Members present: Mayor, Wayne Neddermeyer; Councilmembers Nancy Laurent
William Reiser, Thomas Crosby, Arthur Theis; Clerk, Donna Roehl; Attorney
Richard Schieffer; Planning and Zoning Adm. Jeanne Mabusth
Minutes of December 6, 1977
Richard Schieffer reported that the origninal charges against Jeff Howard
Had been dismissed as his property had been cleaned up according to the
order given.
Motion by Thomas Crosby, seconded by Arthur Theis to approve the minutes
of December 6th, as presented.

1. PUBLIC WORKS DEPARTMENT, HAMEL WELL
Ronald Duran reported that the Hamel well is losing pumping capacity. Lyle
Swanson reported that if it can be kept at 200 gpm. that is all that can be
expected. He stated that they can have specs for a test well prepared by
the January 17th meeting.
Richard Schieffer explained the purchase agreement he had prepared which
would allow the city to dig a test well on the Wallace Doerr property.
If well tests sufficent the city may then obtain the property.
Motionby by Nancy Laurent, seconded by Thomas Crosby to authorize the Mayor
and Clerk to enter in;to purchase agreement with Wallace Doerr for purpose
of drilling test well.
Motion carried unanimously
2. ROAD SIGNS
Discussion of installing "No Parking" signs on Blackfoot Trail and Deer Hill
Rd.
Motion by Nancy Laurent to install "No Parking" signs on Blackfoot Trail and
Deer Hill Rd., west of Willow Dr. No second to the motion.
Council decided to wait for input from residents on these roads before pro-
ceeding.
3. WEED SPRAYING
Motion by Nancy Laurent, seconded by Thomas Crosby to authorize Robert Dressel
and Leroy Giese to take exams in St. Paul for weed spraying.
Motion carried unanimously
4. HOME SEWAGE DISPOSAL WORKSHOP
Motion by Nancy Laurent, seconded by William Reiser to authorize Paul °gland
to attend workshop for home sewage installation inspection.
Motion carried unanimously
5. 8:00 P.M. Public HEARING, BYINGTON ACRES
Mayor called for discussion on the proposed plat.
Motion by William Reiser, seconded by Thomas Crosby to close the public
hearing on the Byington Acres plat.
Motion carri d unanimously
Members discussed park fees as determined by City Assessor using previously
approved formula. Wayne Neddermeyer stated that in cases of small plats
such fees are to large and suggested that the part set off of the orignal
parcel should be the determining factorin setting park fees.
Motion by Thomas Crosby, seconded by Arthur Theis to adopt Resolution 77-46
approving Byington Acres plat subject to:
a. Park fee to be $300 to reflect that a new lot o 2 acres is being cre-
ated.
b. Additional administrative costs not covered by the $150 minimum platting
fee shall be reimbursed to the city by the developer.
c. Future owner of Lot 2, Block 1 must obtain an entrance permit from
Hennepin County Highway Department.

200 6. 8:10 P.M. PUBLIC HEARING, EMBRETS ADDITION
Lyle Swanson reported that drainage easement has been allowed (all of the
wetlands area.)
Motion by Thomas Crosby, seconded by Arthur Theis to close the public hearing.
Motion carried unanimously
Motion by Thomas Crosby, seconded by William Reiser to approve Embrets
Addition, plat, subject to:
a. Variance from Ord. 163 requiring 2 acre minimum of high and dry land
is allowed as there is 1.36 acres of wetlands and 1.70 acres o-F high
ground.
b. Additional administrative costs not covered by the $150 minimum platt-
ing fee shall be reimbursed to the city by the developer
c. This platting leaves a parcel of property to the east landlocked
except for a 10 ft. easement through plat
d. Park fee as determined by City Assessor is $300
Motion carried unanimously
7. 8:25 P.M. D.M.E. PUBLIC HEARING
Mayor called for discussion on the proposed plat.
Motion by Arthur Theis, seconded by Nancy Laurent to close the public hearing.
Motion carried unanimously
Motion by Thomas Crosby, seconded by Arthur Theis to approve the D.M.E. plat
subject to:
a. Buyer to assume responsibility of upgrading Goal Ridge Rd. to city
specifications, to his driveway entrance
b. Additional administratiave costs not covered by $150 minimum platting
fee shall be reimbursed to city by the developer
c. Park fee waived by Council with this platting as subject property has
been previously platted
d. Variance from Odd. 163 requiring 2 acre minimum platting. Prior to
this replatting this was a 1/2 acre lot, now will be a 3/4 acre lot

8. FRED SANDE, DANCE PERMIT
Discussion of Mr. Sande's request for

9. SALARIES
Motion by Nancy Laurent, seconded by Wayne Neddermeyer to table 1978 salary
discussions until the January 3, 1978 meeting.

