So much has happened since I sent you our last monthly round-up: On July 1, we held a walkout in Hadley in support of fellow crew member Steve Andrade, who was terminated in retaliation for his union support. Community members and customers joined our picket (or refused to cross it!) as we spoke, marched, and chanted for Steve’s reinstatement. One week later, we asked our community to help keep up the pressure by calling the Hadley store to demand Steve’s reinstatement, and y’all did not disappoint! As soon as our email went out, the store got so many phone calls that management took the phones off the hook in frustration. Your calls make it clear that the community cares and wants to see Steve reinstated. This message was heard loud and clear by our employer, and it gave us a huge morale boost, too! Thank you. Just when we thought our Louisville local would finally be certified, as recommended by the NLRB Hearing Officers Report on the matter, Trader Joe’s threw another wrench into the process by filing exceptions to the report. These exceptions, while baseless, will delay certification and keep Louisville out of negotiations for an unknown amount of time. We launched our union merch program…and Trader Joe’s filed a lawsuit against us! Our merch lets folks everywhere show their support for Trader Joe’s United and spreads our message far and wide, so we see this lawsuit for what it really is: an attempt to silence our union. THANK YOU for supporting our mission with your merch orders (if you missed out, we’ve got pins, shirts, totes and more right here). The National Labor Relations Board issued a complaint against Trader Joe’s, finding merit in numerous unfair labor practice charges that we’ve filed against Trader Joe’s. It was so validating to have the NLRB affirm what we’ve known all along: that Trader Joe’s is violating our rights as workers. Since Trader Joe’s continues to deny all charges, the case will proceed to a hearing in October, and we’re still awaiting complaints on many other charges we’ve filed. Finally, we celebrated! July 28 was the one year anniversary of our first union election win in Hadley, MA! What we’ve been able to accomplish as a completely worker-driven union in the past year has been absolutely incredible, and far beyond what we anticipated. Support and solidarity from people like you has made this year possible. It’s not just the donations–though those are crucial. It’s also the moral support when you send us a quick note of encouragement, it’s when you amplify our work on social media, show up to our rallies, or make a phone call. This work is challenging, and knowing that you have our back means the world to us. Thank you. Seriously, there’s never a dull month at Trader Joe’s United. This list doesn’t even include all the day-to-day work that goes into running TJU at the national level and our four locals as well as organizing new stores–all between working our grocery shifts and caring for ourselves and our families. Your support makes our work possible. We are an independent union still negotiating our first contract, and as such don’t collect dues yet. How kids spend their summer mattersPACF supports organizations helping to close the summer equity gap With as many as 40 percent of households in the Bay Area headed by single parents, and over 5 percent of youths in Santa Clara and San Mateo Counties living in poverty, finding affordable summer opportunities for children is challenging. For families struggling with limited time and resources, summer enrichment for kids is expensive and essential. Palo Alto Community Fund (PACF) is proud to support local organizations that offer a variety of enriching programs for youth. Staying engaged in meaningful learning experiences throughout the summer has become even more essential given the significant learning loss during COVID-19 resulting from remote and interrupted study. Many of these summer offerings are available free of cost, and provide access to a wide range of activities: academic tutoring, swim lessons, arts and crafts, cultural heritage, dance, hiking, cooking, sports, community service — and pure play! These programs help foster social relationships along with developing valuable skills. A range of summer support for kids and youth Anamatangi Polynesian Voices, based in East Palo Alto, is committed to serving the local Native Hawaiian and Pacific Islander community through heritage preservation and civic and inter-generational engagement. PACF is thrilled to have helped facilitate a partnership between Anamatangi and EPACENTER to help the Anamatangi summer camp youth and elders find space to celebrate the joy of their cultural heritage, learning through singing, dancing, drumming, outrigger canoeing, practicing traditional healing arts, and learning about climate change. Part of the magic is sharing experiences with and learning from Native Hawaiian and Pacific Islander elders. The summer camp took place at two PACF Grantee locations: EPACENTER and Boys and Girls Club of the Peninsula (BGCP), where their culminating performance was under the spotlight as part of the BGCP Summer Showcase. Boys & Girls Clubs of the Peninsula (BGCP) is dedicated to empowering the youth in our community. BGCP provides numerous summer offerings, including K-8 programs for academic skill building, art programs, STEAM, the Barry Carr Sports Leagues for kids to learn life skills and have fun playing sports, and high school/post-secondary programs for student engagement and enrichment via club activities (graphic design, culinary, etc.). The Circuit EPA is an East Palo Alto-based nonprofit centered on technology education and youth development. Their mission is focused on addressing inequities and access to high-quality STEAM (science, technology, engineering, art, math) opportunities in and out of school time. Innovation for everyone StreetCode Academy offers a fun variety of enriching summer programming. Through an emphasis on coding, web design, and game development, StreetCode keeps students learning by removing a major barrier to the tech world in Silicon Valley. They currently offer a weekly open lab for all ages to experience virtual and augmented reality. A safe place to play CoolineKids was founded by middle schooler, Christian Sbragia, in 2013 Christian Sbragia, in 2013 to empower and equip young leaders of color, focused on East Palo Alto youth. CoolineKids provides children with a safe place to play and offers free play-based summer camps for young children in East Palo Alto. Activities range from