Mayor Dennis called the regular meeting of the City Council to III order at 7:35 p.m. on Tuesday, December 17, 1974, in the Council Chamber of the City Hall. 2. The invocation was given by Reverend Katherine Armstrong, West- minster Presbyterian Church, 9642 E. Live Oak Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Dennis. 4. ROLL CALL: Present: Councilmen- Gilbertson, Greenberg, Merritt, Dennis Absent: Councilmen - Tyrell Also Present: City Manager Koski, City, Attorney Martin, Assistant to the City Manager Biel, Planning Director Dragice- vich, Parks and Recreation Director Kobett, Public Works Coordinator Leonetti 1 5. APPROVAL OF MINUTES:. Councilman Gilbertson moved to approve the minutes of the joint meeting of the City Council /Community Redevelopment Agency held Monday, December 2, 1974, with the correction to reflect--that the special meeting held was a joint meeting, seconded by Councilman Greenberg and carried. Councilman Merritt moved to approve the minutes of the regular meeting held Tuesday, December 3, 1974, as written, seconded by Councilman Gilbertson and carried. UNFINISHED BUSINESS: 6. ORDINANCE NO. 74 -395: 2nd read. PROVIDING FOR A CHANGE OF ZONE IN ZONE CHANGE CASE NO. 74 -425 (Santa Anita R -3 to R -2) City Attorney Martin presented Ordinance No. 74 -395 AN ORDINANCE OF THE CITY OF TEMPLE CITY PROVIDING FOR A CHANGE OF ZONE IN ZONE CHANGE CASE NO. 74 -425 by title only. Councilman Gilbertson moved to waive further reading and adopt, seconded by Councilman Green- berg and carried. 7. PROPERTY NUISANCE CASE 74 -26: 10800 Daines Drive City Manager Koski advised subject case has been continued from the City Council meetings of November 5 and 27, 1974; staff inves- tigation on December 12, 1974 revealed the violations had not yet been corrected ;however, the new owner informed staff he will resume work on the property with completion expected by January 1, 1975. Councilman Gilbertson moved to continue the case to the regular City Council meeting to be held January 7, 1975 to allow new owner time to complete corrections of violations, seconded by Councilman Merritt and carried. 8 RESOLUTION NO. 74 -1415: AMENDING THE GENERAL PLAN OF THE CITY (Seeman School Site) Councilman Gilbertson moved to adopt Resolution No. 74- 14I5 "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE GENERAL PLAN OF THE CITY, seconded by Councilman Greenberg and carried. Council Minutes, December 17, 1974 - Page 2 9, RESOLUTION NO. 74-1416: AMENDING THE GENERAL PLAN OF THE CITY (Density and Lower Azusa Road) Councilman Gilbertson moved to adopt Resolution No. 74 -1416 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE GENERAL PLAN OF THE CITY, effective December 31, 1974 seconded by Councilman Greenberg and carried. ouncilman Tyrell arrived prior to consideration of the following agenda I tems' EW BUSINESS: 10, PLANNING COMMISSION ACTION: Meeting of December 10, 1974 - DENYING ZONE CHANGE IN ZONE CHANGE CASE NO. 74 -429 (North side of Lower Azusa Road from Agnes to Glickman) City Manager Koski presented background information, stating the Planning Commission, at their regular meeting held December 10, 1974, held public hearing and considered a change of zone from R -4 to R -2 for the north side of Lower Azusa Road from Agnes to Glick- man Avenue. Planning Commission recommended no change of zone at this time for the reason that Lower Azusa Road is scheduled for widening and improvement in the near future, six property owners in subject area expressed no desire for a change of zone, some suggesting that the entire area be zoned Commercial, and, zoning classifications on the south side of Lower Azusa Road range from C -3 to M-2. Council concurred with Planning Commission and referred the matter to a joint study session with'the Planning Commission to re- evaluate at the completion of the widening and improvement of Lower Azusa Road. 11. RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of December 11, 1974 IA. TEMPLE CITY BOULEVARD AND LOWER AZUSA ROAD - Installation of Mail Box one City Manager Koski presented background information, stating the Traffic Commission, at their regular meeting held December 11, 1974, reviewed request from Temple City Postmaster regarding placement of a snorkel mail box on Temple City Boulevard, south of Lower Azusa Road, the proposed location for the zone being the east side of Tem- ple City Boulevard south of the red curb at Lower Azusa Road. In order to provide loading protection for the snorkel mail box, Traffic Commission recommends a white "Mail Box Use Only" zone be installed which will necessitate the relocation of a parking regulation. Councilman Greenberg''moved to approve installation of 22 feet of white "Mail Box Use Only" zone on the east side of Temple City Boulevard, commencing 46' south