The (buncil of Bal Harbour Village met Saturday, June 30, 1973 at
9:30 A.M. in the Village Hall.
Present. Messrs. Beatty, Printup, Scott and Taplin
Absent.: Mr. Brush
Also present were Fred V. Maley, Village Manager; Mary T, Wetterer,
Village Clerk; and Thomas H. Anderson, Village Attorney.
On motion of Mr. Beatty, seconded by Mr. Scott and voted the minutes
of the previous meeting of May 26, 1973 were approved as submitted.
Mr. Charles Thompson appeared before the Council in regard to screening
his pool. Mr. Maley said the Village had received letters from Mr. Tobin and
Dr. Elias, owners of the adjoining properties, who stated they had no objection
to the requested variance. Mr. Scott pointed out that the variance would be
at odds with our deed restrictions. After discussion on previous owner's requests
for the same variance it was mowed by Mr. Scott, seconded by Mr. Beatty and
unanimously voted that the Council follow the previous actions taken and deny
the request. At Mr. Thompson's request the Mayor agreed to give the matter
reconsideration at the next meeting.
Mr. Anderson read an Agreement from Bal Harbour Towers, Inc. to
Bal Harbour Village giving the Village public access to the beach. On motion
of Mr. Beatty, seconded by Mr. Scott, the Agreement was accepted unanimously
with Mr. Taplin abstaining due to a conflict of interest. Mayor Printup and
Village Clerk t- letterer were authorized to sign the Agreement on behalf of the
Village.
Mr. Maley said that in accordance with the Federal Revenue Sharing Act,
we had published our intended use of the monies received in the Miami Review.
Mr. Beatty requested that the Manager check with the Department of Revenue Sharing
to make sure our using this money for our portion of the library expenses is an
approved expenditure.

Mr. Maley said that he had asked Harton fischeman for their recommer-
darions on the setbacks for Lot 1, Ocean Front. District, and they will be sent
next week.. However, by phone they suggested 50' .front setback, 40' side set-
backs, and underground parking along 96th Street would have to be 20' frcm the
southern lot line. He said that a formal amendment to the 7oning Ordinance
would be ready for the next meeting.
The Villag< Manager said that he has received a complaint about
people living on yachts in the yacht harbor and it was the Council's opinion
that Mr. Maley should take this matter up with the President of the Bal
Harbour Club to see what action they are taking with their members and then
the Council can pursue the matter further at the next meeting.
Mr. Maley said that Mr. von resen will be here about the 8th or 9th
of July to finalize the readvertising for bids on the beach restoration pro-
ject. He said that the work would be advertised no later than July 15th and
bids would be opened at 10:00 A.M., Wednesday, September 12th. Mr. Anderson
asked the Council if they would agree to let. Standard Dredging Company rebid
without prejudice and on motion of Mr. Scott, seconded by Mr. Taplin, and
voted the Council agreed.
Mr. Maley said that he had received the coat estimates for the im-
provements to the water system from i.udovici- orange in the amount of $70,000.00.
He explained that we have about $45,000.00 available and he will recommed some
method of financing at the next meeting.
Mr. Anderson reported that the North Bay Village water rate case
against Miami Beach has been set for trial next month and we are petitioning
to have our case set with theirs under Judge Highsmith.
There being no farther business on motion of Mr. Beatty, seconded by
Mr. Taplin rind voted the meeting was adjourned at 10:55 A.M.