science and engineering to cooking, sports, and even photography. Their program model is centered on using each activity to teach kids communication, creativity, compassion, and collaboration. DreamCatchers offers summer tutoring opportunities for middle school students to gain academic skills and self-confidence while engaging with their peers. During the summer, they offer summer school activities as well as a two-week swim program. Creative time in the summer EPACENTER is a state-of-the-art creative youth development center in East Palo Alto that is all about amplifying the creative potential in young people, and accelerating positive outcomes for vulnerable youth in the city. Programs are led by professional artists and designers and are available all year round. They offer a wide array of summer programs and actively collaborate with other local nonprofit organizations in service of their mission. Tutoring and Tennis EPATT, East Palo Alto Tennis and Tutoring is a wonderful academic support program dedicated to helping students graduate from high school and college and get career ready. Run by caring staff, tutors, and parents that function as a coordinated team, their multifaceted program is designed so that every student enrolled in their program receives the appropriate attention and care. EPATT has been transforming the lives of kindergarteners through post-secondary students for the past 35 years. Fun and emotional support for children touched by cancer Camp Kesem at Stanford offers an extraordinary summer program for children dealing with the trauma of cancer in their family. Their programs allow kids to bond with peers going through similar experiences. Founded in 2000 as a project at Stanford University, Kesem offers year-round services that support both children and adults. A chance to be regular kids for those with special needs Families with special needs children have a particularly difficult time during the summer. There are few opportunities for outdoor enrichment and socialization. The care for these children requires a high staff-to-child ratio. Via Services has been serving the Bay Area since 1945. Every summer, they host Camp Via West, a collection of exceptional summer programs that take place on a beautiful 13.5-acre campus in the Cupertino foothills. They offer camp experiences for children, teens, and adults with excellent camper-to- staff ratios of 3:1, 2:1, and 1:1. Altitude at Camp Via West provides a unique camp experience for youth in middle and high school. Altitude caters to students and teens that possess social cognitive challenges (such as autism and ADHD). Opportunities to build social skills, independence, and self-confidence help prepare campers for the transition to young adulthood. Camping and outdoor education for kids Vida Verde provides camping trips for over 12,500 students and teachers from low- income Bay Area schools. Their summer Leadership Project serves teens with a one- week immersive camping trip, followed by the opportunity for leadership and engagement throughout the school year. For some children, this is their only exposure to camping and to environmental education. A summer of service opportunity for teens Youth Community Service (YCS) hosts a mentorship program for teens to engage in community leadership and civic service. Bay Area high school students are encouraged to apply and be part of one of six “Summer of Service Together” tracks that leave a lasting impact and prepare students’ for life, higher ed, and beyond. Council Members: We were dismayed to learn that the Palo Alto Square Theatre space is once again threatenedwith permanent extinction. In 2016 we signed a petition to force building management to maintain the Palo Alto Square Theatre, a use embedded in the original building permit for thePalo Alto Square development. With new housing proposed at sites all over Palo Alto and particularly at the Fish Market location next door to the theatre, it would be very short-sighted to cut back on recreational andcultural opportunities. Please retain the Palo Alto Square Theatre space. While the movie big screen was once given up for dead, movie going audiences have returned in record-breakingnumbers. It’s quite possible, likely even, that in the future the theatre space could once again serve a vital and popular cultural purpose as a movie house. Perhaps, PA Square management would like to see their original use permit alteredpermanently. How much demand exists for more office space? Regardless, adding more office space will increase the number of workers while also increasing the number of housing unitsmandated in Palo Alto by ABAG’s RHNA Plan. Finally, the Page Mill-El Camino intersection is already the second busiest in Palo Alto. How many more traffic engineering tricks can beimplemented to keep crossing safe? EXECUTIVE SUMMARY On December 19, 2022, City Council directed staff to proceed with the Fiber Expansion Plan to implement the Fiber Rebuild project and Phase 1 of the Fiber-to-the-Premises (FTTP) project. In Phase 1, FTTP wouldbe built out in selected areas of the city, and expanded gradually (Staff Report ID # 14800) 1 . Construction of the fiber backbone and last mile infrastructure to provide FTTP broadband internet to the community willbe a significant undertaking for the City. Before the City begins construction, staff needs to address the below items to control project costs, minimize construction impacts to the community, and prevent majordelays: Align fiber and grid modernization projects - The citywide engineering design for the electric grid modernization project is currently underway. The grid modernization project will overlap with the Fiber ExpansionPlan in engineering make-ready work and construction. Staff will analyze the projects to identify opportunities for alignment, which may help minimize costs and reduce community disruptions, while trying to minimizeimpacts to the Fiber Expansion Plan’s timeline. Page 2 of 7 Coordination with AT&T - The existing joint pole agreement with AT&T requires coordination between the City and AT&T to relocate 3rd party telecom equipment on utility poles and provide space for new fiberattachments, while remaining in compliance with California Public Utilities Commission General Order 95 (GO 95) requirements for overhead electric line construction to insure electric utility service and securepersonnel safety. PROJECT DESCRIPTION The proposed Fiber Expansion Plan is to construct a new fiber optic backbone and implement Phase 1 of fiber-to-the-premises (FTTP) infrastructure (passing ~ 20% of homes and businesses) to providecommunication services throughout the City of Palo Alto. ### If there are 25,901 premises (homes + businesses) in Palo Alto (per staff's 09-28-15 staff report, page 80),https://www.cityofpaloalto.org/files/assets/public/agendas-minutes-reports/reports/city-manager-reports-cmrs/year-archive/2015/id-6104-fttp.pdfand the City passes 7,160 + 875 = 8,035 premises (see page 31), then it's passing roughly 31 percent of premises. However, the proposed plan will be dynamic in nature as efforts to align grid modernization and fiber projects increase in priority and impact the designs and timelines. For informational purposes, the initial plan forfiber construction includes installation of approximately 83 miles of fiber optic cables, consisting of about 48 miles of below-ground cable installations and 35 miles of aerial cable installations using ~6,000 existingutility poles; ### Phase 1 will be attaching to more like 1,300 poles (see page 5). one fiber hut (20’ x 40’) for networking equipment; underground utility vaults (36” x 48” x 34”); and above ground utility cabinets (17” x 17” x 36”). BACKGROUND City Council considered three courses of action for a City-owned FTTP service and directed staff to proceed with the phased build approach. Under this approach, FTTP will be built out in selected areas of the cityusing $34 million from the Fiber Fund and $13 million from the Electric Fund, and the project will expand gradually from there to eliminate the need for debt financing. Building the fiber backbone and last-mileinfrastructure to provide FTTP broadband internet to the community will require significant planning, coordination, communication and construction over the next 18 – 24 months. With the electric grid modernizationproject approved in the FY 2024 budget, staff needs to determine how to align the grid modernization project and projects under the Fiber Expansion Plan to help minimize utility engineering pole make-ready work,pole replacements, noise disruption, and construction activity in neighborhoods. On May 1, 2023, City Council approved Amendment Number 4 to Contract Number C20176363 with Magellan for Fiber program management, organizational change management, network operations and technicalsupport, and utility pole electric make-ready engineering (Staff Report #2303-12152 ). Although the phased build approach to FTTP will decrease the City’s financial risk and increase Council’s control over thevelocity of the buildout, the City does not have the in-house staffing to fully pursue the fiber backbone project and first phase of FTTP while coordinating with electrification grid modernization efforts. These projectsrequire significant staffing and specialized skill sets over the next few years. Page 3 of 7 utilize available staffing resources, the City must also strategically invest in external resources for a successful roll-out. On May 30, 2023, the Finance Committee reviewed the FY 2024 Budget during the budget approval process. The FY 2024 Budget included a new Capital Improvement Project, the Grid Modernization for Electrification Project (EL-24000). On June 19, 2023, the City Council approved the FY 2024 budget with the new Grid Modernization for Electrification Project. The approval of the electrification project accelerated efforts to align electrification andfiber construction, which has begun to impact the Fiber Expansion Plans. ANALYSIS Align fiber and grid modernization projects The City recently conducted an electrification study to evaluate the impacts of projected electrification loads on Palo Alto’s distribution and substation transformers, primary/secondary distribution circuits, and topropose upgrades needed to mitigate overloads. The estimated cost to construct the necessary electric system upgrades for a 100% electrification scenario is between $220 million to $306 million, depending on theapproach. Specifically, the grid modernization project involves replacing and upgrading over a thousand single phase pole top transformers. Approximately 300,000 circuit feet of open wire secondary conductors inthe distribution system will be replaced with aluminum aerial cable. The workplan for this project is a staged, multi-year approached designed to accomplish the upgrade of the electric distribution system to meet theCity’s goal of being ready for full-scale electrification by 2030. Currently, staff is in the process of implementing a pilot project (~600 customers) to convert a 4kV area to 12 kV and upgrade the transformers and secondary networks to facilitate electrification. This work isexpected to be completed by the beginning of 2024, depending on other factors which impact project timelines, such as material lead times, pole make ready, and alignment with the fiber projects. The purpose of thepilot project is to determine the feasibility of electrification design and construction methods, explore opportunities to align with fiber expansion, and implement best practices to facilitate the most cost-effectivedeployment of resources. After the pilot project, the first four years of the electrification project will make approximately 70% of the electric system ready to accept full-scale electrification by residents. This will be accomplished by upgradingover one hundred miles of the overhead electric system that serves these residents and upgrading substation transformers to meet the increased demand. After the overhead electric system is upgraded, the City willupgrade underground residential systems for additional capacity with tentative completion by 2030. Given the hundreds of miles of overhead and underground construction activity between FTTP and electric grid modernization, staff is exploring various construction phasing options to minimize disruption,construction activity, and construction costs within neighborhoods while avoiding prolonged deployments. In addition to construction constraints, staff does not have Item #2 Packet Pg. 16 Item No. 2. Page 4 of 7 enough internal resources to project manage, perform engineering make ready, and inspect construction for both projects in parallel. Staff is currently engaged in discussions with an electric engineering consultant to assess the feasibility of utilizing the fiber engineering make-ready work previously prepared by Magellan for the grid modernizationproject. If feasible, the City of Palo Alto Utilities (CPAU) may be able to expand the pilot area of the grid modernization, accelerate the design, and align construction of grid modernization with