APPROVING CHANGE ORDER #4 & PAYMEN CERTIFICATE #5
HILL DISTRICTIWEST CARTERET SEWE PROJECTS-
B&B CONSTRUCTION CO. IN
WHEREAS, the Governing Body of the Borough of Carteret has previously
awarded a contract to B&B Construction Co. Inc., in th amount of $346,540.00
for the Sewer Repair/Replacement program for the Hi 1 District/West Carteret
Sewer Projects; and
WHEREAS, the Borough's Consulting Engineer fo the project, T & M
Associates, has advised the Governing Body that a modi lcation to the contract is
reasonable and necessary and has recommended that t e aforesaid contract be
modified in accordance with Contract Change Order #4, ttached hereto; and
WHEREAS, Change Order #4 includes a change in th description of work to
reduce and increase quantities to complete project cons ruction and reflect final
as-built quantities and additional work performed on Pek la A venue; and
WHEREAS, Change Order #4 provides for a net increa e in the contract price in
the amount of $1,551.59, resulting in a revised contra t price of $348,091.59,
including all previously approved Change Orders; and
WHEREAS, the Borough's Consulting Engineer, T&M Associates, has advised
that the above described changes and/or modifica1Îo s to the project were
unforeseen at the time of the award of the original contra 1.
NOW, THEREFORE, BE IT RESOLVED by the Ma or and Borough Council
of the Borough ofCarteret, County of Middlesex, State 0 New Jersey as follows:
1. That Contract Change Order #4, attached heret and made a part hereot:
providing for a net increase of $1,551.59 in e overal1 contract price,
including all previous Change Orders, resulting in a revised total contract
price of $348,091.59, is hereby approved.
2. That the appropriate Borough officials are hereb authorized and directed to
execute Change Order #4.
3. That the Borough's Purchasing Department is h eby authorized to execute
final payment pursuant to Payment Certificate #5 See Attached).
4. That a copy of this Resolution and a fully execute copy of Change Order #4
be forwarded to the Borough's Purchasing Depart ent and to T&M
Associates for distribution to B&B Construction o. Inc.

Enclosed are the following documents for final payment an contract closeout of the above
referenced project.
· Payment Certificate No.5 - Final in the amount of $7,4 9.99.
· Change Order No.4 - Final in the amount of$I,551.5 . The Change Order reflects final
as-built quantities and additional work performed on Pekola Avenue. Due to
contaminated soils, B&B was required to dispose of co taminated soils and perform final
paving of disturbed trench area. The resulting revised nal contract price is $348,091.59.
Please be advised that there will be a net overall reduct" n in the total amount of the three
Hill District/West Carteret Sewer contracts.
· Affidavit of Compliance with the New Jersey Prevaili g Wage Act, Chapter 150 of Law
of 1963 (copy of what was previously sent).
· Maintenance Bond #9353MNT in the amount of $87,167.75 (copy of what was
previously sent).
We have reviewed the enclosed documents and recommen approval of Change Order No.4
and final payment and closeout of the contract subject t review of the documents by the
