Ordinance No, 160, regarding the parking of boats, motor homes, etc. In the residential section was read by the Clerk.. After discussion, the Council Instructed Mr. Maley to send out notices to all taxpayers and residents inform- ing them of the intent of the Council to consider this ordinance and outline the provisions. Mr. Maley said that the Americana Hotel bad requested use of their garage space for convention display purposes at various periods through December 14, 1973. On motion of Mr. Beatty, seconded by Mr. Scott, and voted the request was granted. The Council discussed with Mr. Anderson and Mr. Maley the various ways of funding the balance of monies needed to complete the beach restoration project and Mr. Anderson said he would furnish Mr. Maley a legal opinion on the procedure of setting up a special tax district. The Council authorized the purchase of a suitable gift for Mr.111leneuve In recognition of his service as Councilman. There being no further business, on motion of Mr. Taplin, seconded by Mr. Brush, the meeting was adlourned at 11:25A.M. ATTEST: Village Clerk April 28, 1973 4�l`. Mayor May 3, 1973 The Council. of Bal Harbour Village held a Special Meeting, Thursday, May 3, 1973 at 2:OOP.M, in the Village Hall for the purpose of discussing with Standard Dredging Corporation the contract we had submitted to them for the dredging and various other portions of the beach nourishment project. Present: Messrs. Beatty, Printup, Scott, and Taplin Absent: Mr. Brush Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; Thomas H. Anderson, Village Attorney; Mr. Henry von Oesen and Mr. George Whittaker, engineers for the project; and Mr. John Wiser, President of Standard Dredging and Mr. Marion Sibley and Bob Ward, attorneys. Mr, von Oesen said that as a result of the last Council meeting when the Council was advised by letter from Mr. Marion Sibley that Standard Dredging Corporation was withdrawing its bid, he called Mr. Wiser to see if he would come down and talk to us to determine if his company will sign the contract for the work as bid. He said we wished to pursue the matter and asked Mr. Wiser to ex- plain to the Council his company's position to see if we can find a meeting ground, so we can discuss it. Mr. Anderson said that all these discussions should be without prejudice to either party. Mr. Wiser told the Council that they had prepared their bid with the intention of dredging this year, which was incorrect, having determined the work could only be done from May through September. Ile said that he had spoken to Mr. von Oesen and Mr. Maley, who had offered an allow- ance in labor- and fuel oil for the one year delay, but there were too many factors involved and his Board of Directors would rather see it estimated out and a value placed on it. He said that they would like an increase of $500,000.00 over the original bid. This would amount to a change in price for the sand from $1.33 a yard to approximately $1.63. Discussion followed on the advisability of either letting new bids or contacting the U.S.Corpe of Engineers, State of Florida and Dade County to ascertain their feelings about negotiating the addi- tional costs to Standard Dredging not to exceed $500,000.00. Mr. Maley said he feels that we should advise the governmental agencies Involved that we are declaring a default with the bid bond forfeited and seek their approval to re- bid the job. Mr, von Oesen said he would be glad to call the District Engineer In Jacksonville to find out what they would approve of. Mr. Sibley said that the contract was not signed and additional monies needed,due to Bal Harbour mak- ing a change in the contract offered to Hardaway Construction Corporation, There being no further business on motion of Mr. Taplin, seconded by Mr. Scott the meeting was adjourned at 3:30P.M.