phase one of FTTP.Staff will be analyzing the cost savings, timeline, and resources (staffing and contractors) required for project alignment. California Environmental Quality Act (CEQA) The preliminary assessment, or Initial Study, will evaluate the project’s potential impacts on various environmental factors and identify whether those impacts can be mitigated. If the project’s impacts can be mitigatedto a less-than-significant level, then the City may issue a Mitigated Negative Declaration (MND) or Negative Declaration (ND). If the preliminary assessment of the project determines one or more significant impactson the environment despite mitigation, a full environmental impact report (EIR) will be required, which involves a more comprehensive and detailed analysis of the project’s impacts and alternatives. CPAU is seeking to retain a CEQA consultant to prepare a CEQA Initial Study in accordance with local, state, and federal statutes. The Initial Study identifies physical, biological, social and economic factors thatmight be affected by the fiber expansion project. Some environmental factors that could potentially be affected by this project include aesthetics, air quality, geology/soils, hazardous materials, noise, utilities services,and hydrology/water quality. Specific examples of likely CEQA analysis include: o Hydrological analysis to see if any proposed fiber lines would run through areas near bodies of water and show that there would not be significant impacts to waters of the state or waters of the US, as well asprovide recommendations for how to protect nearby waterbodies even if there are no direct impacts (e.g. through proper stormwater protection measures) o Air quality analysis (including understanding how to run claimed calcs for the proposed project to evaluate air quality emissions and GHG emissions) o Noise modeling (including analysis of potential impacts on nearby sensitive receptors from construction noise and vibrations) o Hazardous materials analysis (including evaluation and mitigation if necessary, of potential impacts to construction workers and sensitive receptors especially if any of the dark fiber runs through areas of the cityruns through a plume) Coordination with AT&T CPAU currently has a long-standing joint pole agreement with AT&T executed in 1918. The current joint pole agreement and pole intent process (including billing) may not be feasible to accommodate the increasedvolume of pole transactions expected with the grid modernization and Fiber Expansion Plan. This issue will likely cause significant delays in both projects, so CPAU is reevaluating membership in the NorthernCalifornia Joint Pole Association (NCJPA). The NCJPA Item #2 Packet Pg. 17 Item No. 2. Page 5 of 7 is a 100+ year old non-profit organization formed to support members and provide standardized cost-sharing methodologies for utility poles. ### In a way, if this is a good idea, I'm surprised it hasn't surfaced before now. I don't know why this practice was discontinued. Anyhow, should arepresentative of the City Attorney's office attend the 08-02-23 UAC meeting? In the past, CPAU operated without membership with the NCJPA because the volume of pole replacements was manageable by staff and there were additional costs associated with becoming a member. Given theanticipated increase in pole work, NCJPA membership may be necessary to ensure pole work related to the long-term fiber and electrification projects is conducted in a methodical, timely and cost-efficient manner.CPAU may need to add resources to manage the volume of pole make-ready work and replacements. Other Updates Make-Ready Engineering Magellan completed the survey of approximately 6,000 utility poles in Palo Alto. The survey identified the current load and condition of each pole in preparation for the new fiber backbone and FTTP. The surveyincluded detailed fielding and walk-out of all routes to validate running lines, existing utilities, and constructability. For aerial construction, Magellan provided make-ready engineering pole data to determine polepreparation and pole replacement, as well as timeframes for the work to be completed. For the new fiber backbone and phase one of FTTP, CPAU will be passing 1750 existing poles, attaching to 1300 poles,replacing 100 poles, and coordinating with third parties to move their telecom equipment lower on 325 poles. In addition to the fiber expansion project, CPAU has a recurring Wood Pole Replacement capitalimprovement project to replace approximately 100 deteriorated wood poles annually. Wood poles are used to support overhead utility lines throughout the City of Palo Alto. Though poles are inspected, tested, andtreated to maintain their integrity, over time poles will deteriorate to the point that they are no longer in compliance with GO 95 requirements or safe for community and utility workers. Fiber Hut Sites: Fiber huts are usually a prefabricated building (10’ x 20’) containing electronics and network equipment that connects fiber to neighborhoods. ### On page 2 of the staff report, it says the hut for Phase 1 will be 20' x 40'. The hut also has backup generators and HVAC systems to maintain equipment within its operating environmental specifications. Two fiber huts are recommended for the citywide network for Palo Alto Fiber. ### The City has 25,901 premises, and will probably have more premises in the future. The huts should be designed to serve up to 100 percent of premises. Staff and Magellan evaluated potential fiber hut sites and considered their proximity to strategic areas, planning/land use requirements, and existing infrastructure. As a result, staff narrowed down the potentiallocations to the Colorado substation and anticipated space at City Hall. The Colorado substation was previously identified as an ideal location due to its proximity to the area it serves and its current use for utilities.City Hall is anticipated to have vacated space after the Police Department moves to the new Public Safety Building. City Hall would be an ideal location for a secondary hut. ### I thinks this means "second hut." Due to the centralized location and potential square footage, this site may also be considered for a future data center, further securing the future of the City‘s data infrastructure. Equinix/Data Center: Item #2 Packet Pg. 18 Item No. 2. Page 6 of 7 Equinix is currently the City’s data center provider. They are a vendor-neutral multitenant data center provider where numerous internet service providers and content delivery networks can interconnect andexchange