Councilman Presents the foJ\owing Ordinance Seconded by Councilman AN ORDINANCE TO ADOPT A REDEVELOPMENT PLAN FOR THE W ASHINGTON AVENUE REDEVELOPMENT DISTRICT IN THE BOROUGH OF CARTERET BE IT ORDAINED, by the Mayor and Council of the Borough ofCarteret, as follows: Section 1. e) The Redevelopment Plan wil1 be attached hereto as a) The Borough of Carteret Planning Board, after due consideration and in conformance with the Local Housing and Redevelopment Law, (N.J.S.A. 40A: 12A-I, et seq., "Redevelopment Law"), has recommended the adoption of the Washington Avenue Redevelopment Plan prepared by Beacon Planning and Consulting Services, LLC, dated March 2006, ("Redevelopment Plan") for the V.,lashington Avenue Greyfields Redevelopment Area established by Resolution No. 06-38, (hereinafter referred to as the \Vashington Avenue Redevelopment District or "WARD"), with the area of the W ARA shown as Figure 2 of the Redevelopment Pian; and b) The Redevelopment Plan proposes development guidelines for the WARD as set forth in Section 3.0 et seq. o[the Redevelopment Plan; and c) The Redevelopment Plan is in furtherance of the goals and objectives of the Borough with respect to the WARD and the Redevelopment Law; and d) The Borough Council of the Borough of Cal1eret has reviewed the Redevelopment Plan and held a public hearing about the Redevelopment Plan to receive the comments o[the public and interested parties; and Exhibit A upon adoption of this Ordinance and is prescntly on fi1e with the Borough Clerk's Office for rcview. SECTION 2. The Redevelopment Plan is adopted as the official redeveJopment plan for the WARD, as amended to eliminate Lots 9.02 and 9.08 in BJock 215 as properties that may be acquired for purposes of redevelopmcnt, and further adding Lot 22 in Block 220 as a property that may be acquired for purposes of redevelopment, in accordance with the Local Homing and Redevelopment Law. SECTION 3. The zoning district map of the Borough's Land Development Ordinance is hereby amended to create an overlay zone to renee! the applicahiJity of the Redeve10pment P]an to any and all redevelopment and/or rehabilitation projects undeliaken within WARD and the Borough's Land Development Ordinance as it affects the redevelopment and/or rehabilitation within the WARD '0 06-33 2 PAGE -_._-~ I !I I ,I II II II I is he~eby superseded by the Redeve10pment Plan to the extent sct forth therein, but also allo\ving properties within the Ward to continue 10 be used and developed in accordance with the current, underlying 7.oning design. SECTION 4. A11 Ordinances and/or provisions thereof inconsistcnt with the provision of this Ordinance sha11 be and are hereby repealed as to the extent of any such inconsistencies SECTION 5. If any section, subsection, part, clause or phrase of this Ordinance shall be declared inva]jd by judgment of any Court of competent jurisdiction, the section. subsection, part, clause or phrase shall be decmed to be sevcr able from the remaindcr of this Ordinance SECTION 6.
