MEDINA CITY COUNCIL MEETING MINUTES OF DECEMBER 20, 1994
The City Council of Medina, Minnesota met in regular session on
December 20, 1994 at 7:30 p.m. in the City Hall Council Chambers
with Mayor Anne Theis presiding.
Members Present: John Ferris, Ann Thies, Philip Zietlow and
Mayor Theis.
Members Absent:
Also Present:
James Johnson and Phil Zietlow until 7:46 p.m.

Engineer Shawn Gustafson, Zoning Administrator
Loren Kohnen, City Attorney Ron Batty and
Clerk -Treasurer Jeff Karlson.
1. ADOPTION OF THE AGENDA
Moved by Thies, seconded by Ferris, to adopt the agenda with the
following additions:
A. City Hall Improvements
B. Approval of Thorpe Distributing Repayment Agreement
C. Request from City of Loretto to Annex Wastewater Ponds
D. Update on Comprehensive Plan Amendment for Fred Keller
Motion passed unanimously.
2. CONSENT AGENDA
Moved by Thies, seconded by Ferris, to approve the consent agenda,
as follows:
A. Approval of Gambling License and Beer Permit for Holy Name
Church for Fund Raiser to be held March 11, 1994
B. Resolution No. 94-79, "Resolution Granting Preliminary Plat
Approval to Robert Pepin"
C. Resolution No. 94-80, "Resolution Granting Preliminary Plat
Approval to Dennis Hecker"
D. Resolution No. 94-81, "Resolution Granting Preliminary Plat
Approval to Donald Pearson and Michael Sealand"
E. Resolution No. 94-82, "Resolution Approving 1994 Tax Levy,

Motion passed unanimously.
3. MINUTES
Moved by Thies, seconded by Ferris, to approve the minutes of the
regular meeting of December 6, 1994 as presented. Motion passed
unanimously.
Moved by Thies, seconded by Ferris, to approve the minutes of the
special meeting of December 7, 1994 as presented. Motion passed
unanimously.
4. USE OF NO -PHOSPHOROUS FERTILIZER
Moved by Mayor Theis, seconded by Ferris, to table discussion
regarding the use of no -phosphorous fertilizer until the next
meeting on January 3, 1995. Motion passed unanimously.

5. TRANSTECH TIF AGREEMENT
Ron Batty said the development agreement with Transtech was similar
to the agreement with Thorpe Distributing. Transtech agreed to
reimburse the city for the loss of state aid which would result
from the creation of this TIF district.
Moved by Thies, seconded by Ferris, to approve the TIF agreement
with Transtech, Inc. Motion passed unanimously.
6. THORPE DISTRIBUTING REPAYMENT AGREEMENT
Ron Batty said the repayment agreement with Thorpe Distributing was
just a conclusion of the Thorpe tax increment matter. Batty said
once the building was built and costs had occurred, the repayment
agreement became a free-standing document whereby the City agreed
to reimburse Thorpe for its actual expenditures for "Qualifying
Reimbursable Costs" from tax increment paid to the City after first
deducting the amount necessary to pay special assessments levied
against Thorpe's property.
Moved by Mayor Theis, seconded by Ferris, to approve the execution
of Repayment Agreement with Thorpe Distributing. Motion passed
unanimously.
Phil Zietlow arrived at 7:46 p.m.
7. TRANSFER OF FUNDS
Jeff Karlson asked the council to authorize the transfer of
$48,426.57 from the General Fund to the 1985 G.O. Improvement Fund,
$143,395.59 from the TIF Capital Projects Fund to the TIF Debt
Service Fund, and $196,900.50 from the General Fund to the
Clydesdale Trail/Willow Drive Improvement Fund.
Moved by Thies, seconded by Ferris, to adopt Resolution No. 94-83,
"Resolution Authorizing the Transfer of Funds."
Ayes: Ferris, Thies, Zietlow and Mayor Theis. Nays: None.
Resolution No. 94-83 adopted on a 4-aye and 0-nay vote.
8. HENNEPIN COUNTY PUBLIC WORKS FACILITY
Ron Batty said the Minnesota Pollution Control Agency (MPCA) would
not grant the county the necessary sewage discharge permit for the
proposed county facility. Batty said the county expressed interest
in having the City amend its comprehensive plan to put the 146 acre
site into the MUSA district.
Mayor Theis said in a meeting with James Grube, a transportation
division manager with the county, he reported that the county was
no longer going to request a comprehensive plan amendment, but were
instead exploring the possibility of on -site septic systems. Their
proposal included the removal of a sizable amount of soil. Theis
added that the Met Council indicated that they would not support
the widening of T.H. 55 into a four lane highway outside the MUSA
line because it would encourage leapfrog development. Theis asked
if the council would be willing to have an informal meeting with
the county to discuss the traffic situation.