internet traffic between their networks. As the City expands its fiber footprint, more data center space will be needed. For FTTP, the City will have to increase the number of leasing cabinets (vertical rackssited next to each other, each capable of holding multiple termination/switching boxes in stacked configurations) from five to 12 cabinets. The City is undergoing discussions with Equinix to lease additional spaceavailable in their Palo Alto location and to explore other Equinix locations. The City may also consider increasing the size of the data center at City Hall. Invitation for Bid (IFB) Construction Package: If opportunities exist to align FTTP and grid modernization, CPAU and Magellan may gather and consolidate all supporting documents to bid out construction of FTTP and grid modernization. The IFB package willinclude construction-ready prints for fiber and power, construction details, splice details, pole make-ready details, construction standards as well as all documentation needed to complete the bid package. This shallinclude a written summary and scope of work, estimated costs to construct, as well as labor estimates, bill of materials, and the vendor list. Staffing: As the City solidifies staffing plans in parallel with contracted services, the Director of Information Technology will take on the responsibilities of an Assistant Director for Palo Alto Fiber on an interim basis. Inthe FY 2024 adopted budget, four (4) new FTE positions for the dark fiber expansion and implementation of FTTP were created. These positions will be recruited and filled as needed during the various stages of theproject. • Assistant Director - To provide the vision and strategy for the new fiber business and lead a high-performance team to quickly execute. Responsibilities include and are not limited to: overseeing fiber enterprisefund budget timelines and milestones (including the dark fiber optic business), managing the roll out and expansion of the fiber optic network, Internet Service Provider (ISP) operations, customer service operations,and business development. • Manager Utilities Telecommunications / "Outside Plant Manager" - To lead the construction process, installation and repair service technicians, and ensure the outside plant processes run efficiently and smoothly.Responsibilities include and are not limited to: overseeing construction, managing engineers and contractors, achieving construction budget timelines and milestones. • Manager Information Technology / "Sr. Network Engineer/Architect" – To lead the development process of the overall architecture of the broadband system and manage the system. Responsibilities include and arenot limited to: managing the network and supporting technical needs across the organization. • Manager Utilities Telecommunications / "Sales and Marketing Manager" - To develop the marketing strategy and lead marketing initiatives. Responsibilities include and are Item #2 Packet Pg. 19 Item No. 2. Page 7 of 7 not limited to: meeting revenue objectives, cultivating strong partnerships, and maintaining retention rates. FISCAL/RESOURCE IMPACT This report is for informational purposes so there is no resource impact. Based on Council and UAC input, staff will return with specific actions associated with efforts to align the fiber expansion and electric gridmodernization projects. STAKEHOLDER ENGAGEMENT On November 2, 2022, the UAC unanimously recommended to build fiber backbone and FTTP under a phased approach with existing funds ($34 million from Fiber and $13 million from Electric). The UAC expressedthe goal of FTTP is to provide ubiquitous or citywide high-speed internet access to all residents and businesses in Palo Alto. If financially self-sustaining, and deemed successful, the first phase of FTTP can becomea springboard to a citywide FTTP deployment within five years. On December 19, 2022, City Council directed staff to proceed with the Fiber Expansion Plan to implement the Fiber Rebuild project and Phase 1 of the Fiber-to-the-Premises (FTTP) project without debt financing.Included in the Council’s motion was direction to: a) maximize number of homes and businesses passed; b) consider promotional rates to increase take rate; c) define leading indicators and metrics to determinesuccess; and d) recommend future Council action to accelerate expansion if metrics are positive, including a potential bond to streamline construction and compress construction time as much as feasible. ENVIRONMENTAL REVIEW The UAC’s discussion of the fiber expansion project and its potential alignment with the grid electrification project is not a project requiring California Environmental Quality Act review, because it is an administrativegovernmental activity which will not cause a direct or indirect physical change in the environment. The AT&T negotiations aren't the only factor that could slow down the project. The city still needs to conduct an environmental analysis for the fiber expansion, including an evaluation of how the project would impactair and water and whether these impacts could be mitigated. And it needs to find ways to align the fiber expansion with another massive project: a grid-modernization effort that includes in its first phase upgrading more than 100 miles of the existing overhead electric system aswell as various substation transformers. The goal is to "help minimize utility engineering pole make-ready work, pole replacements, noise disruption, and construction activity in neighborhoods" over the next 18 to 24months, Yuan wrote. ### I don't get why it's necessary to coordinate with the grid-modernization project in order to minimize make-ready work for FTTP. The electric space and the telecom space on poles are completely separate. ### If a pole needs to be replaced to support both FTTP and grid modernization, then it probably wouldn't make sense to do make-ready work on the old pole. Also, if a pole needs to be replaced, then all thetelecom should be installed on the new pole so that no make-ready work needs to be done after that. "Given the hundreds of miles of overhead and underground construction activity between FTTP and electric grid modernization, staff is exploring various construction phasing options to minimize disruption,construction activity, and construction costs within neighborhoods while avoiding prolonged deployments," Yuan wrote. The fiber project has two major components. One is the construction of a new $26-million "fiber backbone" that would primarily be used for municipal purposes like smart meters and enhanced