty thousand dollars in a grant. He said he felt it was a ood project and Green Acres should be in favor of it. Mayor Reiman said we can only proce with the project if we receive the Green Acres funding. Councilmember Rios said this project s long overdue and felt that it will greatly serve the youth of the com unity since the basketball and tennis courts are used frequently. Councilmember Naples asked if the would be putting on a new surface. Mr. Leubner said the cracks will b seal coated and the eXlstmg pavement will be color coated. The improvement de cribed in Section 3 of this bond ordinance has heretofore been auth rized to be undertaken by the Borough of Carteret, New Jersey (t "Borough") as a general improvement. For the improvement or p rpose described in Section 3, there is hereby appropriated the supple ental amount of $2,000,000, such sum being in addition to the $793, 00 appropriated therefore by bond ordinance #03-01 of the Boroug finally adopted February 6, - 2003, and including the sum of $100000 as the additional down payment required by the Local Bond Law. The additional down payment is now available by virtue ofp ovision for down payment or for capital improvement purposes in on or more previously adopted budgets. Section 2. In order to finance the additional cost of the improvement or purpose not covered b application of the additional down payment, negotiable bonds are he by authorized to be issued in the principal amount of $1,900,000 pur uant to the Local Bond Law. In anticipation of the issuance of he bonds, negotiable bond anticipation notes are hereby authorize to be issued pursuant to and within the limitations prescribed by the ocal Bond Law. Section 3. (a) The improvement heretofore authorized and the purpose for the financing of which the bonds are to be issued is for various park improvements and the acq isition of land for parks and open space as described in the bond ord nance #03-01 of the Borough finally adopted February 6,2003. - (b) The estimated maximum amount of bonds or notes to be issued for the improvement or purpo e is $2,655,000, including the $755,000 bonds or notes authorized by ond ordinance #03-01 of the Borough finally adopted February 6, 2 03 and the $1,900,000 bonds or notes authorized herein. 10 APRIL 20, 2006 (c) The estimated cost of the improvement or purpose IS BOND ORDINANCE $2,793,000, including the $793,000 appropriated by bon ordinance #06~26 (In Full) #03-01 of the Borough finally adopted February 6, 20 3 and the $2,000,000 appropriated herein. - Section 4. All bond anticipation notes issued here nder shall mature at such times as may be determined by the chi f financial officer; provided that no note shall mature later than one y ar from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer. The chief financial officer shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financi I officer's signature upon the notes shall be conclusive evidence as o all such determinations. All notes issued hereunder may be renewe from time to time subject to the provisions of the Local Bond Law. The chief financial officer is hereby authorized to sell part or all 0 the notes from time to time at public or private sale and to deliver em to the purchasers thereof upon receipt of payment of the purchas price plus accrued interest from their dates to the date of delivery th reof. The chief financial officer is directed to report in writing to th governmg body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this ordinance is made. Such port must include the amount, the description, the interest rate and t e maturity schedule of the notes sold, the price obtained and the n me of the purchaser. - Section 5. The Borough hereby certifies that it ha adopted a capital budget or a temporary capital budget, as applicable. he capital or temporary capital budget of the Borough is hereby ended to conform with the provisions of this ordinance to the ex ent of any inconsistency herewith. To the extent that the purposes authorized herein are inconsistent with the adopted capital or tempo ary capital budget, a revised capital or temporary capital budget has been filed with the Division of Local Government Services. Section 6. The following additional matters e hereby determined, declared, recited and stated: (a) The improvement or purpose described in ection 3 of this bond ordinance is not a current expense. It is an impr vement or purpose that the Borough may lawfully undertake as a general improvement, and no part of the cost thereof has been r shall be specially assessed on property specially benefited thereby. (b) The period of usefulness of the improvemen or purpose within the limitations of the Local Bond Law, accor 'ng to the reasonable life thereof computed from the date of the bond authorized - by this bond ordinance, is 15 years. (c) The Supplemental Debt Statement requi ed by the Local Bond Law has been duly prepared and filed in the fice of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of ew Jersey. Such statement shows that the gross debt of the Borough a defined in the Local Bond Law is increased by the authorization ofth bonds and notes provided in this bond ordinance by $1,900,00 , and the 11 APRIL 20, 2006 BOND ORDINANCE obligations authorized herein will be within all debt limitations #06~26 (In Full) prescribed by that Law. (d) An aggregate amount not xceeding $358,600 for items of expense listed in and permitted under .l.S.A. 40A:2-20 is included in the estimated cost indicated herein for the purpose or improvement. Of this amount, $158,600 was estimated for these items of expense in bond ordinance #03-01 of the Boroug finally adopted February 6, -' 2003, and an additional $200,000 is esti ated therefore herein. Section 7. Any grant moneys received for the purpose described in Section 3 hereof shall be ap lied either to direct payment of the cost of the improvement or to pa ent of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are so used. Section 8. The chief financial of cer of the Borough is hereby authorized to prepare and to update fro time to time as necessary a financial disclosure document to be dist 'buted in connection with the sale of obligations of the Borough an to execute such disclosure document on behalf of the Borough. he chief financial officer is further authorized to enter into the appr priate undertaking to provide secondary market disclosure on behal of the Borough pursuant to Rule 15c2~ 12 of the Securities and Exchange Commission (the "Rule") for the benefit of holders and b eficial owners of obligations of the Borough and to amend such und rtaking from time to time in connection with any change in law, or i terpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally - recognized bond counsel, consistent wit the requirements of the Rule. In the event that the Borough fails to co ply with its undertaking, the Borough shall not be liable for any mon tary damages, and the remedy shall be limited to specific performance f the undertaking. Section 9. The full faith and cre it of the Borough are hereby pledged to the punctual payment of the rincipal of and the interest on the obligations authorized by this bon ordinance. The obligations shall be direct, unlimited obligations of he Borough, and the Borough shall be obligated to levy ad valorem t xes upon all the taxable real property within the Borough for the pa ent of the obligations and the interest thereon without limitation ofrat or amount. He said the Sewer epartment is cleaning catch basins in the high school area and in West Carteret, the Hill and Chrome Sections and t.v.'d some sewer on Elmwood, Coolidge and Buchanan. He said the Sewer Depart ent washes down the fishing - pier weekly. He said a pump and a gen rator at the Hayward Avenue Pump Station have been repaired.