John Ferris said he would like to hold a public hearing on the
matter.
Phil Zietlow said it bothered him that the county was not
forthright with the city when they insisted that this was a
feasible project.
Ferris said he would not support an on -site disposal system that
would have any meaningful risk.
Mayor Theis said she would not support any proposal which might
jeopardize sewer availability for other Medina residents and
businesses.
Ferris said the project would destroy everything that matters to
people in the Hamel area.
Ron Batty said the council should give the county a sense of where
Medina stood on the issue. Batty said the more steps taken by the
county toward this site, the more expenses they would incur which
would make it more difficult for them to pull out.
Loren Kohnen said the county was going to pursue the possibility of
on -site disposal systems.
Moved by Ferris, seconded by Zietlow, to direct staff to prepare a
letter to Vern Genzlinger, Hennepin Co. public works director,
stating that Medina is not an appropriate location for this
facility and would be better served in a sewered area with greater
traffic accessibility. Motion passed unanimously.
9. CONVEYANCE OF TAX FORFEITED LAND
Hennepin County notified the city in a letter that one parcel (13-
118-23-22-0015) in Medina was declared forfeited to the state by
the county auditor. The parcel was an eight foot strip located
along a 33 foot easement between the Hunter Farms Addition and the
Tuckborough Farm Additions. The county requested that the city
council either approve the parcel for public auction or request a
conveyance to the city for public use.
Jim Dillman said the tax forfeited land could be added to the 33
foot easement which was designated as a park trail.
Moved by Zietlow, seconded by Thies, to adopt Resolution No. 94-84,
"Resolution Approving the Classification of Non -Conservation Tax
Forfeited Land Within the City of Medina."
Ayes: Ferris, Thies, Zietlow and Mayor Theis. Nays: None.
Resolution No. 94-84 adopted on a 4-aye and 0-nay vote.
Moved by Zietlow, seconded by Thies, to adopt Resolution No. 94-85,
"Resolution Requesting the Conveyance of Tax Forfeited to the City
of Medina for Public Use."
Ayes: Ferris, Thies, Zietlow and Mayor Theis. Nays: None.

10. UPDATE ON COMPREHENSIVE PLAN AMENDMENT FOR FRED KELLER
Loren Kohnen said the City of Long Lake was unwilling to allocate
any of their unused sewer units for the proposed Fred Keller
residential development.
Fred Keller said Orono, Long Lake and Medina should jointly
approach the Met Council to talk about development between Highway
12 and County Road 6 and the availability of sewer units.
Shawn Gustafson pointed out that Orono had several homes with
failing septic systems.
Kohnen said Long Lake city administrator Joe Lynch would be writing
a letter to David Licht which would outline the position Long Lake
was going to take on the matter.
11. IMPROVEMENTS TO CITY HALL
Mayor Theis said she talked to the department heads about the city
hall to find out what improvements they were recommending should be
made to the building. Theis said one the most noticeable problems
was water coming through the cement block walls on the lower level
of the building.
John Ferris said the problems should be quantified so a decision
could be made as to what should be done to correct each problem.
Ferris said the department heads should get estimates before any
decision was made to go ahead with an improvement.
12. REQUEST FROM LORETTO TO ANNEX WASTEWATER PONDS
In a letter to Mayor Theis, the City of Loretto asked the Medina
council to consider detaching the property where Loretto's
wastewater ponds were located so the land could be annexed to
Loretto.
John Ferris said he did not know of any reason why Medina would
consider detaching this land so it could be annexed to Loretto.
Ron Batty said Loretto's request to annex this land was probably a
response to a number of incidents where Medina expressed
dissatisfaction regarding the ponds.
Phil Zietlow said it was not to Medina's benefit to detach the
land.
Batty said whether the ponds were in Medina or Loretto really made
no difference.
Zietlow said the point the council was trying to make was that
Medina wanted to be appraised ahead of time before this type of
activity occurred again.
Moved by Ferris, seconded by Zietlow, to direct the city clerk to
notify the City of Loretto that the council had reviewed the
annexation matter and elected to deny their request to annex the

wastewater ponds to Loretto. Motion passed unanimously.
13. PAYMENT OF BILLS
Moved by Ferris, seconded by Thies, to approve payment of Order
Check Numbers 14038-14091 for $65,792.98 and Payroll Check Numbers
14181-14194 for $11,218.44. Motion passed unanimously.
14. ADJOURNMENT
Moved by Thies, seconded by Zietlow, to adjourn the meeting at 8:44
p.m. Motion passed unanimously.