monitoring of the city'selectric, gas and water services. ### As I understand it, all of the infrastructure required to support smart meters (according to the City's design) has already been deployed. No infrastructure in the fiber backbone extension is required. ### One of the stated reasons for deploying a dark fiber backbone extension is to support additional dark fiber customers. This article seems to be saying that's a secondary purpose. The other is a $20-million extension of the fiber ring to local homes and businesses, as long envisioned by local "fiber to the premises" advocates. If things go as planned, the fiber network will turn a profit that wouldbe used to launch future phases in other parts of Palo Alto, ultimately covering most (if not all) of the city. ### The staff report doesn't hedge like this. The vision is to offer FTTP access citywide. The city's fiber plan, according to Yuan, will include installation of about 83 miles of fiber optic cables, which include 48 miles of underground installation and 35 miles of overhead cables that would require use of6,000 existing utility poles. ### The City has only about 6,000 poles in total. They can't all be required to deploy Phase 1 FTTP. ### The 83 miles of fiber optic cables is apparently needed just for Phase 1 FTTP. The construction of a new fiber backbone and the first phase of "fiber to the premise" ### a.k.a "fiber to the premises." will require passing by 1,750 existing poles, attaching cables to 1,300 poles, ### OK. So, it's 1,300 poles, not 6,000 poles. ### I don't have a clear understanding of why fiber cables would pass by 1,750 - 1,300 = 450 poles without attaching to them. replacing 100 others ### I think the staff report doesn't say "others." That is, of the 1,300 poles used to support fiber cables, only 100 would have to be replaced in order to do so. and coordinating with third parties to move their equipment lower on another 325. ### OK. So, of the 1,300 poles used to support fiber cables, 100 would have to be replaced (but then wouldn't also require make-ready), 325 would require make-ready, and 875 could be used as-is (requiringneither replacement nor make-ready). ### Of the 100 poles that would have to be replaced, how many would have to be replaced because they're at end-of-life? AT&T would have to share the cost of replacing these. The city is also beefing up staffing to accommodate the implementation and, ultimately, operation of the expanded fiber system. The current budget adds four positions in Utilities Department dedicated to the effort:an assistant director for customer support services, a manager of information technology and two telecommunications managers. In north Palo Alto, the areas chosen for the first phase include a portion of the Downtown North neighborhood just north of Lytton Avenue, between Bryant and Webster Streets; a western section of Old Palo Alto,roughly bounded by Alma Street, Bryant Street, Churchill Avenue and California Avenues, parts of Evergreen Park and College Terrace just south of Stanford Avenue; and the Mayfield neighborhood just east of ElCamino Real and north of Oregon Expressway. In south Palo Alto, the expansion would include a portion of the Barron Park neighborhood east of Bol Park; a small area in the western portion of Midtown and portions of Loma Verde, Charleston Meadows, PaloAlto Orchards and St. Claire Gardens neighborhoods. Courtesy city of Palo Alto. The upcoming expansion will represent Palo Alto's biggest investment in its fiber utility since its debut about 25 years ago. The fiber optics fund, which pays for system improvements, had budgeted expenditures of$1.8 million in fiscal year 2023; $500,000 in budgeted expenditures in fiscal year 2022; and $1.5 million in 2021, according to budget documents. The budget for fiscal year 2024, which began on July 1, includes$33.1 million in expenditures. In addition to the $20-million fiber expansion — which is being partially funded by the electric utility — the newly adopted capital budget also includes $12.6 million to rebuild the fiber optics network system. Therebuild includes installing substructures and additional fiber backbone cables to increase capacity of section of the network that are currently at or near capacity to meet customer requests for service connections,according to the budget. The main project areas are Stanford Research Park, the Palo Alto Internet Exchange at 529 Bryant St. and the downtown business district. Despite the high costs and the prospect of fierce competition from incumbent telecom giants, the council agreed in December to advance the fiber project after more than two decades of debate and numerous falsestarts. Lydia Kou, who was serving as vice mayor at the time and is now mayor, said she wants the city's municipal system to provide a "competitive edge." "In a way, I think of incumbents as monopolies, and we can provide something similar, or even better," Kou said shortly before the vote. The big thing most users don't realize is the service can be as fast uploadingas well as downloading, so business users at home can get much better performance with AT&T fiber. I was told that Google offered to install fiber throughout the city a few years ago, and the deal was almost signed. One bid, from DynamicCity, didn't agree to those terms but said they'd tell the City how to build its own network. That bid was rejected as being non-responsive. The other bid, from the (ad hoc) 180 Connect Consortium, agreed to the terms, pending secret negotiations to work out the details. Negotiations to work out the details continued until 2009, when the bidder finallygave up. I do know that I want my Internet access managed and supported by a highly qualified organization that will only improve service and reliability. The only problem is that they don't service Palo Alto as of now. ### Sonic has been providing internet service to some parts of Palo Alto, using AT&T's wires (both DSL and FTTP) and speeds. But I believe they are interested. I have been a Sonic customer for many years and now with fiber. When I got fiber it was through AT&T. They came and did the installation. In fact, according to the 1971 "Stanford Land Use Policy/Plan",Stanford owns 1,175 acres of alienable land in the Felt Lake -Interdale area in unincorporated Santa Clara County on bothsides of Highway 280. That land is contiguous with almost 77 acres of Stanford-ownedalienable land along Arastradero Road in the City of Palo Altoknown as the former D. C. Powers lab site. There may be additional adjacent or nearby