of the south curb line of Lower Azusa Road to a point'68' south of said curb line, and relocate one hour parking restriction sign 10' south of its present location, seconded by Councilman Merritt and carried. B. LOWER AZUSA ROAD - TEMPLE CITY BLVD. TO SOUTHERN PACIFIC RAILROAD - Results of Speed Survey City Manager Koski presented background information, stating the Traffic Commission, at their regular meeting held December 11, 1974, reviewed Traffic Engineer's recommendation that speed limits on Lower Azusa Road between Temple City Boulevard and the Southern Pacific Railroad tracks be upgraded from 35 mph to 40 mph and con- curred that 40 mph is a reasonable and prudent speed in light of the recent improvements. Traffic Engineer Envall advised a radar speed check was taken Novem- ber 26, 1974, which showed an average speed of 42 mph, 85th Percen- tile, 45 mph. The speed check compared with one taken July 31,, 1973 indicates that 40 mph would be amore reasonable and prudent speed for conditions which now exist. i 1 1 Council Minutes, December 17, 1974 - Page 3 Councilman Merritt moved to approve recommendation to upgrade speed limit from 35 mph to 40 mph on Lower Azusa Road from Temple City Boulevard to the Southern Pacific Railroad tracks, seconded by Councilman Greenberg. Councilman Gilbertson stated he disagreed with the recommendation based on the fact that there is residential frontage, both north and south sides of Lower Azusa Road within the proposed boundaries. Councilman Tyrell stated he also disagreed with the recommendation, seeing no advantage in having 35 mph speed limit from Rosemead Boulevard to the Southern Pacific Railroad tracks, the 5 mph increase to Temple City Boulevard and reduced again easterly.' Councilman Greenberg withdrew his second to the motion. Councilman Merritt stated he does not feel the increase is a problem, directing Council's attention to the speed survey which indicates traffic is presently doing over 40 mph. Mayor Dennis stated he felt 40 mph is a reasonable speed considering the improved conditions, however, he would be hesitant in approving an increase to 40 mph for such a short distance. Mayor Dennis sec- onded the motion which failed on a roll call vote: ROLL CALL: AYES: Councilmen - Merritt NOES: Councilmen- Gilbertson, Greenberg, Tyrell, Dennis C. LAS TUNAS DRIVE - ROSEMEAD BLVD. TO MUSCATEL AVENUE - Result of Speed Survey City Manager Koski presented background information, stating the Traffic Commission, at their regular meeting held December 11, 1974,' reviewed Traffic Engineer's report regarding the speed limit on Las Tunas Drive from Rosemead Boulevard to Muscatel Avenue which is presently posted 35 mph with pavement markings and concurred that 35 mph is a reasonable and prudent speed for that section. Councilman Tyrell moved to retain the present 35 mph speed limit on Las Tunas Drive from Rosemead Boulevard to Muscatel Avenue and file the appropriate report with the Municipal Court in Alhambra, seconded by Councilman Greenberg and carried. 12. STREET IMPROVEMENTS: RESURFACING PROJECT FY 1974 -75 - TEMPLE CITY BLVD. BETWEEN LIVE OAK AVENUE AND EATON WASH City Manager Koski presented background information, stating funds for the resurfacing of Temple City Boulevard from Live Oak Avenue to Eaton • Wash were included in the budget for the fiscal year 1974 -75, plans and specifications have been drawn up and forwarded for City Council review together with a calendar of events. Councilman Greenberg moved to certify the negative declaration of environmental impact as prepared in accordance with State Law and the City Council considered it in arriving at their decision, approve plans and specifications, authorize the advertising and receiving of bids, and approve the calendar of events, seconded by Councilman Merritt and carried. 13 RESOLUTION NO. 74 -1417: EMPLOYMENT OF PERSONNEL Councilman Tyrell moved to adopt Resolution No. 74 -1417 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL, seconded by Councilman Greenberg and carried, Councilman Gilbertson abstaining. 14. RESOLUTION NO, 74 -1418: TRANSFER OF CUSTODIAN OF PETTY CASH FUND (Marjorie Rockwell) Councilman Merritt moved to adopt Resolution No. 74 -1418 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY TRANSFERRING CUSTODIAN OF PETTY CASH FUND, seconded by Councilman Tyrell and carried. RESOLUTION NO. 74 -1419: WARRANTS & DEMANDS, Demand Nos. 1156 thru 1250 in the amount of $34,052483 Councilman Merritt moved to adopt Resolution No. 74 -1419 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $34,052.83, DEMAND NOS. 1156 THRU 1250, seconded by Councilman Greenberg and carried. I 16. COMMUNICATIONS: There were no communications. 17. