HomeMy Public PortalAboutConservation Minutes 2012-07-10 Orleans Conservation Commission , ...\' °,e; Town Hall, Nauset Room or Meeting, Tuesday, July 10, 2012, PRESENT:; Judith Bruce, Chairwoman; Steve Phillips, Vice-Chairman; Bob Royce; Adrienne Pfluger; James Trainor; Jamie Balliett; John Jannell, Conservation Administrator ABSENT: Jim O'Brien. 8:30 a.m. Call to Order Certificate of Compliance Elliot and Nancv Johnson (2011), 85 Brick Hill Road. The request for a Certificate of Compliance for an Order of Conditions for the construction of a barn. Jamie Balliett inquired if there were plantings associated with this Order which would require additional time to be established. John Jannell reported that only the disturbed area required reseeding which had occurred, and the project was in substantial compliance. MOTION: A motion to issue this Certificate of Compliance was made by Jamie Balliett and seconded by Adrienne Pfluger. VOTE:5-0-1; Steve Phillips abstained. Administrative Reviews Judith Downes, 15C-15D Center Place. The proposed removal of a dead pine and pruning of two oak trees. Work will occur within 100' of the Edge of Pond. John Jannell said this tree was up against the house, and the remainder of the parcel was well treed. MOTION: A motion to approve this tree removal was made by Adrienne Pfluger and seconded by Bob Royce. VOTE: Unanimous LeStaqe,Garner, & Croll, 127 Barlev Neck Road. The proposed removal of a dying cedar tree. Work will occur within a 50' of a Salt Marsh and within the Pleasant Bay A.C.E.C. Work to be done by Frank White. John Jannell explained this area had a Conservation Restriction over it, and was also a part of a turtle habitat project. Judith Bruce was concerned that the snag provided wildlife benefit, and would be best to leave. Steve Phillips noted that there was a row of standing dead locusts to be used by wildlife and this small dead cedar could be removed as proposed. MOTION: A motion to approve this work was made by James Trainor and seconded by Jamie Balliett. VOTE: Unanimous as Egg Homeowners Association, 19 Little Bav Road. The proposed installation of 3 kayak racks on association beach. Work will occur on a Coastal Beach, on Land Subject to Coastal Storm Flowage, and within the Pleasant Bay A.C.E.C. David Lyttle of Ryder &Wilcox passed around a photo of the site, stating that the kayak racks would be installed in-between the gabion toe protection and dinghy post and chain line. Judith Bruce was concerned about the amount of chain and post already existing on the 1 beach, and asked if a reduction from 60 feet to 30 feet in exchange for the installation of the kayak racks would be possible. Bob Royce said that this reduction would only allow 4-5 dinghies to tie up. Steve Phillips asked how many owners the area served, and James Trainor estimated 30-40 owners. Jamie Balliett asked if 12 kayak spots would be ample room for the association members, and if they would be seasonally removed. David Lyttle explained that the association had a meeting regarding the number of racks needed on site; the association felt 12 racks would be sufficient, and the racks would be seasonally removed. John Jannell asked if the existing dinghy posts could be used as part of the kayak rack, thus reducing the amount of proposed posts and allowing the existing posts to serve multiple purposes. David Lyttle thought the contractor, Anchor Marine, would be able to adjust their design accordingly to utilize the existing posts. John Jannell said he could make a note at the bottom of the Administrative Review asking the builder to make use of the existing 4x4 posts on site, and the Commission agreed to authorize him to make the notation. MOTION: A motion to approve this work and the note on the Administrative Review to reuse the existing posts was made by Jamie Balliett and seconded by Adrienne Pfluger.