Stanford-ownedalienable land in the City of Palo Alto. (The 1971 Land UsePolicy/Plan at page 3 states that "A total of about 1,900 acresnot included in the original grant from Senator and Mrs. LelandStanford is not subject to the restriction against sale.") Land acquired by Stanford as part of its Founding Grant cannotbe sold. However, other land owned by Stanford is alienable land thatcan be sold at any time by vote of Stanford Board of Trustees. It is possible to propose compact urban development oncurrently undeveloped Stanford land, provided that the statusof each Stanford-owned parcel is known during the EIR process. Therefore, the EIR should show the location and status of allStanford land in the jurisdictions of both Santa Clara Countyand the City of Palo Alto, identified by Assessor's ParcelNumber and acreage, with an indication of which parts of eachparcel are Founding Grant land or alienable land, and with asummary of existing and proposed academic-related developmenton each parcel. As much of Stanford's alienable land as possible should bepermanently protected from future development, because it canbe sold any time a majority of Stanford's Board of Trusteesdecide to sell it. The EIR should evaluate an alternative to having a four-fifthsvote of the Board of Supervisors change the Academic GrowthBoundary, because that vote can be obtained without theparticipation of a Palo Alto member of the Board of Supervisorseither because that member votes "No", the member representingPalo Alto is from another city in Palo Alto's Supervisorialdistrict, or the member is from Palo Alto but can't votebecause of a conflict of interest due to source of income. The EIR should evaluate the alternative to protecting thatfoothills land (both alienable land and founding grant land) byhaving Stanford identify clusters of foothills land for futuredevelopment that equal ten percent of the acreage in thefoothills, obtaining a vested right to develop in thoseclusters under current county zoning regulations, and annexingthe remaining ninety percent of the alienable land to Palo Alto and having it dedicated for park purposes pursuant to PaloAlto's Charter, so that it can be removed from park dedicationonly by Palo Alto voters. The EIR should evaluate the effect of Stanford increasingacademic facilities in the City of Palo Alto after the adoptionof Stanford's 2000 General Use Permit. Stanford has increased its total academic facilities combinedin Palo Alto and County land above the limits set in the 2000General Use Permit, because the increases in academic space inthe City of Palo Alto have not been covered by the General UsePermit and the EIR for that permit did not evaluate areasoutside the County jurisdiction. Stanford has converted Stanford Research park land to academicfacilities, built hospital and housing in the Sand Hill Roadarea of Palo Alto, and medical clinics at 2450 Watson Court inthe East Bayshore Road area of Palo Alto. An EIR project description that includes both Palo Alto andCounty land should be evaluated that sets limits on the totalacademic gross floor area for Palo Alto and County landcombined. The EIR should show how much additional Stanford academic space(including teaching, research, academic support, and housing)has been added in Palo Alto's jurisdiction since the adoptionof the 2000 General Use Permit, as well as showing theAssessor's Parcel Numbers for those locations and whether theyare on Founding Grant land or alienable land. The 1985 Land Use Policy Agreement says that Stanford "providesits own municipal services to its academic facilities, ratherthan seeking them from adjacent cities". The EIR should evaluate amending the Land Use Policy Agreementto require Stanford to pay an in-lieu fee comparable to the feepaid any other occupier of the same land in Palo Alto thatStanford occupies. For example, any other use in Stanford Research Park isrequired to pay property taxes in exchange for services fromall levels of county and local government, but Stanford maybelieve that academic facilities are exempt from those taxes,which is why they have been moving all kinds of academicfacilities to Palo Alto that are in addition to the limits setin the General Use Permit. Similarly, if Stanford faculty or staff purchase a home from aprivate party in Palo Alto, the faculty or staff member paysproperty taxes, but if Stanford develops land for housing inPalo Alto, or purchases existing homes as it has done in PaloAlto's College Terrace neighborhood, or buys an existing multi-family housing development such as the Oak Creek apartments onSand Hill Road in Palo Alto, Stanford may claim that suchhousing constitutes academic facilities that are exempt fromtaxes. The EIR for a combined project description for both Palo Alto and Stanford should evaluate all land developed or purchased byStanford for housing in Palo Alto to determine whether Stanfordis required to pay taxes or in the alternative pay anequivalent in-lieu fee, since Stanford would not be paying forthose residences' services through payment of property taxesthat other owners of the property would be paying. Castilleja states that all cars driving to the school, whether they park or just drop off students, will be given a stickerto identify the car. However there is no mention of how the application of the sticker will be enforced. Are we to trust all students and parents will apply their stickers to their vehicles? To assume this will happen issheer folly. I have lived on Melville Avenue for 45 years and I have frequently checked cars parked along Emerson, Kelloggand Bryant to see if they showed a Castilleja sticker. I have seen a few staff stickers but in general maybe 1-2% ofcars have had stickers. The TDM states that monitors will check cars on surrounding streets but this is an ineffective measure given howeasy it would be to simply not apply a sticker. For many years students and staff have parked along Emerson Street between Kellogg and Lincoln where parking isprohibited. None of the cars have had stickers. The same is true for Waverley Street near Gamble Garden. Please make it a requirement that all cars driving to the school prove that they have applied stickers by submittingphotos and license plate numbers. The neighborhood committee should receive this information. I hope you can understand how easy it would be to circumvent this requirement. Neighbors deserve to be treatedfairly given the generosity of the Council to approve their overreaching plans for expansion. Please address this matter in your discussions on August 7. However, swapping Terman Park is not the solution – this will create harm to our school community in addition to our Palo Alto neighbors, particularly families and the elderly. Be cautiousof opening attachments and clicking on links.       