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mrs. Linda Graves, 8920 Live Oak, stated she was informed that a gent emen representing Temple City called her brother -in -law that a subpoena for condemnation would be served within the week and wanted to know if this was true since negotiations for acquisition of her property had just begun. Mr. Bo Thom son, brother -in -law to Mrs. Graves, stated he had been contacted y telephone by someone representing a law firm who was representing the City, stating he would be served with a subpoena for condemnation because he had an easement. Mrs. Graves and Mr. Thompson were advised by City Manager Koski and Council that no authorization for condemnation has been given and that no attempt at pressure would be made. Mr. Thompson also stated he had been informed that he should make an offer on another house in order that relocation expenses could be determined, and was advised by Council not to make any offers before his negotiations were completed. IIIRECESS TO CRA: 1 City Council recessed at 8:20 p.m. and convened as the Temple City Com- munity Redevelopment Agency, all members being present and took the fol- lowing action: approved payment for legal services, adopted logo for Agency,_ adopted resolutions re: warrants and demands, authorizing Execu- tive Director to make certain determinations of value and to accept and execute documents relating to the acquisition,and disposition of real property, authorizing calls on letters of credit for acquisition of real properties, and approved agreement for City services. Actions are set forth in full in the minutes of that Agency. RECONVENE AS CITY COUNCIL: City Council reconvened at 8:30 p.m., all members being present. 18. MATTERS FROM CITY OFFICIALS: A. Councilman Gilbertson moved to approve an advance of additional funds in the amount of $3,468.93 as a loan to the Community Redevel- opment Agency, amend the agreement with the Agency and authorize payment to Eugene Jacobs in the amount of $3,468.93. and appropriate additional funds and amend the adopted budget accordingly, seconded by Councilman Merritt and carried. Be Agreement for City Services Councilman Gilbertson moved to adopt Resolution No, 74 -1420 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING AN AGREEMENT FOR CITY SERVICES, seconded by Councilman Greenberg and carried. California Contract Cities Association - Annual Legislative Conference Councilman Greenberg moved to authorize the attendance of Council and City Manager Koski to the 7th Annual California Contract Cities Legislative Conference to be held January 15 and 16, 1975 in Sacra- mento, California and approve necessary expenditures, seconded by Councilman Tyrell and carried. E. Request for Payment - Special Service Re: Zoning Case City vs. Jeri Brown City Manager Koski presented request for $112.32 from Michael Burnham, who as a city employee, was subpoenaed to testify on the City's behalf at the trial of Jeri Brown obi December 4 and 5, 1974 in regard to zoning violations, his new employer refusing to pay for his absence on the City's behalf due to his short tenure. Councilman Merritt moved to approve invoice for services rendered to the City of Temple City in the amount of $112.32 and amend the adopted budget accordingly, seconded by Councilman Gilbertson and carried. F. City Council approved format for the Municipal Code being codified as presented by City Attorney Martin. G. Councilman Gilbertson advised there is a very active movement in the Saugus- Newhall area with regard to the formation of a new county. Councilman Gilbertson also advised Council the Don Bosco Technical Institute will be offering anew course in law enforcement and criminal justice, available to any student at no cost.. H. Councilman Tyrell stated he felt Council should again give serious consideration to the possibility of the formation of a new county. Councilman Tyrell also reported on the progress being made by the West San Gabriel Valley Juvenile Diversion Project. I. Councilman Merritt expressed his concern regarding the fact that mail being sent from the Temple City Postoffice is being forwarded to La Puente for stamping and then processed,: resulting in cancellations reading "U.S. Postal Service" rather than identifying and recognizing the City of Temple City. J. Councilman Greenberg advised he is still distressed about the num- ber of garage sale signs being posted and left when the sale is over, rather than being taken down. Councilman Tyrell directed Council's attention to the two Deputies patrolling the downtown area on foot. He has had very favorable com- ments from the businessmen and residents. 19. ADJOURNMENT: On motion by Councilman Greenberg, seconded by Councilman Tyrell, the meeting adjourned at 8:50 p.m. Next meeting of the City Council will be held Tuesday, January 7, 1975, 7:30 p.m. in the Council Chamber of the City Hall.
