HomeMy Public PortalAbout1973-05-26 MeetingMr. von Oesen said that as a result, of the last Council meeting when the Council was advised by letter from Mr. Marion Sibley that Standard Dredging Corporation sea withdrawing its bid, he called Mr. wiser to see if he would come down and talk to us to determine if his company will sign the contract: for the work as bid. He said we wished to pursue the matter and asked Mr. Wiser to ex- plain to the Council his company's position to see if we can find a meeting ground, so we can discuss it. Mr. Anderson said that all these discussions should be without prejudice to either party. Mr. Wiser told the Council that they had prepared their bid with the intention of dredging this year, which was incorrect, having determined the work could only be done from May through September. He said that he had spoken to Mr. von Oesen and Mr. Maley, who had offered an allow- ance in labor- and fuel oil for the one year delay, but there were too many factors involved and his Board of Directors would rather see it estimated out and a value placed on it. He said that they would like an increase of $500,000.00 over the original bid. This would amount to a change in price for the sand from $1.33 a yard to approximately $1.63. Discussion followed on the advisability of either letting new bids or contacting the U.S.Corps of Engineers, State of Florida and Dade County to ascertain their feelings about negotiating the addi- tional costs to Standard Dredging not to exceed $500,000.00. Mr. Maley said he feels that we should advise the governmental agencies involved that we are declaring a default with the bid bond forfeited and seek their approval to re- bid the job. Mr. von Oesen said he would be glad to call the District Engineer In Jacksonville to find out what they would approve of. Mr. Sibley said that the contract was not signed and additional monies needed,due to Bal Harbour mak- ing a change in the contract offered to Hardaway Construction Corporation. There being no further business on motion of Mr. Taplin, seconded by Mr. Scott the meeting was adjourned at 3:30P.M. Present: Messrs Beatty, Brush, Printup and Scott Absent: Mr. Taplin Also present were Fred Maley, Village Manager; Thomas H. Anderson, Village Attorney; and Petty Carver , Deputy Village Clerk. The minutes of the previous meetings of April 28, 1973 and May 3, 1973 were approved. Mav 26. 197.1 16 4 Mr. Charles Thompson, owern of Lot 8, Block 11, Residential Section, appeared to request a variance to screen his swimming pool.. Mr. Thompaton stated that Dr. Lewis Elias and Airs. Fredric Tobin, his adjacent property owners, had no objection to his screening the pool. area. Letters from Dr. Elias and Mrs. Tobin were requested by the Council. It was moved by Mr. Brush, seconded by Mr. Beatty that action on die variance be tabled until the next meeting. Mr. Raymond Costello appeared requesting a variance to close up his garage to make a den or bedroom at this residence at 101 Bal Cross Drive, Lot 2 Block 6, Residential Section. The Catrcil stated that no variance would be granted to eliminate a garage completely. He was asked to submit architectural drawings of a new garage or carport. -showing the site location, if he still wished to remodel his present garage. Mr. Fred Baisden, Jr. appeared on behalf of the Sutton - Carlton Apart- ments to request a variance to permit a canopy sign on the entrance of the building. Inasmuch as the drawing he presented showed no dimensions, he was asked to present a scaled drawing at the next meeting for consideration. Police Chief Staubesand appeared regarding speeding in the residential section of the Village. The % lice Department was authorized to enforce the 20 MPH speed limit in the Village, and a log is to be kept of names of residents who are stopped the first time and warned of speeding. All Village residents affected are to be advised of this enforcement by a tewsletter. A letter from the Harb our House was read by Fred Maley, advising of $150.00 expenses for re- wiring, etc. in connection with the jetty job, and asking for reimbursement. The amount was approved by the Council for payment upon submission of a formal bill. A letter from Mr. Marion Sibley, attorney for Standard Dredging Corporation, addressed to Mr. Thomas H. Anderson, was read in reply to Mr. Anderson's letter of May 14, 1973 to Standard Dredging Corporation and Commercial Union Insurance Co. Mr. Anderson recommended that a suit against the surety company be delayed until new bids for the dredge and fill work have been opened. It was moved by Mr. Brush, seconded by Mr. Beatty, and unanimously voted that the Village Manager seek approval of the three other governmental agencies involved to re- advertise for bids. ORDINANCE NO. 160 banning campers, house trailers, motor homes, boats and boat trailers, hearses, etc, from being parked in the residential disxrict for more than four (4) hours at a time, was read. On motion of Mr. Brush, seconded by Mr. Beatty and unaimous- ly passed the Ordinance was adopted. Mr.. Maley reported that a statewide Resort Tax Bill was killed in sub - Committee by a vote of 16 -6. Mr. Yaley was authorized to get an opinion from the Community National Bank :4 Trust Co. and other banks, on bonds for the beach project, pledging 100I> of the Resort Tax money and an ad valorum tax on a Special Tax District. A letter was read from Mr. Larry Cliff, president of the Bal Harbour Resort Association, requesting 52,909.00 for a full -page ad in the Florida Edition of the 1973 AAA Tour Book, using Resort Tax Funds, Mr. Beatty moved May 26, 1973 I x,. that the request be granted, seconded by Mr. Scott and passed. On motion of Mr. Beatty, seconded by Mr. Brush, the meeting was adjourned at 11:15 A.M. Beatty, Printup, Scott and Taplin Absent: Mr. Brush Also present were Fred W. Maley, Village Manager; Mary T, Wetterer, Village Clerk; and Thomas H. Anderson, Village Attorney. On motion of Mr. Beatty, seconded by Mr. Scott and voted the minutes of the previous meeting of May 26, 1973 were approved as submitted. Mr. Charles Thompson appeared before the Council in regard to screening his pool. Mr. Maley said the Village had received letters from Mr. Tobin and Dr. Elias, owners of the adjoining properties, who stated they had no objection to the requested variance. Mr. Scott pointed out that the variance would be at odds with our deed restrictions. After discussion on previous owner's requests for the same variance it was moved by Mr. Scott, seconded by Mr. Beatty and unanimously voted that the Council follow the previous actions taken and deny the request. At Mr. Thompson's request the Mayor agreed to give the matter reconsideration at the next meeting. Mr. Anderson read an Agreement from Bal Harbour Towers, Inc. to Bal Harbour Village giving the Village public access to the beach. On motion of Mr. Beatty, seconded by Mr. Scott, the Agreement was accepted unanimously with Mr. Taplin abstaining due to a conflict of interest. Mayor Printup and Village Clerk Wetterer were authorized to sign the Agreement on behalf of the Village. Mr. Maley said that in accordance with the Federal Revenue Sharing Act, we had published our intended use of the monies received in the Miami Review. Mr. Beatty requested that the Manager check with the Department of Revenue Sharing to make sure our using this money for our portion of the library expenses is an approved expenditure.