10. BUILDING INSPECTING FEES
Motion by Thomas Crosby, seconded by Nancy Laurent to adopt the Minnesota
State Building Code and include the provision that if fees are less than
the inspection costs then 125% of the fees listed by the state shall be
charged.
Motion carried unanimously
Ron Duran reported that Paul Ogland will work with sewer, water and septic
inspections but does not want to become involved in the plumbing inspect-
ions.
Discussion of the inspection fees that will be charaged by Orono compared
to theamount now being charged for building, septic, well, sewer and water
connections . In some situations amounts collected will be less than
inspections charges by Orono.
11. GARY LINDGREN, TAX FORFEIT LOTS AND STREET VACATION
Discussion with Mr. Lindgren of vacating streets and purchase of tax forfeit
lots.
Resolution regarading purchase of property will be prepared for the Jan. 3
meeting.
Motion by Thomas Crosby seconded by William Reiser to hold a public hearing
on February 7, 1978 at 8:00 P.M. to consider vacating portions of Fern St.
from Cedar Ave. to Maple Ave.and Maple Ave. from Maple (Lake) St.to Walnut
St. in the Independence Beach plat.
Motion carried unanimously

12. DAIRY QUEEN AND AHLM EROSION CONTROL
Emil Jubert reported that the Minnehaha Creed Watershed Dist. had discussed
erosion control plans of the Dairy Queen and he had informed them of the
proposed Ahlm plat in the same area and the fact that they will need an
erosion control plan also.
They asked that the city keep them informed of the progress of the Ahlms plat.
13. LANDFILL SITE SELECTION
Emil Jubert reported that public hearings will be held when sites have been
selected.
Nancy Laurent stated that she would ask the Hennepin Co. Park officials to
keep the city informed of developments.
14. FIRE DEPARTMENT BUDGET
Thomas Crosby stated that he would discuss the Long Lake budget increase
request with their Fire Chief and he would p epare a specific proposal for
the January 3rd meeting.
15. AUDITOR
Motion by Thomas Crosby, seconded by William Reiser to appoint Merril Hanson
as auditor for 1977 subject to their reconciling bank accounts and spot
checks on cash, for no additional charge.

16. CIGARETTE LICENSES
Motion by William Reiser, seconded by Thomas Crosby to approve the following
cigarette licesnses for 1978: Medina Rec., The Hill Liquor, Pat Wald Liquor,
Rolling Green Country Club, Coleman's Dockside Inn, Don Mayer Inc., Kunz Oil'
Company, Tom's Superette.
Motion carried unanimously
17. S.J. GROVES, PROPERTY TRADE
Lyle Swanson stated that he had inspected the Michael Scherer property and
found it desireable for park purposes. He will complete sketchs of the
area the city may wish to consider and present to the Planning Commission
for consideration.
18. DIVERSIFIED INSULATION AGREEMENT
Motion by Thomas Crosby, seconded by William Reiser to authorize the Mayor
and Clerk to enter into the development agreement with Diversified Insulation.
Motion carried unanimously
19. RUSS BOULEY, BUILDING INSPECTOR
Motion by Thomas Crosby, seconded by Nancy Laurent to pay Russ Bouley $4250.00
for building inspecting for 1977. To recognize his years of service to the
city and to recognize that he would have received $2600 under the previous
years arrangements and to acknowledge that the city has had to spend add-
itional money to assist him in his duties.

Motion by -William Reiser, seconded by Arthur Theis to aughroize the purchase
of a filing cabinet and desk.

21. BOARD OF REVIEW MEETING
Motion by Arthur Theis, seconded by Thomas Crosby to acknowledge the
Counties request to hold the annual Board of Review meeting on April 18,
1978.
Motion carried unanimously
22. TAX FORFEIT LOT ASSESSMENT PROCEDURES
Richard Schieffer recommended that Special assessments on tax forfeit prop-
erty be paid by the purchaser at time of sale of such property.
23. DECEMBER 6th MINUTES
?Motion by Thomas Crosby, seconded by William Reiser to amend the Council
minutes of Dec. 6th to indicate public hearings for Community Development
Block Grant Funds will be held on Jan. 3 and Jan 17, 1978.

24. ORONO BUILDING INSPECTING CONTRACT
Motion by Thomas Crosby, seconded by Arthur Theis` to approve the building
inspecting contract with Orono and authorize the Mayor and Clerk to sign same.

25. BILLS
Motion by Arthur Theis, seconded by Thomas Crosby to pay the bills: Payroll
# 474+3 - 4757 in the amount of $8086.56 and Order Checks # 7132 -7136 in
the amount of $1336.73.
Motion carried unanimously
26. PUBLIC WORKS DEPARTMENT
Ron Duran called Council's attention to problems at Medina Morningside
whereby homeowners, particularly, A11 en Engleman, is pumping seepage
water from his basement onto the street. Council discussed the need for
storm sewer in thearea but could give no immediate solution to the problem.
Ron Duran reported on the Public Works Seminar he had attended.
Council discussed the cut -back in the Hennepin Co. Sheriff's patrdl, with
Police Chief Hoover. Thomas Crosby stated that it will take a major dis-
aster in the middle of the night for all to realize the dilemma Medina
and others are facing.
Motion by William Reiser, seconded by Thomas Crosby to adjourn.