Tonight begins Tisha B’Av, or the Ninth of Av, a day of sadness and mourning in which the Jewish community recounts the many tragedies that have befallen the Jewish people, including the destruction of the Second Temple followed by two millennia of exile in the diaspora. The Rabbis of the Talmud blamed the destruction of the Temple on Sinat Chinam or baseless hatred - the concept of hating another person or group of people for no good reason. What started as disagreements between Jews escalated into mistreatment of one another, and eventually the Temple was destroyed, ultimately leaving the Jewish people without a spiritual or literal home. Sinat Chinam comes in many forms. Racism, Misogyny, and Antisemitism are examples of Sinat Chinam. What starts as political or religious disagreement can turn into Sinat Chinam if we don’t take care to stop it. Many Israelis both in the US and in Israel are connecting this political moment (the Knesset vote on the Reasonableness Law) with historic traumas commemorated by Tisha B’Av by posting on social media with the words “Shisha B’Av” meaning the 6th of Av - the Day of the vote. This is clear play on Tisha B’Av. What they are saying is that this is a moment to take the internal crisis in Israel seriously- it impacts us all. The mission of the JCRC is to educate, to advocate, and to collaborate with others toward promotion and defense of freedom, justice, tolerance and equal opportunity on behalf of the Jewish Community so as to ensure a strong democracy and a vibrant Jewish presence in the Silicon Valley. Consensus decisions are essential in a healthy democracy and the decision on the reasonableness law was made without consensus. More than 800 UnXeptable protesters marched in solidarity across the Mary Street Bridge in Sunnyvale on Sunday and several hundred rallied in front of the Israeli Consulate in San Francisco yesterday. The protesters continue to sing Hatikva. The voices calling for the preservation of Israel’s Democracy and a commitment to consensus are not just Israeli. Senator Scott Weiner, a member of the Jewish Legislative Caucus, released a statement speaking out against what he called the “Netanyahu government’s attack on Israel’s independent judiciary.” “Israel must be a democracy and a place where the rule of law is paramount,” Wiener said. The Jewish Federations of North America released a statement saying they “are deeply pained over the growing polarization we have witnessed in Israeli society as a result of the judicial reform process. I very much miss the large crowds that were gathering at CineArts for Met in HD performances, and I, as many others, would love to be able to have that opportunity again, as well as seeing art and independent movies at CineArts. Other theaters just don’t give me the same feeling as CineArts. I live in a walking distance from CineArts, so going there provides double benefit – I get a nice walk and a great, thought provoking entertainment. It has been my theater for many years, and now that more homes and apartment buildings rise in this area, there would be more people seeking entertainment opportunities close to home. As to the property owner’s wish to convert the unique local movie theater into office space, the theater is only a small part of the Palo Alto Square, all the rest of it is the office space, but the theater provides a very important public benefit that a few more offices cannot compensate for. So I put in a limit order on Sundaynight, July 23, 2023 to buy two shares at $258. I thought it might dip a little on Monday and I'd get some at $258. TSLA opened down Monday, July 24, 2023 at $255.85. Because my limit order washigher than that, my trade was executable. But they did not buy for me right at the open. Others had formed a queue over the weekend and I was back in the queue. TSLA fell another$.20 from the open and then they executed my limit order at $255.65. So I got two shares at $255.65. The low for the day was $254.12. If I had used that price in my limit order I mighthave gotten my shares at that price. But perfect foresight, right to the penny, is difficult in the market. Then TSLA turned around yesterday, July 24, 2023. It closed at $269.06, up $13.41 pershare over what I paid near the open. So I had a total gain on these two shares of $26.82 for the day due to the gyrations in the stock price. One cannot assume that a stock will open at the same price as it closed the previoussession. Today, Tuesday, July 25, 2023, TSLA rolled off a little, down $3.78, but I still have a gain of $19.26 on the two shares purchased yesterday. At this time during the summer, I remember that for many years, the SF Jewish Film Festival rented one of the theaters at Palo Alto Square for their annual festival. I volunteered at this film festival for decades - and over these many years, we were occasionally at other theaters on the Peninsula -- the Park Theater in Menlo Park, the Aquarius in Palo Alto, Century Cinema in Mountain View, the Oshman Family JCC in Palo Alto, Fox Theater in Redwood City -- but the nicest venue of all, the venue wekept returning to, was the theater at Palo Alto Square. So many happy memories of films seen there. Additionally, we have attended many Metropolitan Opera Live in HD events at PaloAlto Square theater. A wonderful musical experience, settling down into our comfortable seats and enjoying the opera. The Palo Alto Square theater is centrally located between freeways 101 and 280,enjoys easy access from El Camino, has ample parking, has good acoustics, a cozy feeling, an attractive lobby, and is in a lovely complex. I was taken aback that improvements were so difficult to complete. One of the reasons cited for the lengthy process is the need to coordinate with eachCity that CA82/ El Camino Real runs through. My comment to Senator Becker is that we simply have to do better. We pay very high taxes and don’t even have safe roads to drive on. In the case of Palo Alto, the timing is mainly a result of state/city cooperation around sewerimprovements being implemented by the City, which would tear up any new asphalt if it were to be laid beforehand. Repaving after the sewer repairs will result in a nicely paved ECR inPalo Alto that will last for years to come. So, my question is where are we with the sewer repairs along ECR?
