The Council, of the. City of Medina met in regular session on Tuesday, December 19, 1989
at 7:30 P.M.
Present: Acting. Mayor, Wilfred Scherer; Councilmembers, Robert Mitchell, Stephen Schmit,
Anne Theis; Clerk -Treasurer, Donna Roehl; Police Chief, Richard Rabenort;
Engineer, Glenn Cook; Attorney, Ron Batty
Absent: Mayor, Thomas Anderson
1. ADDITIONAL AGENDA ITEMS
Moved by Theis, seconded by Mitchell to discuss the following additional items:

2. MINUTES OF DECEMBER 5, 1989
Moved by Mitchell, seconded by Theis to approve minutes of December 5, 1989, as presented.

* CONSENT AGENDA
3. PUBLIC WORKS DEPARTMENT
* Dan -Bar Homes, Independence Estates, Escrow Funds
Moved by Schmit, seconded by Theis to release $12,000 of escrow funds to Dan -Bar Homes for
work completed in Inddpendence Estates.
Motion declared carried
Utility and Street Construction Policy
Glenn Cook explained that the developer of the TRA property on Hwy. 55 had requested that
the city construct the street and utilites on their property and charge the costs against
the property. He stated' that they have plans for fifty seven homesites, plus a ponding
area
Ron Batty stated that the contractor would be working for the city and if the project were
a large project the city would need to bond for the work.
Glenn Cook stated that it would cost about $500,000.
Robert Mitchell stated that several issues should be addressed; if the city took on a large
project for a developer, would city projects be put aside; if a project is done, one year,
will the city be able to complete another project the following year and how do you do a
project for one developer and not all of them that you might be asked to construct.
Anne Theis stated that she was concerned about this particular development and the number
of houses that might be planned for one cul de sac.
Glenn Cook stated that they had a meeting scheduled for wednesday with the Metro Council
regarding the proposed sewer plan and extension of the sewer to the west and north.
Council discussed extension of sewer along Hwy. 55 and how a project would be funded.
Moved by Mitchell,seconded by Theis to direct staff to meet with the cities financial
consultants to determine bonding capacity of the city.

4. POLICE DEPARTMENT
Part time Office Assistant
Rick Rabenort stated that the applicants for part time office assistant had been narrowed
to two and that he would be discussing work hours with each of the applicants, hoping to
have the police office open until 5:00 P.M. or 6:00 P.M. He also asked if he could hire
someone to help with filing, etc. until the new employee was hired.
Donna Roehl stated that Laura Skarda could help them for two hours each day during the
holiday season.
Fax Machine
Rick Rabenort explained that a Fax Machine would be purchased soon and he asked if council
wanted a dedicated line for that purpose.
Donna Roehl stated that there are two available lines on the present telephone system.
Council advised that an existing line should be used for the Fax machine, for the time
being, to find out how busy the two police department lines will be.
Hepatiti "B" Testing
Rick Rabenort stated that testing for Hepatitis "B" is available for $20.00 per officer.
Council agreed to pay for the test, with officers being responsible for any further pre-
ventative treatment.
5. PLANNING AND ZONING DEPARTMENT
* DeVac, Conditional Use Permit Amendment
Moved by Schmit, seconded by Theis to adopt Resolution 89-85, amendment to DeVac Conditional'
Use Permit.

* John Menard, Conditional Use Permit
Moved by Schmit, seconded by Theis to adopt Resolution 89-86, Conditional Use Permit for
John Menard to operate a private dog kennel at 4175 Chippewa Rd.
Motion declared carried
* Miller/Sellars, Final Subdivision
Moved by Schmit, seconded by Theis to adopt Resolution 89-87, approving the Miller/Sellars
subdivision on Co. Rd. 24.
Motion declared carried
* Maple Plain Diary Queen, Phil Carlberg, Final Subdivision
Moved by Schmit, seconded by Theis to adopt Resolution 89-88, approving the Philip Carlberg,
Maple Plain Dairy Queen subdivision.

Woodlake Landfill
Loren Kohnen reported that very little garbage was being hauled to Woodlake, most of it being
directed to the Elk River burn plant. He stated that this may continue so as to fill Hennepin
Countys quota, which would mean that Woodlake would not fill up as soon as believed. He
also reported that a lawsuit had been filed against independent garbage haulers who are
hauling to landfills outside of Hennepin County, which is against regulations.
Well Drilling Regulations
Loren Kohnen reported that beginning in 1990 cities will no longer be issuing permits for
well drilling, repairing, or abandonment. The state will be issuing permits as well as making
inspections. He stated that there are not enough inspectors employed by the state and they
have said that they will not,have the time to make all inspections. He explained that some
counties will be delegated to do the job but he did not know if Hennepin County had enough
employees for the job. He stated that cities should be concerned about this because of the
problems that have developed with water quality in the state.
Moved by Mitchell, seconded by Theis to write a letter to the state, with a copy to Hennepin
County, requesting assurance that wells in Medina will be inspected and to ask them for a
schedule of how, and by whom, the work will be done.
Motion declared carried
Robert Mitchell asked that the letter explain that Medina has a lot of wells and that it
would be a detriment to the city if improper work was done.
6.* BOARD OF REVIEW
Moved by Schmit, seconded by Theis to schedule the 1990 Board of Review meeting for April 3,
1990 at 6:30 P.M.
Motion declared carried
7. 1990 APPOINTMENTS
Wilfred Scherer stated that the Mayor had asked the council if anyone had any problems with
any of the appointments that are in effect for 1989.
Anne Theis stated that the appointments to be made on January 2nd are the Mayors decision.
Donna Roehl asked if Council wanted to make any change in the official newspaper, as some
residents were dissatisfied with the Crow River News not being a free newspaper.
Robert Mitchell asked if she would check with other papers regarding the possibility of
their serving all of Medina with their free newspaper.
8. PAYMENT OF BILLS
Moved by Theis, seconded by Schmit to pay the bills; Order Checks # 8191-8244 in the
amount of $82,388.93 and Payroll Checks # 11327-11347 in the amount of $12,843.72.
